AN ORDINANCE AMENDING ARTICLE VIII ENTITLED "FLOOD PLAIN
REGULATIONS" OF CHAPTER 22 AND ARTICLE IV OF CHAPTER 16
OF THE VILLAGE CODE OF MOUNT PROSPECT
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Section 22.802 of entitled "Definitions" of Chapter 22 of the
Village Code, as amended, is hereby further amended by deleting the definition of
"DWR - Illinois Department of Transportation, Division of Water Resources" and
inserting in proper alphabetical sequence "IDNR/OWR - Illinois Department of Natural
Resources, Office of Water Resources"; so that hereafter said Section 22.802 shall
include:
" IDNR/OWR Illinois Department of Natural Resources, Office of
Water Resources "
SECTION TWO: That wherever reference to "DWR" or "Illinois Department of
Transportation, Division of Water Resources" is made throughout Chapter 22 or the
entire Village Code that reference shall be changed to "IDNR/OVVR" or "Illinois
Department of Natural Resources, Office of Water Resources."
SECTION THREE: That Section 22.802 entitled Definitions of Chapter 22 of the
Village Code, as amended, is hereby further amended by deleting the definition for
"Regulatory Floodway" and substituting therefor the following; so that hereafter said
definition for "Regulatory Floodway" shall be and read as follows:
" Regulatory Floodway - The channel, including on-stream lakes and that portion of
the floodplain adjacent to a stream or water course, as
designated by IDNR/OWR, which is needed to store and
convey the existing and anticipated future 100-year
frequency flood discharge with no more than 0.1 foot
increase in stage due to the loss of flood conveyance or
storage and no more than a ten percent (10%) increase in
velocity. Regulatory floodways are designated for Weller
Creek, McDonald Creek and Feehanville Ditch on the Flood
Boundary and Floodway Map prepared by FEMA and dated
August 2, 1982. The regulatory floodways for those parts
of unincorporated Cook County that are within the
extreterritodal jurisdiction of the Village that may be
annexed into the Village are designated for Tributary A of
Higgins Creek, Higgins Creek, Tributary B of McDonald
Creek and McDonald Creek on the Flood Boundary and
Floodway Map prepared by FEMA and dated April 15,
1981. The regulatory floodway, both within the corporate
limits and unincorporated Cook County, are designated for
the Des Plaines River on the Regulatory Flood Plain Map
prepared by IDNR/OWR and dated October 1, 1978. To
locate the regulatory 'floodway boundary on any site, the
regulatory floodway boundary should be scaled off the
regulatory floodway map and located on the site plan using
reference points common to both maps. Where
interpretation is needed to determine the exact location of
the regulatory floodway boundary, IDNR/OWR should be
contact for any interpretation.

SECTION FOUR: That Section 22.807.B.l.a.(1) of Chapter 22, as amended, is
hereby further amended by accurately reflecting the calculation; so that hereafter said
Section 22.807.807.B.l.a (1) shall be and read as follows:
" (1) Regulatory floodway conveyance,

cross-section, and "R" is the ratio of the area to the wetted perimeter.

SECTION FIVE: That Section 22.807.B.2.c. of Chapter 22, as amended, is hereby
further amended by changing the reference Sections from "Section 22.807. B.l.e"; so
that hereafter said Section 22.807.B.2.c shall be and read as follows:
" c. The IDNR/OVVR will review alternative transition sections and
hydraulically equivalent storage pursuant to Section 22.807.B.1.a.,
Section 22.807.B.1.b and Section 22.807.B.1.h. "
SECTION SIX: That Section 22.808.B.1.a. of Chapter 22, as amended, is hereby
further amended by changing the citation of "Section 22.805.D" to "Section 22.805.C".
SECTION SEVEN: That this Ordinance shall be in full force and effect from and after
its passage, approval and publication in pamphlet form in the manner provided by law.
