ORDINANCE NO. 2058
AN ORDINANCE AMENDING SECTION 9.108 OF' THE MUNICIPAL CODE OF THE VILLAGE OF
MOUNT PROSPECT PROHIBITING ENCROACHEMNTS AIDNG THE RIGHT-OF-WAY ON GOLF
ROAD AS IMPROVED BErWEEN MOUNT PROSPECT ROAD AND IOKA AVENUE.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION 1: That Section 9.108 of the Municipal Code of the Village
of Mount Prospect of 1957, as amended, is hereby further amended by adding
thereto a new paragraph (a) so that Section 9.108, paragraph (a) shall be
and read as follows:
(a) It shall be unlawful for any person, firm. or corporation to
install, construct or maintain any encroachment within the roadway
right-of-way of Golf Road, as improved, by the State of Illinois,
Division of Highways, between Mount Prospect Road and Ioka, under
project known as Golf (Evanston-Elgin) Road (FA Route 58) SBI State
Section 582-R.
Any existing awnings, marquees, advertising signs and similar
overhanging structures supported from buildings inmediately adjacent
to the roadway right-of-way at locations where there are continuous
sidewalks extending to and through the frontage building line and
which do not impair the free and safe flow of traffic on the
highway, may be permitted to remain upon the written approval of
the State of Illinois , Division of Highways and the issuance of
a permit therefor by the Village.
"Roadway right-of-way" as used herein shall mean those areas
existing or acquired by dedication or by fee simple for highway
purposes, and also the areas acquired by temporary easement during
the time the easement is :i:n effect. "Encroachment" as used herein
shall mean any building, fence, sign, or any other structure or
object of any kind (with the exception of utilities, public road
signs and municipally owned parking meters) which is placed. located
or maintained in, on, under or over any portion of the roadway
right-of-way.
SECTION 2: This Ordinance shall be in full force and effect from
and after its passage, approval and publication in the manner provided by
law.
