Trustee Farley was concerned that the original Village system was designed as an "opens' system and that converting it to a "closed" system could result in an increase in the number of main breaks as well as adverse impact on our fire protection capabilities. Trustee Theodore Wattenberg indicated that he would vote to keep the elevated tank in its present location based on the fact that the engineering consultant's report did not recommend that ,,it be moved. Trustee Wattenberg also felt that the tank should be kept as insurance in the event of a catastrophic occurrence such as power failures or major fires. Village Manager Terrance Burghard reviewed with Committee members the design guidelines of the consultant's report and pointed out that it was the consultant's finding that other parts of the present system were adequate to compensate for the loss of the elevated tank. Mr. Burghard did indicate that an open system is clearly superior but that a closed system would serve the Village adequately. Mr. Burghard also pointed out that potential TIF developers saw the tank as a negative but that that negative did not equate into an unwillingness by developers to undertake any type of project in the area. It was simply one of enhanced quality and value. Mr. Burghard pointed out that by removing the tank and developing that site, the Village could expect to realize approximately $988,000 over a twenty-year time span. The cost of a new tank at a different location would be approximately $400,000. Mr. Burghard further pointed out that under the present budgetary conditions in the Water Fund that the Village could afford the cost of relocation and/or removal of the present tank without exceeding the water rate projections made as recently as 1984. Mr. Burghard indicated that the Board was faced with a business decision and recommended that the Board opt for the removal of the tank and the construction of a smaller elevated tank at a different site. Trustee George Van Geem stated that he was not in favor of going to a closed system because of the potential for increased problems such as main breaks and potential property damage. Trustee Van Geem stated that he was in favor of the added insurance an elevated tank gave to the system and would be inclined to leave the tank at its present location. However, he stated that he would like to review in detail the Village's projections for increased revenues and costs and that if it made economic sense then he would be in favor of a possible relocation of the tank. Trustee Van Geem also questioned staff as to whether it might be possible to get a developer to share in the cost of relocating the tank. Staff response was that a developer might allocate some of his total funds toward such an endeavor but that he would have to recoup those expenses somewhere else in the project either as lower land costs or a lesser development. Trustee Van Geem stated that he was not ready to make a final decision at this time and asked that he be given a chance to review staff's figures. Trustee Leo Floros stated that he was displeased that the tank had not appeared as a consideration in the original designation of the TIF District. In his work with the Task Force, it was Trustee Arthur's opinion that the satellite sites currently being utilized by the Village would probably always be required and he also reported that the Task Force had reviewed approximately six different site alternatives including expansion of the present Pine Street facility. Trustee Van Geern indicated that he would be on vacation during the last half of July and would not be able to attend some of the scheduled meetings. He asked that a fellow Board member volunteer to take his place during his absence because he felt that Board representation on the Task Force was important. VII. MANAGER.'S► REPORT Village Manager Terrance Burghard reported that the Tenants' Organization of Illinois was now operating within the Village and that Mr. Michael Pensack was starting to handle some actual landlord/tenant complaints. On a related matter, Mr. Burghard indicated that efforts in the Boxwood area were being stepped up and they included public improvements such as tree planting and taking a landlord to Court for over 230 Code violations* Mr. Burghard also reported that METRA had approved the Grant Agreement for the Train Station improvements and they would be splitting the cost of those Station improvements 50-50 up to $30,000. This followed our original plans and was within our budgetary limits* Under Status Reports, the Village Manager reported that the sale of the Village - owned and student built house at One North Stevenson had reached the point where the Village might consider voiding the Real Estate Contract due to the buyer's inability to obtain a firm mortgage commitment. Assistant to the Village Manager Michael Janonis reported that the contract purchasers had at all times made a good -faith effort to secure a firm mortgage commitment but that the mortgage company was requiring as a contingency to such a commitment that the purchasers sell their existing residence. Mr. Janonis reported that an earlier contract on the purchasers' residence had fallen apart and that the purchasers had not been able to secure a contract to sell their present residence at this time. It was Mr. Janonis, recommendation that the Village void the contract, return the earnest money to the contract purchasers and either sell the house at sealed bid or put the property up with a licensed real estate broker. Mr. Janonis reasoned that it would take approximately 60-90 days to close on a contract at this point which would put the Village in the position of having to hold the property through the winter months. Mr. Janonis indicated that during this time, the house was standing vacant and was a potential target for vandalism and also that Public Works had to maintain the property during this time period. It was the consensus of Board members that the Village place the property with a licensed real estate broker for sale to the highest bidder. The listing price was determined to be $120,000. In these instances we see these buildings as incomplete, in fact, some of those buildings still don't have concrete floors. In those kinds of instances where the buildings are incomplete and additional work is required on the sprinkler system we have been maintaining our position that a backflow preventer must be installed. we feel that this is a substantial compromise. I have spoken to OPUS regarding this matter on .a number of occasions. OPUS apparently feels so confident that they will be able to overturn our administrative decision that one recent set of building plans that showed the .installation of a backflow preventer is now nearing completion without one having been installed. I have told them that I see no way that I can legally change either the state law or our own requirements especially since this is a health and safety question with direct legal implications, for the Village. They suggested going to the Mayor and the Board of Trustees at a public meeting to plead their case on economic grounds] grounds of unfairness on the part of the staff and grounds that we are making a law retroactive to bu:lldi.ng that already had permits issued on them. We have required fairly recently that backflow preventers be installed at the Searle building in OPUS as well as the new Bristol Court banquet hall going in on ',and Road. They are incomplete buildings (shell only) which have not had occupancy and, are equipped with incomplete sprinkler systems (a riser and a few branch lines, in some cases). one of the buildings mentioned is occupied presently by GTE and is already equipped with a complete sprinkler system. There are no plans for revisions so, there is no requirement to retrofit this system with an RPBFP at this time. Should GTE move out and major revisions be made to the sprinkler system, then an RPBFP would be required to be installed to comply with the state law. OPUS has been fully aware of the requirements of both BOCA and the State of Illinois law. There have been previous discussions with them and they have been well represented at the various seminars Code Enforcement members have attended. In fact, they installed an RPBFP in the new building at 1601 Feehanville Dr. and didn't mention in their letter that they were instructed to install one in the new four (4) story building (1661 Feehanville Dr.). What we are doing is required by law, and it is our responsibility to enforce as the custodian of the water system, and is being equally applied. In fact, Serle Lab is reworking their sprinkler system back to the riser and are installing an RPBFP. They were aware of the State of Illinois requirements and submitted plans with an RPBFP. As we discussed, OPUS has expressed a concern with these devices being required on the par - tial systems within existing shell buildings. Past practice was for OPUS to sprinkler some predetermined area of a shell building, usually 20-50% of the area. When the building was going to be completed for occupancy (pour base floor, install electrical/plumbing/HVAC, and interior walls, etc.) the sprinkler system would then be completed. Since less than 50% of the building is sprinklered and was not tenantable, these buildings are being reviewed by us as new construction. OPUS however, views t?ese buildings as existing structures and therefore, should be exempt from compliance. Attached is a copy of the letter to Mr. Burghard from OPUS and a reply from the Acting Fire Chief to Mr. Burghard. It is my under- standing that Mr. Burghard verbally communicated our position to OPUS based upon the reply of the Acting Fire Chief. In addition, our position was presented to them in person on June 30, 1986 at a meeting held at their request. Present at this meeting was Lt. Del Ulreich, Acting Director of Code Enforcement; E. If the violation is minor it can be corrected immediately and then re -inspected by the inspector and no stop work order is posted. If however, the violation is of a more substantial nature requiring reconstruction or reconfiguration then a stop work order is posted on the building in a visible spot identifying the date of the stop work order and the trade or trades which are covered under the order. The inspector then explains to the contractor what needs to be done to correct the violation. The contractor is then given an opportunity to correct the violation and then a re -inspection of the suspect construction is undertaken. If the reconstruction meets code requirements a stop work order is removed and construction can continue as usual. It should be noted that when a stop work order is posted all work at the site does not necessarily come to a halt. For example, if the plumbing presents a problem then a stop work order is issued for plumbing only. Other construction such as electrical and carpentry work can continue as long as it does not render the violation in question inaccessible or more dangerous. Sometimes, a violation is so serious i.e. the structural integrity of a building that a stop work order for all trades will be posted. In all cases the inspector works with the contractor to identify the problems and to come to a mutually agreeable solution. Where the particular Village code is clear on what is required then the inspector has no latitude but to require that the code be followed to the letter. In other areas where the code is vague as to what is acceptable the inspector and contractor will come to an agreement that satisfies the inspectors concern for safety and the overall integrity of the building. The Village always retains final say in such matters. As was noted previously, the contractor and/or homeowner, usually comply with the stop work order and there are no further problems. However, an increasing number of contractors have taken the position that the Village can not stop work or choose to disregard stop work orders and continue to build. There have even been a few instances where inspectors have been threatened and/or verbally abused and in one instance was allegedly physically assaulted resulting in the arrest of the contractor. The following are recent examples of such altercations: 110 South Mount Prose,ect "Road. Contractor began work pouring a new driveway without a permit. Stop work order was issued; contractor secured permit, but wanted immediate inspection. Inspector was not available; contractor began to pour cement, was ordered to stop because the proper base was not being used. Contractor verbally abused inspector and said, "You you can't stop me!" Only the timely arrival of the homeowner with the threat of non payment caused the contractor to stop pouring until code violations were corrected. 716 Noah Terrace. The contractor, claiming to be the owner falsified documents when in fact he was not the owner and thus was able to avoid the requirement of using a licensed plumber and putting up a $10,000 surety bond. The builder deviated from submitted plans; several stop work orders were posted and were disregarded. Several meetings were held with contractor. A fall back position was resort to court either in the form of an extraordinary remedy such as an injunction or a standard long form, complaint seeking fines,. If the contractor was also the homeowner three of the five communities stated that they handled the situation the same. One indicated that they issued tickets and one did not have a formal policy. Three communities follow the BCCA code with regard to stop work orders as does the Village of Mount Prospect. Two communities did not have an ordinance covering stop work orders* Because of the sensitive nature of arresting persons, under any circumstances especially homeowners, it maybe necessary to get formal Board, approval, of a policy of arresting stop work order violators. Of course, such an extraordinary, remedy would be used only in the most extreme circumstances and after all other attempts at administrative resolution have failed. However, in order for the Village to have some "teeth" behind its code and to give our inspectors credibility in the field such an extraordinary penalty is not only necessary but will also act as a deterrent in the future* In conjunction with this policy Code Enforcement has identified some changes to our present code that would strengthen our stop work order ordinance and make it more defensible in court. These changes include adding a possible jail sentence to the penalty section and the deletion of some conflicting code sections with regard to stop work orders. The reason for the addition of a possible jail sentence is that should a contractor fail to appear on his designated court date to answer the charge of violating the ordinance a judge is not likely to issue an arrest warrant for failure to appear in court if the violation is not for a jailable offense. Of course, the Village will not seek nor does it expect a contractor to be sentenced to jail, for this type of violation. , However, in order to prevent �the �whole issue of stop work orders from becoming nothing more than "a paper tiger" such revision is, warranted. Should the Board decide, against allowing the arrest of such, violators the Village will be left with the slow and inefficient process of' filing, a long, form complaint against the contractor after the fact. Not only does this put the remaining construction in a suspect light, it also puts our inspectors into the position of being unable to enforce our codes in the field in a timely manor* It is my recommendation that the Director of Code Enforcement be given the authority to request that a contractor and/or homeowner be arrested for violation of a stop work order with the understanding that this authority is to be used prudently and in only the most extreme cases.
