Absent from the meeting was Trustee Ralph Arthur. Also present at the meeting were: Village Manager John Fulton .Dixon, Assistant to the Village Manager Michael Janonis and Director of Finance .David Jepson. Also present were two persons from the print media. IL MINUTE. 1 The Minutes of the Committee of the Whole meeting of May 26, 1987 were accepted and filed. III. CITIZENS To BE HEARD There being no citizens present wishing to be heard, the Committee moved on to the next item of business. 'k IV. 1986-1987 87 YAR -END BUDGET UPDATE Finance Director David Jepson reviewed with the Mayor and Board of Trustees the year-end ;Budget update for the fiscal year ending April 30, 1987. Mr. Jepson reported that the village is in very sound financial position and that there has been an additional increase in the unobligated fund balance of some $400,000. This was due in large part to several one-time revenue sources as well as lesser expenditures in certain major fund categories. Mr. Jepson painted out that there was an ,area of concern that the Board would need to address in the near future; this being the ever --increasing burden on the General Fund. Mr. Jepson indicated that General Fund expenses have been increas- ing between $800,000 ,and 1 million per year over the last five years. This increase was necessary to maintain the existing level of services being provided by the village. Mr. Jepson stated that was of a concern because in the pant two years, Sales Tax Revenue has not increased at its historic annual rate of 7%. Mr. Jepson indicated that this may very well be the effects of a plateauing of our Sales Tax Revenue and that based on revised projections included in the 1987.1988 Budget, the village could be anywhere from $350,000 to $400,000 short in General Fund Revenues. Mr. Jepson indicated that he would be monitoring the situation and that it was likely with the renovation of . the Mount prospect Plaza and the addition of the new anchor ,stores at Randhurst that the impact would be somewhat lessened. Village Manager John Dixon indicated that he would be bringing this issue before the Committee of the Whole in the very near future* General discussion among the Board members was positive insofar as the Village's current financial position. Trustee Norma Murauskis asked what the timetable for water rate 'increases was and Mr. Jepson indicated that the Village is in a position to hold off the anticipated May 1, 1987 water rate increase until November, 1987. Trustee George Van Geem also asked if there was a possibility of doing a financial analysis of the impact of the new stores being built at Randhurst and also the potential revenue generated from the renovation of the Mount Prospect Plaza* V. MOODY'' CREDIT REPORT Finance Director Dave Jepson reviewed with the Committee members the Moody's Credit Report for the Village of Mount Prospect. This report was issued in conjunction with the Village's recent issue of General Obligation Bonds. Mr. Jepson indicated that the Village retained its Aa Bond Rating. The Moody's Report was very positive with regard to the Village. Brief discussion among Committee members was favorable and Committee members welcomed the report. V1* FOREST RIVER FIRE PROTECTION DISTRICT 11 Village Manager John Fulton Dixon revi 0 ewed with Committee members steps that were taken by the Manager's office and Mr. Jepson to determine the financial condition of the Fire Protection District. A review of the District's financial records indicated that most expenses were reasonable,. Mr. Dixon also discussed an apparent $10,000 cash surplus on the Fire ProteCtIon District's books,* Mr. Dixon reported that this $10,000 was originally money raised by the D'strict for the purposes of undertaking engineering studies in an, effort to bring 'water and, thus, fire hydrants into the area. It was Mr. Dixon's feelings that this money was properly the money of the Fire Protection District and suggested that the money be segregated from on-going Fire Protection District operations* Mr. Dixon also indicated that the community center in the District was owned by the community association and not by the Fire Protection District -9 However, upon review of legal bills, it appeared that the Fire Protection District was paying for legal representa- tion with regard to matters involving the community -owned bu-ildng. Mr. Dixon suggested that the $10,000 that would be segregated from the other Fire Protect"i"on, District monies be used to pay for the cost of legal fees associated with matters involving the community centero I After brief discussion, the Committee members agreed with the recommendations of the Village Manager. Mr. Dixon indicated that he would be meeting with the Fire Protection District to discuss these items and hoped that the matter would be resolved as soon as possible. VII* PROFILE PUBLICATIONS Mr. Dixon asked for direction from the Committee of the Whole with regard to the Village participating in the Chamber of Commerce's brochure on the Village of Mount Prospect. Mr. Dixon indicated that the Village had in the past participated and, that the cost to run a similar ad would be in the nei,ghborhood of $3,300. After brief discussion, the Committee of the Whole authorized the Village Manager to proceed with the Village's participation in the publication, Mayor Krause indicated that in the future she would like to see the Village spend more effort in the area o*f promoting the Village as a place for economic development. Various Board members agreed with the Mayor's position and the Village Manager indicated that he would look into this direction. VULMANAGERRS REPORT 0 Mr. Dixon indicated he had no report for the Board. IX,o ANY OTHER BUSINESS Trustee George Van Geem asked what the status of the George/Albert Streets lawsuit was. Assistant to the Village Manager Michael Janonis indicated that the parties were involved in pre-trial motions including discovery and that until these matters were resolved, there would be no official Court action. Trustee Van Geem asked for a copy of the Discovery Request that the Village had received. Staff indicated that they would get copies of these Pleadings to the Trustees, On a Motion by Trustee George Van Geem and Seconded by Trustee Norma Murauskis, the, Mayor and Board of Trustees convened an Executive Session at 10:42 p.m. There being no further business to be discussed, the meeting was adjourned at 11:15 p.m. MEJ/rcw Respectfully submitted, MICHAEL E. Two three year contract bids were received, Prospect Auto Body and Hillside Towing. Enclosed is a comparison of the town ng costs and other factors con s i d ered when award i ng the contract , Because it is important for a tow truck to respond as quickly as possible in an emergency, one criteria that must be considered is response time, Location of the towing facil ity is also important for the convenience of citizens claiming their vehicles and for officers to inspect and inventory seized and abandoned vehicles. Both Prospect Auto Body and Hillside Towing have positive reputations. There have been few citizen complaints as to their services. Based on the cost of towing, location of towing facility, levels of sere i c e a n d protection of towed vehicles,, it is o u r recommendation that Prospect Auto Body be awarded the Towing Services Contract, Prospect Auto Body also has the overall low bid (see attachment), Please advise my office as to how you would like us to proceed. .......... STORAGE CHARGES - "PILLAGE OF MOUNT PROSPECT No storage charges will be charged to the Village of Mount Prospect for impounded vehicles. These specifications define the terms of a contract for the re- moval of vehicles within the Village of Mount Prospect that have been abandoned or wrecked upon the public streets of the Village or upon village property, or that may have been parked or driven in violation of a Village ordinance or State law. 2. SCOPE of SERVICES The contractor shall furnish all services, labor, equipment, facili- ties, and materials for towing, at the specific request of the Mount Prospect Police Department in each instance for, (1) vehicles involved in traffic accidents, (2) abandoned vehicles, (3) vehicles parked in a manner or location creating, in the Judgment of the Mount Prospect Police Department, a hazard to drivers or individ- uals, (4) vehicles involved in a crime or which the Mount Prospect Police Department believes to have been involved in a crime, (5 ) vehicles as may be requested to be relocated during a Village emergency, and (6) such ether vehiclds as may be requ-es ted by the Mount Prospect Police Department. 3. CALLS FOR SERVICE Service under this contract is to be rendered only upon request of the Village's Police Department. The contractor, upon notification by the Police Department, shall immediately send a tow truck to the designated destination and at` the direction of the police officer in charge at the scene, shall remove the wrecked/abandoned vehicle or vehicles from the scene to the tow company's lot, and for the price specified in the contract. The contractor shall consider calls from the Village Police Department as having first priority . over requestfor towing service from other parties. 44, CONTRACTOR RESPONSIBILITY FOR PROPERTY The contractor expressly assumes full responsibility and liability for all property entrusted in his care, including all equipment and contents thereof, and indemnifies and holds harmless the Village of Mount Prospect against all claims for damages to vehicles and equip- ment entrusted to his care and control. The contractor assumes full responsibility for his employees and agents in the processes under this contract. only competent, courteous, trustworthy, and sober employees will be employed in the performance of this contract. 5. HOURS OF SERVICE The contractor will maintain an open facility with equipment and sufficient labor force adequate to supply demand, on a full twenty- four (24) hour per day basis every day of the year. 1 6 * WRECKER & TOWING EQUIPMENT The contractor will be expected 'to have in operation at all times a minimum of one (1) light wrecker with a 5,000 pound hand or power winch, crane and boom, and one (1) heavy wrecker with a 10,000 pound power winch, crane and boom. Each wrecker will be required to carry the full complement of service items as outlined in the Illinois Vehicle Code, Chapter 95 1/2, 12-606. In addition, the wrecker tow trucks will be equipped with all safety devices and lights to meet all ICC regulations. In regard to the above,, the contractor must have in operation at all times a minimum of one (1) light wrecker. However,, the contractor who is unable to provide the additional equipment (heavy wrecker) may execute a statement indicating that such towing equipment is available to be brought to the scene. Such statement shall be in writing and indicate the name and location of the alternate towing facility which -will, provide said equipment. This statement will be incorporated as part of the contract upon acceptance by the Village of Mount Prospect* 7o REMOVAL OF DEBRIS When debris, shattered glass, or other material from wreckage is prevalent at the site of an accident, the contractor shall remove such material from the thoroughfare. # 8e POLICE VEHICLE TOWS/STORAGE The towing facility will provide to the Mount Prospect Police Department up to and including (4) tows per month at no charge. These tows may consist of squad vehicle tows, vehicles towed for evidentiary purposes or vehicles seized or impounded. Police tows in excess of (4) per month will be charged at the rate specified in the contract. The contractor shall not charge the Village of Mount Prospect storage charges for vehicles stored as described in Attachment (A) Section (G) of this contract. The contractor will process unclaimed and abandoned vehicles as outlined in Chapter 95 1/2 Illinois Revised Statutes and the Municipal Code of the Village of Mount Prospect and maintain all appropriate records as specified by these statutes and ordinances. 9* OTHER CONTRACT PROVISIONS Monday through Friday during normal business hours, the contractor will arrive at the scene of a requested tow with the proper equip— ment within fifteen minutes after notification has been made. On weekends and after normal working hours, the contractor will arrive at the scene of the tow within 25 minutes after notification has been made. The contractor shall provide his/her personnel with the necessary communications equipment to maintain the required response time* During the time when snow and/or accident emergency plans are in effect, the contractor will keep the minimum of one light wrecker available within the corporate limits of Mount Prospect. There will be no charge for this service. Notification of emergency conditions will be made by the police department to contractor's regular and/or emergency phone as is applicable. The contractor shall provide a fenced, secure area for the storing of all vehicles which are towed pursuant .to this contract. Contractor will also be responsible for contacting the owner and/or insurance agent for removal of vehicles which have been towed to the facility of the contractor as a. result of an accident. If after a reasonable time, the contractor has been unable to contact the owner and/or insurance agent, the contractor will notify the Police Department Property officer to begin proceedings to process the vehicle as an unclaimed auto. The contractor shall post in public view a fee listin-g for all types of tows and the costs for daily storage. The contractor shall allow owners of towed vehicles to remove per -- conal property from the vehicle. The owner will also be allowed to remove the license plates from the vehicle. Cash or certified check are to be accepted methods of payment for contractors services by individuals who have had their vehicles towed and/or stored by contractor. 10. CONTRACTOR'S LIABILITY INSURANCE n Contractor shall maintain for the duration of this contract statu- tory Workmen's Compensation and/or Employer's liability insurance. Contractor shall maintain for the duration of this contact liabili- ty insurance in the form of a comprehensive, general and automobile liability policy. Such policy shall protect him from the claims for bodily injury, including death, to his employees and all others; and from claims for property damage, and/or all of which may arise out of or result from the contractor's operations under this con- tract.' The insurance shall be in sufficient amounts to reasonably assure the contractor's solvency' in the event of any injuries, deaths, or property damage with the following minimum limits 1 ,. CONTRACT TERMINATION The Village and the contractor reserve the right to terminate the contract at any time upon. thirty (30) days advance notice to the other party• Such notice of termination shall be in writing. Failure of the contractor to perform any aspect of this contract properly and,/or fail to provide good treatment to the general public, and/or fail to promptly respond to calls for service and such failure is without good reason, will be cause for immediate termination of the contract without a (34) day advance notification. The bestowing of the contract will be looked upon by the village as a trust, and the contractor will be required to give high duality service ,and treatment to the village. 1, 12. This contract shall be in effect beginning June 30, 1987 and remain in effect until June 309 1990, unless terminated by either party under the conditions specified under Contract Termination anal/or other violations of the contractural'agreement. �` 11 13. This contract will be in effect for a three year period. Thirty days prier to June. 30, of the first and second years of the con— tract, the contractor may request an increase of fees based on the current operating costs for the provision of towing services. Such request shall be writing and be directed to the Chief of Police. The request shall include the basis for the fee increase. If the increase is granted, the contrict and all provisions will remain in effect. An amendment to the contract will be drawn up and signed by all parties, indicating the authority for the fee increase. Storage charges will be paid by the owner of the vehicle before the vehicle is released from► the impound lot. Should the, owner of the vehicle not pay the storage charges, and state law allows the sale of the vehicle, the storage charges will be deducted from monies derived from the sale of the vehicle. If the amount paid for abandoned vehicles does not equal the cost of storage fees, the contractor agrees that such costs will be absorbed by contractor. and not the Village of Mount Prospect. 0 CONTRACT -1. GENERAL These specifications define the terms of a contract for the re- moval of vehicles within the Village of Mount Prospect that have been abandoned or wrecked upon the public streets of. the Village or upon Village property, or that may have been parked or driven in violation of a Village ordinance or state law. 2. SCOPE OF SERVICES The contractor shall furnish all services, labor, equipment, facili- ties, and materials for towing, at the specific request of the Mount Prospect Police Department in each instance for, (1) vehicles involved in traffic accidents, (2) abandoned vehicles, (3) vehicles parked in a manner or location creating, in the judgment of the Mount Prospect Police Department, a hazard to drivers or individ- uals, (4) vehicles involved in a crime or which the Mount Prospect Police Department believes to have been involved in a crime, (5) vehicles as may be requested to be relocated during a. Village emergency, and (b) such other vehicles as may be requested by the Mount Prospect Police Department, 3o CALLS FOR SERVICE Service under this contract is to be rendered only upon request of the Village's Police Department. The contractor, upon notification Y y the Police Department, shall immediately send a tow truck to the designated destination and at the direction of the police officer in charge at the scene, shall remove the wrecked/abandoned vehicle or vehicles from the scene to the tow company's lot., and for the price specified in the contract. The contractor shall consider calls from the village Police Department as having first priority . over requests for towing service from other parties, 4e CONTRACTOR RESPONSIBILITY FOR PROPERTY The contractor expressly assumes full responsibility and liability for all property entrusted in his care, including all equipment and contents thereof, and indemnifies and holds harmless the Village of Mount Prospect against all claims for damages to vehicles and equip- ment entrusted to his care and control. The contractor assumes full responsibility for his employees and agents in the processes under this contract. only competent, courteous, trustworthy, and sober employees will be employed in the performance of this contract. 5. HOURS OF SERVICE The contractor will ✓maintain an open facility with equipment and sufficient labor force adequate to supply demand, on a full twenty-- four (24) hour per day basis every day of the year. 6. WRECKER & TOWING EQUIPMENT The contractor will be expected to have in operation at all times a minimum of one ( 1 ) light wrecker with a 5,000 pound hand or power winch, crane and boom, and one (1) heavy wrecker with a 10 ,000 pound power winch, crane and boom. Each wrecker will be required to carry the full complement of service items as outlined in the Illinois Vehicle Code, Chapter 95 1/29 12.60b. In addition, the wrecker tow trucks will be equipped with all safety devices and lights to meet all ICC regulations. In regard to the above, the contractor must have in operation at all times a minimum of one (1) light wrecker. However, the contractor who is unable to provide the additions -l. equipment (heavy wrecker) may execute a statement indicating that such towing equipment is available to be brought to the scene. Such statement shall be in writing and indicate the name and location of the alternate towing facility which will provide said equipment. This statement will be incorporated as part of the contract upon acceptance by the village of Mount Prospect. REMOVAL OF DEBRIS When debris, shattered glass, or other material from wreckage is prevalent at the site of an accident, the contractor shall remove such material from the thoroughfare. 8. POLICE VEHICLE TOWS/STORAGE The towing facility will provide to the Mount Prospect Police Department up to and including (4) tows per month at no charge. These tows may consist of squad vehicle tows, vehicles towed for evidentiary purposes or vehicles seized or impounded. Police tows in excess of (4) per month will be charged at the rate specified in the contract. The contractor shall not charge the Village of Mount Prospect storage charges for vehicles stored as described in Attachment (A) Section (G) of this contract. The contractor will process unclaimed and abandoned vehicles as outlined in Chapter 95 1/2 Illinois Revised Statutes and the Municipal Code of the village of Mount Prospect and maintain all appropriate records as specified by these statutes and ordinances, 41 9. OTHER CONTRACT + Monday through Friday during normal business hours, the contractor will arrive at the scene of a requested tow with the proper equip- ment within fifteen minutes after notification has been made. On weekends and after normal working hours, the contractor will arrive at the scene of the tow within 25 minutes after notification has been made. The contractor shall provide his/her personnel with the necessary communi the Village shall not relieve or decrease the liability of the contractor hereunder. Certificates of such insurance shall be filed with the Village prior to commencing work. 11. CONTRACT TERMINATION The Village and the contractor reserve the right to terminate the contract at ,any time upon thirty (30) days advance notice to the other party* such notice of termination shall be in writing. The owners of Community Cab, prior to their appearance before the Village Board, were made aware of the need to have their vehicles pass a Village safety inspection. They were also given a copy of the Village's Taxi Cab Safety Standards that were developed through the consensus of eight communities in the northwest suburban area. After three inspections, only two Community Cab Company vehicles passed. The owners, Roy and Tim Vana, felt that the inspection standards were unduly stringent and refused to pursue further inspections or licensing. After the Village Board's passing of the Regional Taxi Cab Ordinance, Community Cab was again given the opportunity to license their vehicles and chauffeurs. Their attorney has responded that theVillage's fare structure and restrictions of the new Ordinance would make it unprofitable for Community Cab to operate in the Village. Based on my survey, Mount Prospect's new regular fare structure is competitive with the rates established by the municipalities that Community Cab operates in. American Taxi is the only company licensed to operate in the Village. Arlington Best, Inc., was sold to new owners. The new owners have declined to seek licensing in the Village because they regard our senior citizen rates uncompetitive and unprofitable. We would like to recommend that the Village Board pass a Motion to formally rescind Community Cab Company's authorization to seek licensing in the Village of Mount Prospect. This Motion will not preclude future petitions from Community Cab to seek licensing in the Village. This includes telephone solicitations. Your company is still authorized to _seek licensing of your vehicles and chauffeurs under the conditions of the Ordinance and the regional standards and procedures implemented by the Police Department. Your company will have until May 30, 1987 to begin to license your vehicles and chauffeurs. If you have not begun to have your vehicles and chauffeurs licensed by that date, the Village staff will recommend to the Village Board that your authorization to seek licensing in the Village of Mount Prospect be rescinded. SOLOMON I am responding in behalf of my client, Community Cab Company, to the letter issued from your office dated April 28, 1987 calling attention to the ordinance recently passed by the Village of Mount Prospect concerning the regulation of taxi cab companies that could or might operate within the Village limits. 1 My client is most appreciative of your previous invitation to make application to service the Village, and we assume that that invitation has come about after your analysis of companies doing business in the northwest suburbs which reflected in a positive manner on the competence, integrity and efficiency of the Community Cab Company, which has been in business in the suburban area for the past 11 years. Unfortunately, a careful reading of your ordinance causes us to most respectfully decline your invitation, and, unless we fail to comprehend what is stated in the ordinance, we feel the conditions imposed are too restrictive to make an efficient operation feasible. There is no question but that your proposed regulation of taxi rates would not permit our company a reasonable return cin its investment, places the company in a position of competing with itself, and we would be unable to secure qualified, competent drivers when their income would beso obviously affected by the restrictions you have imposed. The literal wording of your ordinance, which is again emphasized in your letter, mandates that a citizen of your community who chooses to call our company based upon a business relationship that we have enjoyed can no longer call our company for service...,. My office is presently investigating whether or not this particular limitation operates as a violation of any State or Federal statute concerning the free flow of commerce and/or the infringement of individual rights. If we, in fact, do determine that that is the case, we intend to institute the necessary proceedings to challenge that most onerous regulation. This response is not intended to threaten or harras the Village authority. We are well aware of the rights of the Village trustees to act in a manner which they believe to be in the best interest of their citizenry, and as indicated above, it was our intention to apply for formal licensing until the full impact of the ordinance was reviewed. However the Western Union fiber optics cable would have required in ! excess of $2509000 to bury. To leave the fiber optics Gabel aerial and bury the T -Screen cable would cost Metra $44,000', The cost to relocate both cables to the new lightp oles is approximately $18,000. Therefore, Metra has decided to relocate both cables to the light poles. Since the fiber optics cable rust remain aerial the additional $26,000 to bury the T -Screen is not -justified.
