ORDINANCE NO. 2081
AN ORDINANCE AMENDING SECTIONS 27 .AND 31 OF THE MOUNT PROSPECT ZONING ORDINANCE
WHEREAS, the Plan Corrmission of the Village of Mount Prospect here-
tofore on Marcp 29, 1968 did conduct a public hearing under Case No. 68-11P
pursuant to proper legal notice to amend Section 27 of the Zoning Ordinance
of the Village of Mount Prospect regarding Minimum Side Yard Requirements and
Section 31 of the said Zoning Ordinance concerning Definitions; and
WHEREAS, the Plan Corrmission of the Village of Mount Prospect have
recorrmended to the Board of Trustees of the Village of Mount Prospect the
adoption of the aforementioned amendments; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have reviewed the matters herein on May Zl,1968; and
WHEREAS, the said President and Board of Trustees have determined
that the best interests of the Village of Mount Prospect will be attained
by the adoption of the Plan Commission's recommendation on Case No. 68-11P;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, IlLINOIS:
SECTION ONE: 'Ihat Section 27 of the Zoning Ordinance referring to
sid,e yard requirements is hereby amended to read as follows:
Section 27 Minimum Side Yard
In the R-l, R-2. R-3 and R-4 Districts there shall be provided and
maintained an open tmoccupied space along each line of the building
plot which is a side line of the lot used, having a width of not
less than 10 per cent of the width of the lot which need not exceed
10 feet in width. In the R-A District the side yard on each side
shall not be less than 5 feet. Excepted from this regulation are:
(a) incidental or accessory buildings located more than 75
feet from front street line but such buildings shall not be
located within 20 feet of the side street line of a comer lot,
(b) steps, open terraces and tmdergrotmd structures, and
(c) eaves, chimneys, bay windows or other ordinary projections
into such yards not more than 18 inches.
In the Business 1-1 and 1-2 Districts side yards shall not be
required, tmless abutting a residential district, where they
shall be 20 feet. If provided for the "B" Districts they shall
not be less than three (3) feet wide.
, SEG'I'ION 'TWO: That portion of Section 31 of the Zoning Ordinance
referring to the den.nition of Lot is hereby amended to read as follows:
Lot
Land occupied or to be occupied by one main use or one main building
and its accessory buildings together with such open spaces as~are
required by this ordinance, and having its principal frontage upon
a street or public place shown on a plat of survey which has been
submitted to and approved by the Village Board. A lot shall be land
so recorded as a distinct parcel by the Recorder of Cook County or
registered by' the Registrar of} Deeds of Cook County, Illinois.

SECTION THREE: That all existing ordinances or parts of Ordinances
in conflict herewith are hereby repealed.
SECTION FOUR: This Ordinance shall be in full force and effect
from and after its passage, approval and publication in the manner provided
by law.
