RESOLUTION NO. 35-76
A RESOLUTION AUTHORIZING THE ACQUISITION
OF CERTAIN REAL ESTATE BY CONDEMNATION t
IF NECESSARY t WHICH REAL ESTATE IS GENERALLY
LOCATED ON THE EAST SIDE OF 'MAPLE STREET
AND THE SOUTH SIDE OF PROSPECT AVENUE
WHEREAS t the projected expansion of downtown commuter parking by the Village of
Mount Prospect requires the acquisition of additional real estate t specifically t along
the east side of Maple Street and the south side of Prospect Avenue; and
WHEREAS t the expansion of the "Maple Street Commuter Parking Lot" so as to includE
the subject property hereinafter described will provide such additional commuter
parking;
NOW t THEREFORE t BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT t COOK COUNTY t ILLINOIS:
SECTION ONE: That it is hereby determined that the acquisition by the Village of
Mount Prospect of the following described real estate is necessary and desirable for
the expansion of downtown commuter parking t and that the Village of Mount Prospect
acquire fee simple title as well as possession of such real estate for said purposes t
which property t being wholely situated within the corporate limits of the Village of
Mount Prospect t is legally described as follows:
Commencing at the Southeast corner of the Northwest Quarter (!) of
Section 12 t Township 41 North t Range 11 East of the Third Principal
Meridian; thence West along the South line of the said Northwest Quarter
CD for a distance of 754.84 feet; thence North and parallel to the East
line of said Northwest Quarter G) for a distance of 638.78 feet; thence
East and parallel to the South line of said Northwest Quarter CD for a
distance of 13.0 feet to a point of beginning; thence North and parallel
with the East line of said Northwest Quarter for a distance of 252.15 feet
to an intersection with the Southerly line of East Prospect Avenue; thence
Southeasterly along the said Southerly line of East Prospect Avenue for a
distance of 160.33 feet; thence South and parallel to the East line of said
Northwest Quarter (!) for a distance of 174.10 feet; thence Westerly 137.0
feet to the point of beginning t in the Village of Mount Prospect t Cook County t
Illinois.
SECTION TWO: That the President of the Board of Trustees of the Village of Mount
Prospect be and he is hereby authorized to negotiate the aforesaid acquisition.
SECTION THREE: That t in the event such negotiations fail t the Village Attorney be
and he is hereby authorized t empowered t and directed to institute proceedings in

any court of competent jurisdiction to acquire title to and possession of the said real
estate for the Village of Mount Prospect t in accordance with the eminent domain laws
of the State of Illinois.
SECTION FOUR: That this Resolution shall be in full force and effect from and after
its passage and approval in the manner provided by law.
