AN ORDINANCE GRANTING A VARIATION FOR CERTAIN PROPERTY COMMONLY KNOWN AS 606 SOUTH BUSSE ROAD IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, Mr. and Mrs. Chris Hilgeman have filed an application for variation with respect to property commonly known as the 606 South Busse Road in the Village of Mount Prospect, Illinois (the "Subject Property"); and WHEREAS, the Subject Property is described as follows: Lot 18, of Hatlen Heights Estates, Unit No. 1, a Subdivision of part of Lots 3, 4, 5 and 6 taken as a tract in Owner's Division, being a Subdivision of the Southeast Quarter (except the West half of the Southwest Quarter thereof) of Section 10, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois. WHEREAS, Petitioner, seeks a variation from the provisions of Section 14.102.B of Article I and 14.1001.B.3 of Article X of Chapter 14 of the Village Code of Mount Prospect, Illinois, to allow the construction of a carport within the front yard area of single family residence premises whereon there is presently located a residence structure and a garage; and WHEREAS, a public hearing was held on the variation request (designated as Case No. ZBA-73-V-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 19th day of December, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 2nd day of December, 1985; and WHEREAS, the Zoning Board of Appeals has determined to allow the subject carport to be located within the required front yard area and has further submitted its finding and recommendation to the President and Board of Trustees of the Village of Mount Prospect, in favor of granting the subject variations to allow said carport to be erected on property wherein there is also an existing garage, and the President and Board of Trustees of the Village have given further consideration to the variation request and have determined that the same satisfies the standards set forth in Section 14.605 of Article VI of Chapter 14 of the Village Code, and this Board further finds that it would be in the best interest of the Village to grant the request for variation, provided the subject carport construction complies with Village building requirements, including requirements pertaining to adequate foundation and structural supports. NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS, AS FOLLOWS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. AN ORDINANCE APPROVING AND AUTHORIZING A PLANNED DEVELOPMENT AND EXPANSION OF THE AREA COMMONLY KNOWN AS THE RANDHURST SHOPPING CENTER FOR DEVELOPMENT OF TWO DEPARTMENT STORES, THREE OFFICE BUILDINGS AND A RESTAURANT IN THE VILLAGE OF MOUNT PROSPECT, ILLINOIS WHEREAS, the Rouse Corporation with offices at 999 North Elmhurst Road, Mount Prospect, Illinois the Petitioner, herein, has made application for a planned development for the purpose of adding to and expanding an existing shopping center located on property commonly known as the Randhurst Shopping Center, for use in constructing two department stores, three office buildings and one free-standing restaurant; said property being situated within the Village of Mount Prospect, Illinois; and WHEREAS, the Subject Property is legally described on the Exhibit A attached hereto and made a part of this Ordinance by reference; and WHEREAS, the Subject Property is presently part of a regional shopping center development, zoned and classified in the B-3 Business, Retail and Service District, and Petitioner seeks to expand such shopping center to add thereto an additional 323,000 square feet of shopping center area by the construction of two department stores containing approximately 67,000 and 80,000 square feet respectively, the construction of three office buildings, containing approximately 50,000 square feet, 54,000 square feet and 67,000 square feet respectively and having a maximum height (including that roof area used for heating and air conditioning equipment) of not to exceed 60 feet or four stories, whichever is the lesser; and by the construction of a free- standing restaurant having approximately 5,000 square feet of building area; and WHEREAS, said development is set forth and contained in the Site Plan a copy of which is attached hereto as Exhibit B, and conceptual landscape plan, a copy of which is attached hereto as Exhibit C, and made a part of this Ordinance by reference; and WHEREAS, Petitioner seeks approval of this planned develop- ment including the building height for the three proposed office buildings pursuant to the provisions of Article XXV of Chapter 14 of the Village Code of Mount Prospect, Illinois; and WHEREAS, a public hearing was held on said petition (desig- nated as Case No. ZBA-75-SU-85) before the Zoning Board of Appeals of the Village of Mount Prospect on the 19th day of December, 1985, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 2nd day of December, 1985; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the Village to grant the said planned unit development for expanded shopping center uses including the requested building height for the three proposed office buildings, and in accordance with the Site Plan as attached hereto; but subject to the following conditions, to wit: 1. The internal water main system shall be expanded and looped along the North property line of the Subject Property within the Euclid right-of-way area. 2.
