ROLL CALL Present upon roll call: Edward Cavello, Fire Chief/President Richard Jesse, Treasurer Delbert Ulreich, Firefighter Randy Werderitch, Firefighter Donald Barra, Retired Firefighter Stewart McKillop, Firefighter Carol A. Fields, Village Clerk/Secretary Absent: Carolyn Krause, Mayor Village Attorney CONSIDER REQUEST FOR DISABILITY PENSION FROM DAVID GOLD An application for duty incurred disability was received by the Secretary of the Fund on March 18, 1988. The request is based on an injury that occured on February 10, 1979. Carol Fields noted that the Pension Board had considered a request for duty incurred disability pension from David Gold in late 1980 or early 1981. Three medical opinions were obtained at the direction of the Medical Committee, along with an opinion from a 4th doctor not chosen by the Medical Committee, all resulting in the same opinion - that David Gold could not perform the duties of a firefighter, but could function in the position of Fire Inspector. Inasmuch as there was an opening for the position of Fire Inspector at that time and due to the fact such position is related to the fire service, Chief Pairitz offered David Gold the position of Fire Inspector, which he accepted. ZaseQ on the fact that David Gold accepted the position of Fire Inspector the Pension Fund Board voted unanimously to deny the request. A recent administrative directive has ordered David Gold back to duty as a firefighter and Carol Fields stated that no information had been supplied to the Pension Board indicating any change in physical status relative to David Gold's physical condition. Chief Cavello stated that David has undergone medical examinations in line with the department policy and those examinations indicated there was no physical problem. As Secretary of the Fund, Carol Fields again requested that any such reports be forwarded to her so they could be included in the Pension Fund files. Chief Cavello stated that it is his opinion that the request for disability being the subject of this meeting is a new filing and that David Gold was not assigned to the position of Fire Inspector as a result of an injury. Special Meeting, Pension Board March 24, 1988 Page 2 of 2 At the time of the 1981 decision of the Pension Fund Board to deny, David Gold had also requested the Board to authorize specialized treatment at a clinic in Wisconsin. That request was withdrawn by the Petitioner. There was also discussion as to whether the request considered in 1981 was withdrawn or denied. Carol Fields made a motion to accept the medical opinions obtained in 1981. The motion failed for lack of a second. In line with the procedures established by this Board, David Gold will be required to obtain medical opinions from three doctors, the doctors to be chosen by the Medical Committee. Each doctor will be provided a copy of the duties involved with a firefighter/paramedic. Following receipt of those reports the Medical Committee will make a determination and issue a recommendation of their findings to the entire Board. Donald Barra, seconded by Randy Werderitch, moved to remand this matter to the Medical Committee. Upon roll call: Ayes: Cavello, Werderitch, McKillop, Barra, Jesse, Ulreich, Fields Nays: None Motion carried. David Gold, along with his attorney Mr. Gudgeons, was in attendance at the meeting. Mr. Gudgeons stated that a letter had been hand delivered to the Fire Chief requesting David Gold to be returned to the position of Fire Inspector but had received no response. Chief Cavello stated that the order to return to shift duty is an administrative function and not a matter for discussion by the Pension Board nor a matter for the attorney. This request from David Gold for disability pension will be considered' at a future date when the medical opinions have been received and reviewed by the Medical Committee and the Pension Fund Board. Richard Jesse, seconded by Del Ulreich, moved to adjourn the meeting. Upon roll call: Ayes: Unanimous Motion carried. The Special Meeting was adjourned at 8:53 A.M. Carol A. Fields Secretary
