ORDINANCE NO. 2110
AN ORDINANCE AMENDING SECTIONS 20, 27, 28 and 29 OF THE ZONING ORDINANCE OF
THE VILLAGE OF MOUNT PROSPECT
WHEREAS, the Plan Comnission of the Village of Mount Prospect did
hold a pUblic hearing on June 21, 1968 at the hour of 8: 00 P.M. in the
Village Hall, pursuant to proper legal notice under Case No. 68-31P; and
WHEREAS, the subject matter under consideration in Case No. 68-31P
was the proposed text of a new zoning district for the Village of Mount
Prospect ; and
WHEREAS, the Plan Comnission did recommend approval of the said
text along with corresponding amendments to Section 20, 27, 28 and 29 of
the Zoning Ordinance of the Village of Mount Prospect contained hereunder; and
WHEREAS, the Judiciary Corrmittee of the Board of Trustees of the
Village of Mount Prospect have on September 12, 1968 reviewed the subj ect
matter herein and have reconmended to the Board of Trustees of the Village
of Mount Prospect concurrence with the recommendation of the Plan Commission
under Case No. 68- 31P; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect concur in the Plan Comnission's recorrrnendation, and have
determined that the same is in the best interests of the Village of Mount
Prospect; . ,
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, IILINOIS:
SECTION 1: That sub-paragraph "1." of Paragraph "I" of Section 20
of the Zoning Ordinance of the Village of Mount Prospect, as amended, is
hereby further amended, so that said sub-paragraph "111 of Paragraph "I" of
Section 20 shall be and read as follows:
"1. Professional Offices Finance Bankin and Financial Instituti
One parking space shall be provided for each 200 square feet of
gross floor area used in the building in relationship to that use."
SECTION 2: That Section 27 of the Zoning Ordinance of the Village
of Mount Prospect, as amended, be and is hereby further amended, so that the
said Section 27 shall be and read as follows:
"Section 27 Minimum Side Yard:
(A) In the R-X, R-l, R-2, R-3 and R-4 Districts there shall be
provided and maintained an open unoccupied space along each line
of the building plot which is a side line of the lot used, having
a width of not less than 10 percent of the width of the lot
which need not exceed 10 feet in width. In the R-A District the
side yard on each side shall not be less than 5 feet. Excepted
from this regulation are:
(1) incidental or accessory buildings located more than 75
feet from the front lot line but such buildings shall
not be located within 20 feet of the side lot line of a
corner lot, nor within 2 feet of the side lot line of
any other lot,
(2) steps, open terraces and underground structures, and
(3) eaves, Chimneys, bay windows or other ordinary projections
extending into such yards not more than 18 inches.
(B) In the B-2.l Business District, the side yard shall be not

less than 20 feet, where such use abutts ~~ Zoned Residential
District. If provided for in the remaining business districts,
side yards shall not be less than three (3) feet wide.
(6) In the I-l and I-2 Districts no side yard shall be required,
unless such "I" District abutts any zoning district that does
require a side yard; in which event the side yard requirement of
the imnediately adjacent properties of the said "I" District shall
be the same as that of this district it abutts."
SECTION 3: That Section 28 of the Zoning Ordinance of the Village
of Mount Prospect, as amended, be and is hereby further amended, so that the
said Section 28 shall be and read as follows:
"Section 28 Minimum Front Yard:
Any building or structure hereafter erected or relocated in the
Village shall be set back from the front lot line at least 40
feet if it is for a use allowable in the R-X District; at least
30 feet if it is for a use allowable in the R-l, R-A, R-2 or
R-3 District; and at least 20 feet if it is for a use allowable in
the R-4 District. Any building or structure hereafter erected in
the B-2.l District shall be set back from the front lot line at
least 20 feet; except if it is for a use abutting any of the afore-
mentioned Residential Districts, in which event the set-back
shall be not less than that required in such Residential District
the said B-2.l District abutts. Any building or structure here-
after erected in an I-lor I-2 District shall be set back only if
such building is inmediately adjacent to and abutting a zon:ing
district that does require a front yard, :in which event the front
yard requirement of the 1nmediately adjacent properties of the
said llI" District shall be the same as that of the district it
abutts, except if that such district is a residential district,
the m:1nimum front yard shall be not less than twenty (20) feet.
Exceptions:
(a) .. a proposed residence building need not be set back from
a residence building existing in the same block on the
adoption date of this ord:inance more than 1 foot for
each 3 feet of distance between such buildings;
(b) open steps and terraces, and
(c) eaves, chinneys, bay windows and other ord:inary projections
extending into such yards not more than 18 inches."
SECTION 4: That Section 29 of the Zoning Ordinance of the Village
of Mount Prospect, as amended is hereby further amended, so that the said
Section 29 shall be and read as follows:
"Section 29 Minimum Rear Yard:
Any build:ing or structure hereafter erected or relocated shall be
set back from the rear lot l:ine at least 25 feet :in the R-X; R-l,
R-A, R-2, and R- 3 Districts, and at least 20 feet in the R-4,
Business and I-l Districts. However, where such I-l District or
an I-2 District abutts a zon:ing district that requires a side yard.
or a greater side yard, than that required above, then the side
yard requirement of the imnediately adj acent properties of the
said "I" Districts shall be the same as that of the district it
abutts. Excepted from this regulation are:
(a) :incidental or accessory buildings in the R-l, R-2, R-3
and R-4 Districts on interior lots and on corner lots
if located at least 5 feet from a rear lot line which is
also the sideline of the adjoining lot;

SECTION 5: That all ordinances or parts of ord:inances in conflict
herewith be and are hereby repealed.
SECTION 6: That this ord:inance shall be in full force and effect
from and after its passage and approval in the manner provided by law.
