ORDINANCE NO. ~
AN ORDINANCE AMENDING PORrIONS OF ARTICLE III OF CHAPTER 25
OF THE MUNICIPAL CODE
NOd, rl'HEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COtJNTY I ILLINOIS:
SECTION ONE: That Section" 25.301 of the Mmicipal Code of Mount Prospect
<if 1957, as arrended, be further arrended in its entirety by substituting
therefor entirely new provisions defining and regulating "disorderly con-
duct", so that hereafter the said Section 25.301 shall be and read as
follows:
"SECTION 25.301 - DISORDERLY CONDUCT.
A. It shall be unlawful for any person to disturb the
peace and quiet of the Village of ~bunt Prospect
or any portion thereof by disorderly conduct.
B. Disorderly conduct shall be committed by any person
when he either:
(1) Knowingly does any act in such unreasonable
manner as to provoke, J:!1.f)ke.. or .?.id in the
making of a breach of the peace; or
(2) Resists or obstructs the performance by one,
who may reasonably be believed to be a police
officer, of any authorized act within such
officer's official capacity; or
(3) Assenbles with three or more persons for the
purpose of using force or firearms to disturb
the public peace; or
( 4 ) Fails to observe lawful order of dispersal
by any person who may reasonably be believed
to be a police officer, where three or more
persons are committing acts of disorderly
conduct in the i~diate vicinity, which
acts are likely to cause substantial harm
or serious incovenience, annoyance, or alarm;
or
(5) Knowingly enters upon any school property,
public or private, within the Village at any
tine when other persons are present on such
school property, for the purpose or with the
intention of making or doing any unreasonable
or offensive act, utterance, gesture, or dis-
play; or
(6) Knowingly enters upon any school property,
public or private, within the Village at any
tirr:e when other persons are present on such
school property, and while thereon makes or
does any unreasonable or offensive act,
utterance, gesture, or displa.,y, which disrupts
or interferes with or tends to disrupt or inter-
fere with administrative functions, educational
classes, or social and athletic activities
then and there in progress; or
(7) Resists any officer of the Police Departrrent
of the Village of Mount Prospect in the dis-
charge of his duties or in any way interferes
with or hinders or prevents him from dis-
charging his duty as such officer, or offers
or endeavors to do so or assists any person
in the custody of any rrenber of the Police
force to escape or attempt to escape from. such
custody, or attempts to rescue any person in
such custody; or
(8) Creates disturbance of public order by an act
of violence or by an act likely to produce
violence; or
(9) Engages in fig,hting, threatening, or tunul-
tuous behavior; or
(10) Hinders, annoys, or molests persons passing
along any street, sidewalk, cross walk, or
other pUblic way; or
(11) Loiters, sits, or stands around the entrance
of any church, theatre, public building or
other place of public assemblage, in any
rnanner so as to unreasonably obstruct such
entrance; or
(12) Places or erects upon any public way an
obstruction of any type except temporary
barriers or warning signs placed thereon
for the purpose of safeguarding the public
against any hazard; or
(13) Disturbs, threatens, or in an insolent manner,
intentionally damages any occupied house or
vehicle; or
(14) Intentionally inhales vapors or runes or any
substance which induce euphoria., hallucina-
tions, or intoxication - - except as other-
wise provided by law; or
(15) Visits or resorts to any place wherein the
inhaling of vapors or fumes or any substance
which induces euphoria, hallucinations, or
intoxication, is being conducted, practiced,
or carried on illegally therein; or
(16) Makes continuous or causes to be made by the
use of any horn, bell, radio, loud speaker,
or by operation of any other instrument or
divice, any unreasonably loud, disturbing,
and unnecessary noise or noises, which noise
or noises are of such character, intensity,
and duration as to disturb the peace and
quiet of the Village of Mount Prospect or
any portion thereof or to be detrimental to
the life and health of any individual."
SECTION TWO: That section 25.314 of the ~unt Prospect MUnicipal
Code of 1957, as a.rrended, be and is hereby further. arrended by re-
lettering the existing paragraph as paragraph "A" and adding thereto
additional paragraphs "B" and "C", regulating the carrying of fire-
arms or facsimile weapons, so that the said Section 25.314 shall
hereafter be and read as follows:
"SECTION 25.314. FIREARMS OR FACSIMIIE WEAPONS.
A. It shall be unlawful to discharge any firearms or
airgun in the Village; provided that this section
shall not be construed to prohibit any officer of
the law from discharging a firearm in the per-
formance of his duty; nor to any citizen to dis-
charge a firearm when lawfully defending his per-
son or property.
B. It shall be unlawful for any person to carry in
any vehicle or concealed or unconcealed on or
about his person any firearm; except that this
paragraph shall not apply to any private person
when on his own land or in his O\Iffi abode or place
of business or pea.ce officers; members of the arrr.ed
services or reserve forces of the United States;
special agents employed by railroads to perform
police functions; employees of watchmen-guard
agencies ; private detectives and private patrolrren
while on the premises of their employers and actu-
ally engaged in the performance of the duties of
their employrrent; rrenbers of any firearm club or
organization while commuting between their horres
and such target ranges; persons transporting weapons
between a duly licensed firearrrs dealer and his
residence or place of business; duly authorized
military or veterans organizations; school color guards
and drill organizations; and licensed hunters and
fisherrr.en while engaged in hunting or fishing and/or
commuting between their homes and such hunting or fish-
ing grounds.
C. It shall be unlawful for any person to carry or
display any facsimile of a firearm with the intent
to terrify, alarm, threaten, or intimidate any
other person."
SECTION THREE: That Sections 25.327 and 25.328 .of the Municipal Code
of Mount Prospect of 1957, as amended, be and are hereby further amended
by interposing the existing text of one for the other and raising the
minimuin penalty from $1.00 to $10.00, so that hereafter the said Sections
25.327 and 25.328 shall be and read as follows:
"SECTION 25.327. No intoxicated person shall enter,
be or remain in any public park, playground or swirnri.ng
pool, nor shall any person bring into, sell, give away or
drink any alcoholic liquors in any public park, playground
or swimming pool. The term "alcoholic liquors" as used
herein shall be defined by Section 13.101 of the Municipal
Code of rllount Prospect.
SECTION 25.328. Penalty. Any person, firm or corporation
violating any provision of this Article shall be fined not
less than Ten Dollars ($10.00) nor more than TI'lO Hundred
Dollars ($200.00) for each offense."
SECTION FOUR: That Section 25.329 of the MUnicipal Code of Mount Prospect
of 1957, as arrended, is hereby repealed.
SECTION FIVE: That, if any part or parts of this ordinance shall be
held to be unconstitutional, such unconstitutionality shall not
affect the validitJT of the remaining parts of this ordinance; and
that the President and Board of Trustees hereby declare that they
would have passed the remaining parts of this ordinance if they had
known that such part or parts thereof would be declared unconstitutional.
SECTION SIX: That this ordinance shall be in full force and effect from
and after its passage, approval, and publication in the manner provided
by law.
