AN ORDINANCE AMENDmG SECTION 9.108 OF THE MUNICIPAL CODE OF THE VIlLAGE OF
MOUNT PROSPECT PROHIBITING ENCROACHJ.V1F.NrS ALONG THE RIGHT-OF-WAY ON GOLF ROAD

THE VILLAGE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VIlLAGE OF
MOUNT PROSPECT, COOK COUNrY, ILLINOIS:
SECTION 1: 'Ibat Section 9.108 of the Municipal Code of the Village of
Mount Prospect of 1957, as amended, is hereby further amended by amending
paragraph (a) so that Section 9.108, paragraph (a) shall be and read as follow
(a) It shall be unlawful for any person, finn, or corporation to install,
construct or maintain any encroachment within the roadway right-of-way
of Golf Road, as improved, by the State of Illinois, Division of Highways,
between Mount Prospect Road and the westerly corporate limits of the
Village of Mount Prospect, under project known as Golf (Evanston;Elgin)
Road (FARoute 58) SBI State Section 582-R and 582-R.l.
Any existing awnings, marquees, advertising signs and similar overhanging
structures supported from buildings irmnediately adj acent to the roadway
right-of-way at locations where there are continuous sidewalks extending
to anp. through the frontage building line and which do not impair the
free and safe flow of traffic on the highway, may be permitted to remain
upon the written approval of the State of Illinois, Division of Highways
and the issuance of a permit therefor by the Village.
"Roadway right-of-way" as used herein shall mean those areas existing or
acquired by dedication or by fee simple for hig.,hway purposes, and also
the area acquired by temporary easement during the time the easement is
in effect. "Encroachment" as used herein shall mean any building, fence,
Sign, or any other structure or obj ect of any kind (with the exception
of utilities, pUblic road signs and municipally owned parking meters)
which is placed, located or maintained in, on, under or over any portion
of the roadway right-of-way.
SECTION 2: 'Ibis Ordinance shall be in full force and effect from and
after its passage, approval and publication in the manner provided by law.
