Recommended Action Approve this annual agreement required by Court Order which authorizes the Village to
provide emergency services to those in the Forest River Fire Protection District.
Information
The Mount Prospect Fire Department provides emergency response to areas outside the Village corporate
boundaries which fall within the Forest River Fire Protection District. In 1971, the Village of Mount Prospect decided
to pursue annexation of a majority of the area referred to as the Forest River Fire Protection District. After a formal
evaluation, the Village decided not to pursue annexation of two areas within the District. These areas are:
1. The area bounded by Kensington Road, River Road, Gregory Street, and the Canadian National
Railway tracks.
2. The area bounded by Seminole Lane, Mandel Lane, Camp McDonald Road, and Wolf Road.
As a result of the Village's 1971 annexation decisions, the Circuit Court of Cook County imposed a Consent Decree
stipulating that the Forest River Fire Protection District continue to levy taxes at the maximum rate authorized by
statute. These funds were required to be given to the Village of Mount Prospect as payment for emergency response
services.
The proposed resolution is the annual resolution adopting the agreement between the Village and the District.
The Agreement may be subject to modification since the Village has filed a court action in the Circuit Court of Cook
County seeking to have the 1971 Agreed Order modified so that the costs for fire protection, fire prevention and
emergency medical services will be more equitably distributed between Mount Prospect and Forest River Fire
Protection District residents.

stormwater volume control system.

The redevelopment agreement between 20West, LLC and the Village of Mount Prospect, as amended, stipulates a
grant of license to utilize Village property for the purpose of satisfying the Metropolitan Water Reclamation District of
Greater Chicago (MWRDGC) stormwater volume control requirements.
Stormwater volume control requirements are facilities designed to capture the first inch of rainfall from a
development site. The first inch of rainfall usually contains the highest concentrations of pollutants. Capturing the
"first flush" of rainfall, ultimately improves the health of local waterways and can reduce the overall volume of rain
water discharged to local sewers. Volume control measures are required of all real estate development sites in Cook
County larger than a half -acre. These measures are permitted and enforced by the Metropolitan Water Reclamation
District of Greater Chicago in its role as the primary stormwater management agency for Cook County.
In this instance, the volume control facilities include permeable clay pavers installed upon a specialized stone base.
A perforated storm sewer is installed at the bottom of the backfill. The design is intended to collect rainwater and
allow it to percolate into the ground beneath the brick pavers rather than directly discharged to a local storm sewer.
For reference, a typical cross section depicting the volume control measures installed for the 20 West site is
enclosed as Attachment A.
Attachment A also includes a layout map depicting the volume control area. Please note that the volume control is
installed on 20 West property as well as property and public right-of-way owned by the Village.
In summary, the agreement grants 20West, LLC the right to use Village property for the purpose of operating and
maintaining MWRDGC-required stormwater volume control systems. It also stipulates maintenance, repair, and
replacement responsibilities for the volume control features. Notably, 20West, LLC, and all subsequent owners, will
be responsible for cleaning and sanding the permeable paver bricks, maintaining backfill, cleaning the underdrain,
and ultimately replacing worn components at end of useful life. The Village will provide snow removal and street
sweeping services in a manner and frequency consistent with other Village -owned streets. In addition, 20West is
responsible for regulatory compliance and coordinating annual inspections of the volume control system with Village
staff.
The Long -Term Maintenance and License Agreement enclosed as Attachment B memorializes these terms. This
document, once executed, will be recorded against the title of parcels that comprise the 20West development at the
Office of the Cook County Recorder of Deeds.

Recommended Action Accept the proposal from Vigilant Solutions to purchase a License Plate Recognition
System at a cost not to exceed $46,779.00.
The Police Department is seeking to purchase a License Plate Recognition (LPR) system for use within the Village.
The department will equip two (2) vehicles with LPR units. The first unit will be mounted on a marked police squad

car, utilized for both law enforcement and parking enforcement purposes. The law enforcement purposes are
locating stolen vehicles, wanted subject vehicle identification and other investigative tasks.
The second unit, mounted on a marked parking enforcement vehicle, will be solely used for parking enforcement
duties. These duties will include: Permit parking enforcement, Metra lot enforcement, and time -zone enforcement
(e.g. 2 hour parking). The time -zone enforcement, known as "digital chalking," will enable the Police Department to
record the GPS location of parked vehicles without physically chalking tires, and then alert the parking enforcement
officer when it records a vehicle parked beyond the allowed time limit. Due to litigation involving other communities,
the Police Department has discontinued physically chalking tires. Vigilant LPR system will provide a solution to this
issue, allowing the Police Department to enforce time -zoned parking areas within the village.
Research Findings
In researching LPR systems, the most common systems used in the area are provided by Vigilant Solutions and
Genetec. Based on the operational needs of the Mount Prospect Police Department, the Vigilant Solutions License
Plate Recognition (LPR) system appears to be the system best suited to meet those needs. The Vigilant Solutions
LPR system provides both parking enforcement as well as criminal investigation capabilities in a simple to use
system.
The benefits of the law enforcement system are:
• A "Hot List" will be uploaded into the system that will identify stolen or wanted vehicles as license plates are
scanned throughout the community.
• Vehicle location data is available from LPR systems throughout the country, allowing access to data collected
from over 2000 law enforcement agencies and thousands of commercial databases.
• Intelligent data analytics allow for investigators to search for vehicles by entering make, model and/or year of
a suspect's vehicle in order to develop investigative leads.
The benefits of the parking system are:
• Digital Chalking: Replaces the system of manually chalking a tire with GPS tracking and photographic
evidence of the vehicle remaining beyond the posted time limit for timed parking.
• Village Parking Permit Checks: After uploading a current parking permit list from the Village, any
unauthorized vehicles parked in a "Permit Only" location will be identified as parking enforcement officers
drive past, allowing these vehicles to be cited accordingly.
Metra Lot Payment Violations: Pending the software integration with the Metra Lot pay stations, commuters'
license plates will be provided in the pay portals and/or the payment apps, and the parking enforcement
officers will be enabled to drive through the parking lots and identify any non -paid vehicles quickly and
efficiently.
• Scofflaw Detection: After uploading a list of vehicles with unpaid parking citations, alerts are generated once
an offending vehicle is located allowing for the Village's boot list process to occur.
System Cost
The total cost of the Vigilant Solutions System, which includes all required hardware, software, training, data access,
and related support is $46,779.00. Funds are available for this purchase from the Police Department Capital
Investment Software Account #: 020.60.90.00.0.707.561.010.
Single Source Vendor Justification
The options and features available with the Vigilant Solutions LPR system make them the best choice for the
department's LPR needs. Research into the Genetec System indicated a base line cost ($51,362.45 without the
quoted Panasonic Toughbooks) higher than the Vigilant Solutions System. Additionally, the Genetec System fell
short in regard to criminal investigative software capabilities, commercial database access and ease of operation.
Vigilant Solutions is the sole source provider for their license plate recognition (LPR) data sharing initiative that
consists of over 8 billion license plate scans that the Department can use for investigative purposes, furthering the
detection of criminal activity and public safety for the Mount Prospect community.
In reviewing the parking enforcement side of the program, representatives from Vigilant Solutions came to Mount
Prospect and demonstrated the software in our downtown business district for staff to see how it works in our
environment. Vigilant representatives were able to quickly set up timed parking areas within the downtown area and
run timed parking checks within minutes. The ease of setting up these time zones and using the system greatly

impressed staff. Staff also visited a neighboring agency using the Genetec System and did not find that system as
easy to use as the Vigilant System.

The Petitioners, Anna Soltys and Dariusz Zdanowski, propose to perform several site improvements, including
constructing a larger attached garage. The current attached garage has just over a four and a half foot (4.54') side
yard setback to the north. Thus, the primary structure is existing non -conforming. The proposed remodeled house,
and larger attached garage would result in a two and a half foot (2.5') side yard setback. The property is zoned R -A
Single Family Residential, and requires a five foot (5') side yard setback. A variation to deviate from the current
setback standards set forth in the R -A Single Family Residential section of the Village Code is required. The table
below outlines the existing and proposed bulk regulations to the R -A Single Family Residential district:

Village staff believes the Petitioner's request does not meet the standards for a variation and is therefore not
supportive of the request. The property is not unique, as 10 of the 21 properties on the block of the Subject
Property have an identical lot width of forty-eight feet (48'). The property allows for modifications to the
architectural plans to accomplish additional garage space without requiring a variation to this extent; there is ample
space in the rear of the property to construct a detached garage, or a side load attached garage. Additionally, per
the non -conforming structure regulations in the Village Code, the Petitioner may construct a back to back (tandem)
garage utilizing the existing non -conforming setback. The Public Works Department has also determined that
granting the variation request could compromise the drainage for the property and surrounding properties. A two
and a half foot (2.5') side yard setback is insufficient to insure a drainage flow path is maintainable.
The Petitioner provided five letters in support of the variation request, including the adjacent neighbor to the north.
At the Public Hearing held on December 12, 2019, after hearing no objections and four neighboring properties
speaking in favor of the variance, the Planning and Zoning Commission recommended approval of the Petitioner's
request for a variation by a vote of 4-2.
The applicant is requesting a waiver of a second reading; request letter is attached.

curriculum in the Village of Mount Prospect since 1976. They operate out of 805 Burning Bush Lane, which is owned
by the River Trails School District, and need to move because the River Trails School District is planning to reuse the
space currently occupied by Park View Montessori. The proposed new location for the daycare is 1601 Feehanville
Drive, which is zoned I-1 Limited Industrial and has a multi -tenant industrial building at the southeast corner of
Business Center Drive and Feehanville Drive. The daycare requires conditional use approval to operate in the I-1
District.
On May 7, 2019, the Petitioner received conditional use approval to operate a daycare in a space within the
shopping center known as Golf Plaza II, located at 1000-1080 S. Elmhurst Road (Ordinance No. 6454), but is no
longer moving forward with that location and is pursuing to locate at the subject property. The new location will
better meet the needs of the daycare center.

The Petitioner is proposing to operate a daycare center out of an existing office space at the Subject Property. The
daycare would operate Monday through Friday between the hours of 6:30 AM - 6:00 PM. The proposed service is
designed for children aged 6 weeks through 6 years old. Drop off times are planned for 6:30 AM - 9:00 AM, and pick
up times are planned between 3:00 PM and 6:00 PM. The Petitioner plans to provide 20 staff members and care for
up to 125 children at one time. The proposal includes an outdoor playground area along Feehanville Drive.
The Village Code requires parking based on land use. The proposed daycare will require 1 space per every 10
licensed capacity slots and 1 space for each employee, and will bring the overall parking requirement for the multi -
tenant building to 188 parking stalls. The subject property will exceed the required parking by providing 231 parking
stalls. Of the 231 stalls provided, 8 would be reserved for daycare drop off and pick up. Six existing stalls are to be
removed in order to accommodate the proposed outdoor playground area at the northeast corner of the Subject
Property. The table below provides a parking analysis.

Village Staff believes that the Petitioner's conditional use request complies with the conditional use standards and is
supportive of the request. Other departments reviewed the Petitioner's proposal and did not object to the use,
subject to the fire safety concerns being addressed before occupancy is granted. The proposed use will not be a
detriment or endanger the welfare of the general public. Conditional uses have been granted for similar businesses
in the immediate area including Search Development School at 625 Slawin Court, The Gymnastics Shop at 600 N.
Wheeling Road, Lakeshore Academy at 520 Business Center Drive, and MedTec Healthcare at 411 Business Center
Drive. The proposed use complies with the Comprehensive Plan and furthers services available to workers in the
business park.
Staff received a few phone calls from workers in the Kensington Business Center area asking for information on the
request. No one spoke negatively of the conditional use request. Staff recommends that the Village Board approve
the conditional use request for a daycare center located at 1601 Feehanville Drive.
P&Z Recommendation
The Planning and Zoning Commission voted unanimously to recommend approval of the conditional use request by a
vote of 6-0 at the public hearing on December 12, 2019.
The Petitioner submitted a request to waive the second reading (see attached waiver request), and asks for the
Board to take final action at the January 7, 2019 meeting.
Alternatives
1. To adopt an ordinance for a conditional use for a daycare center located at 1601 Feehanville Drive, subject to the
conditions in the attached ordinance.
2. Action at discretion of Village Board.

10. Rand Road Corridor Study - TP
The Petitioner, Everclean CW, LLC. is requesting conditional use approval to allow for a car wash, and parking lot
variations to the side yard setbacks for the property known as 300 E. Rand Road (subject property). The conditional
use request meets the goals of the Rand Road Corridor Study and the future land use map of the Comprehensive
Plan.
The Subject Property is located on the north side of Rand Road and is currently vacant. The Subject Property is
bordered by the R-1 Single Family Residential zoning district to the east, and the B-3 Community Shopping zoning
district on all other sides. A portion of the existing parcel which fronts Kensington Road will be subdivided off to 401
E. Kensington Road in conjunction with a new senior housing facility, which received board approval earlier this year.
As part of that approval, a new Plat of Subdivision is required to properly subdivide that piece of property to the
future facility.
The proposal consists of three (3) drive-through pay station bays (21 stacking spaces overall), a central car wash
facility, eighteen (18) vacuum stalls to the west, nineteen (19) vacuums, and seven (7) employee parking stalls. The
proposed facility will operate from 7 A.M.-8 P.M. Monday -Saturday, and 7 A.M.-5 P.M. on Sunday. The business will
employ 2-3 employees per shift, with a maximum of six (6) employees during peak times. The Petitioner proposes
to encroach into the required parking lot setbacks along the interior side yard property lines (east and west). A B-3
zoned parcel requires ten foot (10') minimum interior side yard setbacks; however, the Subject Property to the east
abuts single-family residences thus requiring a twenty-five foot (25') transitional setback to the east. The proposal
has a five foot (5') interior side setback to the west and a ten and one tenth foot (10.1') interior side setback to the
east. The Petitioner will provide heavy landscaping and a six foot (6) privacy fence on the eastern property line to
properly screen the carwash from the adjacent homes.
Staff received two letters, one in general support of the development with a concern regarding the retaining wall to
the west, and one against the proposal which referenced concern to the noise the proposal would bring. Staff also
received a video clip demonstrating the noise at the Everclean establishment located in Hanover Park which is
attached.
At the Public Hearing held on December 12, 2019, one resident attended the meeting to voice his concerns with
potential noise issues from the proposed car wash. The owner of the adjacent Animal Hospital also testified with
questions about a proposed retaining wall's height, to ensure that the signage to his business was not obstructed.

At the December 12 meeting, the Planning and Zoning Commission recommended approving the Petitioner's request
for a conditional use and variations by a vote of 6-0, subject to the following conditions:
• Development of the site in general conformance with the site prepared by Haeger Engineering dated October
11, 2019;
• Development of the building in general conformance with the elevations prepared by Barker/Nestor
Architectural Design dated October 10th , 2019;
• Compliance with all Development, Fire, Building, and other Village codes and regulations;
• Submittal of an irrigation plan;
• Submittal of a landscape plan which complies with Village Code requirements and exceeds perimeter
landscaping requirements along the eastern property line;
• All exterior lighting shall be full cutoff and pointed straight down;
• Forty-five (45) degree angled parking stalls shall measure 12.7' in width and 17.5' in length;
• Trash and vacuum equipment enclosures shall be effectively screened from all sides with brick walls and
metal doors that are not less than six feet (6');
• Retaining wall to the west shall not block the view of the existing monument sign of 212 E. Rand Road from
the right-of-way (ROW);
• All rooftop units shall be screened from the public right-of-way and property line of all adjacent residentially
zoned property;
• Submittal of a preliminary and final building code analysis; and
• Subject to IDOT and MWRD approval.

Staff Recommendation
Staff believes that the proposed conditional use and parking lot variations meet the conditional use and variation
standards, subject to complying with the conditions listed. The proposal is consistent with development along the
Rand Road Corridor and with several long-range planning documents adopted by the Village. Based on these
findings, staff recommends that the Village Board approve the conditional use and parking lot variation requests.
The applicant has submitted a letter requesting the Board waive the second reading so work on the site can begin as
soon as possible; the letter is attached.
