3. APPROVAL OF MINUTES
3.1 Minutes of the Regular Meeting of the Village Board - May 5 2024
Motion by Paul Hoefert, second by William Grossi to approve the minutes.
Minutes were approved by a unanimous voice vote of the Board.
4. MAYOR'S REPORT
4.1 Proclamation: National Public Works Week May 17 - 23f 2020
Mayor Juracek read the proclamation into record. Mayor Juracek noted that the Public Works Open
House, scheduled for this weekend, is postponed. Mayor Juracek thanked the Public Works
Department for all they do throughout the year. Public Works Director Sean Dorsey thanked the
Board and the community for their continued support. Mr. Dorsey stated he is hopeful that the open
house can be re -scheduled to a date later this year.
4.2 Proclamation: Monarch Butterfly Day May 20, 2020
Mayor Juracek stated the Village selected May 20th as the date to recognize the efforts of the Mount
Prospect Garden Club who preserve and nurture our monarch butterfly population. On this day, the
Public Works Department will deliver mulch to Moehling Park and the Garden Club will work to
beautify and enhance the butterfly garden. Mayor Juracek read the proclamation into record.
4.3 1st reading of AN ORDINANCE AUTHORIZING THE VILLAGE PRESIDENT TO DECLARE A STATE 0
EMERGENCY SHOULD THE NEED ARISE AND AUTHORIZING PURCHASE CONTRACTS AS NECESSARY
TO RESOLVE A STATE OF EMERGENCY WITHOUT PUBLIC ADVERTISEMENT WITHIN THE VILLAGE OF
MOUNT PROSPECT I

Mayor Juracek introduced the ordinance before the Board for consideration which would continue ani
extend the State of Emergency in the Village through June 2, 2020; the current ordinance in effect
expires upon the adjournment of this meeting (May 19,, 2020). Mayor Juracek noted some questions
were raised at the May 5th Village Board meeting regarding the necessity of taking such action.
Mayor Juracek reviewed those questions and stated this is an opportunity to discuss the Village's
response to the crisis. The discussion will also include the Governor's Restore Illinois Plan, and a
letter from the NWMC (Northwest Municipal Conference) requesting the Governor to modify the
Restore Illinois Plan.
Mayor Juracek reviewed the following questions and a discussion regarding each of the points
followed:
Does the ability of the Mayor to call a special meeting make the declaration of a state of
emergency moot? Village Attorney Lance Malina stated the Mayor has the authority to call a
special meeting to discuss time -sensitive issues.
Does FEMA require such a declaration before funds are reimbursed? - Village Manager Michael
Cassady stated FEMA (Federal Emergency Management Agency) altered their stance and no
longer requires the existence of local declarations for fund reimbursements related to COVD-1 9
expenses.

What costs have been incurred from COVID related expenses? Village Manager Michael
Cassady stated the Village has incurred $72,790 in COVID-19 related expenses to date. Mr.
Cassady added the Village will seek reimbursement from FEMA for 75% of those expenses.
Does the Mayor have flexibility as Liquor Commissioner to act during this time without the
existence of an emergency declaration? Mayor luracek noted the only action she has taken
thus far under the declaration is as the role of Liquor Commissioner. Mayor luracek noted that
under the direction of the Illinois Liquor Commission, Village is allowing, for the duration of our
response, the sale of beer and wine including the filling of growlers with restaurant food
orders. Village Attorney Lance Malina stated the Mayor's role as Liquor Commissioner allows
her to enforce the Liquor Code without a declaration in place.
What are the current COVID statistics in Mount Prospect? Mayor luracek read an email from a
resident who expressed concern over the growing number of cases of COVID-19 in Mount
Prospect. Mayor Juracek read aloud her response to the resident. Mayor Juracek review-
! f noted the Village is under the jurisdiction of the Cook County Health
Department which has made obtaining reports of cases and locations difficult when coupled
with HIPAA regulations. Mayor Juracek stated six (6) Mount Prospect residents have lost their
lives due to COVID. Mayor Juracek extended sympathies to the families who experienced loss.
Mayor Juracek also stated that local hospitals have reported a decrease in cases and Northwest
Community Hospital is resuming elective surgeries this week.
Board Comme uestions:
The subject of dram shop insurance was discussed
Decision to not extend the State of Emergency declaration is not a sign of defiance against the
Governor; a local declaration is not needed. Mayor has acted responsibly and no single
purchase over $20,000 has been incurred.
Anyone delivering packaged liquor must be BASSET certified and must check identification
when items are delivered
Village has been operating smoothly and will continue to do so with or with the declaration;
does not see a need to continue the declaration.
Mayor's leadership was recognized with appreciation
Are any future PPE expenditures anticipated? Village Manager Michael Cassady responded,
stating additional expenditures are expected but none that would exceed the Managers'
spending authority. If such circumstances should arise, a special meeting could be called or the
Manager could contact each Board member individually, obtain authority, and ratify the
expense at the next Board meeting.
• Message to the community is important; the decision not to extend the declaration does not
imply the Village is being dismissive. Village leadership and staff remain committed to
preserving the safety of all our citizens.
• The Village is well-prepared to respond to any future unusual circumstances; if a declaration is
not needed, we should not enact it.
• Communication and response amongst Board members is consistent and timely
• Mayor and Village Manager have the confidence and support of the Board
There was no motion to approve the ordinance authorizing the Village President to declare a state of
emergency should the need arise and authorizing purchase contracts as necessary to resolve a state
of emergency without public advertisement within the Village of Mount Prospect. Without a motion,
no further action was taken.
A discussion regarding Governor Pritzker's Restore Illinois strategy followed. Mayor Juracek noted
the Governor has chosen a medically conservative approach and it appears that all four regions are
on track to enter Phase 3 by May 29. Entering Phase 3 comes with questions and concerns.
Restaurants will not be allowed to reopen until Phase 4. Mayor Juracek reviewed Mayor
Lightfoot's re -opening plan which includes the formation of a regional task force. The plan favors
support for restaurants and includes provisions/criteria to allow outdoor dining in Phase 3 with
expectations that social distancing, face coverings, and other safety protocols are followed. Mayor
Juracek reviewed the City of McHenry's approach that allows outdoor dining and consumption in the
City's rights-of-way and further allowing local property and parking lot use for dining. It is a way tit
make the rules work responsibly and safely.

Mayor Juracek discussed the NWMC's letter to the Governor, in lieu of a resolution which did not hav
enough support from the NWMC, to modify the Restore Illinois plan. It includes two major factors: 1
re-examination of the 4 regions into smaller 11 hospital regions (Mount Prospect is in Region 9)
and 2) develop protocols and controls for the re -opening of restaurants and bars in Phase 3. Mayor
Juracek reviewed the conditions of the Resolution which neighboring communities have adopted or
considered that supports the requests of the NWMC letter to the Governor. Mayor Juracek believes it
worthy of consideration at our next Board meeting. Mayor Juracek also noted a discussion regarding
the City of McHenry's approach is also worth consideration.
Would like more information on how the reorganization of the EMS regions would benefit Mount
Prospect
Who is responsible for determining restaurant floor plans and layout? What is the timeline for
the proposal? Mayor Juracek responded, stating Mayor Lightfoot's proposal includes standards
and criteria restaurants would be required to follow to reopen; responsibility of the individual
restaurants to establish floor plans that maintain safe physical distancing. Mayor Juracek
stated Mayor Lightfoot's proposal should be released by the first week of June.
• Too many unknowns and variables to make any decision at this time; supports a more in-depth
discussion at the next Board meeting when more information will be available and conditions
will hopefully stabilize
• Trends are moving in the right direction; more time is needed to measure the stability and
sustainability of these favorable trends
A plan needs to be in place if a spike in cases emerge
We must view these upcoming decisions through a regional approach; determine what is best
for the region and not just our community
• Warmer weather has brought people outside more and many are violating stay-at-home
orders; difficult to enforce
• Need to find a balance between the medical and business aspects of this
Important for people to return to work and ignite the economy responsibly
Economy is faltering; many small businesses will not recover
Believes there are responsible means for restaurants to open dining rooms while maintaining
safe distances between tables
Many small retailers can also open safely by enforcing safety protocols- physical distancing and
face coverings
The economic community is being hurt just as much as the medical community; important to
find a balance
Questioned if the proposed resolution would be our own or a regional proposal of the Mayor of
Chicago? Mayor luracek responded, stating the resolution would indicate Village support of the
Governor's EMS region examination and support for moving restaurant dining from Phase 4 to
Phase 3
A discussion regarding how the Village would approach street closures to support outdoor dining
for restaurant establishments followed.
S. COMMUNICATIONS AND PETITIONS - CITIZENS TO BE HEARD

Mr. Olson submitted a public comment form prior to the meeting. Mayor Juracek read the comment

When will the water drainage issues in the village be addressed more aggressively? I live on
Willow Lane between Tamarack and Lavergne. Every time it rains, my neighbor's yard floods.
The water overflows into the surrounding properties. Yesterday, water reached my neighbor's
back door. A proper drainage system needs to be installed. Last summer I was told there was a
backlog and no funds yet you all gave yourself raises and the Village Manager a hefty 5% raise.
Please address this issue.

Mayor Juracek stated she addressed Mr. Olson's concerns via a lengthy email that included a link to
the July 9,, 2019 Committee of the Whole meeting where this issue was discussed in detail.
Mayor Juracek requested an update on recent rain events and the status of the Des Plaines Rive

Mr. Dorsey displayed a National Weather Service river gauge graph of the Des Plaines River just
north of Euclid. The river crest was just over 19 feet; the highest recorded crest was 20.9 feet in
2013. Significant rainfalls, especially in the past three or four days have produced very high levels.
Mr. Dorsey added that we have already set a new record for rainfall during the month of May (8.25
inches) with several days left. Mr. Dorsey stated storms over the past several years produced bigger
iownpours and larger volumes of rain and are occurring more frequently. Mr. Dorsey reviewed
historic crests of the Des Plaines River.
Mr. Dorsey reviewed the Flood Relief Project at Burning Bush Trails Park. Mr. Dorsey reviewed the
impact of the recent storm/rain events in our Village. Mr. Dorsey stated the Public Works
Department responded to 220 service requests over the past weekend. The majority of the service
requests were regarding street flooding issues. Mr. Dorsey stated staff has responded to most of the
complaints; a few relating to private drainage issues remain and will be addressed appropriately.
The outcome of the event was surcharging that occurred as a consequence of heavy rainfall
particularly on Sunday night which was too much for the sewers to handle. By 8:00 p.m. Sunday
evening, most of the issues resolved on their own.
Mayor Juracek thanked Mr. Dorsey and his staff for attending to the needs of the community swiftly
,2nd timely. Mr. Dorsey answered a few questions from the Board. M

•;.2 A RESOLUTION AUTHORIZING THE MAYOR TO SIGN A PLAT OF EASEMENT ACCEPTING
EASEMENT RIGHTS TO RANDHURST VILLAGE PROPERTY FOR THE PURPOSE OF OPERATING AND
MAINTAINING STREET LIGHTING EQUIPMENT.
This Resolution authorizes the Mayor to sign a plat of easement accepting easement rights to
Randhurst Village property for the purpose of operating and maintaining street lighting equipment.

AMENDMENT TO AN INTERGOVERNMENTAL AGREEMENT O. THE ACQUISITION OF INTEREST IN

This resolution authorizes the Mayor or representative to execute a first amendment to an existin;
intergovernmental agreement with the Forest Preserve District of Cook County granting additiona
easement area to the Village and City of Prospect Heights for the construction of a supplemental
storm water pumping station at Levee 37. The proposed resolution also authorizes the mayor or
representative to sign a plat indicating acceptance of the new easement area.
