ORDINANCE NO. 2260
AN ORDINANCE GRANTING CERTAIN VARIATIONS FOR PROPERTY LOCATED
AT 500 WEST CENTRAL ROAD, MOUNT PROSPECT, ILLINOIS
WHEREAS, the Board of Appeals of the Village of Mount Prospect did
meet on the 28th day of August, 1970, at the hour of 8:00 p.m. at the
Village Hall of Mount Prospect and did hear Case No. 70-2lA pursuant
to legal notice published in the Mount Prospect Herald on August 12,
1970; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect did
hear a petition requesting variations from the front yard, height,
and lot size requirements of the Mount Prospect Zoning Ordinance so
that the petitioner might construct an office building at this loca-
tion; and
WHEREAS, the Board of Appeals of the Village of Mount Prospect has
recommended to the President and Board of Trustees the granting of
the variation requested under Case No. 70-21A for reasons that:
(l) There is a practical difficulty and particular hardshi.p
on the petitioner in that this 33,000 square foot parcel
is zoned I-I, which zoning district allows office buildings
but requires four (4) acre minimum lots with a thirty (30)
foot setback;
(2) The purpose of the variations is not based exclusively on
a desire to make money,
(3) The plight of the owner is due to unique circumstances in
that the land is so located that additional acreage is not
available since contiguous land has been improved with a
lumber yard and railroad tracks---the retail lumber store
having a setback of only twenty (20) feet; and
(4) The alleged difficulty or hardship has not been created by
any person presently having an interest in the property;
(5) The proposed variation will not impair an adequate supply
of light and air. to ,adjacent property, or substantially
increase the congestion in the public streets, or increase
the danger of fire, or endanger the public safety or sub-
stantially diminish or impair property values within the
neighborhood;
(6) The granting of the variations will not be detrimental to
the public or injurious to surrounding property in that it
will not alter the essential character of the locality; and
WHEREAS, the Building Committee of the Board of Trustees of the Village
of Mount Prospect did meet on September 23, and October 28, 1970, and
considered Case No. 70-21A and has recommended that the President and
Board of Trustees concur with the recommendation of the Board of Appeals
to grant these variations; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have reviewed the matter herein and have determined that the
same is for the best interests of the Village of Mount Prospect;
NOW, THEREFORE, BE IT ORDAillNED BY THE PRESIDENT AND BOARD OF TRUSTEES
or THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: T~at the property being the subject ~atter of Case No.
70-21A, being l~gally described as follows:

Lot Three (3) (except the west 282.53 feet thereof) of
Charles Behlendorf's Division of the Southwest Quarter
(1/4) 'of the Northwest Quarter (1/4) and the West 10.58
chains of the Southwest Quarter (1/4) of Section 34,
Township 42 North, Range 11, East of the Third Principal
Meridian (except the right-of-way of the Chicago and
Northwestern Railway Company) in Cook County, Illinois;
is currently zoned under the Zoning Ordinance of the Village of Mount
Prospect as I-I (Light Industrial), which zoning classification shall
remain subject to the variations granted herein;
(a) That the 33,000 square foot size of the subject property
shall be sufficient to construct this I-I (Light Industrial)
office building use;
(b) That the front yard setback shall be twenty (20) feet;
(c) That the maximum height of the building shall not exceed
thirty-four feet six inches (34'6"), provided that the
construction of the proposed use is in accordance with
plans and specifications presented to the Board of Appeals;
(d) That the floor area of the said two-story office building
shall not exceed 20,000 square feet and that no more than
80% of the total land, known as Lot A in Owaer's Resubdi-
vision, shall be used for both building and parking;
(e) That the building shall be so constructed as to provide
off-street parking facilities beneath the two (2) floors;
and
(f) That the developer and/or owner provide sufficient on-site
detention (other than roof detention) for storm water pur-
suant to plans approved by the Village Engineer; and that
the owner sign and record a document wherein said owner
agrees to participate in any future special assessment for
storm sewers servicing this property and wherein he further
agrees to waive his rights and the rights of his successors
in interest to object to any said special assessment storm
sewers.
SECTION TWO: That all requirements of the Mount Prospect Building and
Zoning Code shall be applicable except the variations noted in Section
One heretofore mentioned.

SECTION THREE: That the variations granted by this Ordinance shall be
null and void and of no force and effect whatsoever unless the owners
of the subject property erect a "Right Turn Only" sign at all exits
from this property onto Central Road--which sign shall remain in place
until electronic traffic control devices are erected at the intersec-
tion of Wa-Pella Avenue, Central Road, and the private driveway to
this property.
SECTION FOUR: That this Ordinance shall be in full forceiand effect
from and after its passage, approval, and publication in the manner
provided by law.
