ORDINANCE NO. 2096
AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 1820 BONITA AVE.
WHFEEAS, the Board of Appeals of the Village of Mount Prospect did
hold a Public Hearing on June 27, 1968 at the hour of 8:00 P.M. at the Village
Hall pursuant to proper legal notice; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect heard
testimony at the above-mentioned time presented under Case No. 68-30A pertaining
to a request for a side yard variation of five and one-half (5 1/2) feet; and
WHEREAS, the subject property hereinafter described is currently zoned
in an R-l District (Sing,le-Farnily Residence) which requires a minimum nine
(9) foor side yard; and
WHEREAS, the petitioner rrade the request for this variation in order
that an attached garage may be constructed to the existing structure thereon
and to within three and one-half (3 1/2) feet of the side m lot line thereof; and
IVHEREAS, since upon completion the proposed garage shall extend and
encroach upon the Southwesterly seven (7) feet of the existing ten (10) foot
utility easement, the petitioner has obtained the written consent and release
of the Conm:mwealth Edison and Northern Illinois Gas Companies to so erect the
said garage upon the said easement; and
WHEREAS, the partiCular physical surroundings of the specific property
involved would result in a hardship if the proposed garage were positioned
elsewhere in that an existing exit from the owner's home would be eliminated; an
WHEREAS, the Board of Appeals thereupon recommended approval of the
variation; and
v,1HEREAS, the Judiciary Committee of the Board of Trustees of the Village
of Mount Prospect subsequently met on August 13, 1968 and considered the
recommendation of the Board of Appeals under Case No. 68-30A; and
vJHEREAS, the Judiciary Conmittee has recommended to the Board of Trustees
f the Village of Mount Prospect that the variation as presented by granted; and
WHEREAS, the President and Board of Trustees of the Village of Mount
ospect have reviewed the matter herein and have determined that the same is
the best interests of the Village of Mount Prospect;
NOv!, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUS'IEES
F THE VILLAGE OF MOUNT PROSPECT, COOK COUNl'Y, ILLINOIS:
SECTION 1: That the property being the subject matter of Case No. 68-30A,
eing legally described as follows:
Lot 59 in Hatlen Heights, Unit No. Two, a Subdivision in the South Half
of the Northeast Quarter of Section 10, Township 41 North, Range 11,
East of the Third Principal Meridian, in Cook County, Illinois,
s currently zoned under the Zoning Ordinance of the Village of Mount Prospect
s R-l (Single-Family Residence) which zoning classification shall remain in
1 force and effect to the fOllOWing granted variation:
That the minimum Northeasterly side yard shall be three and one-half
( 3 1/2 ) feet.

SECTION 2: That all requirements of the Village Code shall be
applicable except that variation as specified in Section One heretofore
mentioned.
SEGrION 3: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby directed to issue a building permit in accordance
with the variation hereinabove mentioned.
SEGrION 4: That the variation granted by this Ordinance shall be null
and void and of no force and effect whatsoever unless an application for a
building permit, pursuant to the subject variation herein, shall be made and
construction commenced within one year of the date said Ordinance becomes
effective.
SECTION 5: This Ordinance shall be in full force and effect from and
after its passage, approval and publication in the manner provided by law.
