ORDINANCE NO. 2118
AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED ON THE SOUTHWEST CORNER
OF PINE STREEr AND PROSPEGr AVENUE
WHEREAS, the Board of Appeals of the Village of Mount Prospect, held
a meeting on October 9, 1968 at the hour of 8:00 P.M. in the Mount Prospect
Village Hall pursuant to notice published in the Prospect Day on September
25, 1968; and
WHEREA..S, the Board of Appeals of the Village of Mount Prospect
heard testimony presented under Case No. 68-53A pertaining to a request to
operate a professional office building on property hereinafter described
which request involved a land use variation, a rear yard variation, and a
side yard variation; .~and
WHEREAS, the Board of Appeals recommended to the Judiciary Conrnittee
of the Board of Trustees of the Village of Mount Prospect allowance of the
variations petitioned for; and
WHEREAS, the Judiciary Committee of the Board of Trustees of the
Village of Mount Prospect subsequently met on October 24, 1968 and reviewed
Case No. 68-53A; and
WHEREAS, the Judiciary Conmittee recommended to the Board of Trustee
of the Village of Mount Prospect concurrence with the recorrmendations of the
Board of Appeals; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have reviewed the matter herein and have determined that the
same is for the best il1terests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: That the property being the subj ect matter of Case
No. 68-53A being legally described as follows:
Lots 53 and 511 in H. Roy Berry Co. Colonial Manor Subdivision,
Section 11 and 12, Township 41, Range 11, East of the Third
Principal Meridian
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as R-3 (Apartment Residence District) which zoning classification shall
remain subject to the following granted variations:
(a) That the use of the aforementioned property may consist of
the operation of a professional office building, not to
exceed 3300 sq. ft. in area with provisions for the parking
of at least 16 automobiles upon the said property;
(b) That the Northeast corner of the said building may lie
within (six) 6 feet of the property line abutting Pine
Street; and
(c) That the rear yard may be reduced to a minimt.m1 of twenty-two
(22) feet.
SECTION 2: That all other requirements of the Village Code,
including the maintenance of a thirty (30) foot building set back from the
property line abutting Prospect Avenue, shall be applicable except those
variations as specified in Section 1 hereinabove mentioned.

SECTION 3: That the Director of Building and Zoning of the
Village of Mount Prospect is hereby directed to issue a bUilding permit in
accordance with the variations hereinbefore mentioned.
SECTION 4: That the variations granted by this Ordinance shall
be null and void and of no force and effect whatsoever unless an application
for a building permit pursuant to such variations is made and construction
conmenced within one (1) year from the date this said Ordinance becomes
effective.
SECTION 5: This Ordinance shall be in full force and effect from
and after its passage, approval and publication in the manner provided
by law.
