OPJ)INANCE NO. 2159
AN OPJ)INANCE AMENDING OPJ)INANCE NO. 1067 BY EXTENDING
THE LAND USE VARIATION UPON PROPERTY LOCATED AT NORTH-
EAST CORNER OF WILLIAM STPEET k"JD GOLF ROAD
WHEPEAS, the Board of Appeals of the Village of Mount Prospect did meet on
October 24, 1968 and did hear testimony on a request for a land use variation
under Case No. 68...56A, pursuant to proper legal notice published in the
Prospect Day on October 7, 1968; and
\VHEREAS, Case No. 68-56A pertained to a request to extend a present legal
non-confonning use of land under a previous variation granted by Ordinance
No. 1067 passed and approved on July 20, 1965; and
\VHEREAS, the Board of Appeals recommended to the Judiciary Committee of the
Board of Trustees of the Village of Mount Prospect to allow an extension of
the variation granted under the said Ordinance No. 1067, subj ect to certain
hereinbelow described conditions; and
vJHEREAS, the Judiciary Committee of the Board of Trustees of the Village of
fVIount Prospect subsequently met on January 30, 1969 and considered the recom-
mendation of the Board of' Appeals under Case No. 68-56A; and
WHEREAS, the said Judiciary Committee recommended to the President and Board
of Trustees of the Village of Mount Prospect to allow the variation as pre-
sented, subject to the said conditions; and
WHEREAS, the President and Board of Trustees of the Village .of r:lount Prospect
have reviewed the mat ter herein and have detennmed that the sale is for
the best interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAll'ffiD BY THE PRESID&1\fl' AND BOAPJ) OF TRUSTEES OF 'mE
VILLAGE OF rlIOUNT PROSPEcr, COOK COUNTY, ILLINOIS:
SEcrION ONE: That Ordinance No. 1067 be in full force and effect and shall
include the necessarv variation to allow the construction of an addition to
buildings presently ~xisting by reason of the said Ordinance No. 1067, the
plans for said addition being attached hereto and made a part hereof; pro-
vided, however, that the following conditions shall be met upon the subject
premises:
(a) That the property owner plant, grow, and maintain
honeysuckle not more than four (4) feet apart and at
least five (5) feet high on a line along the east lot
line starting at the front of' the building, thence north
approximately 93 feet, thence west 25 feet, and thence
north to the abutting school property.
(b) That the property owner dedicate the east half of
William Street north of Golf Road for a distance of 396.92
feet.
SEcrION TVJO: That all requirements of the Municipal Code of the Village of
Mount Prospect be applicable, except that variation extension specified in
Section One and that no further increase, or extension of any variation shall
be allowable vlithout an amendment to either this Ordinance or Ordinance No.
1067.

SECTION 'l'HREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby directed to issue a building pennit in accordance
with the variations hereinbefore mentioned.
SECTION FOUR: That the variation granted by this Ordinance shall be null
and void and of no force or effect whatsoever unless an application for a
building permit pursuant to such va:riation is made and construction commenced
vlithin one (1) year of the date of this Ordinance.
SECTION FIVE: That this Ordinance shall be in full force and effect from and
after its passage, approval, and publication in the manner provided by law.
