Kentucky Fried Chicken Mr. Lewis Boemia, of Kentucky Fried Chicken explained to the Board that they are proposing to move their existing facility at 301 E. Rand Rd., to a new location at 720 E. Rand Rd. adjacent to Courtesy Home Center. This facility would be an up-to-date drive through unit with room for 34 sit-in customers and square footage of 18,000 ft. costing 3/4 of a million dollars. This facility would be completely landscaped and provide their customers with all new modern amenities. They have been in Mount Prospect for the past 20 years and the new facility would be company owned and operated. An increase from $500,000 to $700,000 per year would be expected in their sales total. He explained that the typical Kentucky Fried Chicken has 2,200 customers per week whereas other fast food restaurants such as MacDonald's have 10,000. MacDonald's drive-through has approximately 4000 customers per week whereas Kentucky Fried Chicken has about 800. They generate more money per customer with less traffic through their restaurants and drive-through facilities as their average check is much larger than others. Mr. Frank Lund of Kentucky Fried Chicken gave an overview of their existing operation. The existing facility has no drive-through and employs nine people. The new unit would employ approximately 34 people and would be a 60% eat in and 40*10 drive-through business. They expe'ct to service the OPUS development without the traffic having to traverse Rand Rd. These potential customers could use the Courtesy Home Center parking lot via the curb cut on Business Center Drive. Mr. Boemia displayed site plans to the Board . The total side area is 31,532 sq. ft. He stated they have been working on the plan with the Village staff. They have an agreement with Courtesy for joint use of the parking lot. The comprehensive plan identifies this parcel as being best suited for general/commercial/office. This restaurant would fall within this category. The surrounding land uses to the north, east and west are all businesses. William testified as to the fact he has lived there for 20 years and did not receive notice of this zoning variance and he is closest to the site. He questioned his side of Rand Rd. and how this would effect the legal number of parking spots in Courtesy's parking lot. Mr. Bednar explained that Courtesy had far more parking than is actually need and would still be in conformance with codes. Mr. Korn said his street is or should be included in the traffic pattern considerations. He complained that Isabella St. is one of the highest volume residential streets in the Village. Isabella is the only street in the immediate area where you can enter or exit Rand Rd. Others are blocked off or restricted. He suggested a traffic study be done. Also he questioned a change in t h e elevations f o r this planned facility. He also suggested no exit or entrances for this facfility on Rand Rd. but use of Courtesy's parking lot for entrance. He stated that their customers are those that are already,- on the road and there would not be any incremental increase in traffic from the facility. Py"ANNING AND ZONING COMMENTS This proposed Kentucky Fried Chicken Restaurant is to be located on what is the old Honeybee Restaurant site combined with a recently purcha.ced 50 foot wide strip of land from the Courtesy Home Center. This entire parcel is presently vacant and paved with asphalt. As you may recall from a previous 1986 Zoning Board hearing, the Honeybee Restaurant site in itself is practically unbuildable when considering the setback requirements on this odd -shaped lot. Therefore, the Kentucky Fried Chicken representatives have purchased additional land from Courtesy Home Center in order to attempt to meet the setback .requirements and accommodate required parking and car stacking spaces. However, even with the increased parcel size, all setbacks required by Code have not been met. Cur main concern with both the rezoning and special use requests reflect the other Village department's concerns, of traffic. we recognize the fact that traffic movements along the section of Rand Road between Elmhurst and Central are confusing and in need of improvement. we are of the opinion that a drive-through/fast-food restaurant will compound the traffic problems in this area. we also agree w4.th Engineering and Inspection Services that the site design of this property may create on-site traffic problems as well. If this site were to be used for a fast-food restaurant without a drive- through facility, we anticipate improved traffic flow both on-site and off-site. (Please see our attached site plan.) As another option, a larger sized parcel would afford more design flexibility, thereby imp:-oving the traffic flow. The Comprehensive Plan identifies this parcel as being best suited for general/comr.ercial/office . A fast-food restaurant would fall within this category. The surrounding land uses to the north, east and west are all businesses. Single family residential is located across Rand Road. A staff windshield survey of Rand Road businesses identified five fast-food restaurants, including three with drive-through facilities, and five sit-down restaurants in the stretch just west of Elmhurst Road and continuing east to Central. Dixon - Page 2 August 101 1988 Mr. Lannon then moved and was seconded by Mr. Petrucelli to approve a rezoning from R-1 to B-3 along with a special use to allow the service station and food mart with the condition that the petitioner erect a fence around the property and submit a revised landscape plan to staff. The Board voted 2-3 denying the petitioner's request with Lannon, Petrucelli and Cassidy voting nay. Then the request for variations was denied 1-4 with Basnik, Lannon, Petrucelli and Cassidy voting nay. Representatives from Amoco oil Company have since met with staff and have presented a revised plan. This proposal eliminates the car wash and increases the setback on Euclid from 10 feet to 30 feet thereby eliminating the need for -variation. A variation is still required for the 20 foot setback along Wolf Road. The staff recommends approval of the request. The Planning Department believes it is reasonable to allow Amoco to rebuild this station with a modern self-service facility, to remain competitive at this location. Should Amoco not be permitted to construct their new station, there is a possibility that the Company might choose to close the existing station, leaving, the community with a vacant building that could present problems in the future. Also, it is important to note that Amoco eliminated the el.-.ar wash, t1n.erehy rec.olving the major concern of adjoining property owners. This compromise, plus an obligation to construct a new perimeter fence and install a conforming landscape setback next to adjacent single family homes, will provide an attractive new development that is a major improvement over existing conditions. Leonard Monday, 1630 Barberry objected to the noise of motors running, pollution and the fact that the tanks for gasoline would be closer to the Broderick home. Peg O'Hare, 1626 Barberry expressed her concern over distrubing the peace and quiet of the neighborhood due to the car wash. She also was concerned over the possibility of increased traffic and pollution. Jim Walkiwich, 1625 Barberry Lane was not in favor of the new tank locations closer to the Broderick home. He also objected to a possible 24 hour operation and the car wash. He stated he was in favor of improving the facility but not adding the car wash. Mark Busse, 1608 Ironwo ' od, pointed out the need for an attendent for the car wash in cases of mechanical failure or inexperience on the part of patron. Mr. Busse, although there as an interest- ed resident, is the owner of the Busse Car Wash and was pointed out by Mr. Basnik'could be considered an expert witness. Mr. Busse pointed out that stacking space is critical so that traffic does not hang out into the street in high use periods. Another point brought up was the question of drainage for water at the exit end of the wash especially during the winter. He felt that upgrading the station was great but these were some of his concerns. Upon questioning by the Board Mr. Busse stated that the blowers used in the car wash would be the primary cause of noise. He stated that the horsepower of the blowers was the pertinent question as far as noise and he stated he was not personally familiar with this type of car wash. The representatives of Amoco stated that there would be no night time deliveries at the proposed station. The Board was invited to contact facilities in Lincolnshire and at Lincoln and Lake Cook to investigate their cooperation with those Villages. The State Fire Marshall requirement for placement of the tank is 25 ft. from the lot line. Currently they are 75 feet from the lot line. They are proposing a ten foot alteration to 65 feet from the lot line. Amoco will live with lesser hours of operation for the car wash - say 6:00 a.m. to 8:00 p.m. or 7:00 a.m. to 7:00 p.m. The reason for a 24 hour operation for the gas station is to project an image of dependability for Amoco, even though they do not expect a large volume of traffic late at night and through early morning. As far as attendant for the car wash there would be controls in the store and a speaker hooked up for immediate aid for the car was~. Amoco is requesting the 30 foot front yard requirement on Euclid be reduced to 10 feet and the 30 foot requirement on River Road be reduced to 20 feet. The applicant maintains that conforming setbacks would adversely affect on-site maneuvering for customers. The staff's primary concern with this request is the placement of the car wash, and its proximity to the single family home to the south. The impact of the car wash needs to be fully discussed by the petitioner. This impact includes details on noise, lighting, hours of operation, building height, and landscaping of the 20 foot setback. Also, please note that access to the car wash is well designed, and the automobile stacking lane for the car wash meets ordinance requirements. The staff has no objection to the rezoning request including the proposed car wash, provided that measures are taken to eliminate any adverse effect on the single family home to the south. The petitioner has been asked to fully address this consideration. It is recommended that a new fence be constructed along the periphery of the property. The fence should be finished on both sides. Lastly, the staff points out that redevelopment of this site to a modern self-service facility is in the best interest of the community. A full-service station at this location is obsolete, and it is reasonable to allow the owner an opportunity to upgrade the facility. This request will allow implementation of many development Code provisions, thus improving the overall design quality of this site. The staff would be reluctant to see this full-service station closed, and re -used by some other commercial activity, such as a fast-food restaurant. The placement of the house can the lot and the small size of the lot does not lend itself to providing a functional area for a deck. The proposed area seems the most logical for the placement of a deck, although it creates a dangerous fire hazard by abutting the neighboring garage. Staff agrees that there is a hardship and that a variation of some degree is warranted. It is our opinion that they have created their own hardship by constructing a patio area that did not conform to code or to the approved building permit. If the patio were extended into the rear yard, a variation would not be needed. The applicant's 531 X 661 rear yard is unobstructed adjacent to the existing patio, leaving enough room to expand the patio west. The only freestanding structures located in the rear yard are a wood shed and a swingset play area. Neither are in close proximity of the existing patio. This Section shall not be applicable unless appropriate signs are posted upon streets and highways under the respective jurisdictions maintained by the State of Illinois, township, county, park district or Village wherein the school zone is located. He stated that the proposed variation request is minimal and that the staff had no objection to this minor reduction of the lot width. Mr. Brettrager observed that the proposed lots exceed the minimum square footage and, therefore, the variation of the lot width was very minor inasmuch as the lot area exceeded the minimum requirements. Mr. Fried Lutz, property owner at 3.P06 North Westgate introduced himself to the Zolllng Board as the, adjoining, property owner to the east. He concluded by stating that he has considered a number of options to the second floor addition, and indicated that his case does have a hardship, in that, by eliminating the cantilever, it would require more extensive remodeling to a first floor staircase. Mr. David Evancoe, Planning intern for the Mount Prospect Planning and Zoning Department, stated that the staff has no strong objections to the request based on the character of the neighborhood and the fact that there is a similar home in the neighborhood with the identical second floor addition.
