SECTION ONE: That the President of the Board of Trustees of the Village of Mount
Prospect is hereby authorized to sign and the Village Clerk of the Village of Mount
Prospect is hereby authorized to attest the Agreement by and between the Village of
Mount Prospect and the State of Illinois, acting by and through its Department of
Transportation for FAUS PROJECT M-5003 (79) to facilitate the improvement of the
Illinois Route 83 "S" curve, Village Section 75-0050-00-TL from Shabonee Trail
to Milburn Avenue; which Agreement is attached hereto and hereby made a part
hereof as Exhibit I.
SECTION TWO: That the said Agreement shall be binding upon the signatories
thereto and upon their successor municipal authorities for the periods of time
set forth therein.
SECTION THREE: That this Resolution shall be in full force and effect from and
after its passage and approval in the manner provided by law.

FOR FAUS PROJECT M-S003 (79)
THIS AGREEMENT entered into this ~day of -.liJ 1
A.D., 1976, by and between the STATE OF ILLINOIS, acting by and through
its DEPARTMENT OF TRANSPORTATION, hereinafter called the STATE, and the
VILLAGE OF MOUNT PROSPECT, acting through its PRESIDENT AND BOARD OF
TRUSTEES, hereinafter called the VILLAGE.
WIT N E SSE T H
WHEREAS, the STATE and the VILLAGE, in order to facilitate the free
flow of traffic and insure safety to the motoring public, are desirous of
improving approximately 0.41 mile of Illinois Route 83 (FAS Route 128),
this portion being an "S" curve (involving portions of Elmhurst Road,
Lincoln Street and Main Street) between Shabonee Trail and Milburn Street,
in the Village of Mount Prospect, Cook County, Illinois, VILLAGE Section
7S-000S0-00-TL, STATE Section 1976-030-R, FAUS PROJECT M-5003 (79), by
making the following improvements:
'1. Widening and reconstruction of the existing 38 foot and
variable width pavement to 48 feet on Elmhurst Road and
on the curve between Lincoln Str~et and Main Street (to
provide four 12-foot traffic lanes), with one-way roadway
connections to Lincoln Street (east of Main Street) and
Main Street (south of Lincoln Street);

2. Widening and reconstruction of the existing 38-foot and
variable width pavement to 44 feet on Lincoln Street
and on Main Street (to provide four ll-foot traffic
lanes) ;
3. Realignment and reconstruction of portions of Lincoln Street
and Elmhurst Road to provide a 'T' intersection with the
curve between Elmhurst Road and Lincoln Street, and the
channelization of this intersection, including a left-turn
lane for northbound Elmhurst Road traffic and mountable
medians on the curve.
4. Installation of traffic signals, with pedestrian control, at
the above mentioned intersection at relocated Lincoln Str.eet-
Elmhurst Road.
5. Construction of a new curb and gutter and a storm sewer
system for the Project.
and by performing all other work necessary to complete the improvement in
accordance with the approved plans and specifications, hereinafter called
the PROJECT; and
WHEREAS, the STATE and the VILLAGE are desirous of s~id PROJECT in
that the PROJECT will be of immediate benefit to the VILLAGE'S residents
and permanent in nature;
NOW, THEREFORE, in consideration of the mutual covenants contained
herein, the parties hereto agree as follows:

1. The VILLAGE agrees, at its own expense, to make or cause
to be made all surveys, to prepare or cause to be pre-
pared the plans, specifications and estimates, to fur-
nish the resident engineer together with the engineer-
ing, proportioning of materials and inspection during
construction, to provide jOb control sampling and testing
of materials in accordance with the specifications, the
Project Procedures Guide and the methods prescribed by
the STATE, and to cause the PROJECT to be built in
accordance with the approved plans, specifications and
contract (the STATE and the FEDERAL HIGHWAY ADMINISTRA-
TION will reimburse the VILLAGE for a portion of these
costs as hereinafter stipulated).
2. The STATE agrees to provide progress and final sampling,
and to furnish off-site material inspection and testing,
at sources normally visited by STATE inspectors, of steel,
cement, asphalt, aggregates, sewer and drainage pipe,
structural steel, and other materials customarily tested
by the STATE.
3. The STATE agrees, after receiving Federal approval for
the plans, to receive the bids and to award the contract
subject to the concurrence of the VILLAGE and the FEDERAL
HIGHWAY ADMINISTRATION.
4. The VILLAGE has passed a resolution appropriating suffi-
cient funds to pay for its share of the cost of the PRO-

JECT, a copy of which is attached as "Exhibit A",
and will in the future pass a supplemental resolu-
tion to provide the necessary funds for its share if
the amount appropriated herein proves to be insuffi-
cient to cover said cost.
5. The VILLAGE has adopted and will put into effect,
prior to the STATE advertising for the work to be
performed hereunder, an ordinance requiring that

parking be prohibited within the limits of the PRO-
J E CT, a copy of which is attached as II Exhi bit B",
and wi 11 , in the future, prohibit parking at such
locations immediately adjacent to the PROJECT as
may be determined to be necessary by the STATE
from traffic capacity studies.
6. The VILLAGE has adopted and will put into effect, prior
to the STATE advertising for the work to be performed
hereunder, an ordinance prohibiting the discharge of
sanitary and/or industrial waste water into any storm
sewer constructed as a part of the PROJECT, a copy of
which is attached as "Exhibit C".
7. The VILLAGE agrees not to authorize or permit any opera-
ti on, practi ce or encroachment whi ch wi 11 change, impede,
or interrupt the orderly flow of vehicular traffic on
the completed PROJECT, and to enforce such traffic'regula-
tions and local ordinances that affect traffic operations
thereon.

8. Prior to the STATE advertising for the work to be
performed hereunder, the disposition of encroachments
wi 11 be cooperatively determi ned by the Representati ves
from the STATE, the VILLAGE and the Federal Highway
Administration.
A. The VILLAGE has adopted and will put into
effect, prior to the STATE advertising for
the work to be performed hereunder, an ap-
propriate ordinance relative to the disposi-
tion of encroachments, and prohibiting, in
the future, any neW encroachments within the
limits of the PROJECT, a copy of which is
attached as "Exhibit D".
9. The VILLAGE agrees to provide, prior to the STATE adver-
tising for the work to be performed hereunder, approval
by resolution of the plans, and the specifications as
prepared.
10. The VILLAGE agrees not to permit driveway entrance open-
ings to be made in the curb, as constructed, without the
consent of the STATE.
11. The VILLAGE shall exercise its franchise right to cause
private utilities to be relocated at no expense to the
STATE.
12. The VILLAGE agrees to regulate, or cause to be regulated,
on a continuing basis, the use of the highway right of way by

utilitie~ in the manner set forth in the current
State's Utility Accommodation Policy applicable to
the highway system involved.
13. Upon completion of the PROJECT the STATE agrees to
maintain or cause to be maintained the thru traffic
lanes, the left-turn lane, the median, the curb and
gutter adjacent to the thru traffic lanes and the
pavement markings (exclusive of the cross-walk and
stop bar pavement markings) on the following portion
of the PROJECT:
(a) Elmhurst Road from Shabonee Trail to Lincoln
Street,
(b) Li ncol n Street from Elmhurst Road to Main
Street,
(c) t4ain Street from Lincoln Street to Milburn
Street,
and shall retain jurisdiction thereof for as long as
this portion of the PROJECT is used as a STATE Highway.
14. Upon completion of the PROJECT, the VILLAGE agrees to
maintain or cause to be maintained relocated Lincoln
Street-Elmhurst Avenue and the one-way roadways at Lincoln
Street and Main Street, as well as all curb and gutter

flags, sidewalks, manholes, catch basins, storm sewers,
cross-w&lk and stop bar pavement markings, utilities
and appurtenances, not to be maintained by the STATE,
within the limits of the PROJECT.
15. Upon completion of the PROJECT, the VILLAGE agrees to
pay the entire cost of maintaining and furnishing
energy for the traffic signal installation. The
VILLAGE shall make arrangements with the local power
company to furnish the required electrical energy,
and the signal maintenance shall be in accordance
with the Traffic Signal Maintenance Provisions,
attached hereto as "Exhibit E". The STATE reserves
the right to control the sequence and timing of the
signals. The STATE also reserves the right to take
over maintenance of the signals in the event the
VILLAGE fails to provide proper maintenance thereof,.
and to bill the VILLAGE for the cost of such main-
tenance upon providing the VILLAGE written notice
at least thirty (30) days in advance.
16. The VILLAGE agrees henceforth to maintain a technically-
competent traffic engineering unit within its governmental
structure, or to provide other means acceptable to the
STATE and the Federal Highway Administration, for assuring
proper maintenance and operation of the completed PROJECT.

17. The VILLAGE agrees to comply with all applicable
Executive Orders and Federal Highway Acts pursuant to
the Equal Employment Opportunity and Nondiscrimination
Regulations required by the U.S. Department of Trans-
portation.
18. The parties hereto mutually agree that the estimated
cost of the PROJECT is as 'follows:

20. The VILLAGE agrees to pay the tota 1 cost of engineering,
which is an amount estimated to be $98,000.00, subject
to partial reimbursement of said cost by the STATE and
the Federal Highway Administration, as hereinafter
stipulated.

A. The STATE'S share of this cost is 50% of the
Pre}iminary (Phase I) and Design (Phase II)
Engineering, an amount estimated to be $25,000.00,
plus 14.895% of the Construction (Phase III)
Engineering, an amount estimated to be $7,149.60,
for a total estimated amount of $32,149.60.
B. The Federal (FAUS) share of this cost is 70.21%
of the Construction Engineering, an amount estimated
to be $33,700.80.
C. Upon award of the contract for construction of the
improvement, the STATE will reimburse the VILLAGE
an amount equal to 95% of the sum of the STATE
and FEDERAL obligations for the engineering cost,
an amount estimated to be $65,850.40, to be credited
to the VILLAGE'S MOTOR FUEL TAX Account, No. 75-00050-
OO-TL, and will pay to the VILLAGE, in a lump sum in
a similar manner, the remainder of the STATE and FED-
ERAL obligations upon completion of the PROJECT, based
upon final costs. The STATE, in turn, will be reim-
bursed by the Federal Highway Administration for the
Federal (FAUS) obligation for engineering costs, in
accordance with current billing procedures for
Federal-aid projects.
21. The STATE agrees to pay the total contract construction cost,
subject to partial reimbursement of said cost by the VILLAGE

and the Federal Highway Administration, as hereinafter
stipulated.
A. The VILLAGE'S share of this cost is 4.12% thereof,
an amount estimated to be $21,630.00. Upon award
of the contract for construction of the PROJECT,
the VILLAGE will pay to the STATE, in a lump sum
from any funds allotted to the VILLAGE, an amount
equal to 95% of its obligation incurred under this
Agreement, and will pay to the STATE the remainder
of the obligation (including any non-participating
costs for Federal-aid projects) in a lump sum upon
completion of the PROJECT, based upon final costs~
B. The Federal (FAUS) share of this cost is 70;21%
thereof, an amount estimated to be $368,602.50,
which is to be reimbursed to the STATE in accordance
which current billing procedures for Federal-aid
projects.
C. All costs which are ineligible for Federal-aid parti-
cipation shall be borne 100% by the VILLAGE.
22. The STATE agrees to provide contract construction admini-
stration and general supervision of the resident engineer.
23. The VILLAGE agrees to maintain all PROJECT records and to
make them available for review and/or audit by STATE and
Federal personnel during the PROJECT development and con-
struction stages, and to retain said records for a period

of three (3) years after final acceptance. The
VILLAGE further agrees to furnish the construction
records to the STATE for documentation review and
retention for Federal audit purposes until the close
of the calendar year during which construction, is
completed, at which time said records will be re-
turned to the VILLAGE for completion of the period
of retention.
24. The parties hereto mutually agree that failure on the
part of the VILLAGE to fulfill the responsibilities
covered in Items 5, 6, 7, 8, 14, 15, 16 and 17 of
this Agreement will render the VILLAGE ineligible
for Federal-aid participation in future highway pro-
jects for which they have similar responsibilities,
for as long as such failures remain uncorrected.
25. This agreement and the covenants contained herein shall
become null and void in the event the contract covering
the construction work contemplated herein is not awarded
prior to July 1,1978.
26. This agreement shall be binding upon and inure. to the
benefits of the parties hereto, their successors and
assigns.

AN ORDINANCE AMENDING THE IVIUNICIP AL CODE SO AS
TO PERMIT THE Il\1:PROVEMENT OF THE "S" CURVE ALONG
ILLINOIS ROUTE 83 BETWEEN SHABONEE TRAIL AND
MILBURN AVENUE
WHEREAS, the Village of Mount Prospect, hereinafter known as the Village, and
the State of Illinois, acting by and through its Department of Transportation, have
entered into an agreement relative to the improvement of Illinois Route 83 between
Shabonee Trail and Milburn Avenue in the Village of Mount Prospect; and
WHEREAS, in order to facilitate said improvement it is necessary for the Village to
adopt an ordinance regulating encroachments on the right-of-way for said improve-
ments. and prohibit the discharge of sanitary and industrial waste water at certain
locations;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Section 24.801 of the Municipal Code of Mount Prospect of 1957,
as amended, be and the same is hereby further amended by adding thereto a subsec-
tion B, which subsection B shall prohibit the discharge of sanitary and industrial
waste water into the "S" curve along Illinois Route 83 between Shabonee Trail and
Milburn Avenue; so that hereafter the said subsection B of Section 24.801 shall be
and read as follows:
"B. It shall be unlawful for any person, firm, or corporation to dis-
charge any sanitary or industrial waste water into any storm
sewers constructed by the State of Illinois as part of the improve-
ment of the Illinois Route 83 between Shabonee Trail and Milburn
Avenue -- all within the corporate limits of the Village of Mount
Prospect, known as Village Section 75-00050-00-TL, State Section
1976-030-R. FAUS PROJECT M-5003 (79)."
SECTION TWO: That Section 9.108 of the Municipal Code of Mount Prospect of 1957.
as amended. be and the same is hereby further amended by adding thereto a new sub-
section E, which subsection E shall prohibit encroachments along the "8" curve with-
in the Illinois Route 83 between 8haboneeTrail and Milburn Avenue; so that hereafter
the said subsection E of Section 9.108 shall be and read as follows:
"E. It shall be unlawful for any person, firm, or corporation, to erect
or cause to be erected, or to retain or to be retained, anyencroach-
ment (hereinabove defined) within the roadway rights-of-way of
Illinois Route 83 (FAS Route 128) as improved by the State of Illi-
nois, Division of Highways, between 8habonee Trail and Milburn
Avenue. in the Village of Mount Prospect, under the project known
as Village Section 75-00050-00-TL, State Section 1976-030-R, FAUS
PROJECT M-5003 (79)."

its passage, approval. and publication in the manner provided by law.
SECTION THREE: That this Ordinance is intended to and shall be an addition to
all other ordinances, rules and regulations concerning encroachments and shall
not be construed as repealing or amending any other ordinance or part of any
ordinance unless in direct conflict therewith.

A RESOLUTION APPROVING PLANS AND SPECIFICATIONS
FOR IMPROVING ILLINOIS ROUTE 83 BETWEEN SHABONEE
TRAIL AND MILBURN AVENUE
BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE
OF MOUNT PROSPECT. COOK COUNTY, ILLINOIS:
SECTION ONE: That the President of the Board of Trustees of the Village of Mount
Prospect is hereby authorized to sign and the Village Clerk of the Village of Mount
Prospect is hereby authorized to attest the Agreement by and between the Village of
Mount Prospect and the State of Illinois. acting by and through its Department of
Transportation for F AUS PROJECT M-5003 (79) to facilitate the improvement of the
Illinois Route 83 "S" curve t Village Section 75-0050-00-TL from Shabonee Trail
to Milburn Avenue; which Agreement is attached hereto and hereby made a part
hereof as Exhibit I.
SECTION TWO: That the said Agreement shall be binding upon the signatories"
thereto and upon their successor municipal authorities for the periods of time
set forth therein.
SECTION THREE: That this Resolution shall be in full force and effect from and
after its passage and approval in the manner provided by law.
