ORDINANCE NO. 2238
.AN ORDINANCE GRANTING A VARIATION FOR A FREE-STANDING BUILDING
FOR USE AS JEWEL-OS CO STORE LOCATED AT THE RANDHURST SHOPPING CEN'IER
WHEREAS. the Board of Appeals of the Village of Mount Prospect held a
regular meeting on May 7. 1970. at the hour of 8: 00 P. M. in the Mount
Prospect Village Hall pursuant to notice published on April 22. 1970. in the
manner proVided by law; and
WHEREAS. the Board of Appeals of the Village of Mount Prospect heard
testimony presented under Case No. 70-8A pertaining to a request to
construct a free-standing building as part of a shopping center on said
property described hereafter; and
WHEREAS. the Board of Appeals have recommended to allow the variation
for reasons that:

1. The particular physical surroundings. shape. or
topographical condition of the specific property
involved would result in a practical difficulty
or particular hardship upon or for the owns!'.
lessee or occupant. as distinguished from a mere
inconvenience, if the strict letter of the regulations
were carried out by construction of the proposed
addition in a manner contiguous to the integrated
building arrangement of the existing shopping center
building;
2. The conditions upon which the petition for a
variation is based are unique and would not be
generally applicable to other property within
the B-3 zoning classification;
3. The punpose of the variation is not based exclusively
upon a desire to make more money out of the property;

4. The particular difficulty or hardship has not
been created by any person presently having an
interest in the property;
5. The granting of the variation will not be materially
detrimental to the public welfare or injurious to
other property or improvements in the neighborhood
in which the property is located; and
6. The proposed variation will not impair an adequate
supply of light and air to adj acent property. or
substantially increase the congestion in the public
streets, or increase the danger of fire. or
endanger the pUblic safety. or SUbstantially diminish
or impair property values within the neighborhood; and
WHEREAS. the President and Board of Trustees of the Village of
Iv'bunt Prospect subsequently met on May 19. 1970. and concurred with
the recommendations of the BeaPd of Appeals under Case No. 70-8A;

WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have reviewed the matter herein and have determined
that the same is for the best interests of the Village of Mount
Prospect.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT ~~D BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That the property being the subject matter of
Case No. 70-8A, being legally described as:
The West half of the Southeast quarter of Section 27$
Township 42 North, Range 11, East of the Third Principal
Meridian (except that part thereof falling in a 100 foot
strip conveyed to the County of Cook by deed recorded
~1ay 6, 1941~ as document 12674702 and filed May 6~ 1941,
as document LR 895623, the center line of which is des-
cribed as follows: Beginning at the Northwest corner
of the Southeast quarter of Section 27 aforesaid; thence
East along the North line of said Southeast quarter, a
distance of 550 feet to a point of curve; thence in a
generally Easterly direction along a curved line tangent
to said North line of the Southeast quarter, convexed
Northerly, and having a radius of 24,555.35 feet, a
distance of 1028.57 feet to a point of tangency; thence
in a generally Easterly direction along a straight line
tangent to the last described curved line a distance of
165.03 feet to a point of curve, thence in a generally
Easterly direction along a curved line tangent to the
last described straight line, convexed Southerly, and
having a radius of 24,555.35 feet~ for a distance of
1028.57 feet); also

The West 460 feet, as measured along the North line,
of the East half of the Southeast quarter of Section 27,
Township 42 North, Range 11, East of the Third Principel
Meridian (except that part thereof falling in a 100 foot

of which is described as follows: Beginning at the
Northwest corner of the Southeast quarter of Section 27
aforesaid; thence East along the North line of said
Southeast quarter, a distance of 550 feet to a point
of curve; thence in a generally Easterly direction
along a curved line tangent to said North line of the
Southeast quarter, convexed Northerly~ and having a
radius of 24,555.35 feet, a distance of 1028.S7 feet
to a point of tangency; thence in a generally Easterly
direction along a straight line tangent to the last
described curved line, a distance of 165.03 feet to a
point of curve; thence in a generally Easterly direc-
tion along a curved line tangent to the last described
straight line, convexed Southerly, and having a radius
of 24,555.35 feet, for a distance of 1028.57 feet; and
also except the North 70 feet of the West 70 feet of
the South 120 feet of said East half of the Southeast
quarter of Sectiori 27) all in Cook County, Illinois.
is currently zoned under the Zoning Ordinance of the Village of
Mount Prospect as B-3 (Business - Retail & Service) and contains

a shopping center use having four or more indoor retail stores, connected
by party walls. developed under one ownership, with an integrated building
arrangement having an aggregate floor area of more than twenty thousand
square feet; which zoning classification and use shall remain in effect
subj ect to the following granted variation.
SECl'ION TWO: That a free-standing building of approximately 40,000 square
feet to be used by the Jewel-0sco retail grocer,y and drug stores in
conjunction with the Randhurst Shopping Center may be constructed and
erected on the above-described property in the following manner and
satisfying the following conditions:
A. 'Ihe said free-standing building and i ts off-street parking
shall be located at the northeast corner of the above-
described property, on that 49,000 square foot area which
is 535.0 feet west of the shopping center's "East Drive"
and 278 feet. more or less, south of south line of
Euclid Avenue.
B. The Randhurst Corporation, the petitioner. shall pave and
provide sufficient off-street parking equal at least
to meet the minimum shopping center parking requirement
of four (4) square feet of parking area for ever,y one (1)
square foot of floor area in the said free-standing
building addition. which parking area shall be additional
to the now existing shopping center parking lot facilities.
C. All of the requirerrents of the Vil1;me Code t including building
set-back requirements, shall be applicable -- except the
variation set out herein and any such requirement of the Code
which may be construed to be in conflict with said variation.
SEcrION THREE: That the Director of Building and Zoning of the
Village of ~unt Prospect is herepy directed to issue a building permit
in accordance with the variation and limitation hereinbefore
mentioned.
SEcrION FOUR: That the variation granted by this Ordinance shall be
nu11 ana voId and of no force and effect whatsoever unless an
application for a building permit pursuant to such variation is made
and construction commenced within one year of the date said
Ordinance becomes effective.
SECl'ION FIVE: That this Ordinance shall be in full force and effect
from and arter its passage t approval, and publication in the manner provided
by law.
