ORDINANCE NO. 4773
AN ORDINANCE GRANTING A VARIATION FOR PROPERTY
LOCATED AT 524 EAST NORTHWEST HIGHWAY
VVHEREAS, Korathu and Dolly Thomas (hereinafter referred to as Petitioners) have filed
an application for a variation from Chapter 14 of the Village Code of Mount Prospect,
Illinois, for property commonly known as 524 East Northwest Highway (hereinafter
referred to as Subject Property), legally described as:
Lot 23 in Momingside Gardens being a subdivision of part of the Northeast
Quarter of Section 12, Township 41 North, Range 11, East of the Third
Principal Meridian, in Cook County, Illinois; and
WHEREAS, Petitioners seek a variation from Section 14.223 to allow the number of off-
street parking spaces to be reduced from nine (9) to (3) three spaces in order to operate
a doctors office with two (2) examining rooms; and
WHEREAS, a public hearing was held on the variation requested being the subject of
ZBA Case No. 18-V-95 before the Zoning Board of Appeals of the Village of Mount
Prospect on the 14th day of December, 1995, pursuant to due and proper notice thereof
published in the Mount Prospect Journal and Topics on the 24th day of November, 1995;
and
WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation
to the President and Board of Trustees of the Village of Mount Prospect and the
President and Board of Trustees of the Village have given further consideration to the
variations being the subject of ZBA 18-V-95 and have determined that the best interests
of the Village of Mount Prospect would be served by granting said variation.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings
of fact by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect
hereby grant to the Subject Property the variation requested in ZBA 18-V-95 to permit
three (3) off-street parking spaces, which variation shall be in full force and effect only for
as long as Dr. Dolly Thomas operates her practice from this facility and with no more than
two (2) examining rooms, as shown on the site plan, a copy of which is attached hereto
and hereby made a part hereof as Exhibit "A".
SECTION THREE: That the Village Clerk is hereby authorized and directed to record
a certified copy of this Ordinance with the Cook County Recorder of Deeds.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
