PUBLIC HEARING This Public Hearing, called pursuant to proper legal notice, is for the purpose of considering the vacation of a portion of Evergreen Avenue just west of Elm Street, and Elm Street between Northwest Highway Evergreen. 1. 1st reading of AN ORDINANCE VACATING SPECIFIED VILLAGE RIGHT-OF-WAY This Ordinance authorizes vacation of Village right-of-way in conjunction with TIF No. 1. Plat of Subdivision 4. 1st reading of AN ORDINANCE RATIFYING THE DEVELOPMENT AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND HOME BY HEMPHILL BEING THE SUBJECT OF ORDINANCE 3891 (Exhibit A-1) 5. 2nd reading of AN ORDINANCE REZONING CERTAIN PROPERTY COMMONLY KNOWN AS HEMPHILL DEVELOPMENT This ordinance rezones the subject property to R-3 ( Multi -family) (Exhibit B) 6. 2nd reading of AN ORDINANCE GRANTING A SPECIAL USE IN THE NATURE OF A PLANNED UNIT DEVELOPMENT This Ordinance grants a Special Use to permit a Planned Unit Development comprising of 51 townhomes. (Exhibit C) 7. 2nd reading of AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS HEMPHILL DEVELOPMENT This Ordinance grants the variations necessary to construct 51 townhomes within this Planned Unit Development. (Exhibit D) 8. 2nd reading of AN ORDINANCE GRANTING MODIFICATIONS FROM THE DEVELOPMENT CODE This ordinance will permit a driveway width of 20 feet and elimination of curb and gutters on private roadways. The Plan Commission recommended granting these requests by a vote of 5-2. (Exhibit E) B. ZBA 8 -V -88r 701 East Prospect Avenue 2nd reading of AN ORDINANCE REPEALING ORDINANCE NO. 3510 AND ESTABLISHING SPECIFIED STANDARDS FOR PROPERTY COMMONLY KNOWN AS 710 E. PROSPECT AVE. By repealing a portion of Ordinance No. 3510, this Ordinance reinstates the variation granted to permit 48 parking spaces for the subject property, along with regulations governing the type of use that will be permitted in this office building. ZBA 79 -V -87y 900 Tower Lane 1st reading of AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 900 TOWER LANE This Ordiannce grants a variation to permit a driveway and sidewalk 241 7" wide. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. (Exhibit G) D. ZBA 2-V-880 322 Marcella 1st reading of AN ORDINANCE GRANTING VARIATIONS FOR PROPERLTY COMMONLY KNOWN AS 322 MARCELLA This ordinance grants a variation to permit a 15 foot front yard instead of the required 30 feet in order to add an attached garage to a single family home. The Zoning Board of Appeals recommended granting this request by A vote of 6-0. (Exhibit H) E. ZBA 3 -V -88t 1005 Cypress 1st reading of AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY COMMONLY KNOWN AS 1005 CYPRESS This Ordinance grants variations to permit a parking pad resulting in a driveway width of 27-1/2 feet wide, a side yard of 6-1/2 feet instead of 7.3 feet and a zero foot front yard. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. (Exhibit J) F. ZBA 1 -SU -88, Lt=xington Homes - Old Orchard The Petitioner is requesting a Special Use in the nature of a Planned Unit Development to permit an amendment to the Consent Decree to permit the construction of a 332 townhouse - arbor home complex. The Zoning Board of Appeals recommended granting the request by a vote of 7-0. ORDINANCE AUTHORIZING THE EXECUTION OF AN AMENDMENT TO AMENDED CONSENT DECREE'IN CHICAGO TITLE AND TRUST, ETC. ET AL.tV MOUNT PROSPECTr NO. 65 CH 5300 t (Exhibit K) H. A RESOLUTION APPROVING THE FISCAL YEAR 1988 COMMUNITY DEVELOPMENT BLOCK GRANT ENTITLEMENT PROGRAM The Plan Commission has reviewed the projects and allocation for 1988 and recommended approval by a vote of 7-0. (Exhibit L) I. Safety Commission recommendations: 1. Request of resident to install STOP sign on Milburn at Emerson instead of YIELD for eastbound traffic. The Safety Commission recommended granting the request. J. 1st reading of AN ORDINANCE AMENDING CHAPTER 18 ENTITLED "TRAFFIC CODE" OF THE VILLAGE CODE OF MOUNT PROSPECT This Ordinance prohibits overnight parking in municipally owned and/or operated parking lots as well as deleting 30 minutes parking zones and replacing it with four hour zones. (Exhibit M) K. 2nd reading of AN ORDINANCE AMENDING CHAPTER 9 (SIGN REGULATIONS) OF THE VILLAGE CODE (Exhibit N) I.E. NEW BUSINESS A. ZBA 81 -AP -87, Ray Naegle, 2013 E. Euclid Petitioner is requesting variation from site plan to permit parking in rear yard. This case has been continued to March 1 meeting. B. 1st reading of AN ORDINANCE TO AMEND ARTICLE X ENTITLED "FOOD AND BEVERAGE TAX" OF CHATPER 8 OF THE VILLAGE CODE OF MOUNT PROSPECT This Ordinance revises the enforcement provisions. (Exhibit 0) X.
