PURPOSE:
Present a recommendation that the annual budget be amended for fiscal year beginning
January 1, 2006 and ending December 31, 2006.
BACKGROUND:
Ordinance 5528, adopted December 20, 2005, established the annual budget for the
year ending December 31, 2006. Ordinance 5553 adopted on March 22, 2006 provided
for amendment #1 of the 2006 budget.
DISCUSSION:
Each year the Village prepares two separate amendments to the current year's budget.
Amendment #1, prepared in early Spring, amends the budget for carry-over items from
the prior year's budget. These are typically construction or other contractual service
type projects that are started in the previous year but not completed. Amendment #2,
prepared in December, amends the budget to account for material variations in
revenues and expenditures. Many times these are the result of fluctuations in the
economy affecting revenues (either positively or negatively) or extraordinary or
unanticipated charges for expenditures that occurred during the year.
A proposed ordinance amending the 2006 Annual Budget is attached for the Board's
consideration. In total, we are increasing our revenue projections by $1,402,115 and
increasing the budget for expenditures by $1,666,436. Amendments to the budget
impacting revenues are made up of various adjustments to tax, fee and other
intergovernmental revenue accounts, grant receipts and other reimbursements. There
is only one significant budget adjustment related to expenditures. Transfers totaling
$892,827 were made during the year from the General Fund. These transfers provided
for the establishment of the Foreign Fire Tax Board Fund ($44,202) and closed out the
Series 2003 Project Fund ($848,625). Other expenditure amendments worth
mentioning include transfers from Fund 430 and Fund 440 to the Street Improvement
Construction Fund totaling $120,613. These transfers closed out two street
construction related debt service funds that were paid off in 2005. Remaining surplus

funds were moved to support the ongoing street improvement program. Two JAWA
related accounts in the Water Fund required an amendment to account for higher than
expected costs for the purchase of water. The total amount of these two amendments
is $280,000. Workers' Compensation costs were also higher than expected requiring
the budget for this line item to be increased $125,000. Surplus funds are available in
each of these Funds to cover the budget changes.
RECOMMENDATION:
It is recommended the Village Board waive the requirements for two readings of an
ordinance and adopt the proposed budget amendment for the 2006 Annual Budget.

AN ORDINANCE MAKING CERTAIN AMENDMENTS TO THE ANNUAL
BUDGET ADOPTED FOR THE FISCAL YEAR COMMENCING JANUARY 1,2006
AND ENDING DECEMBER 31, 2006
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have passed
and approved Ordinance No. 2342 which sets the finances of the Village under the "Budget
Officer System"; and
WHEREAS, pursuant to the aforesaid Ordinance and the Statutes of the State of Illinois an annual
budget for the fiscal year commencing January 1, 2006 and ending December 31, 2006 was
adopted through the passage of Ordinance No. 5528 approved by the Corporate Authorities of the
Village of Mount Prospect on December 20,2005; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have passed
and approved Ordinance No. 5553 on March 22, 2006, amending the annual budget for the fiscal
year commencing January 1, 2006 and ending December 31, 2006; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have further
reviewed certain additions and changes to the aforesaid budget for the fiscal year beginning
January 1, 2006 and ending December 31, 2006; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect believe the
changes, as specified on the attached January 1, 2006 through December 31, 2006 Budget
Amendment No.2 to be in the best interest of the Village of Mount Prospect; and
WHEREAS, the Village has now revised the revenue projections or has reserves in each of the
Funds in which the budget is being increased adequate in amount to cover the budget changes
reflected in Budget Amendment No.2, attached hereto.
NOW THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE
EXERCISE OF THEIR HOME RULE POWERS:
SECTION ONE: That the fiscal year budget for January I, 2006 through December 31, 2006 for
the Village of Mount Prospect is hereby amended, as detailed on Budget Amendment No. 2
attached hereto.
SECTION TWO: That this ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.

SUBJECT: AMEND CHAPTER 17AND APPENDIX A, DIVISION II OF THE VILLA
CODE
PURPOSE:
To present for the Board's consideration an Ordinance amending the section of Village Code
pertaining to replacement vehicle stickers.
BACKGROUND:
The Village currently requires all vehicles registered within Mount Prospect to display a vehicle
sticker (or in the case of a motor cycle a medallion). There are certain exemptions from this
requirement listed in the Code. In the event a sticker needs replacement due to circumstances
such as transfer caused by sale or where the sticker was lost, mutilated or destroyed, there is
a cost for replacement. Currently, the charge for a replacement sticker is $2.00. The cost of
the replacement sticker has not changed since the inception of the program.
DISCUSSION:
In order to bring the cost of a replacement sticker closer to the actual cost of administration, it
is requested that the fee for replacement be increased to $5.00. In addition, it is being
requested that the Village Code be amended to reflect changes related to the replacement of
lost stickers.
RECOMMENDATION:
It is recommended the Village Board approve the attached ordinance amending Chapter
17 and Appendix A, Division II of the Village Code.

AN ORDINANCE AMENDING CHAPTER 17 AND APPENDIX A, DIVISION II,
OF THE VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF
THEIR HOME RULE POWERS:
SECTION ONE: That Subsection B of Section 17.108, entitled Plates and Windshield Sticker, of
Article I of Chapter 17 of the Village Code of Mount Prospect is hereby deleted and a new
Subsection B inserted in Section 17.108 to be and read as follows:
B. There shall be an additional charge to the fee set forth in section 17.103 of this article
to replace during the license year any windshield sticker or plates which have been
mutilated or destroyed, or for a transfer caused by the sale of the vehicle to which the
original sticker or plates were issued, in the amount as set forth in appendix A,
division II of this code. The sticker (or plate(s)) or an identifiable portion of the
sticker (or plate( s)) must be returned along with the original receipt.
SECTION TWO: That a new subsection D shall be added to Section 17.108, entitled Plates
and Windshield Sticker, of Article I of Chapter 17 of the Village Code of Mount Prospect, to be
and read as follows:
D. There shall be an additional charge to the fee set forth in section 17.103 of this article
to replace during the license year any lost windshield sticker or t>lates in the amount
set forth in section 17.103 of appendix A. division II of this code for the annual
license fee.
SECTION THREE: That appendix A, division II of the Village Code of Mount Prospect shall
be amended to increase the fees in Sections 17.108.B and 17.109.C from $2.00 to $5.00, to be
and read as follows:
Section 17.108: Plates and Windshield Sticker:
B. Additional fee charge for replacement: $5.00
Section 17.1 09: Transfer:
C. Transfer fee, including for newly acquired vehicle: $5.00
SECTION FOUR: This Ordinance shall be in full force and effect from and after its

ADOPTION OF CARBON MONOXIDE ALARM DETECTI

Under Public Act 094-0741, the State of Illinois General Assembly has enacted a Carbon
Monoxide Alarm Detector Act that. will be effective January 1, 2007.
The Fire Department and the Community Development Building and Environmental Health
Divisions met to evaluate the enacted state act, determine its impact on Village structures.
Staff also dialogued and will continue to formulate ways to inform residents on the new State
Law.
In essence, the state act requires that every dwelling unit be equipped with at least one carbon
monoxide alarm in operating condition within 15 feet of every room used for sleeping
purposes. Staff has assembled some enhancements to the State Act. These are detailed in
the attached draft that was assembled by Village Counsel. Some Local Amendment
Enhancements to the State Act include, yet are not limited to the following:
· New construction requires carbon monoxide alarms to be hard wired and have a
secondary batter backup. This is consistent with present regulations which require
smoke detectors to be hard wired in new construction.
· Carbon monoxide alarms must be installed in accordance with manufacturer
requirements.
· The responsibilities of building owners and tenants were clarified.
· Negligently failing to install or maintain a carbon monoxide alarm was added as an
offense.
· The second exemption of the statute was clarified in Section 24.207(F)(2) and (3) to
provide as follows:

o A specific exemption is provided for a dwelling unit located in a building that is
connected to a parking structure that is protected by an operating carbon
monoxide detection system and that structure is the only source of carbon
monoxide.
o A specific exemption is provided for buildings 4 stories or greater where the
Building Commissioner determines that the source of carbon monoxide is
adequately separated from the dwelling units by approved construction methods
and/or a mechanical exhaust system. (example: The Emerson and The Village
Centre.)
. Penalties are established ranging from $100 to $1,500 per offense.
I would recommend adoption of the attached draft ordinance. Staff will be available to answer
questions that may arise.

OF THE VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TROSTEES OF THE VILLAGE OF
MOUNT PROSPECT, COOK COUNTY, ILLINOIS, ACTING IN THE EXERCISE OF THEIR
HOME RULE POWERS:
SECTION 1: A new Section 24.207 shall be inserted into Chapter 24, Fire Prevention,
Article II, "Sprinkler Equipment, Alarm Systems And Fire Hydrants", to be and read as follows:
Section 24.207 CARBON MONOXIDE ALARMS
A. Definitions.
1. A "carbon monoxide alarm" or "alarm" means a device that emits an audible
warning upon sensing carbon monoxide and complies with the rules and
regulations of the Illinois State Fire Marshal, bears the label of a nationally
recognized testing laboratory, and complies with the most recent standards of the
Underwriters Laboratories or the Canadian Standard Association.
2. "Dwelling unit" means a room or suite of rooms used for human habitation, and
includes a single-family residence, each living unit of a multiple family residence,
and each living unit in a mixed-use building.
3. For purposes of this Section 24.207, the terms "owner" and "tenant" shall have
the meanings set forth in Section 23.1803 of the Village Code.
4. "Building" means any structure used or intended for supporting or sheltering any
use or occupancy.
B. Carbon monoxide alarm required.
1. Every dwelling unit shall be equipped with at least one carbon monoxide alarm in
an operating condition within 15 feet of every room used for sleeping purposes.
2. Every building that contains more than one dwelling unit shall contain at least one
approved carbon monoxide alarm in operating condition within 15 feet of every
room used for sleeping purposes.

3. A carbon monoxide alarm may be combined with smoke detecting devices
provided that the combined unit complies with the respective provisions of the
Illinois Administrative Code, reference standards, and Illinois State Fire Marshal
rules relating to both smoke detecting devices and carbon monoxide alarms, and
provided that the combined unit emits an alarm in a manner that clearly
differentiates the hazard.
4. Carbon monoxide alarms shall be either battery powered, plug-in with battery
back-up, or wired into the building's AC power line with a secondary battery
back-up, except for new construction, as defined in Section 21.05 of the Village
Code, in which carbon monoxide alarms shall be wired into the building's AC
power line with a secondary battery back-up.
5. Carbon monoxide alarms shall be installed in accordance with manufacturers'
requirements.
C. Responsibility of the owner of a building.
1. The owner shall supply and install all required alarms.
2. The owner shall provide one tenant per dwelling unit with written information
regarding alarm testing and maintenance.
3. The owner shall ensure that the batteries are in operating condition at the time the
tenant takes possession of the dwelling unit.
4. Upon written notice of the tenant of any deficiencies in an alarm that the tenant
cannot correct, the owner shall correct such deficiencies.
D. Responsibility of a tenant.
1. A tenant shall replace any required batteries in alarms in the tenant's dwelling
unit, except upon taking possession of the dwelling unit.
2. A tenant shall test and provide general maintenance for the alarms within the
tenant's dwelling unit or rooming unit, and notify the owner or the authorized
agent of the owner in writing of any deficiencies that the tenant cannot correct. .
3. The tenant shall provide the owner or the authorized agent of the owner with
access to the dwelling unit to correct any deficiencies in the carbon monoxide
alarm that have been reported in writing to the owner or authorized agent of the
owner.
E. Failure to install or maintain carbon monoxide alarm; Tampering with carbon monoxide
alarm.

1. It shall be unlawful for any person to willfully or negligently fail to install or
maintain in operating condition any carbon monoxide alarm required under this
section.
2. It shall be unlawful for any person to tamper with, remove, destroy, disconnect, or
remove the batteries from any installed carbon monoxide alarm, except in the
course of inspection, maintenance, or replacement of the alarm.
3. Any person violating any provision of this section shall be fined as set forth in
appendix A, division III of this code.
F. Exemptions.
1. A dwelling unit is exempt from the requirement of having an operating carbon
monoxide alarm if it is located in a building that: (a) does not rely on the
combustion of fossil fuel for heat, ventilation, or hot water; and (b) is not
connected in any way to a garage.
2. A dwelling unit is exempt from the requirement of having an operating carbon
monoxide alarm if it is located in a building that is connected to a parking
structure, which is protected by an operating carbon monoxide detection system,
and that structure is the only source of carbon monoxide in the building.
3. The Building Commissioner, upon written request, may approve an exemption for
buildings four (4) stories or greater where he/she determines that the source of
carbon monoxide is adequately separated from the dwelling units by approved
construction methods and/or mechanical exhaust systems.
SECTION 6: The following shall be added in numerical order to Appendix A, Division
III "Penalties and Fines" of the Mount Prospect Village Code:
Section 24.207: PENALTY: CARBON MONOXIDE ALARM
E.l. Failure to install or maintain a carbon monoxide alarm in operating condition: not less
than $100.00 nor more than $1,500.00 for each offense.
E.2. Tampering with, removing, destroying, disconnecting, or removing the batteries from
any installed carbon monoxide alarm: not less than $100.00 nor more than $1,500.00
for each offense.

WHEREAS, the Forest River Fire Protection District has requested the Village
of Mount Prospect to provide services of the Fire Department of the Village to said

WHEREAS, the President and the Board of Trustees of the Forest River Fire
Protection. District have determined that it would be in the best interests of the District
and the Village to enter into an Agreement with the terms and conditions set forth in
Exhibit " A" attached hereto providing that the Mount Prospect Fire Department service
said District.
NOW, THEREFORE, be it resolved by the President and the Board of Trustees of

WHEREAS, THE Village of Mount Prospect, hereinafter, r~ferredto as . "The
Village", a municipal corporation organized under the laws of the State of Illinois and the
Forest River Fire Protection District, hereinafter referred to as the "District", a municipal
corporation organized under the laws of the State ofIllinois, and ....
WHEREAS, both the Village and the District are municipal corporations
organized under the laws of the State of Illinois and as such have the power under State
Law to enter into agreements for providing fire protection and emergency services, and
WHEREAS, THE Village has agreed to provide such services to. the District in
accordance with the terms hereinafter set forth.
NOW THEREFORE, IT IS AGREED BY AND BETWEEN THE VILLAGE
AND THE DISTRICT AS FOLLOWS:
1. That for the period beginning January 1, 2007 to December 31, 2007, at 12:00
midnight said day, the Village shall furnish all fire fighting, fire protection, fire
prevention and other emergency services, including emergency ambulance service, by
such volunteer or paid on call and/or regular firemen available to the Village as the Fire
Chief of the Village shall determine, to the District for a certain area as shown and
outlined in red on Exhibit 1 attached hereto and made a part hereof.
2. That for the period of time during which this Agreement shall be in full force and
effect, the District agrees to pay and the Village agrees to accept as full payment for said
fire protection, fire prevention services and emergency services, that amount of monies
received from tax receipts, replacement taxes, interest and other miscellaneous income
collected during the period beginning January 1, 2007 and ending December 31, 2007,
less all reasonable costs of running the said District, including, but not limited to, all
administrative legal salaries and other expenses incurred.
(2)
A. It is understood th~t the District shall levy taxes at the maximum rate authorized
by statute without referendum, which shall not be less than .30% of the value of
all taxable property within the District, and shall apply for and make all efforts to
receive any available state and/or federal aid to fire protection districts as is now
available or may be available during the term hereof.
B. The District will retain the sum of $2,500.00 to handle any contingency or
emergency matters that may develop during th~ year. All other monies shall be
paid to the Village as follows: On January 15, April 15, July 15 and October 15,
2007 all monies over and above the aforementioned $2,500.00 contingency fund
shall be paid to the village.
C. In addition, the District shall provide the Village with the follows:
( I ) A copy of the schedule of meetings of the District for the year
2007, be furnished upon execution of this Agreement.
(ii) A certified copy of the Tax Levy Ordinance adopted by the District
for the fiscal year 2006thru 2007, to be furnished upon execution
of this Agreement.
(iii) A copy of the District's audited financial statement for the. period
ending June 30, 2006, to be furnished within thirty (30) days after
receipt by the District.
( iv ) A copy of the Minutes of each District meeting, to be furnished
within (30) days after each meeting, when requested by the
Village.
( v ) The District shall provide the Village with copies of its quarterly
receipts and disbursements, for informational purposes only, it
being fully understood right of pre-approval regarding said
disbursements.

3. That the Fire Chief of the Village shall have the sole and exclusive right,
duty and responsibility to prescribe the manner and method of giving the alarm for fire
andlor other emergencies occurring within the District's territory as outlined upon said
Exhibit I.
4. That the Fire Chief of the Village or his authorized representative shall
have the sole and exclusive authority and responsibility to direct and control any and all
fire fighting, fire protection, fire prevention and other emergency operations carried on at
the scene of any alarm or emergency occurring within that territory of the District shown
upon the said Exhibit I.
5. That all fire fighting, fire protection, fire prevention and other emergency
procedures conducted under the provisions hereof shall be conducted in accordance with
the regulations of the Mount Prospect Fire Department and the ordinances of the Village.
Furthermore, the District agrees that within thirty (30) days of the execution hereof, if
permitted by state statute, it shall pass and approve ordinances identical in form and
content to the ordinances of the Village which deal with fITe fighting, fire protection, fire
prevention, building construction as related to fire safety and other emergency
procedures. Certified copies of said Ordinance(s) shall be submitted to the Village within
ten (I 0) days of their adoption by the District.
6. That all expenses and cost of maintaining equipment, apparatus, salaries,
insurance premiums and any and all other items of expenses connected with the several
services contemplated herein to be supplied by the Village to the District shall be borne
by the. Village. The only expense falling upon the District shall be in the form of the
payments scheduled to be made hereinabove under Paragraph 2b.
7. That, within seven (7) days of receipt of notice of annexation by an
municipality of land and territory within its district (as shown in orange upon the said
Exhibit I hereto), the District shall forward a copy of said notice (with the legal
description contained therein) to the village by addressing same to the attention of:
