ORDINANCE NO. 4754
AN ORDINANCE AMENDING ARTICLE I OF CHAPTER 13
(ALCOHOLIC BEVERAGES) OF THE
VILLAGE CQDE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, IN THE EXERCISE OF
THEIR HOME RULE POWER:
SECTION ONE: That Section 13.'129 of Article I entitled "General Provisions" of
Chapter '13 of the Village Code of Mount Prospect, as amended, is hereby further
amended by amending subsection E to read as follows and by adding thereto a
subsection F; so that hereafter said Section 13.129.E and Section 13.129.F of Article I
of Chapter 13 shall be and read as follows:
"E. In every place in the Village where alcoholic liquor is sold there shall be displayed
at all times in a prominent place a printed card which reads substantially as
follows:
UNDERAGE DRINKING
If you are under 21, you are subject to a mandatory fine of $500.00
if you purchase any alcoholic liquor. If you misrepresent your age
for the purpose of purchasing or obtaining any alcoholic liquor, you
will also be subject to restricted driving privileges within the Village
of Mount Prospect and a loss of your Illinois Drivers License. If you
buy for or deliver an alcoholic beverage to an underage person, you
will be subject to a mandatory fine of $1,000.00.
F. Penalty.
Any person found guilty of violating subsection A, B or E of this Section shall be
fined in the mandatory amount of five hundred dollars ($500.00)."
SECTION TWO: That subsection E of Section 13.134 of Chapter 13 of the Village Code
of Mount Prospect, as amended, is hereby further amended; so that hereafter said
Section 13.134.E shall be and read as follows:
"E. The vehicle shall not be released until the person seeking the release has paid an
administrative fee of one hundred fifty dollars ($150.00) to the Police Department,
plus any towing or storage costs."
SECTION THREE: That Section 13.137 entitled "Penalties; General" of Chapter 13 of
the Village of Mount Prospect, as amended, is hereby further amended in its entirety; so
that hereinafter said Section '13.137 of Chapter 13 shall be and read as follows:
" Section 13.137. Penalties; General
Unless another penalty is set forth in this Chapter, every
person found guilty of a violation of any of the provisions of this Chapter shall be
subject to a fine of two hundred fifty dollars ($250.00) for the first offense and five
hundred dollars ($500.00) for each subsequent offense. A separate offense shall
be deemed to have been committed on each day during or on which a violation
occurs or continues. Any fines set forth in this Chapter shall be assessed
regardless of whether the violator is convicted or placed on supervision by the
court. If the court is of the opinion that the ends of justice would be better served
by requiring community service of the violator or a combination of a fine and
community service, the fine may be mitigated at a rate of one hour of community
service for every ten dollars ($10.00) of the mandatory fine. If the offense is
related to alcohol or substance abuse and the offender is under twenty-one years
of age, the court may, in lieu of any mandatory fines, assign the offender to a
chemical abuse counseling program that is licensed by the Illinois Department of
Alcohol and Substance Abuse which includes a certified evaluation program and
not less than four (4) hours of counseling. Fines assessed by the court against
any offender may be in addition to any penalty assessed against a licensee in any
administrative proceeding."
SECTION FOUR: AIIpriorordinancesandresolutionsinconfiictorinconsistentherewith
are hereby expressly repealed only to the extent of such conflict or inconsistency.
SECTION FIVE: This ordinance shall be in full force and effect upon its passage,
approval and publication in the manner provided by law.
