ORDINANCE NO. 2108
AN ORDINANCE AMENDING SECTION 2 OF THE ZONING ORDINANCE OF THE VILLAGE
OF MOUNT PROSPECT
WHEREAS, the Plan Corrnnission of the Village of Mount Prospect did
hold a Public Hearing on June 21, 1968 in the Village Hall, pursuant to
proper legal notice, under Case No. 68-31P; and
WHEREAS, the Plan Corrrnission reconmmded approval of the text of
the proposed amendment to Section 2 of the Zoning Ordinance of the Village
of Mount Prospect contained hereunder; and
WHEREAS. the Judiciary Comnittee of the Board of Trustees of the
Village of Mount Prospect have on September 12. 1968 reviewed the subject
matter herein and have reconmended to the Board of Trustees of the Village
of Mount Prospect concurrence with the reconmendation of the Plan Corrmission
under Case NO. 68-31P; and
WHEREAS. the President and Board of Trustees of the Village of
Mount Prospect concur in the Plan Corrrnission' s reconmendation, and have
determined that the same is in the best interests of the Village of Mount
Prospect;
NOW, THEREFORE. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VIlLAGE OF MOUNT PROSPECT. COOK COUNTY, ILLINOIS:
SECTION I: That Section 2 of the Zoning Ordinance of the Village
of Mount Prospect, as amended. is hereby further amended by changing
paragraph "D" thereof and adding to said Section 2 a new paragraph "E". so
that paragraphs "D" and "E" of said Section 2 shall be and read as follows:
"SECTION 2. APPLICATIONS, PERv'IITS, AND OCCUPANCY CERrIFICATES.
(D) No permit for excavation for. or the erection or alteration
of, any building or structure shall be issued until application
has been made to the Director of Building and Zoning.
(E) No building or addition thereto shall be occupied. and no
vacant land shall be used for any purpose. until a certificate of
occupancy has been issued by the Office of the Department of
Building and Zoning. No change in a use of any bUilding, of an
addition thereto, or of vacant land shall be made until a
certificate of occupancy has been issued by. the Office of the
Department of Building and Zoning. Every cert ificate of occupancy
shall state that the use or occupancy canplies with all of the
provisions of this zoning ordinance.
1. Application for Occupancy Certificate
Every application for a building permit shall be deemed
to be an application for an occupancy certificate.
Every application for an occupancy certificate for a
new use of land where no building penni t is required
shall be made directly to the Office of the Department
of Building and Zoning.
2. Issuance of Occupancy Certificate
No occupancy certificate for a building or addition
thereto shall be issued until construction has been
completed and the premises inspected and certified by
the Office of the Department of Building and Zoning to
be in confonnity with the plans and specifications upon
which the building pennit was based. No occupancy

certificate for a building or an addition to an existing
building shall be issued nor shall such building or
addition be occupied until the premises have been
inspected and certified by the Office of the Department
of Building and Zoning to be in compliance with all of
the applicable performance standards of this zoning
ordinance. An occupancy certificate shall be issued,
or written notice shall be given to the applicant stat-
ing the reasons Why a certificate cannot be issued, not
later than seven (7) days after the Office of the
Department of Building and Zoning is notified in writing
that the building or premises is ready for occupancy.
3. Posting of Occupancy Certificate
Upon the issuance on an occupancy certificate for any
building other than single family and duplex residence
buildings, such occupancy certificate and duplicate
thereof shall be permanently maintained and prominently
displayed at every entrance to 5a.id, building. Duplicate
occupancy certificate shall be issued upon request to
the Department of Building and Zoning of the Village of
Mount Prospect."
SECTION 2: That all other ordinances or parts of ordinances in
conflict herewith be and are hereby repealed.
SECTION 3: 'Ihat this ordinance shall be in full force and effect
from and after its passage and approval in the manner provided by law.
