A. Request of property owner at 419 Ojibwa for an exception from the Development
Code (Chapter 16) requiring a connection for water service. By a unanimous
vote, the Plan Commission recommends denying this request.
B. Safety Commission recommendation:
Request of resident for STOP or YIELD signs on Eastwood at Memory.
The Safety Commission voted unanimously to recommend a YIELD sign at
this intersection. I
C. I st reading of AN ORDINANCE AMENDING ARTICLE X ENTITLED
"NONRESIDENT AMBULANCE FEE" OF CHAPTER 8 OF THE VILLAGE CODE
This Ordinance increases the fee for non-residents using the Village ambulance
from $125.00 to $200.00,
D. 1st reading of AN ORDINANCE AMENDING ARTICLE XVIII ENTITLED
"LANDLORD TENANT REGULATIONS" OF CHAPTER 23 OF THE
VILLAGE CODE
This Ordinance increases the license fee for multi -family dwelling units from
$14.00 to $20.00 per year, per unit in 1998, $25.00 per year, per unit in 1999
and $31.00 per year, per unit in the year 2000 and thereafter.
E. I st reading of AN ORDINANCE AMENDING THE TRAFFIC CODE (CHAPTER 18)
This Ordinance establishes parking regulations around Prospect High School.
F. 1st reading of AN ORDINANCE AMENDING CHAPTER 9 OF THE VILLAGE CODE
This Ordinance establishes entrance markers in public rights-of-way as an

full compliment of members.

recommendation of the Mayor to appoint Trustee Lohrstorfer, term to expire

OLD BUSINESS
PUBLIC HEARING Mayor Fadey called a Public Headng to order at 8:04 P.M. It was noted that
notice of this Public Hearing had been published in the Mount Prospect
Journal & Topics on December 3rd and in the Mount Prospect Herald on
December 4th and was called for the purpose of presenting the annual
budget for the Village of Mount Prospect for fiscal year 1998 and the
property tax levy for 1997.
There was no audience participation as part of this Public Hearing.
Members of the Village discussed options for retaining the Village Blood donation BLOOD
program. It was noted that the original budgeted amount for this program was PROGRAM
$3,500 however that amount had been reduced by a majority of the Village Board
to $1,750. Trustee Nocchi requested corporate sponsorship of this program so
It could continue.
It was announced that the newest bank in town, Mount Prospect National Bank,,
50 North Main Street, has committed to donate $1 000 towards the Blood Program.
Trustee Corcoran expressed his concerns that some of the reimbursable items
funded by the Village are inappropriate and noted that he does support the blood
program in general,
Trustee Nocchi, seconded by Trustee Hoefert, moved to fund the Blood Program
in the amount of $2,750, $1,750 from the Village and $1 000 from the sponsorship
of the Mount Prospect National Bank.

Mayor Farley closed the Pubic Hearing at 8:12 P.M.
An Ordinance adopting the budget for 1998 was presented, representing a total ADOPT
budget of $58,741,549.00. 1998
BUDGET
Trustee Clowes stated that since he is a member of TAP, which is funded by
the Village in the amount of $2,000.00, he didn't feel it appropriate to vote on
the proposed budget Ordinance.

A request was presented to authorize the purchase of one 3/4 ton pick-up PICK-UP
truck as part of the joint purchase bidding procedure conducted by the TRUCK
Northwest Municipal Conference. It was noted that as part of this joint
purchase, the base bid for a8 3/4 ton pick-up truck was $19,679 and Vith
the options deemed necessary for the Mount Prospect use, the total
would be $21,294.56.
Trustee Corcoran, seconded by Trustee Hoefert, moved to concur with the LARRY FAUL
recommendation of the administration and authorize the purchase of one CHEVROLET
3/4 ton pick-up truck from Larry Faul Chevrolet in conjunction with the

joint purchase program conducted by the Northwest� Municipal Conference
in an amount not to exceed $21,294.56, which includes the required
options.

Brian Caputo, Director of Finance, presented various insurance proposals. INSURANCE5.
The first recommendation was for the Village to join 1PBC (intergovernmental MEDICAL
Personnel Benefit Cooperative) to provide the medical insurance for employees, INSURANCE
and retirees. This recommendation was as set forth in Medical Insurance
Alternative #7 in the memorandum from Brian Caputo dated December,5, 1997,
the subject of which is 1998 Medical Insurance Program, a copy of which is
attached to these minutes.
Trustee Wilks, seconded by Trustee Corcoran, moved to concur with the 1BPC
recommendation of the administration and join IPBC to provide the medical

insurance coverage for Village and Library employees and retirees.

CLASS R LIQUOR LICENSE
CHANGE IN OWNERSHIP
On Wednesday, December 17, the Village Manager met with Ms. Mary Tsagalis to discuss
her request for a change of ownership with regard to the existing Liquor License
classification for Sunrise Pancake House, 905 East Rand Road. Ms. Tsagalis and her
husband recently took over operation of the existing business and are operating a
restaurant under the same name. Ms. Tsagalis would also like to maintain the Class R
Liquor License authorized for this location. The Class R designation provides for the
operation of a restaurant offering full liquor service by the drink with the restriction that
service will be at dining tables only. Since December 16, 1997, the business has been
operating without a Liquor License pending Village Board review of this request.
Ms. Tsagalis is the sole corporate officer of the business and along with her husband,
plans to manage the restaurant as a full-time endeavor. Ms. Tsagalis and her husband
have previous restaurant experience having owned and operated Tiffany's Restaurant in
Des Plaines which had a Liquor License. Mr. Tsagalis was previously a co-owner of Seven
Brothers' Restaurant in Morton Grove.
Routine inspections by the Environmental Health Division of Community Development
indicate that extensive upgrading of the kitchen facilities is necessary. In discussions with
Village staff, Ms. Tsagalis has agreed to undertake a phased upgrading of the facilities
over the next year or two. A conditional Business License (good for a period of one year
with an option to renew for an additional year) has been issued for the business. Based
upon progress with the upgrading, the conditional Business License will be reviewed and
extended as appropriate.
The Village Manager discussed at length the Village's particular sensitivity to the sale of
alcoholic beverages to minors as well as over service to intoxicated persons. Ms. Tsagalis
indicated that she understood the requirements of the Village's Liquor Ordinances and
would comply with all aspects of same. All required paperwork has been completed, fees
have been paid and the applicant has submitted to fingerprinting and a background check.

If the Board considers this application favorably, a Motion to recognize a change in
ownership would be in order. Since a Class R License already exists for this location, no
additional action is necessary. The Village Manager would also recommend that the Liquor
License be conditioned upon progress with facility upgrading. Should there be little or no
progress, the Village Manager would seek either non -renewal or suspension of the Liquor
License depending on the circumstances.

WHEREAS, the Village of Mount Prospect is a municipality which exercises authority
pursuant to Chapter 65, Act 5, Section 11-74-4-1 et seq. of the Illinois Municipal Code
as set forth in the Illinois Compiled Statutes, known as the "Tax Increment Allocation
Redevelopment Act"; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect did
adopt Ordinance No. 4898 entitled "An Ordinance Authorizing the Acquisition of
Certain Real Property for the District No. 1 Redevelopment Project Area in the Village
of Mount Prospect, Illinois"; and
WHEREAS, a Real Estate Purchase Contract (the "Contract") has heretofore been
submitted to the Village of Mount Prospect with regard to a portion of the District No. I
Redevelopment Project Area"; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
reviewed the Contract in substantially the same form and materially similar to Exhibit
"A7 which is attached hereto and made a part hereof and find that the Contract is in the
best interests of the Village of Mount Prospect and finds that the Contract is in
furtherance of the goals, objectives and purposes of the District No. I -Redevelopment
Project Area; and
WHEREAS, pursuant to the provisions of Chapter 65, Act 5, Section 11 -?4.4-4(c) of the
Illinois Municipal Code as set forth in the Illinois Compiled Statutes, the Village of
Mount Prospect is authorized to acquire property, real or personal, within the District
No. I Redevelopment Project Area by purchase, donation, lease or eminent domain for
the purposes of 'implementing said redevelopment project.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That it is hereby determined that it is necessary, proper and
desirable that the Village of Mount Prospect acquire title to and possession of the real
property being the subject of the Real Estate Purchase Contract, which is to be in

DEVELOPMENT CODE EXCEPTION - SEWER AND WATER
The Plan Commission transmits their recommendation to deny both sewer and water Development Code
exceptions requested for the 419 Ojibwa Trail property. The Plan Commission recommends that the
petitioner sign a restrictive covenant guaranteeing the installation of a sewer and water main to Code to the
petitioner's south property line when the property owner south of the site wishes to connect to these utilities
or when requested by the Village of Mount Prospect.
Michael Sims, Planner explained that the owner of the property, Oneita J. Brandon, was seeking two
exceptions: (1) to waive the requirement for the extension of the sanitary sewer across the width of the
property; and (2) an exception to waive the requirement for the extension of the water main across the width
of the property. The petitioner previously requested Village approval to extend the Village's sanitary sewer
and water main from the adjacent property to the north to serve his site. This included extending the sanitary
sewer and water main from the neighboring property through to the opposite side lot line. The proposal had
been approved by all Village departments and required governing agencies. However, the petitioner found
that the cost of this extension would be between $29,000 to $45,000. As a result, the petitioner approached
the Village seeking relief from the Development Code requirements, asking that they be permitted to extend
the utilities only as far as the middle of their property and that they not be required to extend it in the future.
Sections 16.404 and 16.406 of the Development Code state that sewer and water mains shall be extended
to the property line of the development along public rights of way and at other locations as required by the
Director of Public Works. The Engineering Division has suggested that, in lieu of installing the mains to
the south property line, the owner sign a restrictive covenant guaranteeing that the mains will be installed
by the property owner/petitioner to the south property line at a later time when the south property owner
wishes to connect to these utilities or when requested by the Village of Mount Prospect.
The Plan Commission discussed the case and determined that a hardship, as defined by the Development
Code, had not been presented and voted 6-0 to deny the requested exceptions.

The Brandons were asked if they had approached the neighbor at 42 1. Mr. Brandon said yes, and that th -

On October 28, 1996, the petitioner formally requested Village approval for the extension of the Village's
sanitary sewer and water main from the adjacent property to the north to serve his property. (See attached
Figure). The existing sanitary sewer and water main extend south on the east side of Ojibwa Terrace from
Lincoln Street and buns west at the middle of 4 15 Ojibwa Terrace, the lot north of the petitioner's property.
These utilities had not been extended south to the petitioner's property because the south extension of Ojibwa
Terrace had not been dedicated.

The petitioner proposed extending the sanitary sewer and water main through to the south side lot line. His
proposal had been approved by all Village departments and required governing agencies. However, the
petitioner soon found that the cost of this extension would be between $29,000 to $45,000. As a result; he

approached the Village seeking relief from the Development Code requirements asking that he be permitted
to extend the utilities only as far as the middle of his property and that he not be required to extend it in the
future. On September 13, 1997, the petitioner attended a coffee with council to inquire about the related
development standards. On October 2, 1997, Jeff Wulbecker, Village Engineer, responded to the petitioner
that the Village would permit him to install the sanitary sewer and water main as requested, if he submitted
a recorded covenant agreeing that the cost of the complete extension would be paid by him or the future
owner of his property when the property to the south wishes to connect to these utilities. Mr. Brandon did
not agree with this method of compromise. As a result, the petitioner is seeking a Development Code
exception.
Sections 16.404 and 16.406 of the Development Code state that sewer and water mains shall be extended
to the property line of the development along public rights of way and at other locations as required by the
Director of Public Works. This prevents future developments from tearing up existing streets, disrupting
the activities in existing developments, and provides completed developments with the full benefit of public
improvements. This requirement is consistent with the sidewalk, curb and gutter, parkway tree, and other
public improvement sections in the Development Code that call for these improvements to also be installed
the full width of a property.
The Development Code permits exceptions to be granted when there is a finding that a severe hardship,
caused by conditions uniquely attributable to the land under consideration, would be imposed by the
regulations, and that alternative solutions exist that would both fulfill the purpose of the regulations and
protect the public. The Engineering Division has suggested that, in lieu of installing the mains to the south
property line, the owner sign a restrictive,covenant guaranteeing that the mains will be installed by the
property owner/petitioner at a later time when the south property owner wishes to connect to these utilities
or when requested by the Village of Mount Prospect. (See the attached Engineering Division memo of
December 4, 1997.) Staff believes this compromise position is a reasonable alternative and will protect the
public interest.

The Public Works'Department is not in favor of granting a Development Code exception
for the subject project regarding extension of the watermain and sanitary sewer
construction to the edge of the development as specified in Sections *16.404 and 16.406 of
the Village Code. These codes are routinely required of all developments, concerning the
extensions of watermain and sanitary sewer across the frontage of the development
property. This code requirement is consistent With other code 'requirements such as those
for curb and gutter, sidewalk and pavement which must be constructed across the full
width of the development property, . h
This requirement has been applied to recently constructed projects such as the three lot
development of the Hickory - Lincoln Subdivision. Additionally two three lot subdivisions
currently under review for approval (Pine -Hill Subdivision and Oakwood Subdivision) have
been required to conform to this code requirement A third subdivision being considered
south of Haven on Douglas Street has been notified through informal discussions that that
development would also be required to meet that code.
My letter dated October 2, 1997 explains the history of the watermain to which the
resident at 419 Ojibwa intends to connect to. Also in that letter I outlined what I believe to
be a reasonable compromise to the current situation. Plans were subrnitted and,approve" d
by Staff which show the watermain and sanitary sewer extensions only to the point
necessary for the service line connections from the building at 419 Ojibwa. In fact the
MWRD permit has been applied for and obtained by the resident for that plan. In order for
final approval and a permit to begin construction however the resident is required to
submit a covenant which states that if required in the future, the resident will be
responsible for the cost to extend the sewer and watermain to the south property of 419
Ojibwa.
The Public Works Staff, in fairness to all development, is in favor of consistent enforcement
of this code,,

This letter isin response to your questions raised at the September 13, 1997 Coffee with
Council. You questioned why your neighbor at 415 Ojibwa was not required to extend the
water and sewer mains to his south property line.
In response to that question, 415 Ojibwa did not extend the water and sw4ver mains to the
south end of the property because they were not the ones constructing the water and sewer
improvements. In 1975, there was a new three -home development that was constructed on
Wigwam Trail. Prior to that time the water and sewer mains extended south from Lincoln
Street only to 405 Ojibwa. In order for this developer to obtain water and sewer services for
the new homes, he had to extend them from 405 Ojibwa to a point south that would intersect
with Wigwam Trail. From that point he continued the construction to the west to his new
development, (see the attached map). This is why the water and sewer mains were not
extended all the way to the south property line of 415 Ojibwa.

Subject December Safety Commission Recommendation
Stop/Yield Signs at Eastwood Avenue and Memory Lane
The Safety Commission transmits their recommendation to
deny 4 -way stop signs at Eastwood Avenue and Memory Lane &
approve yield signs on Eastwood Avenue at Memory Lane
Mr. Heinrichs, 602 N. Eastwood Ave, requested stop/yield signs at Eastwood/Memory because
of two accidents in June of 1997. Per police record, there have been no accidents at this
intersection for the last five years except the two recent accidents. No sight obstruction
problems were found at this intersection. Two accidents in a month are considered to be a
rare coincidence.
The Engineering Staff sent out surveys per the Notification Policy to all affected residents to
collect their opinions and notify them of the December Safety Commission Meeting Schedule.
A total of 23 surveys were sent out in October of 1997 to collect and analyze the resident's
opinion. 22 surveys were returned to the Village. 19 residents favored and 3 residents were
against the 4 -way stop signs.
The intersection, however, does not meet the stop sign warrants based on the number of
accidents, the traffic volume, nor the speed study.
By a vote of 8-0, the Safety Commission recommends to deny 4 -way stop signs at
Eastwood Avenue and Memory Lane.
The Safety Commission felt that, due to the two recent accidents, yield signs in the north/south
directions would be helpful to clarify the right of way at this intersection.
By a vote of 8-0, the Safety Commission recommends to approve yield signs on
Eastwood Avenue at Memory Lane.
Please include this on the January 6th Village Board Meeting Agenda.

APPROVAL OF MINUTES
Commissioner Bencic, seconded by Commissioner Bobikewicz, moved to approve the Minutes
of the Regular Meeting of the Safety Commission held on November 1, 1997. The Minutes were
approved by a vote of 8-0.

A) STOP OR YIELD SIGN REQUEST AT THE INTERSECTION OF
EASTWOOD/MEMORY
1) Background Information
Mr. Craig Heinrichs, 602 N. Eastwood Avenue, requested stop or yield signs at
the intersection of Eastwood/Memory because he recently moved into the
Village and witnessed two near accidents at this intersection. He feels that some
motorists do not slow down because there are no stop signs at this intersection.
The Engineering Staff performed a stop sign study. The findings are as follows:
a) Accidents

The above accident records do not meet the stop sign warrant (minimum
five accidents per year) for the Multi -Way Stop Sign Warrants. The
police accident reports are attached.
b) Speed Study
Representative speed surveys were performed on Memory Lane west of
Eastwood Avenue between Tuesday, September 16, 199" and
Thursday, September 18, 1997 and on Eastwood Avenue south of
Memory Lane between Monday, September 22, 1997 and Wednesday,
September 24, 1997, The 85th percentile speeds are follows.*
Eastbound Memory 27-28 mph
Westbound Memory 23-24 mph
Southbound Eastwood 26-27 mph
Northbound Eastwood 24-25 mph
The speed limits of Memory Lane and Eastwood Avenue are 25 mph,,,
Including the slightly high speeds on Eastbound Memory Lane and
Southbound Eastwood Avenue, there is not a significant speeding
problem at this intersection.

C) Traffic Volume
The minimum traffic volume for the multi -way stop sign warrant is 500
vehicles/hour for an eight hour period (500 x 4000 cars/8 hrs). The
traffic volume at this intersection (499 cars/8 hrs) is approximately 12%
of the stop sign warrant.

d) Sight Obstruction
A number of parkway trees are located at the intersection. However,
these parkway trees do not present sight obstruction problems.
e) Survey Results
A total of 23 surveys were sent out in October 1997 to collect and
analyze the resident's opinion. 22 surveys were returned to the Village.
19 residents favored and 3 residents were against the 4 -way stop sign at
Eastwood/Memory.
0 Existing Traffic Control Signs
Existing traffic control signs are located at all 4 intersections adjacent to
this intersection and are shown on the attached map.
Mr. Heindchs stated in his letter that, as an alternative to stop signs,
yield signs could also improve the safety at this intersection. As shown
on the attached map,, there are stop or yield signs at the four adjacent
intersections. For the east/Westbound traffic, 2 -way stop or yield signs
are located approximately 200 ft from this Intersection. For the
north/southbound traffic, 2 -way stop signs are located approximately 600
ft from this intersection. Because of two recent accidents, yield signs in
the north/south direction at this 'Intersection are recommended in order
to clarify the right of way.
Recommendation:
Because the intersection of Eastwood Avenue and Memory Lane does
not meet any of the multi -way stop sign warrants, despite the resident
support for the stop signs, N,
The Village TraWic Engineer recommends-.
4 -way stop signs at the intersection of Eastwood Avenue and
Memory Lane not be *installed.

have enough speed limit signs. Sean Won said that he will inspect the 400 &
500 block of Eastwood and the Public Works would install more speed limit
signs, lf�needed.

B) PEDESTRIAN TRAFFIC SIGNAL REQUEST AT BUSINESS CENTER DRIVE AND
RAND ROAD

Commissioner Andy Mitchell, 311 N. School Street, requested the installation of

pedestrian traffic signals to cross Rand Road at Business Center Drive because,,
This intersection is the only signalized intersection crossing on Rand
Road between Kensington Road and Central Road.
This intersection also serves as a bicycle route crossing Rand Road.
The Engineering Staff performed a pedestrian volume crossing count at this
intersection. In accordance with the request, the pedestrian count was
performed in the winter. It is projected that the pedestrian volume may be
somewhat higher in the summer.
Pedestrian counts crossing Rand Road on Wednesday November 12,1997 were
as follows:
Between 8:00 AM and 10:00 AM**'One

The minimum pedestrian volume for a traffic signal is 100 or more for each of
any,four hours. Therefore, this intersection does not meet the warrant.
Even though this intersection does not meet the warrant, a pedestrian traffic
signal is justified because 1) this is the only signalized intersection which coul
provide a pedestrian crossing between Central and Kensington, 2) this crossin

is a bicycle route, and 3) the traffic volume of Rand Road is heavy (more than
30,000 vehicles per day). I

dangerous to cross Rand Road at Business Center Drive due to the heavy traffic
volume without a pedestrian traffic signal. Commissioner Mitchell stated that the

Commissioner Mitchell said that Sean Won suggested a pedestrian count in the
summe r but he wanted to discuss this time because it would take more than 6
monih to obtain a permit from the Illinois Department of Transportation (IDOT).
Commissioner Bobikewicz agreed that it takes a long time to obtain a permit
from Cook County and IDOT. Commissioner Bobikewicz wanted to obtain a
permit for crossings at Randhurst Shopping Center. Commissioner Bobikewicz
recommended that pedestrian.traffic.,signals be installed at most of the
intersections. Chairman Beening said that spending $3,000 dollar for only one
pedestrian might not be a good investment. Commissioner Bencic said that
installing a pedestrian traffic signal on Rand Road at Hill Street should be

year at Hill Street Park.
Commissioner Bencic asked Sean Won whether we would have a better chance
to obtain a permit if the pedestrian count is higher. Sean Won said that, if the
pedestn"an count is higher, obtaining a permit from IDOT might be easier.

Commissioner Mitchell moved to install a pedestrian traffic signal on Rand
Road at Business Center Drive. The motion failed because no one
seconded.
..or Bencic, seconded by Commissioner loliere, moved to do
the pedestrian count again in the summer (June of 1998) and bring the
issue back to the Safety Commission.
The motion was approved by a vote of 8-0.
Sean Won extended the Village's appreciation and holiday greeting to the Safety Commission
and presented each member with a gift.

AN ORDINANCE AMENDING ARTICLE X ENTITLED
"NONRESIDENT AMBULANCE FEE" OF CHAPTER 8
OF THE VILLAGE CODE OF MOUNT PROSPECT
WHEREAS, the President and Board of Trustees have established a nonresident ambulance
transportation fee; and
WHEREAS, it has been determined that in order to cover the cost to provide emergency services
to nonresidents, the fee for such services should be increased from $125.00 to $200.00.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That paragraphs A and B of Section 8.1103 entitled "Fee Established" of
Article X (Nonresident Ambulance Fee) of Chapter 8 of the Village Code of Mount Prospect, as
amended, is hereby further amended by increasing the fee from $125.00 to $200.00; so that
hereafter said Section 8.1103.A and B shall be and read as follows:
Sec. 8.1103. Fee Established
A. If a nonresident requires an ambulance of the Mount Prospect Fire Department to
transport them to an emergency care facility due to an automobile accident, a fee
of two hundred dollars ($200.00) shall be due and owing to the Village upon
receipt of a bill issued by the Director of Finance of the Village.
B. If a nonresident requires an ambulance of the Mount Prospect Fire Department to
transport them to an emergency care facility due to an injury or illness incurred at
any location other than a residence, a fee of two hundred dollars ($200.00) shall
be due and owing to the Village upon receipt of a bill issued by the Director of
Finance of the Village.
SECTION TWO: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEE OF
THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Section 23.1813.13.3 of Section 23.1813 entitled "License to Operate
Multi -Family Rental Structures" of Chapter 23 of the Village Code, as amended, is hereby further
amended in its entirety; so that hereafter said Section 23.1813.B.3 shall be and read as follows:

"STREETS AND SIDEWALKS"

WHEREAS, many areas of the Village of Mount Prospect have entrance markers that designate specified
subdivisions and/or business parks; and
WHEREAS, some entrance markers were constructed on public property therefore constitute an
encroachment on the public right-of-way; and
WHEREAS, it has been determined that while entrance markers are a desirable symbol to neighborhoods
and/or business parks, the responsibility of maintaining an entrance marker located within public a right-of-
way shall fall upon the particular neighborhood and/or business park.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
That Section 9.105A entitled "Obstructions and Encroachments Regulated* of
Chapter 9 (Streets and Sidewalks) of the Village Code of Mount Prospect, as amended, is hereby further
amended by adding thereto in proper alphabetical sequence the definition of "Entrance Marker"; so that
hereafter said Section 9.105.A shall include the following:
"ENTRANCE MARKER Any structure, fence, edifice or other installation erected for the purpose of
identification, demarcation or improvement of an entrance to a specific
subdivision, neighborhood or business park. "
SECTION TWO: That Section 9.105 entitled (Obstructions and Encroachments Regulated" of
Chapter 9 (Streets and Sidewalks) of the Village Code of Mount Prospect, as amended, is hereby further
amended by adding thereto paragraph D; so that hereafter said Section 9.105.D shall be and read as
follows:
D. Entrance Markers as Exceptions.
Entrance markers installed on public rights-of-way in existence on October 1, 1997, as set forth on
a schedule kept by the Village Clerk, shall be considered an exception to the prohibited
encroachments, subject to:
1 The entrance marker shall be maintained by and at the sole expense of the homeowners
or business owners whose property or subdivision is delineated by the entrance marker.
2. No entrance marker located solely on a public right-of-way may be expanded in any
manner. Work on such entrance marker shall be limited to maintaining the entrance
marker in a good state of repair consistent with the very same design and structure as
existed on October 1, 1997.
I No landscaping shall be permitted that constiMes a sight obstruction as set forth in Section
9.511.A. of this Chapter.
4. If an entrance marker is damaged, the Village may assist the appropriate association,
neighborhood or subdivision representative in obtaining reimbursement for repair or
replacement.

5. In the event an entrance marker on the public right-of-way falls into disrepair, the Village
may, in its sole discretion, declare the entrance marker a nuisance which may be abated in

posting the entrance marker for five (5) consecutive days with a sign stating the Village's
Intent to remove the entrance marker. In order to repair an entrance marker, a permit:
must be obtained from the Village. *
SECTION THREE: That this Ordinance shall be in full force and effect from and after
its passage, approval and publication in pamphlet form in the manner provided by law.
