ORDINANCE NO. 2200
AN ORDINANCE AMENDING SEC'rION 23.306 OF THE
MUNICIPAL CODE OF THE VILLAGE OF ~,10UNI' PROSPEC'r
BE IT ORDAINED BY THE PPESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF
MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SEC'rION ONE: That Sub-section B of Section 23.306 of the Municipal Crnfe of f
the Village of Mount Prospect of 1957, as amended, is hereby further amended'
in its entirety, retaining sirrilar provisions and adding thereto paragraphs
1 and 2 so that the said Sub-section B of Section 23.306 shall hereafter be
and read as follows:
"Section 23.306 -
B. All Village users within the Village, except as set forth in
paragraphs 1 and 2 below, having a direct or indirect connection
with Village \'Tater rrains shall pay the following rates per quarter:
First 100,000 gallons ................. $.55 per M
Over 100,000 gallons ................. $.50 per M
MiJlimum Charge: $3.85 per quart~r
1. In addition to the foregoing charges, all Village users re;..;;
siding in the Fairview Gardens Subdivision, being legally
described as:
"Begiming at a point on the South line of the South East
Quarter of Section Thirty-five (35), Township Fcety-t~ro (42)
North, Range Eleven (11) East of the Third Principal f.1er-
idian in the County of Cook in the State of Illinois, which
said point lies 660.30 feet "'lest of the Southeast comer of
said Section Thirty-five (35); running thence \-lest for a
distance of 1,320.48 feet along the section line; running
thence North to the North line of the Southeast Quarter of
said Section Thirty-five (35), being a distance of 2,646.66
feet, more or less; running thence East for a distance of
1,319.23 feet along the said North line of the Southeast
Quarter of said Section Thirty-five (35); running thence
South to the point of begiming; and
That part of Section Thirty-five (35), Township Fouty-bro
( 42) North, Range Eleven (11) east of the Third Principal
r(<eridian in the County of Cook in the State of Illinois des-
cribed as follows: Canrnencing at the Southeast comer of said
Section Thirty-five (35), running thence 1tJest on the South
line of said Section Thirty-five (35) for a distance of
66.30 feet; running thence North for a distance of 2,646.66
feet; running thence F-ast for a distance of 653.20 feet to
a brass monument in Wolf Road; running thence South to the
point of beginning; and
Apartment project located in the C. A. Goelz Prospect Gardens,
being a subdivision of the West 1/2 of the West 1/2 of the
Southeast 1/4 together ~Tith the F-ast 2/3 of the North 3/4
of the Northeast 1/4 of the Southwest 1/4 of Section 35,
Township 42 North, Range 11, East of the Third Principal
Meridian, in Cook County, Illinois;
shall pay an additional charge of Thirty-two and 5/100 Dollars

(32.05) per quarter as part of their water bill. Said charge
shall be terminated upon the payrrent of the user t s share of the
cost of acquisition of the Fairview Utility facilities pursuant
to a certain agreement by and between the Village and Fairview
Utility Co., dated October 28, 1969. Any user within the above-
described area rray terminate his liability for such additional
payments by payment in full of his share of the acquisition
cost, as determined by the Village Clerk.
2. Not"Tithstanding the foregoing, all Village users residing in
the certificated area of the Village of Mount Prospect serviced
by the Utility Sewer & vJater 00. pr:i.or to October 18, 1969, shall
pay the follo~ling rates per month:
First 4,000 Gal./Month
Next 3,000" "

SEC'rION TWO: That this Ordinance shall be in full force and effect from
and after its passage, approval, and publication in the manner provided by
law.
