ORDINANCE NO. 2217
AN ORDINANCE AMENDING ORDINANCE NO. 466. GRANTING A USE
.VARIATION FOR PROPERlY LOCATED AT 401 i'lEST PROSPECT
vJHEREAS. the Board of -Appeals of the Village of Mount Prospect did rreet on
January 9, 1970, at the hour of 8:00 P.M. in the Village Hall to hold a public
hearing under Case No. 70-lA, pursuant to proper legal notice; and
l,;JHEREAS. the Board of Appeals of the Village of Mount Prospect did hear a peti-
tion requesting a variation 1:0 place an addition upon a medical - dEntal build
ing pre-existing under a variation granted by Ordinance No. 466; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect has recommended
to the President and Board of Trustees of the Village of Mount Prospect the
granting of this additional variation by a vote of 4-0 and has found that
1. There is a practical hardship on the petitioner in that his
present building exists and operates under a previous var-
iation granted by Ordinance No. 466. passed and approved
November 3, 1955;
2. The purpose of the variation is not ba'3ed exclusivley upon
the desire to make money;
3. The granting of the variaiton will not be detrimental to the
public or injurious to surrounding property in that it will
not alter the essential character of the locality; and
WHEREAS, the Building Committee of the Board of Trustees of the Village of
Mount Prospect did subsequently meet on January 14, 1970. and considered Case
No. 70-lA, and recommended to the President and Board of Trustees that the var-
iation requested under the said Case No. 70-lA be granted; and
WHEPEAS, the President and Board of Trustees have reviewed the matter herein
and have determined that the same is for the best interests of the Village of
rtlOunt Prospect;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDE~1T AND BOARD OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Section One of Ordinance No. 466 be and is hereby amended
by placing therein the legal descriptions of two (2) additional lots (28 and
29) and other wordmg allowing an addition to the existing constructed building
upon the subj ect property and utilized as a medical - dental center; so that
hereafter the said Section One of Ordinance No. 466 shall be and read as
follows:
"SECTION ONE: That the property legally described as follows:
"lots 28. 29 and 30 in H. Roy Berry Co.'s Colonial IVanor
a subdivision of part of the northeast quarter of Section
11 and part of the northwest quarter of Section 12, Town-
ship 41 North, Range 11, East of the Third Principal ~~e-
ridian in Cook County. Illinois;"
is currently zoned under the Zoning Ordinance of the Village of Mount Prospect
as R-3 (Apartment Residence District) which zoning classification shall remain
subject to the variations granted herein.
A. That the above-described property may be improved with a

building addition containing 1427.50 usable square feet
with adjoining parking for a total building area of 2808.64
square feet, which construction shall be made and parking ; ,
arrangedpursuant to the plans and specifications attached
hereto and made a part hereof;
B. That the above-described property may be used and maintained
as a medical - dental professional office building;
C. That the parking area shown on the said attached plans
shall be used in such fashion that entry thereto shall be
from the adj acent alley, and exit therefrom shall be into
Prospect Avenue;
D. That the three (3) lots described above shall be resub-
divided into one (1) lot and further that the subdivider
execute and deliver to the corporate authorities of the
Village of Mount Prospect Performance Bond for the improve...
ment according to the specifications of the Village of the
entire alley adj acent to the sugj ect property -- which
bond shall be in an amount 10% in excess of the cost of the
proj ect as estimated by the Village Engineer."
SECITON TV10: That all requirements of the Buildihg Code and Zoning Code of th
Village of Mount Proppect shall be applicable. except the variations noted
in SECTION ONE above.
SECTION THREE: That the Director of Building and Zoning of the Village of
Mount Prospect is hereby authorized to issue a Building Permit for constructio
in accordance with the plans hereinbefore mentioned and attached hereto and
made a part hereof.
SECTION FOUR: That the expansion of the existing variation granted by this
ordinance shall be null and void and of no force whatsoever unless an appli-
cation for a Building Permit pursuant to this arrnrendatory ordinance is made
and construction commenced within one year of the date this ordinance
becomes effective.
SECTION FIVE: That this ordinance shall be in full frrce and effect from and
after its passage, approval, and publication in the roamer provided by law.
