ORDINANCE NO. 2262
AN ORDINANCE AMENDING SECTION 24.302 OF THE
MUNICIPAL CODE
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That Section 24.302 of the Municipal Code of Mount Prospect
of 1957, as amended, be and is hereby further amended: in its entirety, so
that hereafter said Section 24.302 shall be and read as follows:
"Section 24.302. Applications - Issuance
A. Applications for such permits shall be made to the Village Clerk
at least four-teen (14) days prior to the date issuance is de-
sired on forms which shall contain the following information:
1. Name of applicant and name of organization of which"the
permit is sought.
2. Residence and business address of applicant.
3. The day(s) and date(s) for which a tag day permit is
sought.
4. A statement as to whether the organization has been
granted in the past such a permit from the Village of
Mount Prospect; if none, then a statement as to permits
granted by other municipalities in Illinois within the
preceding two year period; if no permits have been grant-
ed in Illinois in the two year period preceding the ap-
plication then a statement as to permits granted by any
state, other municipality, governing body or licensing
authority. Also
a. A list of such permits or licenses;
b. A statement of the date, place, and by whom
issued; and
c. A statement as to whether any such authority has
ever revoked or refused to issue or renew such a
permit or license either to the applicant or to the
organization he represents and an accurate statement
as to the reasons for any such revocation or refusal.
5. A statement as to whether the applicant or the organization
seeking such a permit has ever been convicted of a viol-
ation of any ordinance or law~-- and, if so, the nature
of the offense and the punishment or penalty assessed
therefor.

B. Upon receipt of a fully completed application form, the
Village Clerk shall send same to the Village Manager, who
shall within seven (7) days after the date said application
is received approve or disapprove the application. The
Village Manager may refuse to issue such permit or may
revoke an exi~ng permit, if he finds: Either
1. That the applicant or permit holder is not an indiv-
idual of good moral character and business responsibility;
or
2. That the application of the applicant or permit holder
contains any false, fraudulent, or misleading material
statement; or

3. That the applicant or permit holder has made any false,
fraudulent, or misleading statement in the course of
soliciting in the Village of Mount Prospect; or
4. That the applicant or permit holder has violated any
of the Statutes of the State of Illinois or Ordinances
of the Village of Mount Prospect; or
5. That the applicant or any member or agent of the organ-
ization holding such a permit has solicited in any un-
lawful manner or in such a manner as to constitute a
breach of the peace or a menace to the health, safety,
or general welfare of the public.
C. Any individual aggrieved by the action of the Village Manager
in refusing to issue such permit or in revoking any such
permit already issued shall have the right to appeal to the
President and Board of Trustees of the Village of Mount Prospect.
1. Such appeal shall be taken by filing a written statement
setting forth fully the grounds of appeal with the Village
Clerk within seven (7) days after notice of the action
complained of has been mailed by the Village Manager,
postage prepaid, to such individual's last known address.
2. The President and Board of Trustees shall set a time and
place for a hearing on such appeal, and notice of such
hearing shall be given to the appellant in writing at
his last known address at least five (5) days prior to
the date set for hearing.
3. The appellant shall have the right to be represented at
such hearing by counsel.
4~ The decision and order of the President and Board of
Trustees on such appeal shall be final and conclusive.
D. If any part or parts of this Article shall be held to be
unconstitutional, such unconstitutionality shall not affect
the validity of the remaining parts of this Article. The
Board of Trustees hereby declares that it would have passed
the remaining parts of this Article if it had known that such
part or parts thereof would be declared unconstitutional.
SECTION TWO: That this Ordinance shall be in full force and effect
from and after its passage, approval, and publication in the manner
provided by law.
