CAF/ 1 ~4~96 ORDINANCE NO. 4774 AN ORDINANCE VACATING UNIMPROVED ROADWAY (OJIBWA TRAIL & GO WANDO AVENUE) WHEREAS, 65 ILCS 5/11-9'1-1 of the Illinois Compiled Statutes, as amended, authorizes the vacation of a municipal street, sidewalk or alley, or part thereof, by passage of an Ordinance by at least a three-fourths vote of the Trustees of the Village; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect find that the public interest of the Village of Mount Prospect would best be served by vacating that portion of unimproved Ojibwa Trail and Go Wando Avenue dedicated for public purpose, which proposed vacated portions of Ojibwa Trail and Go Wando Avenue is legally described as follows: All of Ojibwa Trail, being 66.0 feet wide,which lies south of and adjoins the North line of the South Half of Lot 3 extended East and which lies North of and adjoins the North line of the south 11 feet of Lot 4 extended East, said south half of Lot 3 and Lot 4 (except the south 11 feet thereof) being in Willson and Florence's Country Club Subdivision of the East 233 feet (as measured on the North line) of the Northwest quarter of the Northwest quarter of the Southwest Quarter of Section 11, township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois - also all of Ojibwa Trail, being 33 feet wide, which lies East of and adjoins the South 11 feet of Lot 4, all of Lots 5 and 6; and also all of Go-Wando Avenue, being 33 feet wide, which lies south of and adjoins Lot 6 (except the West 33 feet thereof) all being in VVillson and Florence's Country Club Subdivision, aforesaid, in Cook County, Illinois; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect, pursuant to proper legal notice having been published in the Mount Prospect Herald on the 1st day of January, 1996, did hold a public hearing on January 16, 1995, for the purpose of considering the vacation of unimproved Ojibwa Trail and Go Wando Avenue as shown on the Plat of Vacation, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A"; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that it would be appropriate and proper to designate the beneficial interest in the vacated areas; so that the beneficial interest in the vacated parcels shall be vested as indicated on the attached Designation of Beneficiaries of Vacated Parcel, a copy of which is attached hereto and hereby made a part hereof as Exhibit "B"; and WHEREAS, it was determined by the President and Board of Trustees of the Village of Mount Prospect that the best interests of the Village would be served by passage of this Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That the President and Board of Trustees of the Village of Mount Prospect do hereby authorize the vacation of unimproved Ojibwa Trail and Go Wando Vacate Ojibwa Trail Page 2 of 2 Avenue, which area is legally described as: All of Ojibwa Trail, being 66.0 feet wide,which lies south of and adjoins the North line of the South Half of Lot 3 extended East and which lies North of and adjoins the North line of the south 11 feet of Lot 4 extended East, said south half of Lot 3 and Lot 4 (except the south 11 feet thereof) being in Wiilson and Florence's Country Club Subdivision of the East 233 feet (as measured on the North line) of the Northwest quarter of the Northwest quarter of the Southwest Quarter of Section 11, township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois - also all of Ojibwa Trail, being 33 feet wide, which lies East of and adjoins the South 11 feet of Lot 4, all of Lots 5 and 6; and also all of Go-Wando Avenue, being 33 feet wide, which lies south of and adjoins Lot 6 (except the West 33 feet thereof) all being in Willson. and Florence's Country Club Subdivision, aforesaid, in Cook County, Illinois; SECTION THREE: That upon passage and approval of this Ordinance, the Village Clerk is hereby authorized and directed to file a certified copy of this Ordinance together with a fully executed Plat of Vacation, a copy of which is attached hereto and hereby made a part hereof as Exhibit "A" and Exhibit "B", Designation of Beneficiaries, shall be recorded with the Recorder of Deeds of Cook County, Illinois. SECTION FOUR: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
