ORDINANCE NO. 2097
AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED AT 804 SOUTH WAVERLY
WHEREAS, the Eoard of Appeals of the Village of Mount Prospect did
hold a public hearing on August 6, 1968 at the hour of 8:00 P.M. at the
Village Hall pursuant to proper legal notice; and
\lJHEREAS, the Board of Appeals of the Village of Mount Prospect heard
testimony presented under Case No. 68-40A pertaining to a request for a side
yard variation of five feet and a rear yard variation of fifteen (15) feet; and
WHEREAS, the petitioner made the request for these variations so that
a home could be constructed upon this odd-shaped lot; and
WHEREAS, the Eoard of Appeals found that the particular shape of the
lot would result in a practical difficulty and hardship upon the owner, and
recommends approval of the variations as sought; and
WHEREAS, the Judiciary Committee of the Eoard of Trustees of the
Village of Mount Prospect recommended to the Board of Trustees of the Village
of Mount Prospect the granting of the variations; and
WHEREAS, the President and Eoard of Trustees of the Village of Mount
Prospect have reviewed the matter herein and have determined that the same is
in the best interests of the Village of Mount Prospect;
NOW, THEREFORE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: That the property being the subject matter of Case No.68-110A,
eing legally described as follows:
Lot 35 in Green Acres Unit One, being a Subdivision of part of
the East 1/2 of the Northwest 1/4 of Section 14, Township 41 North,
Range 11, East of the 3rd Principal Meridian, in Cook County,
Illinois.
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
s R-l (Single-Family Residence), which zoning classification shall remain
full force and effect subject to the following granted variations:
A. The minimum south side yard shall be five (5) feet.
B. The minimum rear yard shall be ten (10) feet.
SECTION 2: That all requirements of the Village Code shall be
pplicable except those variations as specified in Section One heretofore
ntioned. ..
SECTION 3: That the Director of Building and Zoning of the Village
f Mount Prospect is hereby directed to issue a building permit in accordance
ith the variations hereinabove mentioned.
SECTION 4: That the variations granted by the ordinance shall be
ull and void and of no forfe and effect whatsoever unless an application
or a building permit, pursuant to subject variations, is ma.de and construct-
on comrnenced within one year of the date said Ordinance becomes effective.

SECTION 5: This Ordinance shall be in full force and effect from
and after its passage, approval and publication in the ma.nner prescribed
by law.
