CITIZENS TO BE HEARD IV. BUILDING/FIRE PROTECTION CODE VARIANCE OPUS, builders and developers at the Kensington Center for Business, are seeking an exemption to local and state building and fire prevention codes that require backflow preventers on the public water supply system. OPUS is of the opinion that the Village staff is applying the laws retroactively to buildings partially constructed and that compliance with the safety measures required by the codes and state EPA regulations are too expensive. They have refused compliance* Apparently, the Code Enforcement staff missed the backflow preventer requirement when building permits were issued prior to January 1, 1986. We have taken the administrative position that all buildings currently incomplete and/or unoccupied must be fitted with such devices. Other developers are complying with the provision. OPUS finds our position unacceptable and desires an appeal to the Mayor and Board* V. DISREGARD OF STOP WORK ORDERS Recently, the Division of Code Enforcement has been experiencing trouble in enforcing stop work orders at construction sites throughout the Village. Contractors and/or homeowners acting as contractors have begun disregarding such orders on a more regular basis. The result is a serious compromise of Village codes and a loss of credibility of our inspectors. - A memo from Assistant to the Manager, Michael E. Janonis, details this problem and recommends policy changes to deal with it. Acting Director of Code Enforcement, Lt. Del Ulrelch, will also be available to answer questions* VI. WATER STORAGE TANK As we approach final planning to enter negotiations with TIF developers, the issue of the elevated water storage reservoir should be resolved promptly* Attached is a memo from the Village Manager, our planning consultant, and financial data prepared by- Finance Director, Dave Jepson.
