ORDINANCE NO. 2055
FLOOD PLAIN ORDINANCE
WHEREAS, the Plan Commission of the Village of Mount Prospect did
hold a Public Hearing on September 15, 1967 pursuant to legal notice under
Case No. 67-21P; and
WHEREAS, the Plan Commission of the Village of Mount Prospect did
recommend approval of the proposed Flood Plain Ordinance; and
WHEREAS, the Metropolitan Sanitary District issued a directive to all
municipalities within its jurisdiction in September of 1967 indicating that
no sewer permits are to be granted in Flood Plain areas until local governments
have passed a Flood Plain Ordinance designed to control flooding in certain
areas; and
WHEREAS, there are areas within the Village of Mount Prospect subj ect
to periodic flooding resulting in a hazard to persons and damage to property
from the accumulation or run-off of strom or flood waters; and
WHEREAS, the Village of Mount Prospect is undergoing development in
heretofore tmdeveloped areas which are located within the areas subj ect to
such periodic flooding; and
WHEREAS, it is deemed necessary to avoid or lessen the hazards of
damage to persons or property resulting from flooding, by prescribing rules
and regulations for the purposes;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: That Chapter 23 of the Municipal Code of the Village of
Mount Prospect of 1957, as amended, is hereby further amended by adding thereto
a new Article 6, which Article 6 of Chapter 23 shall be and read as follows:
Article 6. Flood Plain Ordinance
Section 23.601. Definitions:
(a) "Flood Plain Areas" are those areas delineated on the naps
prepared by the United States Geographical Survey in cooperation
with the Northeastern Illinois Area Planning Commission.
(b) "Flood Base Elevation" is the elevation of the highest flood of
record, as indicated on the HYDROLOGIC INVESTIGATION ATLAS as
prepared by the United States Geographical Survey in cooperation
with the Northeastern Illinois Area Planning Commission. Flood
base elevations at intermediate locations shall be interpolated
along the water course between the two nearest flood base
elevations, one each upstream and downstream. The controlling
flood base elevation for any building site shall be the same as
the flood base elevation at the nearest point of the water
course as measured on a line perpendicular to the direction of
the water course.
Section 23.602. Flood Plain Rerlations:
(a) The Flood Plain Areas shal be subject to flood plain regulations
as established by the Village of Mount Prospect and set forth
in this ordinance. Said regulations will guide development in
order to promote the public health, safety and welfare through
flood regulations, provided however, that the provisions of this
ordinance shall not apply to existing subdivisions within the
flood plain as to which covenants, approved by the Village Board,
pertaining to the minimum elevations of streets, lots and
structures recorded prior to the date of the passage of this
ordinance.
(b) No new or existing building or structure shall be erected or
moved within a flood plain unless the lowest floor including the
basement floor is at an elevation which is not less than two and
one-half (2-1/2) feet above the Flood Base Elevation for the
site; provided, however, that basement floors may be erected
below such elevation when the top of any basement wall or the
bottom of any opening therein is not less than two and one-half
(2-1/2) feet above such elevation and the construction of such
basement floors and walls complies with the requirements of the
Village of Mount Prospect Building Code.
(c) The elevation of the ground for a minimum distance of five (5)
feet 1rrrnediately surrounding any building or structure erected
or moved within a flood plain shall be at an elevation which is
not less than one (1) foot above the Flood Base Elevation for
the site and shall be sloped to drain away from the walls for a
distance of at least five (5) feet.
(d) The crown of street pavements hereafter built in the Flood Plain
Area shall not be lower than the Flood Base Elevation plus two
(2) feet, in case of major streets, and plus one (1) foot, in
the case of other streets.
(e) All sanitary sewer manholes constructed in the Flood Plain Areas
must have a rim elevation a minimum of one (1) foot above the
record Flood Base Elevation for the area as indicated on the
flood map prepared by the United States Geological Survey.
When the manhole rim is less than two and one-half (2-1/2) feet
above the flood of record a watertight manhole cover must be
provided.
(f) No building or structure shall be erected or moved within the
area bounded on each side of a line parallel to and one hundred
(100) feet distance from the center line of Weller Creek.
(g) Existing streams, water courses, and flood water run-off channels
as delineated by the HYDROIroIC INVESTIGATION ATLAS, or by the
determination of the Village Engineer, are to be retained either
in their present location or in locations approved by the Village
Engineer. Floodway easements of at least twenty (20) feet wide
shall be provided and shown on the plat when designated as
necessary by the Village Engineer to safeguard the intent of this
Ordinance. The easement shall permit necessary public channel
maintenance and improvement work and access of equipment therefor
but shall prohibit buildings, fences and other obstructing
structures thereon by the owner.
(h) Retention or Detention Basins; A topographical survey plat shall
be submitted to the Village Engineer for detennination of the
present run-off factor. A topographical survey indicating the
improvements proposed and Flood Plain property displaced must
also be submitted. A retention or detention basin may be require
on the subject property to accommodate the acre feet displaced
as a result of the proposed improvements. The sizing and
location of said retention or detention basin shall meet with
the approval of the Village Engineer. When a retention or detent. t
basin is determined necessary, proper easements shall be granted
to insure the maintenance and operational function of same.
(i) Exceptions to the elevation restrictions stated herein may be
granted upon the recomnendation of the Village Engineer by the
Village Board only in certain situations where it can be determin
that recent engineering improvements have been undertaken to lowe
the actural Flood Base Elevation as defined herein and if the
alternate plan of flood control and storm drainage plan is in
harmony with the purposes and intent expressed in this Ordinance

and is equally effective as provided herein. In no case,
however, shall a building or structure be allowed to be
erected with the lowest foundation opening elevation lower
than the Flood Base Elevation.
SECTION 2: All ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 3: This Ordinance shall be in full force and effect from and
after its passage,approval, recordation and publication as provided by law.
