HomeMy WebLinkAboutOrd 2225 02/17/1970 '~" . ...-.... ~, ~ ORDINANCE NO. 2225 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED ON THE NORI'H- EAST CORNER OF KENSINGTON AVENUE AND EIMHURST ROAD (ILLINOIS RTE. 83) WHEREAS, the Board of Appeals of the Village of Mount Prosepct held public hear ings on November 22, 1968 and on January 22, 1969 at the hour of 8:00 p.m. in the Mount Prosepct Village Hall pursuant to proper legal notice; and WHEREAS, the Board of Appeals of the Village of Mount Prospect heard testimony presented under Case No. 68-66A pertaining to a request to erect an office building 136 feet high on the south end of property described hereinunder; and WHEREAS, the Board of Appeals recornrrended to the Judiciary Committee of the Board of Trustees of the Village of Mount Prosepct to allow the variation on th subject property for the height petitioned for; and WHEREAS, the Judiciary Committee of the Board of Trustees of the Village of Mount Prospect subsequently met and considered the recommendations of the Board of Appeals under Case No. 68-66A; and WHEREAS, the Judiciary Committee recorrmmded to the President and Board of Trustees of the Village of Mount Prospect to allow the variations as presented; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have reviewed the natter herein and have determined that the same is for the best interests of the Village of Mount Prospect; NmJ, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT: SECTION ONE: That the property being the subject rnatter of Case No. 68-66A, being legally desCribed as follows: Parcel 1 'lhe West half of the Southeast quarter of Section 27, Township 42 North, Range 11, East of the Third Principal Meridian (ex- cept that part thereof falling in a 100 foot strip conveyed to the County of Cook by deed recorded May 6, 1941 as document 12674702 and filed May 6, 1941 as document LR 895623, the center line of which is described as follows: Beginning at the Northwest corner of the Southeast quarter of Section 27 aforesaid; thence East along the North line of said Southeast quarter, a distance of 550 feet to a pOint of curve; thence in a generally Easterly direction along a curved line tangent to said North line of the Southeast quarter, convexed Northerly, and having a radius of 24,555.35 feet, a distance of 1028.57 feet to a point of tangency; thence in a generally Easterly direction along a straight line tangent to the last described curved line a distance of 165.03 feet to a point of curve; thence ~ ,~. . /~ ~, in a generally Easterly direction along a curved line tangent to the last described straight line, convexed Southerly, and having a radius of 24,555.35 feet, for a distance of 1028.57 feet); also Parcel 2 The West 460 feet, as measured along the North line, of the East half of the Southeast quarter of Section 27, Township 42 North, Range 11, East of the Third Principal Meridian (except that part thereof falling in a 100 foot strip conveyed to the County of Cook by deed recorded October 8, 1941 as document 12771139, the center line of which is des- cribed as follows: Begiming at the North- west corner of the Southeast quarter of Section 27 aforesaid; thence East alcng the North line of said Southeast quarter, a distance of 550 feet to a point of curve; thence in a generally Easterly directicn along a curved line tangent to said North line of the Southeast quarter, con vexed Northerly, and having a radius of 24,555.35 feet, a distance of 1028.57 feet to a point of tangency; thence in a generally Easterly direction along a straight line tangent to the last described curved line, a distance of 165.03 feet to a point of curve; thence in a generally Easterly direction along a curved line tangent to the last described straight line, convexed Southerly, and having a radius of 24,555.35 feet, for a distance of 1028.57 feet; and also except the North 70 feet of the West 70 feet or the South 120 feet of said East half of the Southeast quarter of Section 27) all in Cook Coutny, Illinois;' is cUITent1y zoned under the Zoning Ordinance of the Village of Mount Prospect as B-3 (Business - Retail and Service) which zoning classification shall remain subj ect to the following granted variations: (a) That the owners of the land described above shall have the right to construct an office building having a naxirnum height of 136 feet or ten (10) stories, whichever is the lesser, and such building shall be freestanding - being in no way connected or joined to the existing shopping center complex thereon. (b) That one parking space shall be provided for each 200 square feet of gross floor area of said office building rather than the four (4) square feet of parking area for every one (I) square foot of noor area required for the existing Shopping center com- plex. (c) That the building set back from all lot lines shall be not less than the total height of the said building, and the minimum ~ ',-' ,- horizontal distance between the said orfice building and any other building shall be equal to the heigl1t of the tallest building from which the measurement is taken. SECTION TWO: That all requirements of the Village Code be applicable, except those variaitons as specified in Section One heretofore mentioned. SECTION THREE; That the Director of Building and Zoning of the Village of Mount Prosepct is hereby directed to issue a building permit in accordance with the variations hereinbefore mentioned. I SECTION FOUR: That the variations granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variations is made and construction cormnenced wi thin one year of the date said: ~ance becomes effective. SECTION FIVE: This Ordinance shall be in full force and effect from and after its publication and approval in the manner providedby law.
