ORDINANCE NO. 2253
AN ORDINANCE AMENDING PORrIONS OF ARrICLES I AND III OF THE
BUILDING CODE OF THE VILLAGE OF MOUNT PROSPECl'
.
BE IT ORDAINED BY THE PRESIDENT .AND BOARD OF TRUSTEES OF THE VILLAGE OF
MOUNT PROSPECl', COO~" COUNTY, ILLINOIS:
SECl'ION ONE: That Sections 21.103 through 21.106 inclusive, of Chapter
21 (the Building Code) of the Municipal Code of Mount Prospect of 1957,
as amended, be and the same are hereby amended an/or added to adopt a
1970 edition of the BOCA Basic Building Code and make other changes so
that the said sections shall be and read as follows:
"Section 21.103 ADOfTION OF THE BOCA BASIC BUILDING CODE .AND THE
NATIONAL CODE
There is hereby adopted for the purpose of establishing rules and
regulations for the construction, alteration, removal, demolition,
equipment, use and occupancy, location and rraintenance of buildings and
structures other than as provided for in Article XII of thas Chapter 21
the following:
(a) The 1970 edition of the BOCA Basic Building Code recomnended
Building Officials Conference of America, together with all Supple-
ments and Appendices, except such portions as are hereinafter ex-
pressly deleted, modified or amended.
1. This code shall establish restrictions within fire limits
and regulate the construction of all buildings and structures
except where the provisions of Article XII of tMs Chapter 21
", are appliqable, or where other provisions of this Chapter spe-
cifically cover the subject matter in question.
2. The following exceptions to the 1970 edition of the BOCA
Basic Building Code and amendments thereto shall control wnere
applicable or where in conflict with the said BOCA Code.
(a) Deletions: Section 128.0 of Article I and the entire
Articles X, XI, XIV, XV, XCI, XVII, XVIII of the BOCA Basic
Buildin~ Code as adopted in this Section are hereby deleted
from this Chapter 21 of Municipal Code of the Village of
Mount Prospect.

(b) Changes:
(i) Table 6 is amended and revised in part as follows:

Note (c) of Table 6 and Section 309.0 are revised to permit un-
limited areas only for buildings of noncombustible types of constructioL
or of heavy timber construction in which all ,,,ood members are of app:' ved
fire retardant treated lumber in either case having a permanent accessi-
ble opeD space of 80 feet between the wall of the building under consid-
eration and any other building on the same lot or the nearest line to
which a building is or may legally be built on another lot} with the
further provision that the 80 feet of open space may be reduced to not
less than 30 feet on one side if the building wall facing that side is
built as a fire wall and otherwise conforms with requirements of sub-
section 40l.3d (3) of the National Building CodeJ 1967 E:ition.
(ii) Protection to Exterior Wall Openings
The first paragraph of Section 916.0 shall be
changed by deleting the words 1imore than ~chree (3) stories
or forty (40) feet in height.n
(iii) Protection to Communications through Fire Walls
Sections 908.3 and 908.4 are revised so as to T8-
quire a 3-hour automatic or self-closing fire donr
approved for Class A openings on each side of every
opening in a fire wall.
(iv) Thickness and Fire Resistance of Exterior and
Fire Walls
The title of Section 867.0 is hereby revised by

Sections 907.0 through 907.4 are hereby revised to
be identical to Sections 800.1 to 800.6 of the National
Building Code, 1967 Ed~tic~.
In Table 5, Item 3, Fire Walls, the specified
fire resistance ratings are omitted and a note reading
as :Eu1.1m.,rs is inserted: ilFire walls shall be con-
structed as specified in Section 907.0.0

Section ~04.0 is hereby revised to prohibit un-
protected noncombustible T)~e 2C and wood frame Types
4A and 4B ccnst~Lction w~thin Fire District No.2, ex-
cept as provided in Section 400.6 of the National
B'lilding Code.
(vii) Elevator Construction
Article 16 is hereby revised to include pro-
visions for the constTuction of all passenger type
elevator equirment; all passenger elevator cabs and
door openings shall be of a size large enough to
accept a standard portable ambulance cot in its
horizontal position.
~b) The 1967 Edition of the National Building Code, recommended by th8
American Insurance Assoc~.ation. together with all its appendices; ex-
cept such portions as are herei~after expressly deleted, modified, or
amended.

are hereby adopted in their entireties, except such portions as may be

of Hea: Producing Appliances~ Ventilating, Air Conditioning? Blower and
EY~aust Systems as set forth in Sections 21.103 and 21.104 have been
and are now filed in the Office of the Village C1erk~ being nevertheless
hereby a~opted and incorporated as fully as if set out at length herein,
anrl the provisions thereof shall be controlling the construction of all
Lhildings and structures to the extent specified therein, within the
corporate limits of the Village of Mount Prospect.
(e,) IF the. event any of the provisions of any of the above named
codes are in conflict with either this Building Code or the Zoning
Ordinances of the Village of Mount Prospect? this Building Code and
the Zoning Ordinance shall prevail and the conflicting provisions
of all 'f those codes hereinabove adopted by references shall be of
ao aflee t.
(b) The term 1'building official;; as used in any of the above adopted
codes shall mean the Director of Building and Zoning of the Village
of Mount Prospect.
(c) Any references in any of the above adopted codes to the "munici-
pali ty\1 or to the \lci tyH or to the ;'vil1agel> shall mean the Village
of Moun~ Prospect.
Section 21,106 MISCELLA1\JEOUS PROVISIONS
(a) The Provisions of this code shall be deemed to supplement and
other"dse voi cl Lny exis ting building ordinances.
Cb) The existing zoning ordinances, or revisions thereof, are hereby
made a part of this code. Should a provision in the zoning code con-
fl~ct with that of tho building code, the most restrictive one shall
govel~n .
(c) Any cxist5.ng State laws or revisions thereto pertaining to the
erectioL, maintenance or occupancy of buildings and structures are
hereby m~~~ a p~r~ of ~h~s code. .S~oul~ any pro~is~ons in the State
l~:s ~O~~~lct ~~tn a Slmlla~ prOV1Slon ln the bUl1dlng code, the most
Test~ictive one shall govern.
Cd) If any chapter or part of a chapter or paragraph of this code
is decla:ted invalid or unconstitutional~ it shall not be held to
invalidate O? impair the validity, force or effect of any other~chap-
ter or chapters or part of a chapter or paragraph of this code. ~

(c) Automatic sprinkler equipment approved by any nationally recog-
nized testing laboratory shall be installed and connected to an adequate
water supply? with the sprinkler heads? valves, and auxilla':;:,y equip-
ment being of standard types as determined by the Chief of the Fire
Department.
Cd) No automatic sprinkler equipment shall be installed or a+tered
until plans have been submitted to the Bureau of Fire Prevention and
approved by the Chief of the Fire Department or his authorized agent.
(e) The Fire Chief shall require the installation of such approved
automatic sprinkler equipment in all instances based upon the following
standards:

Schools and Public Buildings. In basements) in kitchens,
and in other shops? and other spaces where combustible
materials are stored or handled, of schools or other public
buildings of non-fire-resistive construction over two
stories in height, or of two stories in height if of 10)000
square feet in area or over.
Hos itals and Other Institutional Buildings. Throughout
all lospitals and ot er institutlonal uildings of non-fire-
resistive construction over two stories in height or if
over 5)000 square feet in area regardless of height.
Theatres and Halls. Throughout all buildings occupied or
used, as places of public assembly having a stage arranged
for theatrical) operatic or similar performances) excepting
only the auditorium) foyers, lobbies and immediate vicinity
of automatic stage ventilators and throughout all buildings
of non-fire-resistive construction, if such places of
assembly are located above the first floor) whether or not
there is a stage.
Buildings Containing Four Stories or More) Multi-family
Houses) and Dormitories. In the basement, trash chutes)
cellars, kitchens, store rooms, work rooms, dumbwaiters)
hallways) and stairways of all buildings containing four
stories or more) all mUlti-family houses and dormitories
of non-fire-resistive construction more than three stories
in height and more than two stories in height if over
5~000 square feet area.
Hotels. Throughout all hotel buildings of non-Eire-resis-
tive construction more than three stories in height and
more than two stories in height if over 5 p 000 square fee-;:
area.
Basements. Throughout all basements and cellars of
buildings having an area of 2)000 square feet or more used
for the manufacture, storage or sale of com~ustible material
or merchandise) or the housing of automobiles.

SECTION TWO: That Article III of Chapter 21 (the Building Code) of
the Municipal Code of Mount Prospect of 1957) as amended~ be and the
same is hereby further amended by adding thereto Sections 21.313
through 21.316 inclusive; which sections shall provide regulation
for automatic fire detection devices and high rise construction; so
that the said added sections shall hereafter be and rea,: as follows;

(a) Authori ty is hereby conferred upon the Chief of the Fire De;:O\,rt.
ment to adopt and promogate rules based upon the standards of aD~
nationally recognized organization embodying details for the inst:il1a..
tion ~nd construction of automatic sprinkler equipment and/or autc-
matic fire detection equipment in such instances where, based upon thE
standards contained herein, any building or part thereof bCC2.U'30 of
its size; cons truction, occupancy, or lack of sui table protcc -::'i va
equipment shall be deemed by the said Fire Chief or his duly autto :ea
aCiJnt to cansti tute a special fire hazard to life or property 0'( c';;
excessive burd~~ ~:on the fire extinguish facilities of the fire Depart-
ment.
(b) All automatic sprinkler equipment and/or fire detectio11 equi.
SpGc~_:fied herein shall be inspected at least once each yea:;:.' by 'LL,:::

tive condition bv the owner or occupant of such buildinQ.~ The oc;;;u
pant(s) of such buildings containing such equipment shall prompLly
notify the Fire Prevention Bureau of the Fire Department in CP,S0 st5.ch
sprinkler system Dr any other equipment specified herein is ~ittdrawn
from such ~uilding, or the use of such equipment therein inte~ruPted
curtailed, or altered.

(7)
Garages. Throughout all garages and parking areas as
follows: Fire-resistive buildings over 10;000 square
feet in area; Non-fire-resistive buildings over 6?OOO
square feet in area~ and in all parking areas located
under any building.
(8)
Buildings for the Manufacture, Storage or Sale of Combustible
Goods or Merchandise.
(a) Throughout every fire-resistive building occupied in
whole fer the manufacture, storage or sale of combustible
goods or merchandise; if over two stories in height and

in height r~gardl~ss of area.
(b) Throughout every story occupied, in whole or in part,
for the manufacture, storage or sale of combustible goods
or merchandise in fire-resistive buildings over two stories
in height and more than 7;500 feet in area, or over five
stories in height regardless of area.
(c) Throughout every building of other than fire-resistive
construction as herein defined; occupied, in whole or in
part, for the manufacture, storage or sale of combustible
goods or merchandisei if more than 7,500 square feet in
area, or if over five stories in height regardless of area,
or in such parts of buildings of this class as may be speci-
fied by the Chief of the Fire Department.
(9) Especially Hazardous Properties. Throughout every building,
which by reason of its inferior construction or highly com-
bustible occupancy involves a severe life hazard to its
occupants or in the judgment of the Chief of the Fire De-
partment constitutes a fire menace to adjoining property.
(f) Nothing herein shall be construed to require the installation
of sprinklers in safe deposit or other vaults, or in rooms or buildings
devoted to the manufa(:tul'e or storage or aluminum powder, calcium
carbide, calcium phosphide, metallic sodium and potassium, quicklimo~
magnasium powier~ sodium paroxide or like materials, where the appli-
cation of water may cause or increase fire, nor in any other location
~here the ins~allation of sprinklers may increase the hazard; nor shall
it be construed in any way to interfore with the substitution of other
approved automatic protective equipment.
SECTION 21.314. Special Regulations FOT All Buildings Containing

be no further than ten (10) feet apart) shall be located on
the front wall of any such building, shall be readily acces-
sib1e~ and shall be located no further than 300 feet from
the nearest Village fire hydrant -- which 300 feet shall be
measured along a route normally used by motor vehicles.
(2) Wet standpipes with hose racks for Class III service shall
be provided on each floor.
(a) All hose so installed shall be of a type double jacket
rubbeT lined 600 P.S.I. Test with N.S.T.
(b) Such standpipes shall be installed in accordance lvi th
the National Fire Protection Association Pamphlet No. 14.
(h) Elevators.
(1) One elevator in each fire area shall be equipped with a
Fire Department key control) located in the lobby at a
place designated by the Fire Chief~ to override all controls
except pressure actuated door safety controls.
(2) No elevator door shall be equipped with heat or smoke
sensitive elevator door openers.
(c) Fire Extinquishers And Pull Stations.
(1) Ten pound ABC Fire Extinquishers shall be installed in
breakable glass fronted cabinets at locations meeting the
requirements of I1the standard for the installation of
portable fire extinguishersu~ National Fire Protection
Association Pamphlet No. 10.
(2) At least one fire pull station shall be located on each
floor. . Fire detector heads will not be required where
approved automatic sprinkler systems are installed and the
water flow alarm for such system is connected to the fire
detection system.
(d) Special Wiring.
(1) Non-energized W1rlng to provide emergency power for fire
fighting and other purposes shall be located as near as
Possible to standpipe cabinets throughout each bUilding in
the following manner:
(a) Standard three-prong female twist-lock outlet sockets
shall be located on each floor.
(b) One standard three-prong male twist-lock socket shall
be located at ground level to accept generator: pr .."""'T a~_.-'L

elsewhere throughout the bUilding.
(2) Non-energized interconnected communication jacks and

associated Wlrlng for fire fighting purposes shall be lo-
cated as near as possible to standpipe cabinets throughout
the bUilding, in the main floor lobby) and at ground level,
The exact location of such outlets shall be determined by
the Fire Chief or his authorized agent.
(3) Emergency lighting circuits shall be provided for all exit
signs and in all corridors~ stairwells, basements, assembly
rooms, and any other public areas.
(e) Blue Prints.
(1) Prior to the issuance of any building permit, all plans,
specifications and blue prints for all construction shall
be approved by the Bureau of Fire Prevention of the Mount
Prospect Fire Department.
(2) All such blue prints shall conform to the requirements
specified in liThe Life Safety Coden, National Fire Protec-
tion Associatio~ Pamphlet No. 101,
(f) Smoke Hatches. Smoke hatches shall be provided in all stairways.
Such hatches shall be activated by automatic smoke detection devices.
(g) Miscellaneous.
(1) All stairways~ shafts~ corridors, boiler or furnace rooms)
laundry rooms~ storage rooms, trash rooms) janitor closets,
mechanical equipment rooms shall be completely .nclosed and
fire rated at no less than two hours.
(2) One smoke proof tower shall be provided on all buildings
exceeding seven stories in height.
SECTION 21.315. Ventilation Panels. All buildings of a controlled
atmosphere design, having non-operable windows or no windows at ali,
and exceeding three stories in height shall be constructed with Fire
Department ventilation panels at all floor levels at a location to
be determined by the Fire Chief.
SECTION 21.316, Conflict With Other Ordinances. Nothing in this
Article III shall be deemed to conflict with any other law or ordi-
nance of the Village of Mount Prospect or any such regulations con-
tained in this Chapter.~

SECTION THREE: That this Ordinance shall be in full force and effect
tl~nd after its passage, approval, and publication in the manner
provided by law.
