HomeMy WebLinkAboutOrd 2047 02/06/1968 ~, ,,~ .-" ~ ORDINANCE NO. 2047 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED ON THE SOUTHWEST CORNER OF PROSPECT AVENUE AND EDWARD STREEr. WHEREAS, the Board of Appeals of the Village of Mount Prospect did hold a Public Hearing on November 2, 1967 at the hour of 8:00 P.M. at the Village Hall, pursuant to legal notice ; and WHE{lliAS, the Board of Appeals of the Village of Mount Prospect heard testimony presented under Case No. 67-58A pertaining to a request for a side yard variation of ten (10) feet and a rear yard variation of fifteen (15) feet; and WHEREAS, the subject property hereinafter described is currently zoned in the 1-1 District (light industrial) which requires a minimum twenty (20) foot side yard and a minimum thirty (30) foot rear yard; and WHEREAS, the petitioner made the request for these variations so that a building addition may be constructed to the existing structure thereon; and WHEREAS, the Board of Appeals recorrmended approval of the variations sought subject to the petitioner's providing an ingress and egress driveway from the proposed parking lot to Prospect Avenue; and WHEREAS, the Judiciary Committee of the Board of Trustees of the Village of Mount Prospect subsequently met and considered the recornnendations of the Board of Appeals under Case No. 67-58A; and WHEREAS, the Judiciary Corrmittee recommended to the Board of 'Irustees of the Village of Mount Prospect to grant the variations as presented subject to the petitioner submitting a plot plan showing the addition of a driveway from the proposed new parking lot to Prospect Avenue, and a request that a 2-hour parking limit sign be posted on Edward Street abutting the subject property; and WHEREAS, the President and Board of 'Irustees of the Village of Mount Prospect have reviewed the matter herein and have determined that the same is in the best interests of the Village of Mount Prospect; NOW, THEREFORE J BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION 1: That the property being the subj ect matter of Case No. 67-58A, being legally described as follows: Lot 8 in Gleich's Industrial Park, being a sub~ division of part of the W 1/2 of the N.E. 1/4 and part of the W 1/2 of the S.E. 1/4 of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as 1-1 (light industrial), which zoning classification shall remain in full force and effect subj ect to the following granted variations; A. The minimum side yard shall be ten (10) feet. B. The minimum rear yard abutting the public alley shall be fifteen (15) feet. /~ ,-, ,-, ~ SECTION 2: That all requirements of the Village Code shall be applicable except those variations as specified in Section 1 heretofore mentioned. SECTION 3: That the Director of Building and Zoning of the Village of Mount Prospect is hereby directed to issue a building permit in accordance with the variations hereinabove mentioned, providing that the plot plan submitted indicates a driveway from the proposed new parking lot to Prospect Avenue and the property owner has requested, by letter, that a 2-hour parking limit sign be posted on Edward Street abutting the subj ect property. SECTION 4: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit, pursuant to subject variations, is made and construction corrmenced within one year of the date said Ordinance becomes effective. SECTION 5: This Ordinance shall be in full force and effect from and after its passage, approval and publication in the manner prescribed by law.
