The property has been unproductive for years and has been highlighted in the Comprehensive Plan as underdevelzped, under-utilized, and prime Kensington frontage. Xr. John Finnemore, Construction Manager for KinderCare, 2198 Gladstone Court, Suite J, Glendale Heights, Illinois 60139 stated that KinderCare is currently in the process of making application with the state for the additional seventeen feet of right-of-way required. Kindercare has also agreed to a restrictive covenant an the property, whereupon when the state allows the street lights to be installed, their fair share will be paid. Sanitary services are being done per Engineering Department requirements. The sewer to be tied into still has capacity left and will be the one used. The question of storm sewers will also be handled per requirements from Engineering running water east or west on Kensington into state sewers. Scope of Regulations. The off-street parking and loading provisions of this ordinance shall apply as follows: For all buildings and structures erected and all uses of land established after the effective date of this ordinance or amendment thereto accessory parking and loading facilities shall be provided as required by this Article. However, where a building permit has been issued prior to the effective date of this ordinance, and provided that construction is begun within six months of such effective date and diligently prosecuted to completion, parking and loading facilities as required hereinafter need not be provided. When the intensity of use of any building, structure or premises is increased through additional dwelling units, gross floor area, seating capacity, or other units of measurement specified herein for required parking or loading facilities, parking and loading facilities as required herein shall be provided for such increase in intensity of use. Sec. 14.3002. Change of Use. Whenever the existing use of a building or structure which has been provided with the required number of off-street parking and loading spaces shall hereafter be changed to a new use, parking or loading facilities shall be required as provided for such use. However, if the building or structure was erected prior to the effective date of this ordinance, additional parking or loading facilities are mandatory only in the amount by which the requirements of the new use would exceed those for the existing use if the latter were subject to the parking and loading provisions of this ordinance. No Certificate of occupancy may be issued by the Village until such time as parking modifications have been substantially completed. Sec. 14.3003. Existing Parking and Loading Facilities. off- street parking or loading facilities which were in existence on the effective date of this ordinance or were provided voluntarily after such effective date shall not hereafter be reduced below the requirements of this ordinance for a similar new building or use. Sec. 14.3004. Downtown District Non -Conforming. In the Downtown District, when existing floor space is intensified and cannot conform to the parking requirements, the owner may request to donate to the Village parking funds. These restrictions or covenants are to run with the land and shall be binding on all the parties and all firms claiming under them, including the Village, a Municipal corporation. C. If the parties thereto, or any of them, or their heirs or assigns shall violate or attempt to violate any of the covenants herein, it shall be lawful for the other parties hereto including the Village to prosecute any proceeding at law or in equity against the person or persons violating or attempting to violate any such covenant, and either to prevent him or them from so doing or to recover damages or other dues for such violation. C. Such guarantee must be furnished to the Zoning Board of Appeals of the Village for its consideration in making its recommendation to the President and Board of Trustees of the Village. Sec. 14.3008. Parking Area Design. It shall be the responsi- bility of the Planning and Zoning Director to review plans for all parking lots to ensure compliance with the parking section of these regulations and his approval must be obtained before building permit issuance. The arrangement, character, extent, width, grade and location of all parking areas shall be con- sidered in relation to existing and planned streets, to reason- able circulation to traffic within and adjacent to parking areas, to separation of parking, loading, and drive -up stacking, to topographical conditions, to runoff of storm water, public convenience and safety, and in their appropriate relations to the proposed uses of the area to be served. All traffic inter- sections and confluences must encourage safe and efficient traffic flow. Any such submission must comply with the require- ments of this ordinance and the Development Code. Parking lots and accesses shall be designed so as to discourage use of same as short-cuts and/or bypasses when located between major arterial roadways. Sec. 14.3009. Parking of Vehicles in Residential Districts. No truck, commercial vehicle with license plates indicating a gross weight or licensed weight in excess of 8,001 lbs., or trailers, shall be parked or stored on any residential premises except when making a delivery, rendering a service at such premises. Personal use vehicles such as pickups and vans, are not subject to this restriction. Sec. 14.3010. Repair and Service. No motor vehicle repair work of a commercial nature shall be permitted in conjunction with off-street parking facilities provided. Sec. 14.3011. Handicap Parking* At least one handicapped parking stall shall be provided in all off-street parking areas larger than 15 spaces. Additional handicapped parking shall be provided at the rate of 2% of the total number of stalls. Handicapped parking stalls shall be at least 16 feet by 18 feet for 900 parking, and shall be proportionately larger at the other angles as per Figure 1 hereinafter adopted in this Article. All stalls shall be appropriately marked and signed, be located in close proximity to the principal building, and shall offer barrier free access to the principal building. A designation of handicapped parking stalls shall constitute consent by the property owner to the enforcement of the restriction of such spaces to handicapped motorists by the Village. Sec. 14.3012. Computation of Required Parking and Loading Spaces. Use Chart #1 to calculate the number of spaces required for each use. Chart #2 should be used to determine how many loading spaces are necessary for each use. Even though they have a warranty clause on workmanship, the contractor for the last three years has failed to respond to the contracting officer from Hines Hospital Mary Crawford, in resolving some peeling problems they experienced and other workmanship related problems. (c) El Greco Painting Contractors also had a contract for the painting of a steel tank at Ft. Sheridan, Ill. and in talking to Tina Welcher, a representative of the U.S. Army Corps of Engineers, she stated that she would have to give them an unsatisfactory rating on performance. Their contract to paint their tank was to have ended July 29, 1987 because of delays by the contractor. However, they extended it for 60 days, and even to this day it still is not fully completed. They kept giving excuses it was either too hot to paint too cold to paint, or they did the same thing as they had done at Hines Hospital - just gave any excuse and refused to respond to calls* These are the only tanks that I am aware of that this contractor has been awarded. All other work allegedly was done painting buildings, bridges, interior decorating, etc. Even then, according to the Corps of Engineers' representative at Ft.
