CAF/ 9/11/97 ORDINANCE NO. 4890 AN ORDINANCE GRANTING A CONDITIONAL USE AND VARIATION FOR PROPERTY GENERALLY LOCATED AT 50 NORTH MAIN STREET (MOUNT PROSPECT NATIONAL BANK WHEREAS, Ben Trapani (hereinafter referred to as Petitioner) has filed a petition for a Conditional Use and a Variation with respect to property located at 50 North Main Street, (hereinafter referred to as the Subject Property) and legally described as follows: Lot "A" (excepting therefrom that part thereof lying East of a line described as beginning at a point on the South line of said Lot A, which is 10.33 feet West of the Southeast comer of said Lot 1 and running thence North 510.01 feet to a point on the North line of said Lot A which is 11.50 feet West of the Northeast comer of said Lot A) in Block 1, in Ernst Busse Addition to Mount Prospect, being a subdivision of the South 543 feet of the East % of the Southwest 1/4 of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian. ALSO Lot "A" in Hill Crest, being a Subdivision in the East 1/4 of Section 14, Township 42 North, Range 11, East of the Third Principal Meridian, according to the Plat thereof recorded July 15, 1926 as Document Number 9339722, all in Cook County, Illinois. WHEREAS, Petitioner seeks a Conditional Use to permit a drive-thru facility in conjunction with the operation of a financial institution and a variation to allow parking in the required setback; and WHEREAS, a public hearing was held on the request for Conditional Use being the subject of ZBA Case No. 22-97 before the Zoning Board of Appeals of the Village of Mount Prospect on the 14th day of August, 1997, pursuant to proper legal notice having been published in the Mount Prospect Journal on the 30th day of July, 1997; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees relative to the requests being the subject of ZBA 22-97; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given consideration to the requests herein and have determined that the same meets the standards of the Village and that the granting of the proposed Conditional Use and Variation would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That the President and Board of Trustees of the Village of Mount Prospect do hereby grant a Conditional Use to permit a drive-thru facility on the Subject Property, which drive-thru facility will be in conjunction with the operation of a financial institution. A variation is also granted to allow parking in the required setback area, all as shown on the Site Plan attached hereto and hereby made a part hereof as Exhibit "A". The Conditional Use and variation are granted subject to the following conditions: 1. That prior to the issuance of a building permit, the Petitioner shall make a cash contribution of $225.00 per tree in lieu of the required installation of parkway trees along Central Road, Main Street (Route 83) and Henry Street. That prior to the issuance of a building permit, the Petitioner shall resubmit fifteen copies of the development plans revised in accordance with the memorandum and exhibit dated August 6, 1997 relative to ZBA 22-97, a copy of which is attached hereto and hereby made a part hereof as Exhibit "B". 3. That prior to the issuance of a building permit, the Petitioner shall submit three copies of a recorded Plat of Error relocating the property line located at the center of the proposed bank building to a location south of the proposed drive-through facility or submit to the Village a request for Plat of Subdivision approval to consolidate the two northernmost parcels illustrated on the development plans. 4. That if the Village determines that the configuration of the parking lot exiting onto Henry Street, as shown on the Site Plan, has a negative impact on the surrounding residential neighborhood, the Petitioner shall be responsible for modifying the east Henry Street exit lanes to restrict exiting vehicles from making a left turn onto Henry Street. SECTION THREE: That the Village Clerk is hereby authorized and directed to record a copy of this Ordinance with the Recorder of Deeds. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law. Fields Village Clerk CENTRAL ROAD CENTRAL ROAD ~ ~ ~ TREET ~ ~ HENRY STREET VILLAGE OF MOUNT PROSPECT Corn?unity Development Department - Planning Division MEMORANDUM TO: CASE ZBA-22-97 FROM: DANIEL UNGERLEIDER, AICP, PLANNING COORDINATOR ~ DATE: AUGUST 6, 1997 SUBJECT: MOUNT PROSPECT NATIONAL BANK RECOMMENDED DEVELOPMENT PLAN REVISIONS Based on a review if the petitioner's request, Staffrecommends the following revisions (as shown on the attached exhibit) be incorporated into the proposed development plans: 1. Shift the shared parking lot between the proposed bank and the existing shopping center three (3') feet to south and add one (1') foot to the landscaped area proposed between the park'mg lot and the ATM drive though lane. This larger landscaped area shall contain a combination of shade trees and shrubbery and/or another form of architectural screening. Wheel stops shall be installed along the shopping center's north side to prevent parking vehicles from damaging the shopping center's wall. Shift the proposed bank building two (2') feet to the south. The resulting Henry St. building setback will comply with the Village's B-5 Central Commercial District zoning requirements. 2. Relocate the handicap parking spaces so that they are adjacent to the new bank building's entrance. Each handicap space shall have an individual ramp and sign indicating a $100 fine as required by the Americans with Disability Act of 1990. 3. Provide delineated pedestrian crosswalks and access ways as illustrated on the exhibit. Staff recommends that crosswalks be delineated with brick pavers similar to those used in the downtown streetscape program. The downtown streetscape design guidelines are available in the Planning Division. 4. Connect the sidewalk in front of the bank with the Henry St. public sidewalk. 5. Provide details illustrating that the two trash enclosures will be constructed of masonry material compatible with the buildings they serve. Landscape screening shall be incorporated around the shopping center's trash enclosure as illustrated on the exhibit. MOUNT PROSPECT NATIONAL BANK RECOMMENDED DEVELOPMENT PLAN REVISIONS Page 2 6. Provide a six (6') foot high decorative or a solid wood fence along the west property line between the north end of the shopping center and the bank's set back from Henry Street. The fence shall be constructed finished-side out (west). Existing fences along the west property line must be removed before the new fence is constructed. 7. Provide on-site traffic control signage as illustrated on the exhibit. 8. Provide four (4) diamond-shaped landscape islands within the parking lot as illustrated on the exhibit. Each island shall contain one shade tree and live ground cover in accordance with the Village's landscape requirements. 9. Provide a three (3') foot high hedge adjacent to Rt. 83 between Henry St. and Central Road. 10. Replace the four (4) northern most parking spaces in front of the bank with a curbed landscape area. The area will provide a landscaped entry feature for the bank, and potentially the downtown business district. 11. Increase the amount and area of foundation landscaping along the proposed bank's north side. *** See attached exhibit, dated August 6, 1997, for additional comments and recommended revisions.
