ORDINANCE NO. 2202
AN ORDINANCE GRANTING VAlUATIONS FOR PROPEFTY LOCATED AT
THE CORNER OF RAND ROAD, KENSINGTON ROAD, AND MAIN STREET
vJHEPEAS, the Board of Appeals of the Village of Mount Prospect held a regular
meeting on July 24, 1969, at the hour of 8:00 P. M. in the Mount Prospect
Village Hall pursuant to notice published in the Prospect Day on July 8, 1969;
and
WHEREAS, the Board of Appeals of the Village of Mount Prospect heard testimony
presented under Case No. 69-40A pertaining to a request to operate a furniture
store with less than one parking space for each three hundred (300) square
feet of floor area of building and less than three (3) loading spaces for the
said store building; and
vJHEREAS, the Board of Appeals found that:
1. There is a practical hardship on the mmer in that
furniture stores do not generate as much traffic
as other retail establishments;
2. Village parking requirements would cause economic
hardship and practical difficulty for the owner; and
3. The variations requested will not alter the essential
character of the locality; and
WHEREAS, the Building Conrnittee of the Board of Trustees of the Village of
Mount Prospect subsequently met on October 21, 1969, and considered the re-
conmendations and findings of the Board of Appeals under Case No. 69-40A; and
WHEREAS, the Building Committee has recomnended to the President and board of
Trustees of the Village of rVfount Prospect to concur with the recorrrnendations
of the Board of Appeals; and
WHEREAS, the Hresident and Board of Trustees of the Village of Mount Prospect
have reviewed the Subject matter herein and have determined that the same is
in the best interests of the Village of l\1ount Prospect;
NOvl, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, IILINOIS:
SECTION ONE: That property being the subject matter of Case No. 69-40A, being
legally described as:
The North 361.6 feet of that part of the North 1'lest quarter
of the North East quarter of Section 34, Township 42 North,
Range 11, East of the Third Principal Meridian, lying v.Iest
of center line of Rand Road, in Cook County, Illinois
is currently zoned under the Zoning Ordinance of the Village of l\~onnt Prospect
as B-3 (Business-Retail p" Service) which zoning classification shall rerrain
subject to the foll~ling p:ranted variations:
a. That the building upon the land described above shall
include a minimum number of two (2) loading spaces as
described in paragraph (J) of Section 20 of the Mount
Prospect Zoning Ordinance.

b. That the land described above shall include a
minimum of one hundred twelve (112) ten (10) foot
by twenty (20) foot parking spaces for automobiles,
which spaces shall be in excess of all necessary
driveways, lanes ,mrrps and maneuvering areas.
SECTION TWO: That all the requirements of the Village Code be applicable
except those variations set out in Section One above.
SECTION THREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby directed to issue a building permit in accordance
with the variations and limitations hereinbefore mentioned.
SECTION FDUR: That the variations granted by this Ordinance shall be null
and void and of no force and effect whatsoever; (1) unless an application for
a building pem.it pursuant to such variations is made and construction com-
menced within one year of the date said ordinance becomes effective; (2) if at
any future time the proposed use for furniture store is teminated and another
use comrrenced upon the above'-'described property.
SECTION FIVE: That this Ordinanceshall be in full force and effect from and
after its passage, approval, and publication in the manner provided by law.
