ORDINANCE NO. 2117
AN ORDINANCE GRANTING A SIDE YARD REQUIREMENT VARIATION LOCATED AT 320 NORTH
WILLE STREET MOUNT PROSPECT. ILLINOIS
WHEREAS, the Board of Appeals of the Village of Mount Prospect did
meet on the 26th day of September, 1968 at the hour of 8:00 P.M. at the
Village Hall of Mount Prospect and did hear Case No. 68-44A pursuant to legal
notice published in the Mount Prospect Day on September 6, 1968; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect did
hear a petition requesting a variation of the side yard requirements in
order that the petitioner may erect a two-car garage on the property legally
described herein; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect have
recommended to the Board of ~rustees of the Village of Mount Prospect to
grant the variation requested; and
WHEREAS, the Judiciary Committee of the Board of Trustees of the
Village of Mount Prospect did meet on October 24, 1968 and considered Case
No. 68-44A and recommended to the President and Board of Trustees that the
variation requested under Case No. 68-44A be granted because of the hardShip
created by the petitioner's narrow lot; and
WHEREAS, the President and Board of Trustees do believe that the
granting of the variation would not be detrimental to the irrmediate
neighborhood or to the residents of the Village of Mount Prospect and that
the best interests of the residents of the Village of Mount Prospect will
be subserved by the granting of this variation;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, IILINOIS:
SECTION 1: That the property being the Subject matter of Case
No. 68-44A being legally described as follows:
Lot 36 in H. Roy Berry Co. 's 1st addition to Castle Heights being
a subdivision of the South 1/2 of the Southeast Quarter of the
Northwest Quarter and the North 95.02 feet of the East 1/2 of the
Southwest Quarter all in Section 34, Township 42 North, Range 11,
East of the Third Principal Meridian in Cook County, Illinois
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as R-l (Single Family Residence) which zoning classification shall remain
Subject to the variation granted herein:
(a) That the side yard abutting Gregory Street may be reduced
to a minimum of ten (10) feet.
SECTION 2: That all requirement s of the Mount Prospect Building
and Zoning Code shall be appliCable except the variation noted in Section
One heretofore mentioned.
SECTION 3: That the Director of Building and Zoning of the Village
of Mount Prospect is hereby authorized to issue a building permit for the
erection and construction of a garage in accordance with the variation
hereinbefore mentioned.

SECTION 4: That the variation granted by this Ordinance shall
be null and void and of no force and effect whatsoever unless an application
for a building permit pursuant to such variation is made and construction
comnenced within one year of the date said Ordinance becomes effective.
SECTION 5: This Ordinance shall be in full force and effect from
and after its passage and approval in the manner provided by law.
