CAF 1/4/96 ORDINANCE NO. 4772 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 209 SOUTH PINE STREET WHEREAS, Keith A. and Robert A. Edmonson (hereinafter referred to as Petitioners) have filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 209 South Pine Street (hereinafter referred to as Subject Property), legally described as: Lot 36 and the north half of Lot 37 in Busse's Resubdivision of Lots 1 to 6 inclusive of the Resubdivision of Lots 1 to 6 inclusive in Block 4 also of Lots 2 and 3 in Block 5, all of Block 6, Lots 13 to 24 inclusive in Block 7, Lots 17 to 20 in Block 8, all in Meier's Addition to Mount Prospect, a Subdivision in the Northwest Quarter of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, situated in the Village of Mount Prospect; and WHEREAS, Petitioners seek a variation from Section 14.2215 to allow a circular driveway in the front yard, which circular driveway would be nine feet (9') wide; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 16-CU-95 before the Zoning Board of Appeals of the Village of Mount Prospect on the 14th day of December, 1995, pursuant to due and proper notice thereof published in the Mount Prospect Journal and Topics on the 24th day of November, 1995; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 16-CU-95 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.2215 to allow a circular driveway nine feet (9') in width. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its BA 16-CU-95 Page 2 of 2 passage, approval and publication in pamphlet form in the manner provided by law.
