Chairman Donnelly called the meeting to order at 7:03 pm. Commissioner Beattie made a motion
seconded by Commissioner Szymcak to approve the minutes from the Planning and Zoning Commission
meetings on November 14.,2019. The minutes were approved 5-0 with Commissioner Fitzgerald
abstaining. Chairman Donnelly introduced case, PZ -26-19108 S. George Street as a Variation to the side
yard setback. This case is Village Board final.
Mr. Harmon gave a brief description of the Subject Property and explained the existing conditions of the
Subject Property, and that the primary structure is currently existing non -conforming. Mr. Harmon
explained that the Petitioner would like to remodel the existing home, add an addition on the rear, add
a concrete porch, and enlarge the existing attached garage. Mr. Harmon explained that the Petitioner is
requesting a two and a half foot (2.5') setback, and the R -A Single Family Residential zoning district
requires a five foot (5') interior side yard setback. Mr. Harmon explained the building materials within
the elevation drawings of the proposal.
Mr. Harmon stated that Staff does not find that the variation complies with the standards as listed in the
Zoning Ordinance and is therefore not supportive of the request. Mr. Harmon stated that Staff feels that
there are alternatives to the proposal that would comply with code and remove the existing

nonconformity. Mr. Harmon further explained that the Public Works Department is also not supportive
of the request due to drainage issues. Based on these findings, staff recommends that the Planning and
Zoning Commission make a motion to adopt staff's findings as the findings of the Planning and Zoning
Commission and recommend denial of the following motions:
1. A variation to allow a two and a half foot (2.5') side yard setback for 108 S. George Street,, as
shown on plans created by KAdd Associates, dated October 21, 2019.
He stated the Village Board's decision is final.
Commissioner Beattie and Chairman Donnelly had general discussion with Mr. Harmon regarding the
roof overhand and drainage concerns raised by Public Works.
Commissioner Filippone had a general question about Public Works reviewing the case, and Mr.
Shallcross indicated that Public Works reviews all cases.
Chairman Donnelly swore in one of the Petitioners,, Anna Soltys, 108 S. George Street.
Ms. Soltys gave an overview and had general discussion on the project., and indicated that her existing
garage is too small and needs to be enlarged for practicality reasons. Ms. Soltys stated that she prefers
to preserve the green space in her backyard and the most functional way to do that is to request this
variation. She further stated that other alternatives were considered, however with the proposed floor
plan, this would not be feasible to alter the site plan.
Commissioner Filippone asked if there are any cost estimates of alternatives on the site.
Ms. Soltys stated there are no other cost estimates other than their proposal.
Commissioner Fitzgerald asked how the Petitioner planned on addressing Public Works comments about
drainage.
Kevin Anderson of KAdd Associates stated ways to mitigate the drainage through the use of north/south
downspouts.
There was some general discussion about how drainage would be impacted given alternative site design
by Mr. Anderson and the Commission.
Chairman Donnelly asked how wide a typical one and two car garage is.
Mr. Anderson stated that there are multiple factors that determine this.
After some general discussion, Ms. Soltys stated that a new floor plan and site would need to be created
if they were to conform to Village Code. Chairman Donnelly stated that a variation is warranted only if
there is no viable alternative, such as a slope on the lot.
There was more general discussion regarding the width of the lot, and the need for the variation.

Chairman Donnelly swore in Judy Paczko, Wally Paczko, 106 S. George Street, Lindsay Johnson, 110 S.
George Street, Beth Dukes, 105 S. George Street., Rachel Depcik., 103 S. George Street
Ms. Paczko and Mr. Paczko expressed their support for the project and feel that the improvements
would help the neighborhood, and state that the drainage isn't a concern as long as the flow pattern is
north to south.
Ms. Johnson stated that she supports the variation request and that one of the Petitioners is a small
business owner in Mount Prospect.
Ms. Dukes expressed concern about the drainage, and is in support of the request.
Ms. Depcik stated that she is in support of the variation request.
The Commissioners had general discussion regarding alternative site designs, lot coverage totals, and
the floor plan of the proposed remodel.
Commissioner Filippone asked if any other lots had similar variations granted.
Mr. Harmon stated that there were two variations granted on the block, one for an unenclosed front
porch, and one for an exterior yard setback in 1974, both of which are not applicable to this case.
There was discussion about what defines a hardship.
Hearing no further comments Chairman Donnelly closed the hearing and asked for a motion.
Commissioner Beattie made a motion seconded by Commissioner Griffin to approve the following
motion:
I. A variation to allow a two and a half foot (2.5') side yard setback for 108 S. George
Street, as shown on plans created by KAdd Associates, dated October 21, 2019.
UPON ROLL CALL AYES: Beattie, Szymczak, Griffin., Donnelly
NAYS: Fitzgerald, Filippone
A vote of 4-2 was taken with a positive recommendation to the Village Board
After hearing two additional cases., Commissioner Beattie made a motion seconded by Commissioner
Fitzgerald and the meeting was adjourned at 8:51 pm.
