AN ORDINANCE AMENDING ARTICLE XXll OF CHAPTER 14
OF THE VILLAGE CODE OF MOUNT PROSPECT
VVHEREAS, the Village of Mount Prospect, through its administration, (hereinafter
referred to as "Petitioner"), has filed an application for a text amendment, which would
amend paragraph A.3 of Section 14.2215 entitled "Driveways" of Chapter 14 entitled
"Zoning Ordinance"; and
WHEREAS, Petitioner proposes Section 14.2215.A.3 be amended to permit drives
serving three (3) car garages to exceed the maximum ddveway width up to ten feet
(10') within the front yard setback; and
WHEREAS, a public headng was held on the request for a text amendment, being the
subject of ZBA Case No. 2-A-96, before the Zoning Board of Appeals of the Village of
Mount Prospect on the 25th day of January, 1996, pursuant to due and proper legal
notice thereof published in the Mount Prospect Journal and Topics on the 10th day of
January, 1996; and
VVHEREAS, the Zoning Board of Appeals has submitted its findings and
recommendation to the President and Board of Trustees of the Village of Mount
Prospect and the President and Board of Trustees of the Village of Mount Prospect
have further considered the text amendment requested and find that it would be in the
best interest of the Village to grant the request being the subject of ZBA 2-A-96.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings
of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: That Section 14.2215.A.3 of Article XXII of Chapter 14 (Zoning) of
the Village Code of Mount Prospect, as amended, is hereby further amended in its
entirety and substituting therefor the following; so that hereafter said Section
14.2215.A.3 shall be and read as follows:
"3. Width. Ddveway width shall be determined by the maximum front yard lot
coverage of thirty-five percent (35%) for all lots with widths of sixty to seventy-
five feet (60' - 75'). The maximum driveway width for lots less than sixty feet
(60') in width shall be twenty-one feet (21'). Lots which exceed seventy-five
feet (75') in width shall have a maximum driveway width of twenty-six feet (26').
a. Width of driveways serving three-car garages shall be permitted to be up
to the same width as the garage, no greater than thirty-two feet (32'),
within fifteen feet (15') of the garage's front elevation. The garage width
is determined by measuring the width of the garage doors plus, if
applicable, the separation between garage doore plus two feet (2'). The
driveway width must be tapered to no greater than the maximum width at
the lot line as set forth hereinabove.
b. All driveways shall be unobstructed from an encroachment such as
chimneys, fireplaces and bay windows. The maximum driveway width
shall include all adjacent walkways.
c. Parallel paving stdps shall be permitted as alternatives to paved
driveway surfaces."
SECTION THREE: That this Ordinance shall be in full force and effect from and after

its passage, approval and publication in pamphlet form in the manner provided by law.
