HomeMy WebLinkAboutOrd 2239 06/16/1970 '" ORDINANCE NO. r2:l3 cr AN ORDINANCE AMENDING CHAPTER 18 OF THE MUNICIPAL CODE IN ITS ENTIRETY WHEREAS~ the Fire and Police Committee of the Village of Mount Prospect heretofore on June 8, 1970 ~ did investigate the"passage of an entirely new Traffic Code to replace the present Chapter 18 of the Mount Prospect Municipal Code to coordinate same with the newly adopted Illinois Vehicle Code passed by the Illinois General Assembly to be effective July 1, 1970; and WHEREAS~ the Fire and Police Committee of the Village of Mount Prospect have recommended to the President and Board of Trustees that a new Chapter 18 replacing the existing Traffic Code of the Village of Mount Prospect would be in the best interests of the Village of Mount Prospect~ and WHEREAS~ the President and Board of Trustees of the Village of Mount Prospect have determined the best interests of the Village of Mount Prospect will be attained by the adoption of the Fire and Police Committee's reco~nendation regarding the Traffic Code; NOW ~ THEREFORE ~ BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT~ COOK COUNTY~ ILLINOIS; SECTION ONE: That Chapter 18 of the Municipal Code of Mount Prospect of 1957~ as amended, be and is hereby further amended in its entirety by substituting therefore a new Chapter 18 which shall be and read as follows: t-, ,,-,., Article XVIII, Abandoned; Lost) Stolen Or Unclaimed Vehicles Section 18,1801. Abandonment Of Vehicles Prohibited. A. The abandonment of a motor vehicle or other vehicle or any part thereof on any street or highway in this Village is hereby declared unlawful and no person shall leave any vehicle at any place within the Village of Mount Prospect for such time and under such circumstances as to cause such vehicle reasonably to appear to have been abandoned. B. The abandonment of a motor vehicle or other vehicle or any part thereof on private or public propertY9 other than a street) in vie,,; of the general public" anywhere in this Village is unlawful except on property of the owner or bailee of such abandoned vehicle. A motor vehicle or other vehicle or any part there of so abandoned on private property may be authorized for removal in the manner provided in this Article, Section 18.1802. Abandoned~ Lost) Stolen Or Unclaimed Vehicle, Notification To Law Enforcement Agencies. When an abandoned; lost, stolen--or unclaimed motor vehicle or other vehicle comes into the temporary possession or custody of a person in this Village, not the owner of the vehicle, such person shall immedi- ately notify the Police Department when the vehicle is within the corporate limits of the Village of Mount Prospect. Upon receipt of such notifications the Police Department will author- ize a towing service to remove and take possession of the abandoned ~ lost, 5 to1en or unclaimed motor vehicle or other vehicle. The towing service will safely keep the towed vehicle and its contents; maintain a record of the tow as set forth in Section 18.1804 for law enforcement agencies, until the vehicle is claimed by the owner or any other person legally entitled to possession thereof or until it is disposed of as provided in this Article. Section 18.1803. Removal Of Motor Vehicles Or Other Vehicles ~ ""--.------ Towi~Or Hauling Away. A. When a motor vehicle or other vehicle is abandoned on a street in the Village of Mount Prospect ten (10) hours or more~ its removal by a towing service may be authorized by the Mount Prospect Police Department. Definitions. Section 18.101. Definitions Of Words And Phrases. Whenever in this Chapter the following words and phrases are used, they shall, for the purposes of this Chapter, have the meanings re- spectively ascribed to them in this Article~ except when the context otherwise indicates. Section 18.102. Alley. A public way within a block, gener&llj giving access to the rear of lots or buildings and not used fer general traffic circulation. Section 18.103. Area. The geographical boundaries within which an operating motorcycle or operating motor-driven cycle can be heard. Section 18.104. Bicycle. Every device propelled by human power upon which any person may ride, having two tandem wheels either of which is more than 16 inces in diameter. Section 18.105. Department. The Police Department of the Virrage of' .Mount Prospect. ~ Section 18.106. Districts. The word Vldistrict" may be used with reference to: A. Business District. The territory of the Village contiguous to and including a highway when within 60 feet .along such" highway there are buildings in use for business or industria_ purposes, including but not limited to hotels, banks, or office buildings, railroad stations, and public buildings which occupy at least 300 feet of frontage on one side or 300 feet collectively on both sides of the highway. B. Residence District. The territory of the Village contiguous to and including a highway not comprising a business dis ,. trict w~en the property on such highway for a distance of 300 feet or more is in the main improved with residences or residences and buildings in use for business. C. Suburban District. That portion of the Village other than the business and residence districts. D. Urban Districto The territory contiguous to and including any street which is built up with structures devoted to business? industry or dwelling houses situated at intervals of less than 100 feet for a distance of a quarter of a mile or more. Section 18.107. Drag Racing. The act of 2 or more individuals competing or racing on any street or highway in this Village in a situation in which one of the motor vehicles is beside or to tile rear of a motor vehicle operated by a competing driver and the one driver attempts to prevent the competing driver from passing or overtaking him~ either by acceleration or maneuver, or one or more individuals competing in a race against time on any street or highway in this Village. Section 18.108. Explosives. Any chemical compound or mechani- cal mixture that is commonly used or intended for the purpose of producing an explosion and which contains any oxidizing and combustive units or other ingrediants in such proportions, quantities; or packing that an ignition by fire; by friction9 by concussion, by percussion9 or by detonator of any part of the compound or mixture may cause such a sudden generation of highly heated gases that the resultant gaseous pressures are capable of producing destructive effects on contiguous objects or of destroying life or limb. Section 18.109. Fire Lane, Any travel lanes reserved for fire fighting equipment so that such fire equipment can move freely thereon. ~. Section 18.110. Flammable Liquid. Any liquid which has a flash point of 70 degrees P., or less9 as determined by a tagliabue or equivalent closed cup test device. Section 18.111, Holidays. When used in this Chapter or on official signs authorized by this Chapter, holidays shall mean New Yeari s Day) Good Friday, Memorial Dc_y.;; Independence Day, Labor Day~Thanksgiving Day- and Christmas Day. Section 18.112. Muffler. A device consisting of a series of chambers or baffle plates or other mechanical design for thE: purpose of receiving exhaust gas from an internal combusion engine and effective in reducing noise. Section 18.113. Official Time. Standard or daylight-saving time~ whfchever may be in current use in this Village. Section 18.114. Official Traffic Control Devices. All signs, signals, mark in g-s;:-ana-Cle vi ce s--wnlcnconform - wi tnthe Sta te of Illinois Manual and not inconsistent with this Chapter} placed or erected by authority of a public body or official having jurisdiction, for the purpose of regulating, warning, or guiding traffic, including: ~. A. Lane Control Signal. An electrica11y controlled and illu- minated signal of a square or rectangular design and em- ploying distinctive colors or symbols used to control direction of vehicular flow on the particular lane to which the indication applies. B. Railr9a~__~~gI!.~_Q~ Signals. Any sign, signal, or device erected in accordance with the laws governing same and i~- I~ tended to give notice of the presence of railroad tracks or the approach of a railroad train. C. Traffic Control Signal. Any device, whether manually, electrically or mechanically operated~ by which traffic is alternately directed to stop and to proceed. Section 18.115. Park or Parking. When prohibited means the standing of a vehicle, whether occupied or not? otherwise than temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers. Section 18.116. Parking Meter. A mechanical device located up'oll' a public street, sidewalk, or other place designated as a parking meter zone, which device may be activated by the a~propriate United States coins and which thereafter clocks the number of minutes of parking privilege thereby extended to the person depositing such coin or coins. Section 18.117. Person. Every natural person, firm, co-part- nershipJ association, or corporation, including: A. Chauffeur. 1. All persons employed by another for the principal pur- pose of driving a motor vehicle, and 2. All persons who drive a school bus transporting cnlldren and 3. All person employed in connection with the operation of any schoolj day camp, summer camp, or nursery school, who drive any motor vehicle transporting children to C1' from any schoolj day camp, summer camp, or nursery schooj and 4. All persons who drive any motor vehicle when in use for the transportation of persons or property for compensa- tion; B. Crossing Guard, An adult civilian authorized by the Mount Prospec~Cnler-of Police to supervise and expedite the crossing of pedestrians at assigned crossings. Co Driver. Every person who drives or is in actual physical control of a vehicle. D. Motor Carrier. An operator of For-Hire vehicles pursuant to the Illinois State Motor Carrier of Property Law. ~ Eo Non-Resident. Every person who is not a resident of the State of Illinois, T"' H Operator. Every person, other than a chauffeur, who drives or is in actual physical control of a motor vehicle upon a highway or who is exercising control over or steering a vehicle being towed by a motor vehicle. G. Owner. A person who holds the legal title of a motor vehicle or in the event a motor vehicle is the subject of an agree- ment for the conditional sale or lease thereof with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee, or in the event a mortgager of such motor vehicle is entitled to possession, then such conditional vendee or lessee or mortgager shall be deemed the owner for the purpose of this Chapter. H. Pedestrian. Any person afoot. I. Police Officer. Every officer authorized to direct or regu- late traffic or to make arrests for violation of traffic regulations. ..J. Res iden t ~ ~. 1. Every natural person who resides in this state shall be deemed a resident of the State of Illinois. 2. In the case of a firm, copartnership or association. If the principal place of business of such firm, co- partnership or association is located in the State of Illinois, then such firm, copartnership or association shall be deemed a resident of the State of Illinois. 3. In the case of a corporation3 if the corporation was incorporated under the laws of the State of Illinois or if the principal place of business of such corpor~- tion is in the .State nf Illinois, "them such corpor'rc:L().G shall be deemed a resident of the State of Illinois. Section 18.119. Property Line. The line of demarcation between ~ a public way and private property abutting thereon. Section 18.120. Public Building. Any building or portion of any building occupied and used by any governmental agency. Section 18.121. Push Car. A conveyance designed to be pro- pelled by a person on foot. Section 18.122. Racing of Motor. A sudden accerleration or deceleration of the motor of a motorcycle or motor-driven cycle. Section 18.123. Railroad. A carrier of persons or property upon cars, other than street cars~ operated upon stationary rail~ Section 18.124. Railroad Train. A steam engine, electric or other motor, wi th or wi thout cars coupled thereto, operating UIJcn rails, except street cars. Section 18.125. Right-Of-Wa~. The right of one vehicle or pedes trian to proceed in a lalfiful manner in preference to anothsr vehicle or pedestrian approaching under such circumstances of direction} speed, and proximity as to give rise to danger of collision unless one grants precedence to the other. ,~ Section 18.126. Safety Glazing Materials. Glazing materials so constructed, treated, or combined with other materials as to reduce substantially, in comparison with ordinary sheet glass or plate glrrss, the likelihood of injury to persons by objects from exterior sources or by these safety glazing materials when they may be cracked or broken. Section 18.127. Seat Safety Belts. A set of belts or a harness--meeting thespecifications established by the State of Illinois Department of Public Safety and installed in such manner as to orevent or materially reduce the movement of the person using lhe same in the even~ of collision or upset of the vehicle. Section 18 .l~_~_ S}!-,?~nJLCel1!er. Premises having one or more stores or business establishments in connection with which there is provided on privately-owned property near or contiguous thereto an area, or areas, of land used by the public as the means of access to and egress from the stores and business es- tablishments on such premises and for the parking of motor vehicles of customers and patrons of such stores and busin8ss establishments on such premises. Section 18.129. Situs Or Base Of Vehicle. The place where a vehi-cle is principally garaged;-or" froIll whence it is principally dispa tched ~ or where the movements ,of such vehicle usually origi.- nate. Section 18.130. Stand Or Standing. Means the halting of a ~. ,~ vehicle~ whether occupied or not, otherwise than when temporarll} and actually engaged in receiving or discharging passengers. Section 18.131. Stop. When required means complete cessation from movement. A.. Stop Or Stopping, When prohibited means any halting even momentarily of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic-control sign or signal. B. Bus Stop.. A designated area in the roadway~ parallel and adjacent to the curb or shoulder, used for the purpose of loading or unloading passengers. Secti~n 18.132. Street Or Highway. The entire width between boundary lines of every way or place of whatever nature when any part thereof is open to the use of the public, as a matter of right~ for the purposes of vehicular traffic other than public ways for vehicular traffic within the parking lots of shopping centers wherein authority to patrol has not been given by the owners thereof and other than public ways for vehicular traffic within a park district for which such park district has mainte- nance responsibility but otherwise including: A. Arterial Street, Any United States or Illinois State numbered route~ controlled access highway, or other major radial or circumferential street or highway de5ignated by the President and Board of Trustee~ of the Village of Mount Prospect within the corporate limits of the Village of Mount Prospect as part of a major arterial system of streets or highways, " n. Bus Stand. A designated area in the roadway, parallel and adjacent to the curb or shoulder to be occupied exclusively by buses for purposes of maintaining schedules, or awaiting passengers. D, Crosswalk. 1. That p.'lTt of a roadway at an intersection included within the connections of the lateral lines of the siJewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from ~hd edges of the traversable roadway, ~ 2. Any portion of a roadway at an intersection or else- where distinctly indicated for pedestrian crossing by lines or other markings on the surface. E. Improved Highway. Any roadway of concrete, brick, asphalt, macadam and crushed stone or gravel. F. Intersection. 1. The area embraced within the prolongation or connection of the lateral curb lines, or, if none, then the lateral boundary lines of the roadways of two highways which join one another at, or approximately at, right angles or the area within which vehicles traveling upon differ- ent roadways joining at any other angle may come in conflict. 2. Where a highway includes two roadways 40 feet or more apart~ then every crossing of each roadway of such divided highway by an intersecting highway shall be regarded as a separate intersection. ,'-' G. Laned Roadway. A roadway which is divided into 2 or more clearly marked lanes for vehicular traffic. H. Loading Zone, A designated area in the roadway, adjacent to the curb or shoulder, to be occupied exclusively by vehicles during the loading or unloading of passengers and/or material. L One-Way Street Or One-Way Alley. A public way in which trafficlspermlttect"-To-tra,vefln only one direction. J. Parking Meter Zone. A designated and marked off area in the roadway, adjacent to the curb or shoulder or any other place so designated, to be occupied exclusively by vehicles for the purpose of parking for the period of time allocated to the zone by the parking meter. K. Private Road Or Drivew<!y. Every way or place in private ownersl1Ip '-and--us'ed-foi- vehicular travel by the owner and those having express or implied permission from the OI-'mer but not by other persons. L. Publi~--.ll\]ay. That portion of a highway improved, designed, or ord-inarily used for vehicular travel, exclusive of the berm cr shoulde~. In the event a highway includes 2 or more separate roadways the term "roadwayli as used herein shall refer to any such roadway separately but not to all such .~., ~ roadways, collectively, N, Safety Zone. Section 18.133. Stunting. Operation of a vehicle in a manner causing it to weave or suddenly change course~ or the loss of body contact with the seat by a driver or passenger~ and not for the purpose of safe operation of such vehicle. Pedestrians, ridden or herded animals, vehicles~ street cars, and other conveyances either singly or together while using any highway for purposes of travel. A. Merging Traffic. A maneuver executed by the drivers of vehicles on converging roadways to permit simultaneous or a1 ternate entry into the junction thereof ~ whe,rein the driver of each vehicle involved is required to adjust his vehicular speed and lateral positions so as to avoid a collision with any other vehicle. . Section 18.138. Vehicle. Every device in~ upon, or by which any person or property is or may be transported or drawn upon a highway; except devices moved by human power or used exclu- sively upon stationary rails or tracks~ including: A. Abandoned Vehicle. A motor vehicle standing or parked on a public way which 1S either: 1. In such a state of disrepair as to be incapable of being driven or operated in its condition~ or 2. Unmoved or unused for seven (7) consecutive days or more. B. Ant ique Vehicle. Any motor vehicle or other veh lele 30 years of age or older. C. Authorized Emergency Vehicles. Emergency vehicles of the municipal departments of the Village of Mount Prospect or public service corporations as are designated or authorized by the Village of Mount Prospect Board of Trustees; police vehicles; vehicles of the Fire Department and ambulances. D. Bus. Every motor vehicle designed for carrying more than ten (10) passengers and used for the transportation of persons; and every motor vehicle, other than a taxicab, designed and used for the transportation of persons for com- pensation. E. .Commercial Vehicle. Any vehicle operated for the trans- portation of persons or property in the furtherance of any .commercial or industrial enterpriseJ For-Hire or Not-Foy- Hire not including however a recreational vehicle not being used commercia 1. Fleet. Three or ]:~orn corr:mer-cial Bator vehicles. ~. ,~ 2. Non-Fleet Vehicle. Anyone or two commercial motor vehicles not part of a fleet F, Funeral Procession. A caravan or motorcade consisting of two or more motor vehicles, in combinations of any of the following: automobiles designed and used for carrying not more than seven (7) passengers, funeral hearses, and floral cars~ when such vehicles are proceeding to places of burial. For purposes of this Chapter, pedestrians or equestrian units may also constitute funeral processions either alone or in combinations of any of the motor vehi- cles described in this subsection. G. House Trailer. 1. A recreational trailer or semitrailer equipped and used for living quarters or for human habitation (temporarily or permanently) rather than for the transportation of freight, goods, wares and merchan- dise; or ~. 2. A house trailer or a semitrailer which is used commer- cially (temporarily or permanently), that is, for the advertising, sales, display or promotion of mer- chandise or services, or for any other commercial purpose except the transportation of property for hire or the transportation of property for distribu- tion by a private carrier. H. 1~~l!len~tJ!!lsbandry. Every vehicle designed and adapted exclusively for agricultural, horticultural, or livestock raising operations, including farm wagons, wagon trailers or like vehicles, used in connection therewith, or for lifting or carrying an implement of husbandry, provided that no farm wagon, wagon trailer or like vehicle having a capacity of more than 400 bushels or of a gross weight of more than 30,000 pounds, shall be included hereunder. I, Motorcycles. Every motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground but excluding a tractor. J. Motor Driven Cycles. Every motorcycle, every motor scooter, or every bicycle with motor attached with less than 150 cubic centimeter piston displacement. K. Motor Vehicle. Every vehicle which is self-propelled and every vehicle which is propelled by electric power obtained from overhead trolley wires, but not operated upon rails. For this Chapter, motor vehicles are divided into two divisions: ,..-" ~, ~, First Division. Those motor vehicles which are de- signed for the carrying of not more than 10 persons. 2 . Second Division. Those motor vehicles which are designed for carrying more than 10 persons, those designed or used for living quarters and those motor vehicles which are designed for pulling or carrying freight or cargo, and those motor vehicles of the First Division remodelled for use and used as motor vehicles of the Second Division. L. Noncommercial Vehicle. Any vehicle that 1S not a commercial vehicle. M. Passenger Car. A motor vehicle of the First Division, that is, designed for carrying not more than ten (10) persons, N. Public Passenger Vehicle. A motor vehicle used for the transportation of passengers for hire, except those devotc0 exclusively to funeral purposes or to the operation of metropolitan transit authorities or public utilities under the laws of the State of Illinois. r', O. Reconstructed Vehicle. Every vehicle of a type required to be registered hereunder materially altered from its original construction by the removal~ addition or substi- tution of essential parts, new or used. P. Recreational Vehicle. Every vehicle originally designed or permanently converted and used for living quarters or for human habitation and not used as a commercial vehicle, including any house car, house trailer, camper or private living coach. 1. Camper. A recreational motor vehicle of the Second Division converted or equipped and used for living quarters or for human habitation, rather than for the transportation of freight~ goods, wares, and merchandise. 2. House Car. A recreational motor vehicle of the First Division converted or equipped and used for living quarters or for human habitation, rather than as a passenger car. r-- 3. Private Living Coach. A recreational motor vehicle of the Second Division equipped and used for living quarters, human habitation or for mobile living, rather than for the transportation of persons, and with direct access to the living quarters from the driver1s seat. Q. Rural Mail Delivery Vehicle. Every vehicle used to deliver U.S. mail on a rural mail delivery route. /""", R. School Bus. Every motor vehicle of the Second Division owned or operated by or for a public or governmental agency or by or for a private or religious organization for the transportation of pupils in connection with any school ac- tivity. This definition does not in,lude a bus operated by a public utility or a municipal corporation authorized to conduct local or interurban transportation of passengers. S. Specially Constructed Vehicle. Every vehicle of a type required to be registered hereunder not originally con- structed under a distinctive name1 make 1 model or type by a generally recognized manufacturer of vehicles and not materially altered from its original construction. ~. T. Special Mobil Equipment. Every vehicle not designed or used primarily for the transportation of persons or property and only incidentally operated or moved over a highwaY1 in- cluding but not limited to: ditch digging apparatus1 well boring apparatus1 and road construction and maintenance machinery such as asphalt spreaders~ bituminous mixers1 bucket loaders 1 tractors other than truck tractors1 ditchers1 leveling graders, finishing machines, motor graders, road rollers, scarifiers1 earth-moving carry-aIls and scrapers, power shovel and drag lines) and self-propelled cranes and earth moving equipment. The term does not include house trailers, dump trucks, truck mounted transit mixers, cranes or shovels, or other vehicles designed for the transportation of persons or property to which machinery has been attached. U. Tractors. Tractors shall include: 1. Farm Tractor. Every motor vehicle designed and used primarily as a farm implement for drawing wagons~ plows, mowing machines and other implements of husbandry~ end every implement of husbandry which is self-propelled. 2. Road Tractor. Every motor vehicle designed and used for drawing other vehicles and not so constructed as to carry any load thereon either independently or any part of the weight of a vehicle or load so drawn. 3. Truck Tractor. Every motor vehicle designed and used primarily for drawing other vehicles and not so con- structed as to carry a load other than a part of the weight of the vehicle and load so drawn. V. Trailer. Every vehicle without motive power in operation, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that no part of its weight rests upon the towing vehicle. 1. Pole Trailer. Every vehicle without motive power designed to be drawn by another vehicle and attached to the towing vehicle by means of a reach or pole~ or by being boomed or otherwise secured to the towing vehi- cle~ and ordinarily used for transporting long or irregularly shaped loads such as poles~ pipess or structural members capable; generally, of sustaining themselves as beams between the supporting connections. 2. Semitrailer. Every vehicle without motive power, other than a pole trailer, designed for carrying persons or property and for being drawn by a motor vehicle and so constructed that some part of its weight and that of its load rests upon or is carried by another vehicle. 3. Stinger-steered Semitrailer. Every semitrailer which has its kingpin on a projection to the front of the structure of such semitrailer and is combined with the 5th wheel of the truck tractor at a point not less than two feet to the rear of the center of the rearmost axle of such tractor. W. Truck. Every motor vehicle designed, used~ or maintained primarily for the transportation of property? X. Used Motor Vehicle. Every motor vehicle which has been sold, bargained, exchanged, given away, or title transferred from the person who first acquired it from the manufacturer or importer, dealer, or agent of the manufacturer or im- porter and so used as to have become what is commonly known as IIsecondhandH within the ordinary meaning thereof: Pro- vided, that a new motor vehicle shall not be considered as a "used motor vehicle)! until it has been placed in a bOlla fide consumer use, notwithstanding the number of transfers of such motor vehicle. The term "bona fide consumer use" means actual operation by an owner who acquired the vehicle for use in business or for pleasure purposes and ltJho has been granted a Certificate of Title on such motor vehicle and has registered such motor vehicle, all in accordance with the laws of the residence of the owner. Section 18.139. Weight. This is the gross weight of a vehicle, whether operated singly or in combinationj without a load plus the weight of any load thereon. Section 18.140. Yield Right-Of-Way. When required by an official sign means the act of granting the privilege of the immediate use of the intersecting roadway to traffic within the intersection and to vehicles approaching from the right or left? but when the roadway is clear may proceed into the intersection. ~ ~ Article II. Obedience To And Effect Of Traffic Laws Section 18.201. Provisions of Chapter Refer to Vehicles Upon the Highways - Exceptions. The provisions of this Chapter relating to the operation ofdvehicles refer exclusively to the operation of vehi- cles upon highways except: A. Where a different place is specifically referred to in a given Section. B. The provisions of Article IV and V of this Chapter shall apply upon highways and elsewhere throughout the Village. Section 18.202. Required Obedience To Traffic Laws. It is unlawful and, unless otherwise declared in this Chapter with respect to partic- ular offenses, it is a misdemeanor for any person to do any act for- bidden or fail to perform any act required in this Chapter. Section 18.203. Obedience to Police Officers. No person shall wil- fully fail or refuse to comply with any lawful order or direction of any police officer invested by law with authority to direct, control, or regulate traffic. Section 18.204. Fleeing Or Attempting To Elude Police Officer. A. Any driver or operator of a motor vehicle who, having been given a visual or audible signal by a peace officer directing such driver or operator to bring his vehicle to a stop, wilfully fails or refuses to obey such direction, increases his speed, extin- guishes his lights, or otherwise flees or attempts to elude the officer, is guilty of a misdemeanor and shall be fined not less than $50 nor more than $500. B. The signal given by the peace officer may be by hand, voice, siren, red or blue light; provided, the officer giving such signal shall be in police uniform, and, if driving a vehicle, such vehicle shall be marked showing it to be an official police vehicle. r'" Section 18.205. Public Officers And Employees To Obey Act -- Exceptions. A. The provisions of this Chapter applicable to the drivers of vehi- cles upon the highways shall apply to the drivers of all vehicles owned or operated by the United States, State of Illinois, or any county, city, town, district or any other political subdivision of the State of Illinois, except as provided in this Section and subject to such specific exceptions as set forth in this Chapter with reference to authorized emergency vehicles. B. The driver of an authorized emergency vehicle, when responding to an emergency call or when in pursuit of an actual or suspected violator of the law or when responding to but not upon returning from a fire alarm, may exercise the privileges set forth in this Section, but subject to the conditions herein stated. ,,-,. ~ C. The driver of an authorized emergency vehicle may: 1. Park or stand, irrespective of the provisions of this Chapter; 2. Proceed past a red or stop signal or stop sign, but only after slowing down as may be required and necessary for safe opera- tion; 3. Exceed the maximum speed limits so long as he does not endan- ger life or property; 4. Disregard regulations governing direction of movement or turning in specified directions. D. The exceptions herein granted to an authorized emergency vehicle, other than a police vehicle, shall apply only when the vehicle is making use of either an audible signal when in motion or visu. a1 signals meeting the requirements of Section 12-114 of Chapter 9S 1/2, Illinois Revised Statutes. E. The foregoing provisions do not relieve the driver of an author- ized emergency vehicle from the duty of driving with due regard for the safety of all persons, nor do such provisions protect the driver from the consequences of his reckless disregard for the safety of others. F. The provisions of this Chapter, with the exception of Articles IV and V of this Chapter, do not apply to persons, teams, motor vehi- cles and other equipment while actually engaged in work upon the surface of the highway but apply to such persons and vehicles when traveling to or from such work. Section 18.206. Traffic Laws Apply To Persons Riding Bicycles Or Animals Or Driving Animal-Drawn Vehicles. Every person riding a bicycle or an animal or driving any animal drawing a vehicle upon a roadway shall be subject to the provisions of this Chapter applicable to the driver of a vehicle, except those provisions of this Chapter which by their nature can have no application. Section 18.207. Direction of Traffic At Scene Of Fire. Any Fire Department officer in command, or any fireman designated by him, may exercise the power and authority of a police officer in directing traffic at the scene of a fire or where the Fire Department has re- sponded to any emergency call for so long as Fire Department equip- ment is on the-scene, in the absence of or in assisting police. ~ ~. Article III. Traffic Signs~ Signals and Markings ?3ction 18.301. Temporary Controls. In cases of emergency? or when public health? safety or convenience require, the Village Manager may establish temporary traffic controls, including the designation of one way streets and the regulation or restriction of parking on any street or alley; provided that such controls shall not become effective until the posting of proper signs which must remain conspicuously displayed while said regulation is in effect; and provided further that no con- trol or regulation established pursuant to this Section shall be per- mitted to continue for a period of time in excess of twelve (12) con- secutive hours in a twenty-four (24) hour day. Section 18.302. Display Of Unauthorized Signs? Signals, Markings, Or Advertising Signs. A. No person shall place, maintain or display upon or in view of any street any unauthorized sign, signal, marking, or device which purports to be or is an imitation of or resembles an official traffic-control device or railroad sign or signal, or which atternp1ils to direct the movement of traffic, nor shall any person place, maintain or display upon or in view of any highway any other sign which hides from view or interferes with the movement of traffic or the effectiveness of any traffic control device or any railroad sign or signal. B. No person may place or maintain nor may any ~ubl~c aut~ority permit upon any. street ~hy traffic sign or slgna~ bearIng tnereon any commercial advertising. Co Every such prohibited sign, signal or marking is a public nuisance and the same shall be removed without notice Section 18.303. Interference With Official Traffic-Control Devices Or Railroad Signs Or Signals. No person shall without lawful author- ity attempt to or in fact alter~ deface, injure, knock down, or remove any official traffic-control device~ or any railroad sign or signal or any inscription, shield, or insignia thereon, or any other part thereoi. Sec tion 18.304. Unlawful Use Or Damage To Highways, Appurtenances. And Structures. It shall be unlawful for any person to wilfully in- jui~ or damage any public highway or street or any bridge, culvert, sign, signpost~ or structure upon or used or constructed in connection with any public highway or street for the protection thereof or for protection or regulation, of traffic thereon by any wilfully unusual, improper or unreasonable use thereof, or by negrig~~t driving or use of any vehicle thereon, or by wilful mutil~tion~ defacing or destruction thereof. ~ Section .J_~..~Q.~~_.__Qbe_9:iE:nc~_ To TrafJi_<:_=-Co.!?:trol Devices. A. No driver of a vehicle disobey the instructions of any official~raffic-contro~ ~evice placed in accordance with the provisions of this Chapter, unless at the time otherwise directed by a police officer. B. ,,-\ It shall be unlawful for any person to leave the roadway and travel across private property to avoid an official traffic device. ,.., ~ . No provision of this Chapter for which signs are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official sign is not in proper posi- tion and sufficiently legible to be seen by an ordinarjly observant person. Whenever a particular section does not state that signs are required, such section shall be effective even though no signs are erected or in place. Section 18.306. Traffic-Control Signal Legend. Whenever traffic is coni:rolled by traffic-control signals exhlbiting different colored lights successively one at a time, or with lighted green arrows, only the following colors shall be used and such terms and lights and lighted green arrows shall indicate and apply to drivers of vehicles and nedestrians as follows: A. Circular green (alone). 1. Vehicular traffic facing the signal may proceed straight through or turn right or left unless a sign at such place prohibits either such turn. But vehicular traffic shall yield the right-af-way to other vehicles and to pedestrians lawfully within the intersection at the time such signal is exhibited. ~ 2. Pedestrians facing the signal may proceed across the roadway within any marked or unmarked crosswalk unless directed otherwise by a pedestrian signal as provided under Section 18.307 of this Chapter. B. Steady yellow. 1. Vehicular traffic facing a steady yellow signal is thereby warned that the related green movement is being terminated or that a red indication will be exhibited immediately there- after when vehicular traffic may not enter the intersection. 2. Pedestrians facing a steady yellow signal unless otherwise directed by a pedestrian control signal, as provided in Section 18.307 of this Chapter, are thereby advised that there is insufficient time to cross the roadway, and no pedestrian shall start to cross. C. Steady red indic~!}on. 1. Vehicular traffic facing a steady red signal alone must stop at a clearly marked stop line, but if none, before entering the crosswalk on the near side of an intersection, or if none~ then before entering the intersection, and shall remain stand- irig until an indication to proceed is shown except as provided in paragraph C.2 of this Section. 2. When a sign is in place permitting a turn, vehicular traffic ~ facing a steady red signal may cautiously enter the inter- section to make the turn indicated by such sign after stoppi~g as required by paragraph C.1 of this Section. Such vehicular ~, traffic shall yield the right-of-way to pedestrians lawfully within an adjacent crosswalk and to other traffic lawfully using the intersection. .3. No pedestrian facing such signal shall enter the roadway unless he can do so safely without interfering with any vehicular traffic or unless a separate "Wallell indication 15 shown. D. Green straight-through arrow (alone). 1. Vehicular traffic facing the signal may proceed straight through, but shall not turn right or left. Such vehicular traffic shall yield the right-af-way to other vehicles and to pedestrians legally within the intersection at the time such signal is exhibited. 2. Pedestrians facing the signal may proceed across the roadway within the appropriate marked or unmarked crosswalk unless directed otherwise by a pedestria~ signal as provided in Section 18.307 of this Chapter. ~ E. Green turn arrow (with circular green, with steady yellow~ with steady red, or with green straight-through arrow). 1. Vehicular traffic facing the signal shall comply with the meaning of the circular green, steady yellow, steady red, or green straight-through arrow indication as if it were shown alone, except that such vehicular traffic may cautiously enter the intersection to make the movement indicated by the green turn arrow. Vehicular traffic shall yield the rigtt- of-way to pedestrians lawfully within a crosswalk and to other traffic lawfully using the intersection. " 1..1 ~ Pedestrians facing such signal shall comply with the meanlng of the circular green, steady yellow, steady red, or straight- through arrow indication as if it were shown alone, unless directed otherwise by a pedestrian signal as provided in Section 18.307 of this Chapter. ~ In the event an official traffic control signal or flashing red signal is erected and maintained at a place other than an inter- section, the provisions of this Section and Section 18.309 shall be np,licable except as to provisions which by their nature can have no application. Any stop required shall be at a traffic sign or a marking on the pavement indicating where the stop shall be made. ~. Section 18.307. Pedestrian Control Signals. Whenever special pedes- trian control signals exhibi ting the words nWalk" or "Don It Walkll ar~," in place such signals shall indicate as follows: ~ .-. A. Walk. While the "Walk" indication is illuminated~ pedestrians ~ facing such signal may proceed across the roadway in the diree tion of the signal, and shall be given the right-af-way by the drivers of all vehicles. B. Donlt Walk. While the "Don't WalkV1 indication is illuminated~ either steady or flashing~ no pedestrian shall start to cross the roadway in the direction of the signal~ but any pedestrian who' has partly completed his crossing during the "WalkV1 indication shall proceed to a sidewalk~ or to a safety island if one is provided. Section 18.308. Lane-Control Signals. Whenever lane-control signals ~r~.us?d in co~junction with official signs, they shall have the ~S'_Lo~l~ng m~~~n]n8s: A. Opaque arrow on green. green arrow on opaque background, or greeL alone. Drivers of vehicles facing such signal are permitted to use the lane or lanes over which the signal is displayed provided no intersection traffic control signal gives a stop indication affecting the lane or lanes involved. B. Opaque ;lX'/ on red, red I1X" on opaque background~ or red alone. Drivers of vehicles facing such signal are prohibited from using the lane over which the signal is displayed. Section 18.309. Flashing Signals. Whenever an illuminated flashing red or yellow signal is us~d in conjunction with a traffic control device it s]lal1 require obedience by vehicular traffic as follows: ~. B. Flashing yellow (caution signal). When a yellow lens is illumi- nated with rapid intermittent f1ashes~ drivers of vehicles may proceed through the intersection or pas~ such signal only with caution. ~ .~. Article IV. Accidents Section 18.401. Accidents Involving Death Or Personal Injuries. \. The driver of any vehicle involved in an accident resulting in injury to or death of any person shall immediately stop such vehicle at the scene of such accident, or as close thereto as possible and shall then forthwith return to, and in every event shall remain at, the scene of the accident until he has fulfilled the requirements of Section 18.403. Every such stop shall be made without obstructing traffic more than is necessary. ~. p~rson who has failed to stop or to comply with said require- ments shall, within 48 hours after such accident, or, if hospi- talized and incapacitated from reporting at any time during such period, within 48 hours after beins discharged from the hospitcl, report the place of actident, the date, the approximate time, his name, address, the registration number of the vehicle driven, a~d the names of the occupants, if any, of such vehicle, at the Moun~ Prospect police station. No report made as required under this Subsection shall be used, directly or indirectly, as a basis foy the prosecution of any violation of Subsection A of this Section. C.. Any person failing to comply wi th Subs ection A of this Sec tion shall upon conviction be fined not less than $100 or more than $300. D. Any person failing to comply with Subsection B of this Scctiorr shall upon conviction be fined not less than $300 nor more than $SOO~ or by both such fine and imprisonment. Section 18.402. Accident Involving Damage To Vehicle. The driver or any-Vehicle involved-in-an accident resulting only in damage to a vehicle which is driven or attended by any person shall immediately ston such vehicle at the scene of such accident or as close thereto as ~ossible, but shall forthwith return to and in every event shall remain at the scene of such accident until he has fulfilled the re- quirements of Section 18.403 of this Chapter. Every such stop shall be made without obstructing traffic more than is necessary. Section 18. 403. _J2~1L-I~ Giv~_ I~:~Jo~l]lai:Lop___~.nd_!3-ender Aid. A. The driver of any vehicle involved in an accident resulting in 5_::ljury to I);:' d8il th of any pe:tson or damage to any vehicle which is driven or attended by any person shall give his name, address, and the registration number of the vehicle he is driving and shall upon request and if available exhibit his driverls license to the person struck or the driver or occupant of or person attending any vehicle collided with an shall render to any person injured in such accident reasonable assistance, including the carrying or the making of arrangements for the carrying of such person to a physi- cian, surgeon or hospital for medical or surgical treatment. if it is apparent that such treatment is necessary or if such carrying ~ ~. 1S requested by the injured person. B. If none of the persons entitled to information pursuant to this Section is in condition to receive and understand such information and no police officer is present, such driver after rendering reasonable assistance shall forthwith report such accident at the Mount Prospect police station? disclosing the information required by this Section. f.e :::tion 18.404. Duty Upon Damaging Unattended Vehicle Or Other Prope~'~cr The driver of any vehicle which collides with or is involved in an n.cciden t wi th any vehicle which is una ttended ~ or other property;. Every such stop shall to m2dc without obstructing traffic more than is necessary. ,..,-.... Section 18.405. Striking Unattended Vehicles~Fixtures Or Other ~erty Prohibited. It shall be unlawful for the driver of any vehicle to strike unattended vehicles? fixtures or other property legally upon or adjacent to a street. Section 18.406. Duty To Report Accident. A. The driver of a vehicle which is in any manner involved in an accident within this State~ resulting in injury to or death of any person, or in which damage to the property of any one pcrson~ including himself, in excess of $100.00 is sustained, shall" 'is soon as possible but not later than 10 days after such accide11t, forward a written report of such accident to the Police DepartFcnt of the Village of Mount Prospect. B. The Department may require any driver" occupant or owner of a vehicle involved in an accident of which report must be made as provided in this Section or Section 18.410 of this Chapter to file supplemental reports whenever the original report is in- sufficient in the opinion of the Department, and may require wit- nesses of the accident to submit reports to the Department. Section 18.407. Immediate Notice Of Accident. The driver of a vehic]c; ~hichis in any manner involved in an accident described in Section 18.406 of this Chapter shall immediately and by the fastest means of communication submit notice of the accident at the police department, Village Hall, Village of Mount Prospect. Section 18.408. Police To Report. Every Village law enforcement ~fficer who investigates a vehicle accident of which a report is re- ~. .~ quired by this Art~ 1e or who prepares a writt . report as a result of an investigation either at the time and scene of such accident or thereafter by interviewing participants or witnesses shall file a written report of such accident to the Department on forms provided by the Department. Section 18.409. False Reports. Any person who provides information in an oral or written report required by this Article with knowledge or reason to believe that such information is false shall, upon con- viction, be fined not to exceed $500. Section 18.410. When Driver Fails To Report. Whenever the driver of a vehicle is physically incapable of making a required accident report and if there was another occupant in the vehicle at the time of the accident capable of making a report, such occupant shall make or cause to be made such report. If said driver fails for any reason to make such report, the owner of the vehicle involved in such accident, shall, as soon as he learns of the accident, make said report to the Depart- ment. Section 18.411. Accident Report Forms. A. The Department shall prepare and upon request supply without cost to other police departments, coroners, sheriffs, and other suitable agencies or individuals, forms for accident reports required here- under, which reports shall call for sufficiently detailed infor- mation to disclose with reference to a traffic accident the cause, conditions then existing, and the persons and vehicles involved. B. However, every required accident report shall be made on a fOTm approved by the Department of Public Works and Buildings of the State of Illinois. Section 18. 41~~~c_<:ide1-1J: ReQQr!~_~o~ttAeAtial 0 Ao All required accident reports and supplemental reports shall be without prejudice to the individual so reporting and shall be for the confidential use of the Department except that the Department may disclose the identity of a person involved in an accident whe~ such identity is not otherwise known or when such person denies his presence at such accident. No such report shall be used as evidence In any trial, civil or criminal, arising out of an accident, ex- cept that the Department shall furnish upon demand of any person who has, or claims to have made such a report, or upon demand of any court, a certificate showing that a specified accident repor~ has or has not been made to the Department solely to prove a com- pliance or a failure to comply with the requirement that such a report be made to the Department. B. The Department may furnish to the Department of Public Works and Buildings of the State of Illinois and the Secretary of State c0pies of required accident reports or infornation taken from such reports. Ali such copies of reports or information taken from them shall be for the confidential use of the Department of Public Works and buildings of the State of Illinois and the Secretary of State. Section 18.413. Furnishing Copies -- Fees. The Department may furnish copies of any traffic accident report that has been recorded by the Mount Prospect Police and shall be paid a fee of $2.00 for each such copy. ..~ Article V, Driving While Intoxicated; Transporting Alcoholic Liquor9_ And Reckless Driving Section 18,501, Persons Under The Influence Of Intoxicating Liquo:t _Qr ~arcotice Drugs, J\., No person who is under the influence of intoxicating liquor may drive or be in actual physical control of any vehicle within this Village. j No person who is an' habitual user of or under the influence of an~T narcotic drug or who is under the influence of any other drug to a degree which renders him incapable of safely driving a vehicle may drive or be in actual physical control of any vehicle within ~his Village. The fact that a person charged with a violation of this subsection B is or has been entitled to use such drug under the law of this State does not constitute a defense against any charge of violation of this subsection B. ~ Upon the trial of any action or proceeding arising out of the acts alleged to have been committed by any person while driving or in :ctual physical control of a vehicle while under the influence sf jntoxicating liquor9 evidence of the amount of alcohol in the per- son's blood at the time of the act alleged as shown by a chemical analysis of his breath, blood, urine, saliva or other bodily sub- stance is admissable~ as provided hereinafter in this paragraph C and the result of any such analysis shall give rise to the fol- 1m-ving presumptions: 1. If there was at the time of such analysis 0.05 percen~ or less by weight of alcohol in the person's blood~ it shall be presumed that the person was not under the influence of intoxicating liqcor; 2. If there was at the time of such analysis in excess of 0.G5 percent but less than 0.10 percent by weight of alcohol in the person's blood, such fact shall not give rise to any presumption that the person was or was not under the influ ence of intoxicating liquor, but such fact may be considered with other competent evidence in determining whether such person was under the influence of intoxicating liquor; 3. If there was at the time of such analysis 0,10 percent or more by weight of alcohol in the person's blood:; it shall be presumed that the person was under the influence of in toxi-- cating liquor, Percent by weight of alcohol in the blood shall be based upon grams of alcohol per 100 cubic centimeters of blood, Evidence based upon a chemical analysis of blood, urine, breath or other bodily substance shall not be admitted un- less such substance was procured and such analysis made with the consent of the person as provided by this Chapter, whose ~ bodily substance was so analyzed. The foregoing provisions of this paragraph C shall not be construed as limiting the introduction of any other com- petent evidence bearing upon the question whether or not the defendant was under the influence of intoxicating liquor. D Chemical analysis of the person's blood or breath to be con- sidered valid under this Section must be performed according to uniform standards adopted by the Illinois State Department of Public Health~ in cooperation with the Superintendent of State Highway Police, and by an individual possessing a valid permit issued by that Department for this purpose. L. When an unconscious person or person otherwise incapable of refusal is given a blood test at the request of a Mount Prospect police officer under the provisions of this Chapter, only a physician authorized to practice medicine in all its branches, a registered nurse or other qualified person may withdraw blood, in a. manner prescribed by the Illinois Department of Public Health for the purpose of determining the alcoholic content therein. F. The person tested may have a physician authorized to practice ~. medicine in all its branches, a qualified technician, chemist, registered nurse, or other qualified person of his own choosi to administer a chemical test or tests, at his own expense~ ir-. addition to any administered at the direction of a Mount Prospcc~ police officer. The failure or inability to obtain an additional test by a person does not preclude the admission of evidencG Ie lating to the test or tests taken at the direction of a Mount Prospect police officer. G. Upon the request of the person who submitted to a chemical test or tests at the request of a Mount Prospect police officer, full information concerning the test or tests must be made available to him or his attorney. H. Evidence of a refusal to submit to a chemical test is inadmissible in any civil action or proceeding, or quasi-criminal action ..- under this Se~tion' 18.501 brought against him for a vio12- tion of a local ordinance prohibiting driving a motor vehicle while under the influence of intoxicating liquor. However, nothing in this paragraph H shall prevent the admission of evi- dence of such refusal in a hearing on the suspension of a person' privilege to operate a motor vehicle" ~. 1. Every person who is convicted of a violation of this Section shall be punished by fine of not less than $100 nor more thaD $500. On a second or subsequent conviction for an offense committed within 5 years after the commission of the first offense he shall be punished by a fine of not less than $300. ~ 2. On a second or subsequent conviction for an offense committed within 5 years after the commission of the first offense he sha] 1 be punished by a fine of not less than $300 nor mOTe than $500. Section 18.502. Transportation Of Alcoholic Liquor -- Penalty. Ao No person shall transportJ carrYj possess or have any alcoholic liquor in or upon or about any motor vehicle except in the origi nal package and with the seal unbroken. R, A,person convicted of violating this Section shall be fined not less than $25 nor more than $500. Section 18.503. Reckless Driving. Any person who drives any vehicle with a willful or wanton dis- ~eg8.rd for the safety of persons or property is guilty of rec~- less driving. ..-' " EV0ry person convicted of reckless driving shall be punished upon conviction by a fine of not less than $25 nor m~re than $500. ~ Section 18.504. Drag Racing, Any person who, as an opera tor of <:' motor vehicle) is convicted of being a participant in drag racing shall be punished upon conviction by a fine of not less than $50 nor more than $500. .1"""""". .~ Article VI. Speed Restrictions. ~ Section 18.601. General Spe~d Restri~!ions. A. No vehicle may be driven upon any highway of this Village at a speed which is greater than is reasonable and proper with rcga to traffic conditions and the use of the highway~ or endangers the safety of any person or property. The fact that the speed of a vehicle does not exceed the applicable maximum speed limit dees not relieve the driver from the duty to decrease speed 0~ approaching and crossing an intersection~ when approaching and going around a curve, when approaching a hill crest, when traVR-' lng upon any narrow or winding roadway? or when special hS.Zdt:! exists with respect to pedestrians or other traffic or by reaso~ of weather or highway conditions. Speed must be decreased as may be necessary to avoid colliding wi th any person or v2hich: on or entering the highway in compliance with legal requireme:;).t2: and the duty of all persons to use due care. M. No person may drive a vehicle upon any highway of this Village at a speed which is greater than the applicable statutory maxi- mum speed limit established by paragraphs C or D of this Section, O~ by Section 18.605. o '\.! Unless some other speed restriction is established under this Chapter; the maximum speed limit in an urban district for all vehicles is: .,-.., 1. 30 miles per hnur; 2. 15 miles per hour in an alley; and 3. the said urban speed limit may be increased as posted but not in excess of 65 miles per hour and may be diminished as posted but not less than 20 miles per hour, when such deter- mination is passed and approved by ordinance, signpostcd, and included in Schedule I of the appendix to this Chaptc:. D. Unless some other speed restriction is established under this Chapter; the maximum speed limit in a residence district for all vehicles is: 1. 2S miles per hour; 2. 10 miles per hour in an alley; and ,,-.,\ 3. the said urban speed limit may be increased as posted but not in excess of 65 miles per hour and may be diminished as posted but not less than 20 miles per hour; when such determination is passed and approved by ordinance, sign- posted~ and included in Schedule I of the appendix to this Chapter. ,~ ~, ~ S~ction 18.602. Prima Facie Evidence Of Violation. Section 18.603. Motor Vehicles Of The Second Division. No person shall drive any vehicle of the - second di v-is ion ~ lvhich has a gross weight of fifteen thousand (15,000) pounds or more, at a speed greater than twenty-five (25) miles per hour in any district in this Village, notwithstanding the provisions of any other Section of this Article. Section 18.694. Railroad Crossing1~ed At Grade. No person shall drive any vehicle at a speed greater than fifteen (15) miles per hour when approaching within fifty (SO) feet of a grade crossing or any railroad when the driver's view is obstructed. A driver's view shall be deemed obstructed when he does not have a clear and uninterrupted view of the crossing itself and for a distance of three hundred (~OO) feet in every direction from the crossing. Section 18.605. ~pecial Speed Limit Wl~ile. Passing Schools. ~ A. No person shall drive a motor vehicle at a speed in excess of 20 miles per hour while passing a school zone or while traveling upon any public thoroughfare on or across which children pass along to and from school during scheel days when school dl'~l are present. B. This Section shall not be applicable unless appropriate signs arc posted upon streets and highways under the respective juri5d5c- tions maintained by the State of Illinois" township 9 c()uny, .,:,f district, or Village wherein the school zone is located. Such signs shall give proper due warning that a school zone is be5ng approached and shall indicate the school zone and the maximum speed limit in effect during school days when school children aTe present. Section 18.608. Special Speed Limitation On Elevated Structures 0 A. No person shall drive a vehicle over any bridge or other elevate" structure constituting a part of a highway at a speed which is grea ter than the maxim.um speed l,,,hich can be maintained wi th safety to such bridge or structure~ when such structure IS 5 ~ posted as provided by Ordinance. ts. Upon the trial of any person charged with a violation of this Section~ proof of the determination of the maximum speed by said Ordinance and the existence of such signs is conclusive evidence of the maximum speed which can be maintained with safety to such bridge or structure. ~. Section 18.609. Emergency Vehicles. The speed limits established by this Article or by regulation or ordinance made pursuant to the provisions of this Article do not apply~ except as otherwise pro- vided in Article XIV as to ambulances" to an authorized emergency vehicle ~n motion when responding to an emergency call and when th~ driver thereof sounds an audible signal by bell~ siren, or exhaust whistle, as may be reasonably necessary, provided that the vehicle is equipped and has in operation at least one lighted lamp displaying en? oscillating, rotating, or flashing red beam visible under normal at- mospheric conditions from a distance of 500 feet to the front of such vehicles. An authorized emergency fire department vehicle may be equipped and have in operation a triple eight moving white beam light visible under normal atffiospheric conditions from a distance of 500 feet to the front of such vehicle, in lieu of, or in addition to a rotating or flashing red beam, in order to be exempt from the speed Ihnits established by this Article or by regulation or ordinance l!lade pursuant to the provisions of this Article. No other autherized emergency vehicle shall use any oscillating triple eight moving white beam light other than fire department vehicles. Driving On Right Side Of Roadway Overtaking And Passing1 Etc, Ccction 18.701. Drive On Right Side Of Roadway -- Exceptions. A. Upon all roadways of sufficient width a vehicle shall be driven upon the right half of,the roadway, except as follows: 1. When overtaking and passing another vehicle proceeding In the same direction under the rules governing such movements; 2. When an obstruction exists making it necessary to drive to the left of the center of the highway; provided, any person so doing shall yield the right-of-way to all vehicles traveling in the proper direction upon the unobstructed por- tion of the highway within such distance as to constitute an immediate hazard; 3. Upon a roadway divided into three marked lanes for traffic lanes for traffic under the rules applicable thereon; 4. Upon a roadway restricted to one way traffic; ~ 5. Whenever there is a single track paved road on one side of the public highway and 2 vehicles meet thereon, the driver on whose rlght is the wider shoulder shall give the right-of-way on such pavement to the other vehicle, 11., Upon all roadways any vehicle proceeding at less than the norma.l speed of traffic at the time and place and under the conditions then existing shall be driven in the right-hand lane available for traffic, or as close as practicable to the right-hand curb or edge of the roadway 1 except when overtaking and passing another vehicle proceeding in the same dir~ction or when pre- paring for a left turn at an intersection or into a private road or driveway. Section 18.703. Overtaking A Vehicle On The Left. The following rules govern the overtakfng and passing of vehicles proceeding in the same directionJ subject to those limitations, exceptions, and special rules otherwise stated in this Chapter: ~ A. B. Except when overtaking and passing on the right is permitted. the driver of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle on audible signal and shall not increase the speed of his vehicle until completely passed by the overtaking vehicle. C. The driver of a 2 wheeled vehicle may not, in passing upon the lcft of any vehicle proceeding in the same direction, pass upon the right of any vehicle proceeding in the same direction unless there is an unobstructed lane of traffic available to permit such passing maneuver safely. Section 18.704. When Overtaking On The Right Is Permitted. A. The driver of a vehicle with 3 or more wheels may overtake and pass upon the right of another vehicle only under the following conditions: ~ 1. When the vehicle overtaken 1S making or about to make a left turn; 2. Upon a street or highway with unobstructed pavement not occupied by parked vehicles of sufficient width for 2 or more lines of moving vehicles in each direction; 3. Upon a one-way s treet ~ or upon any roadway on which traf:f;_,. is restricted to one direction of movement, where the road- way is free from obstructions and of sufficient width for 2 or more lines of moving vehicles. B. The driver of a 2 wheeled vehicle may not pass upon the right of any other vehicle proceeding in the same direction unless the unobstructed pavement to the right of the vehicle being passed is of a Hiclth of not less than 8 feet. c. The driver of a vehicle may overtake and pass another vehicle upon the right only under conditions permitting such movement in safety. In no event shall such movement be made by driving off the pavement or main-traveled portion of the roadway. Section 18.705. Limitations On Overtaking On The Left. No vehicle shallbe drIve-i1To--fh-e-Teft s-fCledOf the-Ceu-ferot-theroadway in overtaking and passing another vehicle proceeding in the same direc- tion unless authorized by the provisions of this Chapter and unless such left side is clearly visible and is free of oncoming traffic fer a sufficient distance ahead to permit such overtaking and passins to be completely made without interfering with the safe operation ,..-" ,,-, ~ of any vehicle approaching from the opposite direction or any vehi- cle overtaken. In every event the overtaking vehicle must return to an authorized lane of travel as soon as practicable and in the event the passing movement involves the use of a lane authQ:[i.z.cd for vehicles approaching from the opposite direction, bef6t~: . coming with1n 200 feet of any vehicle approaching from the oppOSi~0 direction. Secticm 18.706. Of Roadway. Further Limitations On Driving To The Left Of CenTC A. No vehicle may, in overtaking and passing another vehicle, be driven to the left side of the roadway under the following con- ditions: 1. When approaching or upon the crest of a grade or curve in the highway where the driver's view is obstructed within such distance as to create a hazard in the event another vehicle might approach from the opposite direction. 2. When approaching within 100 feet of or traversing any inter- section or railroad grade crossi~g. B. The limitations in sub-paragraphs 1 and 2 do not apply upon a ~ one-way roadway nor upon a roadway wi th unobstructed paver,lent of sufficient width for 2 or more lanes of moving traffic in each direction nor to the driver of a vehicle turning left into or from an alley, private road or driveway when such movements can be made with safety. Section 18.707. No Passing Zones. A. Where overtaking and passing or driving to the left of the road- way would be especially hazardous and whe~ by appropriate signs or markings on the roadway indicating the beginning and end of such zones~ the signs or markings are in place and clearly visi- ble to an ordinarily observant person, every driver of a vehiclE) shall obey the directions thereof. B. Where signs or markings are in place to define a no-passing zone as set forth in paragraph A no driver may at any time drive on the left side of the roadway within the no-passing zone or on the left side of any pavement striping designed to mark such nc- passing zone throughout its length except as otherwise indicated in this Section. C. The pavement striping designed to mark the no-passing zone may be crossed : ~. 1. From the left-hand lane for the purpose of completing a pass that was begun prior to the beginning of the zone in the driver's direction of travel; ~. ~ l~ 2. From the right-hand lane when making a left turn into or from an alley, private road or driveway when such movement can be made with safety, or 3. Under conditions set forth in Section 18.701 A. 2 of this Article. Section 18.708. One-way Roadways And Rotary Traffic Islands. A. It shall be unlawful to operate any vehicle upon a street or roadway designated and signposted for one-way traffic other than in the direction designated by Ordinances passed, approved and published by the Board of Trustees of the Village of Mount Prospect; and included in Schedule III of the Appendix to this Chapter. B. Upon a roadway so designated for one-way traffic~ a vehicle shall be driven only in the direction designated at all or such times as shall be indicated by official traffic devices. C. A vehicle passing around a rotary traffic island must be driven only to the right of such island. ~ D. Whenever any highway has been divided in to 2 01' more roadWEty:. by leaving an intervening space or by a physical barrier or a clearly indicated dividing section so constructed as to impede vehicular traffic~ every vehicle must be driven only upon the right-hand roadway unless directed or permitted to use another roadway by official traffic-control devices or police officer~. No vehicle may be driven overy across, or within any such di- viding space, barrier~ or section, except through an opening in the physical barrier, or dividing section, or space, or at a cross-over or intersection as established by public authority. ;::5':c:ion 18.709. Driving On Roadways Laned For Traffic. Whenever ')l roadv.ray has been di videa-in to 2 or more clearly marked lanes for traffic the following rules in addition to all others consistent herewith shall apply. Ao A vehicle shall be driven as nearly as practicable entirely within a single lanciand shall not be moved from such lane un- til the driver has first ascertained that such movement can be made with safety. B. D. Official traffic control devices may be installed prohibiting the changing of lanes on sections of roadways and drivers of vehicles sh~ll obey the directions of every such device. Section 18.710. Following too closely. le. The driver of a motor vehicle _ shall not follow another vehicle more closely than is reasonable and prudent~ having due regard for the sneed of such vehicles and the traffic upon and the condition~ of the highway. ~ B. The driver of any motor vehicle of the second division or mO~0r vehicle drawing another vehicle when .(raveling upon a roa(hTaY outside of a business or residence district shall not follow within 300 feet of another motor vehicle of the second divisian or motor vehicle drawing another vehicle. The provisions Ot this subdivision shall not be construed to prevent overtaking and passing nor shall the same apply upon any lane specially designated faT use by motor vehicles of the second division. c. Motor vehicles being driven upon any roadway outside of a busi- ness or residence district in a caravan or motorcade whether or not towing other vehicles shall be so operated as to allow suffi cient space between each such vehicle or combination of vehiclc:s so as to enable any other vehicle to enter and occupy such space without danger. This provision shall not apply to funeral pro- cessions. Section 18.711. Restrictions On Use Of Controlled Access Highway. The driver of a vehicle upon a highlvay upon meeting or overtaking) from either direction) any school bus which has stopped on the highway for the purpose of receiving or discharging any school children shall stop the vehicle before reaching the school bus when there is in operation on the school bus a visual signal as specified in Article XV of this Chapter~ and the driver shall Eot proceed until the school bus resumes motion or the driver of the vehicle is signaled by the school bus driver to proceed or the visual signals are no longer actuated. Bo Every school bus when used for the transportation of school ,~ ,~ ,~ ~, children must comply with the color requirements established by the Superintendent of Public Instruction and shall bear upon the front and rear thereof plainly visible signs containing the words 1'SCHOOL BUS" in letters not less than 8 inches in height, and in addition shall be equipped with visual signals meeting the requirements of Article XV of this Chapter; which shall be actuated by the driver of the school bus whenever the brakes ,-<IC applied. Such visual signals must remain actuated when children are loading or unloading from a school bus which is stopped on a roadway. Article VIII. Turning And Starting And Signals On Stopping And Turning Section 18.801. Required Posi tion And Method Of TurninE; At Intersections. The driver of" a vehicle intending to iurn at an intersection shall do so as follows: A. Both the approach for a right turn and a right turn shall be made as close as practical to the right-hand curb or edge of the road- way. B. The driver of a vehicle intending to turn left at any intersection shall approach the intersection in the extreme left-hand lane lawfully available to traffic moving in the direction of tn.v!;c of such vehicle} and after entering the intersection, the left turn shall be made so as to leave the intersection in a lane lawfully available to traffic moving in such direction upon the road"iay be ing entered. Whenever prac ticab Ie the Ie ft turn shall be made in that portion of the intersection to the left of the center of the intersection. "-\ \.. The several highway authorities in their respective jurisdictions within the corporate limits of the Village of Mount Prospect may cause official traffic control devices to be placed within or adjacent to intersections and thereby require and "Jirest that a different course from that specified in this Section be trav~led by vehicles turning at an intersection, and when such devices are so placed no driver of a vehicle shall turn a vehicle at an intersection other than as directed and required by such devices. Section 18.802. Turning On Curve Or Crest Of Grade Prohibited. No vehicle shall be tu~ned so as to proceed in the opposite directicl. upon any curve, or upon the approach to, or near the crest of a grade, where such vehicle cannot be seen by the driver of any other vehicle approaching from either direction within 500 feet. Section 18.803. Starting Parked Vehicle. No person shall start a vehicle which is stopped, stallding,-or parked unless and until such movement can be made with reasonable safety. Section _~:..804 ._When S~_gnal_Required. A. No person may turn a vehicle at an intersection unless the vehic~2 is in proper position upon the roadway as required in Section 18.801 or turn a vehicle to enter a nrivate road or driveway, 01' otherwise turn a vehicle from a dire~t course or move right' or left upon a roadway unless and until such movement can be made with reasonable safety. No person may so turn any vehicle with- out giving an appropriate signal in the matter hereinafter p~o- vided. ~ B, A signal of intention to turn right or left when required must be given continuously during not less than the last 100 feet ~. ~, ~ traveled by the vehicle before turning within a business OY residence district, and such signal must be given continuously during not less than the last 200 feet traveled by the vehicle before turning outside ~ business or residence district. Co No person may stop or suddenly decrease the speed of a vehicle without first giving an appropriate signal in the manner pro- vided in this Chapter to the driver of any vehicle immedia~ely to the rear when there is opportunity to give such a signal. D. The electric turn signal device required in Article XV of this Chapter must be used to indicate an intention to turn, change lanes or start from a parallel parked position but must not be flashed on one side only on a parked or disabled vehicle or flashed as a courtesy or lido passH signal to operators of other vehicles approaching from the rear. Section 18.805. Signal By Hand And Arm Or Signal Device. Any stop or turn signal when required herein shall be given either by means of the hand and arm or by an electric turn signal device. Section 18.806. Method Of Giving Hand And Arm Signals. All signals herein required given by hand and arm shall be given from the left side of the vehicle in the following manner and such signals shall indicate as follows: A. Left Turn -- Hand and arm extended horizontally. B. Right Turn -- Hand and arm extended upward. c. Stop Or Decrease Of Speed -- Hand and arm extended downward. Section 18.807. Prohibited Turns. It shall be unlawful to operate any vehicle so as to make any of the following turning movements' A. To turn so as to proceed in the opposite direction where pro' hibited, or otherwise unless such movement can be made in safety and without backing into traffic or otherwise inter- fering with traffic. B. As prohibited by Ordinance passed, approved, and published by the Board of Trustees of the Village of Mount Prospect; sign- posted and included in Schedule II of the Appendix to this Chapter. ~ .~ ~ Article IX. Right-Of-Way Section 18.901. Vehicles Approaching Or Entering Intersection. A. When 2 vehicles approach or enter an intersection from differen~ roadways at approximately the same time, the driver of the vehicle on the left must yield the right-of-way to the vehicle on the right. B. The right-of-way rule declared in subsection A. of this Section is modified at through highways and otherwise as stated in this Chapter. Section 18.902. Vehicle Turning Left. The driver of a vehicle in- tending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right-of-way to any vehi- cle approaching from the opposite direction which is so close as to constitute an immediate hazard, but said driver. having so yielded may proceed at such time as a safe interval occurs. ~ Section 18.903. Vehicles Entering Stop Crosswalk. Where stop signs or flashing red signals are in place at an intersection or flashing red signals are in place at a plainly marked crosswalk between inter- sections, drivers of vehicles shall stop before entering the nearest crosswalk and pedestrians within or entering the crosswalk at either e~g0 of the roadway shall have the right-of-way over vehicles so stopped. Drivers of vehicles having so yielded the right-of-way to pedestrians entering or within the nearest crosswalk at an inter- section shall also yield the right-af-way to pedestrians within any er crosswalk at the intersection. Section 18.904. Vehicle En!~ring Stop Or Yield Intersection. jl, Preferential right-of-way at an intersection may be indicated by stop or yield signs as authorized by the Village Manager, sign- posted, and included in Schedule IV of the APpendix to this . Chapter. .~ ~ Except when directed to proceed by a police officer or traffic- control signal, every driver of a vehicle approaching a stop intersection indicated by a stop sign shall stop at a clearly marked stop line, but if none) before entering the crosswalk on the near side of the intersection, or if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the intersection. After having stopped) the driver shall yield the right-of-way to any vehicle which has entered the intersec- tion from another roadway or which is approaching so closely on the roadway as to constitute an immediate hazard during the time when the driver is moving across or within the intersecticn, but said driver having so yielded may proceed at such time as G safe interval occurs. C. The driver of a vehicle approaching a yield sign shall in obedi- ence to such sign slow down to a speed reasonable for the exis'(> ing conditions andJ if required for safety to stop) shall stop at a clearly marked stop 1ine~ but if none, before entering the crosswalk on the near side of the intersection, or if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway. After slowing or stopping~ the driver shall yield the right-of- way to any vehicle in the intersection or approaching on anothe~ roadway so closely as to constitute an immediate hazard during the time such driver is moving across or within the intersection. D. If a driver is involved in a collision at an intersection or interferes with the movement of other vehicles after driving past a yield right-of-way sign~ such collision or interference shall be deemed prima facie evidence of the driver's failure to yield right-of-way. Section 18.905. Merging Traffic. At an intersection where traffic lanes are provided for merging trafficJ the driver of each vehicle ort the converging roadways is required to adjust his vehicular speed and lateral position so as to avoid a collision with another vehicle. Section 18.906. Vehicle Entering Highway From Private Road Or Driveway. The driver of a vehicle about to enter or cross a high- way from an alley~ buidling, private road or driveway shall yield the right-af-way to all vehicles approaching on the highway to be entered. . Section 18.907. Operation Of Vehicles On Approach Of Authoriz:3d Emergency Vehicles. A. Upon the immediate approach of an authorized emergency vehicle: making use of audible and visual signals meeting the requirements of this Chapter or a police vehicle properly and lawfully makinp use of an audible or visual signal~ the driver of every other vehicle on the same roadway shall yield the right-of-hTay and. s!lalJ_ immediately drive to a position parallel to, and as close as pas- s ib Ie to, the right- hand edge or curb of the street c leal' of a:ny intersection and shall stop if possible and remain in such posi- tion until the authorized emergency vehicle has passed, except when otherwise directed by a police officer, B. This Section shall not operate to relieve the driver of an au- thorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the h hway. Section 18.908. Funeral Processions. A. Funeral processions have the right-of-way at intersections when vehicles comprising such procession have their headlights lighted, subject to the following conditions and exceptions: 1. Operators of vehicles in a funeral procession shall yield the righ t- of -way upon the approach of an authorized emer.. I""""- gency vehicle giving an audible or visible signal; ~\ 2 . Onerators of vehicles in a funeral procession shall yield the right-of-way when directed to do so by a traffic officeY~ 3. The operator of the leading vehicle in a funeral procession shall comply with stop signs and traffic control signals but when the leading vehicle has proceeded across an inter- section in accordance with such signal or after stopping as required by the stop sign, all vehicles in such proces- sion may proceed without stopping~ regardless of the sign or signal and the leading vehicle and the vehicles in procession shall proceed with due caution. B. The operator of a vehicle not in the funeral procession shall not drive his vehicle in the funeral procession except when authorized to do so by a traffic officer or when such vehicle is an authorized emergency vehicle giving audible or visual signal. c. Operators of vehicles not a part of a funeral procession may not form a procession or convoy and have their headlights lighted for the purpose of securing th~ right-of-way granted by this Section to funeral processions. D The operator of a vehicle not in a funeral procession may over- take and pass the vehicles in such procession if such overtaking and passing can be accomplished without causing a traffic hazard or ~nterfering wit~ such procession. ~\ The lead vehicle in the funeral procession may be equipped with a flashing amber light which may be used only when such vehicle is used as a lead vehicle in such procession. Vehicles com- prising a funeral procession must ~tilize funeral pennants or flags or windshield stickers to identify the individual vehi- cles in such a procession. ,~ Sc;ctiofl 18.909. BlindPedestrians - Right-Of:-Way. Any blind person :;;rho rs carrYln'&E':in a 'rGdsed or extended positron-a cane or walkins stick which is white in color or white tipped with red, or who is being guided by a dog, shall have the right-of-way in crossing any s~re8t or highway, whether or not traffic on such street or highway is controlled by traffic signals, anything in this Chapter notwith- standing. The driver of every vehicle approaching the place where ~".. ~)lifLd person, so carrying such a cane or wa:::'king stick or being so guided, is crossing a street or highway shall bring his vehicle to a full stop and before proceeding shall take such precautions as may be necessary to avoid injury to the blind person. The pro- visions of this Section shall not apply to a blind person who is not carrying such a cane or walking stick or who is not guided by a dog, but the other provisions of this Chapter relating to pedes- trians shall then be applicable to such person. Article X. Pedestrians' Rights And Duties r-, Section 18.1001. Pedestrian Obedience To Traffic Control Devices And Traffic Regulations. A. A pedestrian shall obey the instructions of any official traffic control device specifically applicable to him, unless otherwise directed by a police officer. B. Pedestrians shall be subject to traffic and pedestrian control signals provided in Sections 18.306 and 18.307 of this Chapter~ but at all other places pedestrians shall be accorded the privi- leges and shall be subject to the restrictions stated in this Article. Section 18.1002. Pedestrians' Right-Of-Way At Crosswalks. A. Where traffic control signals are not in place or in operation the driver of a vehicle shall yield the right-of-way~ slowing down or stopping if need be to so yiel~ to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection? except as otherwise provided in this Article. B. Whenever any vehicle is stopped at a marked crosswalk or at any unmarked crosswalk at an intersection to permit a pedestrian to cross the roadway ~ the driver of any other vehicle a::ml~oacr.- ing from the rear shall not overtake and pass such stopped vehl- cleo C. Whenever stop signs or flashing red signals are in place at a~ intersection or at a plainly marked crosswalk between intersec- tions, pedestrians shall have the right-af-way over drivers of vehicles as set forth in Section 18.904 of this Chapter. ~_ection l8.100~~_~ros..?_ing ~_~_Qth~.E_~~?-~~rC?sswalks. Every pedestrian crossing a roadway at any point other than ',^fit;J.in a marked crosswalk or within an unmarked crosswalk at an inter- section shall yield the right-of-way to all vehicles upon the roadway. ,~ . J\ny pedestrian crossing a roadway at a point where a pedestrian tunnel or overhead pedestrian crossing has been provided shall yield the Tight-of-way to all vehicles upon the roadway. r Notwithstanding the provisions of this Section every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian upon any roadway and shall give warning by sounding the horn when necessary and shall exercise proper precaution upon observing any child or any confused or incapacitated person upon a roadway. .~ ~ Section 18.1004. Blind Persons -- Right-Of-Way. Any blind person who is carrying in a raised or extended position a cane or walking stick which is white in color or white tipped with red, or who is being guided by a dog, shall have the right-of-way in crossing any street or highway, whether or not traffic on such street or highway is controlled by traffic signals, anything in this Chapter to the contrary notwithstanding. The driver of every vehicle approaching the place where a blind person, so carrying such a cane or walking stick or being so guided, is crossing a street or highway shall bring his vehicle to a full stop and before proceeding shall take such precautions as may be necessary to avoid injury to the blind person. The provisions of this Section shall not apply to a blind persoil who is not so carrying such a cane or walking stick or who is not guided by a dog, but the other provisions of this Chapter relating to pedestrians shall then be applicable to such person. However, the failure of a blind person to so use or carry such a cane or walking stick or to be guided by a guiue dog when walking on streets, highways or sidewalks shall not be considered evidence of contributory negligence. Section 18.1005. Pedestrians To Use Right Half Of Crosswalks. Pedestrians shall move, whenever practicable, upon the right half of crosswalks. Section 18.1006. Pedestrians Soliciting Rides Or Business. A. No person shall stand in a roadway for the purpose of soliciting a ride from the driver of any vehicle. B. Outside a business or residence district, no person shall stand on or in the proximity of a roadway for the purpose of soliciting employment, business; or contributions from the occupant of 2ny vehicle. C. No person shall stand on or in the proximity of a roadway for the purpose of soliciting the watching or guarding of any ve- hicle while parked or about to be parked on a street or highway. Section 18.1007. Pedestrians Walking On Roadway. A. Any person walking 'along and upon improved roadways shall keep on the left of the paved portion? or on the left shoulder thereof, and upon meeting a vehicle when walking on such paved portion shall step off to the left. B. Where sidewalks are provided it is unlawful for any ?edestrian to walk along and upon an adjacent roadway except at a crosswalk. C. It is unlawful for any pedestrian who is under the influence of intoxicating liquors to be upon any roadway of this Village. ,'-'" Eection 1801008. Pedestrians I Right-Of-1Nay Or: Sidewalks. The driver of a vehicle emerging from or entering an alley, b~ilding private road~ or driveway shall yield the right-of-way to any pedestrian approaching on any sidewalk or any sidewalk area ex- tending across such alley~ building entrance, road or driveway. Section 18.1009. Interference With Other Citizens. A. Any person who shall wilfully and unnecessarily hinder;; ob- struct, or delay, or who shall wilfully and unnecessarily attempt to delay) hinder, or obstruct any other person in lawfully driving or traveling along or upon any Village street or highway or who shall offer for barter or sale merchandise on said highway so as to interfere with the effective movement of traffic shall be guilty of a misdemeanor. B. It shall be unlawful for any pedestrian to stand upon any sidewalk except as near as is reasonably possible to the building line or curb line) if such standing interferes with the use of said sidewalk by other pedestrians. ,~ ,~ r<-' ~ ~. Article XI. Motorcycles Sec~ion 18.1101. Operation Of Motorcycles Or Motor-Driven Cycles Upo;~ A Public Street. I t shall be unlawful for any person ~ corpora tfon'~--- partnership or other legal entity to operate or cause to be operated a motorcycle or motor-driven cycle upon any street within the cor- porate limits of the Village of Mount Prospect except in compliance with the following: A. The operator of such vehicle shall have upon his or her posscssicTI a valid driver's license issued by the State of Illinois (or if such operator is a non-resident~ such operator shall have upon his or her possession evidence of a non-resident's operating p~ivilege) and which has not been suspended, limited, or cancelled B. Such vehicle shall at such time of operation be capable of per- forming in accordance with the standards then fixed by the Motor Vehicle Laws of the State of Illinois and by the Ordinances of the Village of Mount Prospect. c. The operator shall operate said vehicle in accordance with the Motor Vehicle Laws of the State of Illinois and Ordinances of the Village of Mount Prospect. D. Such vehicle shall be equipped with an exhaust system in good working order, sufficient to prevent excessive or unusual noises; and no such vehicle shall be equipped with any muffler cut-out? removable exhaust pipe cover. or any by-pass in a muffler, O~ any muffler from which the baffle plates, screens, or other origi- nal internal parts have been removed or altered, nor shall Hny such vehicle be ~quipped with an exhaust system which has been modified in a manner which will amplify or increase the noise emitted by the motor of such vehicle above that emitted by the exhaust system originally installed on the vehicle, nor shall such vehicle be equipped with an exhaust system which has been modified or altered in any way from that furnished by the veLicle manufacturer; provided, however, that equipment equivalent to that originally installed may be substituted when parts are re- placed. E" If said vehicle is rented, leased~ or borrowed from another, said operator shall first have demonstrated to the lessor, re~~e~j or lender of such eq~ipment that he or she is sufficiently pro- ficient to operate such vehicle upon a public street without un- reasonable danger to others. F. No person under 18 years of age shall purchase, rant, lease, O~ borrow a motorcycle or motor-driven cycle unless he or she has first obtained written consent from either of his or her parents, or his or her legal guardian; and no such person under 18 years of age shall take possession of and operate any motorcycle or motor-driven cycle unless on the occasion of such purchasing, cr on the first occasion or such renting; leasing or borrowing of such motorcycle or motor-driven cycle such person under 18 years (' ! ,~ ~ of age obtains and files with such seller, renter, lessor, or lender an acknowledgement in writing, signed by either parent of such minor or such minoris legal guardian, in the presence of and witnessed by such lessor, renter, or lender, or his duly authorized agent, to the effect that permission is granted for such child to purchase a vehicle, or to rent, lease or borrow a motorcycle or motor-driven cycle from such renter, lessor, or lender, and that such parent or guardian consents to such sale and/or consents to the renting, leasing, or lending of a motor- driven cycle to such child, and assumes full legal responsibility for acts or actions of such child in the operation of any such motorcycle or motor-driven cycle then or thereafter sold, rentod, leased, or lent to such child, and such responsibility and C0rn- mitment of such parent or guardian shall continue until it 'is revoked in writing by either parent or by said guardian by written instrument delivered to such seller, lessor, renter, or lender. A copy of this written permission must be in possession of the operator of cycle for presentation upon request. The operator of a motorcycle shall ride only astride the permanent and regular seat or saddle attached thereto, and the operator sh~ll not permit more than one other person to ride thereon nor shall such other person ride on the motorcycle unless it is designed to carry 2 people, in which event the passenger shall also ride astride the permanent and regular seat or saddle if it is designed for 2 persons, or astride another seat or saddle firmly attached to the rear of the operator; however, any seat or saddle designed for a passenger must be equipped with permanent handgrips and, in addi- tion, the motorcycle must be equipped with footrests adjusted to fit such passenger. A sidecar may be attached to a motorcycle in which additional persons may ride. H. No motorcycle or motor-driven cycle shall be operated in any manner so as to cause a disturbance in any area of the Village. I. No operator of a motorcycle or motor-driven cycle shall engage in maneuvers, stunting or other opeTations dangerous to himself or his passenger or to the person or property of others; and ex- cept, when done for the better control of a vehicle, in cmcygen- cias or to maneuver rough passages of a street, an operator must at all times keep body contact with the saddle or see.t of SUc[~ vehicle. J. Special Equipment For PersoI!:?__~i~inR_l1~tor_cYc:_les. 1. The operator of a motorcycle and every passenger thereon must wear protective headgear. The Illinois State Department of Public Safety shall determine the standards for this equip- ment and such standards may not be less than those established by the United States Department of Transportation. 2. In addition, the operator of a motorcycle and every passenger thereon shall be protected by glasses> goggles or a trans- parent shield. The Illinois State Department of Public Safety ~. ~ shall determine the standards for this equipment, 3. Protective headgear specified in this Section that is sold or used in the State of Illinois must bear a permanent dis- tinguishing mark or stamp of approval to indicate that it meets the minimum standards. K. Required Equipment On Motorcycles. 1. No person shall operate any motorcycle or motor-driven cyc]e with handlebars more than 15 inches in height above that portion of the seat or saddle occupied by the operator. 2. Any motorcycle carrying a passenger~ other than in a sidecar or enclosed cab, shall be equipped with permanent ha~dgrips on the seat or saddd1e carrying such passenger, and with footrests adjusted to fit such passenger. Section 18.1102.. Punishment. Any person, corporation} partnership} or other legal entity violating any of the terms of or provisions of this Article shall, upon conviction thereof) be punished by a fine of not less than $25.00 nor more than $500.00. ,~. Article XII. Special Stops Required ~ Section 18.1201. Obedience To Signal Indicating Approach Of Train. A. Whenever any person driving a vehicle approaches a railroad grade crossing and a clearly visible electric or mechanical signal device gives warning of the immediate approach of a train, the driver of such vehicle shall stop within fifty feet but not less than ten feet from the nearest track of such rail- road and shall not proceed until he can do so safely. B. The driver of a vehicle shall stop and remain standing and not traverse such a grade crossing when a crossing gate is lowered or when a flagman gives or continues to give a signal of the approach or passage of a train. . C. The driver of a vehicle shall stop, within SO feet but not less than 10 feet from the nearest track when a train is approaching so closely that an immediate hazard is created, and shall not proceed until he can do so safetly. Section 18.1202. Certain Vehicles Must Stop At All Railroad Grade Crossings. A. The driver of any motor vehicle carrying passengers for hire, f~ or of any school bus carrying any school child, or of any vehi- cle carrying liquid petroleum and liquid petroleum products, explosives, flammable or oxidizing liquids and solids, flammable or poisonous compressed gases, volatile liquids and solids which emit poisonous fumes, corrosive liquids, and radioactive materi- als as a cargo or part of a cargo, before crossing at grade any track or tracks of a railroad, shall stop such vehicle within 50 feet but not less than 10 feet from the nearest rail of such railroad and while so stopped shall listen and look in both directions along such track for any approaching train, and for signals indicating the approach of a train, except as hereinafter provided, and shall not proceed until he can do so safely. D, No stop need be made at any such crossing where a police officer or a traffic control signal directs traffic to proceed. C. This Section shall not apply to street railway grade crossings within a business or residence district. Section 18.1203. Moving Heavy Equipment At Railroad Grade Crossing. !~ A. No person shall operate or move any track type vehicle, steam shovel, derrick, roller, or any equipment or structure having a normal operating speed of 6 or less miles per hour or a verti- cal body or load clearance of less than 9 inches above the level surface of a roadway upon or across any tracks at a railroad . grade crossing without first complying with this Section. ~ B. Notice of any such intended crossing shall be given to a super- intendent of such railroad and a reasonable time be given to such railroad to provide proper protection at such crossing. C. Before making any such crossing the person operating or moving any such vehicle or equipment shall first stop the same not less than 10 feet nor more than 50 feet from the nearest rail of such railway and while so stopped shall listen and look in both directions along such track for any approaching train and for signals indicating the approach of a train~ and shall not proceed until the crossing can be made safely. D. No such crossing shall be made when warning is given by auto- matic signal or crossing gates or a flagman or otherwise of the immediate approach of a railroad train or car. Section 18.1204. Stop And Yield Signs. A. Preferential right-of-way at an intersection may be indicated by stop signs or yield signs as authorized in Section 18.302 of this Chapter and Schedule IV bf the appendix hereto. B. Except when directed to proceed by a police officer or traffic control signal, every driver of a vehicle . approaching a stop intersection indicated by a stop sign shall stop before entering the crosswalk on the near side of the intersection or, in the event there is no crosswalk, shall stop at a clearly marked stop line, but if none, then at the point nearest the intersection roadway where the driver has a view of approaching traffic on the intersecting roadway before entering the intersection. C< The driver of a vehicle approaching a yield sign if required for safety to stop shall stop before entering the crosswalk on the near side of the intersection or, in the event there is no cross- walk, at a clearly marked stop line, but if none, then at the point nearest the intersecting roadway where the driver has a view of approaching traffic on the intersecting roadway. Section 18.1205. Emerging From Alley, Building, Private Road Or Driveway. The driver of a vehicle emerging from an alley~ building" private road or driveway shall stop such vehicle immedi- ately prior to driving into the sidewalk area extending across such alley, building entrance, road or driveway. or in the event there is no sidewalk area, shall stop at the pointnear~st the street to be entered where the driver has a view of approaching traffic thereon, and shall yield the right-of-way to any pedestrian as may be necessary to avoid collision, and upon entering the rbad~ way shall yield the right-of-way to all vehicles approaching on said roadway. "'-", ~ Article XIII. Stopping~ Standing~ And Parking Section 18.1301. Stopping~ Standing Or Parking Outside Of Business Or Residence District. A.. Upon any street outside of a business or residence district no person shall stop~ park~ or leave standing any vehicle~ whether attended or unattended~ upon the paved or main-traveled part of the street when it is practical to stop, park, or so leave such vehicle off such part of said street, but in every event a clear and unobstructed width of the street opposite such standing vehicle shall be left for the free passage of other vehicles and a clear view of such stopped vehicle shall be available from a distance of 200 feet in each direction upon such street. !~ b. The Village Manager shall have authority to prohibit the stopping, standing~ or parking of vehicles or to prescribe time limits for parking on any street or highway under the control and jurisdic- tion of the Village or for the maintenance of which the Village is responsible, in such manner as he shall deem necessary to promote public convenience and safety and so as to facilitate traffic. Any such regulations adopted by the Board of Trustees or the Village Manager regarding the stopping, standing or parking of vehicles upon any specific street, streets, or high- ways shall become effective on and after the qate of the erec- tion of appropriate signs indicating such regulations and such designation is included on Schedule V of the APpendix to this Chapter. C. This Section shall not apply to the driver of any vehicle which is disabled while on the paved or main-traveled portion of a street in such manner and to such extent that it is impossible to avoid stopping and temporarily leaving such disabled vehicle in such position; provided~ however, that at least one door of any motor vehicle permitted to stand unattended on the paved or main~traveled part of any highway shall be left unlocked. Section 18.1302. Officers Authorized To Remove Illegally Stopped Vehicles. A. Whenever any police officer finds a vehicle standing upon a high- way in violation of any of the prqvisions of this Article such officer is authorized to move sucq vehicle, or require the driver or other person in charge of the Vehicle to. move the same, to a position off the paved or improved or main-traveled part of such highw'ay. ~. B. Any police officer is hereby authorized to remove or casue to be removed to a place of safety at the expense of the owner any un- attended, abandoned or disabled vehicle left standing upon any street~ highway~ bridge, causeway, or elevated structure, or within a tunnel underpass or subway in such a position or under ~. ~.. ~ such circumstances as to obstruct the normal movement of traffic, or any vehicle left unattended on any highway in this Village for a period of 24 hours or more. The same authority is also granted regarding any vehicle found upon any street when: 1. Report has been made that such vehicle has been stolen or taken without consent of its owner, or 2. The person or persons in charge of such vehicle are unable to provide for its custody or removal, or 3. When the person driving or in control of such vehicle is arrested for an alleged offense for which the officer is required by law to take the person arrested before a proper judicial official without unnecessary delay. Whenever the Department finds an abandoned or disabled vehicle standing upon the paved or main-traveled part of a street~ which vehicle is or may be expected to interrupt the free flow of traffic on the street or interfere with the maintenance of the street, the Department is authorized to move the vehicle to a position off the paved or improved or main-traveled part of the street. Section 18.1303. Parking Prohibited In Specific Places. ~. A. No person shall park a vehicle, except when necessary to avoid conflict with other traffic or except in compliance with the directions of a police officer or traffic control device in any of the following places: 1. On a sidewalk; 2. In front of a public or private driveway; 3. Within an intersection; 4. Within 15 feet of a fire hydrant; ~. On a crosswalk; 6. Within 20 feet of a crosswalk at an intersection; 7. Within 30 feet upon the approach to any flashing beacon, stop sign, or traffic-control signal located at the side of a roadway; 8. Between a safety zone and the adjacent curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is in- dicated by signs or markings; 9. Within 50 feet of the nearest rail of a railroad grade crossing; .~. ~ 10. Within 20 feet of the driveway entrance to any fire station and on the side of a street opposite the en- trance to any fire station within 75 feet of said en- trance when properly signposted; 11. Alongside or opposite any street excavation or obstruc- tion when such parking would obstruct traffic; 12. On the roadway side of any vehicle parked at the edge or curb of a street; 13. Upon any bridge or other elevated structure upon a high- way or within a highway tunnel; 14. At any place where official signs prohibit parking; pro- vided such sign is included in the appropriate Schedule(s) of the appendix to this Chapter; 15. Upon any berm, shoulder~ or parkway adjacent to any road- way; excluding driveways. B. No person other than a police officer~ as provided in Section 18.1302 of this Chapter, shall move a vehicle into any such prohibited area or away from a curb such distance as is unlaw- ful or start or cause to be started the motor of any motor vehicle, or shift) change, or move the levers, brake, starting ~. device, gears, or other mechanism of a parked motor vehicle to q position other than that in which it was left by the owner or driver thereof, or attempt to do so. Section 18.1304. Angle Parking -- One-Way Roadways. A. Every vehicle stopped or parked upon a roadway where there is an adjacent curb shall be so stopped or parked with the right- hand wheels of such vehicle parallel with and within 12 inches of the right-hand curb, unless angle parking is permitted by other ordinance. B. Except when otherwise provided in this Chapter, every vehicle s topped or parked upon a one -.way roadway shall be so stopped or parked parallel to the curb or edge of the roadway, in the direction of authorized traffic movement, with its right-hand wheels within 12 inches of the right-hand curb or edge of the roadway, or its left-hand l-.rheels within 12 inches of the left- hand curb or edge of the roadway. Section 18.1305 0 ~io~9:_!:_tt:l!l Of Parking Regulation - - Leased Vehicles. ,~ A. Every person in whose name a vehicle is registered pursuant to the \lIllinois Motor Vehicle Law", approved July 11~ 1957~ as heretofore and hereafter amended and who leases such vehicle to others, after receiving written notice of viola- tion of this Article involving such vehicle, shall upon request provide such police officers as have authority of the offense, and the court having jurisdiction thereof~ with a written state- ~ /~, ~ ment of the name and address of the lessee at the time of such offense and the identifying number upon the registration plates of such vehicle. b. A person convicted of violating this subsection shall be fined at least Twenty-Five Dollars ($25.00) but not to exceed One Hundred Dollars ($lDO.OO), notwithstanding any other Sections or subsections in this Chapter to the contrary. Section 18.1306. School Bus Stopping On 4 Lane Highway. A. A school bus traveling on a highway having 4 or more lanes for vehicular traffic shall stop for the loading or discharging of passengers only on the right side of the highway and when so stopped shall load or discharge only those passengers whose residences are located to the right of the highway. .r~ The routes of school buses shall be so arranged that no child shall be required to cross such a 4 or more lane highway to board a school bus or to reach his residence after leaving the bus. This subsection shall not apply when children are escorted by competent persons designated by the school author- ities or by law enforcement officers. ~ Section 18.1307. Interference With Fire Apparatus Prohibited. The ,irIver-6f any vehicle other than one on officiat tushiesS-shall not park such vehicle within the block where fire apparatus has stopped in answer to a fire alarm. Section 18.1308. Unattended Motor Vehicle. No person driving or in charge of--a-' motor vehicle shall permit it to stand unattended without first stopping the engine; locking the ignition and removing tho key} or when standing upon any perceptible grade without effec- tively setting the brake thereon and turning the front wheels to the curb or side of the street. S~~t~~Q~ 18.1309. Alleys. No person shall park a vehicle within an alley in such a manner or under such conditions as to leave available less than 10 feet of the width of the roadway for the free movement of vehicular traffic, and no person shall stop~ stand9 or park a vehicle within an alley in such a position as to block the driveway entrance to any abutting property. Section 18.1310. Cab Stands - Bus Stands. No vehicle other than r:-licensed taxicab shall be parked in any area designated by Ordi- nance as a cab s tand ~ and no velli cle 0 ther than a bus shall be parked in a place so designated as a bus loading zone; when such cab and bus stands are signposted and included on Schedule VI of the appendix to this Chapter. ~ Section 18.1311. Loading Zone. During the times specified herein; Itshallbeun1aw{ul for the driver of a vehicle to stand a passen- ger vehicle for a period of time longer than is necessary for the loading or unloading of passe~gsrs~ not to exceed three minutes; r-.. ~ and for the driver to stand any freight carrying vehicle fOT a period of time longer than is necessary to load; unload and de- liver materials, not to exceed thirty minutes, in any of the following places: ^ "' . In any public alleyy during any hour of the day or night. B 0 At any place not to exceed 75 feet along the curb before the entrance to any hospital or hotel at any time. I~ 'u. At any place not to exceed 75 feet along the curb before the entrance to a public building between 8 olclock a.m. and 6 o'clock p.m. except on Sunday. Directly in front of the entrance to any theater at any time the theater is open for business. D. Section l8.~3l2. Truck Loading And Parking In Residence Districts. No person~ firm, or corporation shall stand or park any truck~ tractor, semi-trailer or bus on any street in any residence district within the Village for a longer period than is necessary for the expeditious loading or unloading of such vehicle: provided that, where any street fronts in part on a residence district and in part on any district otherwise classified. ,~. Section 18.1313. Parking Of Vehicles For Sale. It shall be un- la\~Tfurt() park miy vehicle upon any street for the purpose of dis- playing it for sale, or to park any vehicle upon any business street from which vehicle merchandise is peddled. Section 18.1314. No Parking During Snow Removal. No Park.ing Any Time, Except in compliance with u.5rections of a police officer ~ at any time it shall be unlal'lful ~0 permit any vehicles to stand in any of the places designated b;i the Village Manager and signposted and included on Schedule VI of the APpendix to this Chapter. Section 18.1316. Sunday Parking. Except in compliance with the c;Trc'ction of a police officer or traffic signal , it shall be unlaw- fil to permit any vehicle to stand, stop, or park in any of the l~ce designated by the Village Manager and signposted and in- cluded on Schedule VI I of the I\ppendix to this Chapter. ~ ~)E ction 18.1317. Weekday Parking. The parking of any vehicle is Pl'-ohlbl ted on all weekdays ~ excluding Saturdays and Sundays be- iween the hours of 7:00 a.m. and 4:00 p.m. on such streets desig- nated by the Village Manager and signposted and included on Schedule VIII of the APpendix to this Chapter. ~, ~ Section 18.1318. Parking During School Hours, The parking of any vehicle is prohibited on school days between the hours of 8:00 a,ill, and 4:00 p,m. on such streets designated by the Village Manager ~!ld signposted and included on Schedule IX of the Appendix to this :Ji1apter. Section 18.1319. All Night Parking. ^ I ~, . No person shall park any vehicle on any street within the ViII between the hours of 2:00 a.m, and 6:00 a.m. on any day, excep~ physicians on emergency calls. B. The parking of any vehicle is prohibited between the hours o~ 6:00 p,rn. and 6:00 a,m. on such streets designated by the Village Manager and signposted and included on Schedule X of the Appendix to this Chapter. ,;,:c':icn. 18.1320. Time Limits. It shall be unlawful to park any vehicle for a longer period than the time des ignated in any area set aside by the Village Manager~ signposted and included on the Schedules listed below: I~' A. Two. Hour Parking. Parking of automobiles and other vehicles is limited to two (2) hours on any day except Sundays and legal holidays between the hours of 7:00 a.m. and 6:00 p.m. on the streets or portions thereof included on Schedule XI of the Appendix to this Chapter. B. One Hour Parking. Parking of automobiles and other vehicles is limited to one (1) hour on any day except Sundays and legal holidays between the hours of 7:00 a.m. and 6:00 p.m. on the streets or portions thereof included on Schedule XII of the Appendix to this Chapter. ---.---- C. Fifteen Minute Parking. Parking of automobiles and other vehi- cleS1s-limi fed tofifteen (15) minu tes on any day except Sundays and legal holidays between the hours of 7:00 a.m. and 6:00 p.m. on the streets or portions thereof included on Schedule XIII of the AppendiX to this Chapter. Section 18.1~~1. Obstructing Fire Lanes. A. Whenever fire lanes are designated as provided in. Section 24,410, it shall be unlawful for any person to block or ob- struct9 wholly or partly, any duly designated and posted fire lane described in Sch~dule XIV of this APpendix to this Chapter. B. Any person convicted of a violation of this Section shall be fi~e~ no less than $10.00 nor more than $500.00 for each offense. Section 18.1322. Parking M~ter Zones. ~ A. There are hereby established certain parking zones to be known as parking meter zones~ which zones shall be within the dis- tricts or upon those streets or parts of streets described ~. in Schedule XV of the APpendix to this Chapter. B, In the Chicago and Northwestern Railway Lots #1, #2, and #3~ established as having a parking time limit of 12 hours, the deposit of certain coins shall establish the allowed parking time up to the maximum time limit as follows: 1. Upon the deposit of one (1) five (5) cent coin a parking limit of one (1) hour shall be established, 2. Upon the deposit of two (2) five (5) cent coinsJ or one (1) ten (10) cent coinJ a parking limit of two (2) hours shall be established, 3, Upon the deposit of three (3) five (5) cent coins, or one (1) five (5) cent and one (1) ten (10) cent coins~ a parking limit of three (3) hours shall be established. 4. Upon the deposit of sufficient United States coins~ ex- cept pennies, amounting to twenty (20) cents~ a parking limit of six (6) hours shall be established. 5. Upon the deposit of sufficient United States coins, ex- cept pennies~ amounting to twenty-five (25) cents, a parking limit of twelve (12) hours shall be established, ~. C, In specific parking meter zones other than those catagorized in paragraph B above, the costs and time limits shall be as follows: 1. In the Maple Street parking meter zones, established as having a parking time limit of twelve (12) hours, the deposit of certain coins shall establish the allowed parking time up to the maximum time limit as follows: a, Upon the deposit of one (1) five (5) cent coin, a parking l'imit of one-and-a-half (1 1/2) hours shall be established. b. Upon the deposit of two (2) five (5) cent coins, or one (1) ten (10) cent coin, a parking limit of three (3) hours shall be established, c. Upon the deposit of three (3) five (5) cent coins, or one (1) five (5) cent and one (1) ten (10) cent coinsJ a parking limit of four-and-a-half (4 1/2) hours shall be established. ~. d, Upon the deposit of sufficient United States coins, except pennies, amounting to twenty (20) cents, a parking limit of six (6) hours shall be established. e. UDon the deposit of sufficient United States coinsJ ~. .~, except pennies, amounting to twenty-five (25) centsJ .~. a parking limit of seven-and-a-half (7 1/2) hours shall be established. f. Upon the deposit of sufficient United States coins 3 except pennies 3 amounting to thirty (30) cents~ a parking limit of twelve (12) hours shall be established, ') .., . In the Village Hall parking meter zonesJ established as having a parking time limit of three (3) hours, the deposit of certain coins shall establish the allowed parking time up to the maximum time as follows: a. Upon the deposit of one (1) five (5) cent coin9 a parking limit of one-half Cl/2) hour shall be es- tablished. b. Upon the deposit of two (2) five (5) cent coins? or one (1) ten (10) cent coin~ a parking limit of one (1) hour shall be established. c. Upon the deposit of three (3) five (5) cent coins~ or one (1) five (5) cent and one (1) ten (10) cent coins) a parking limit of one-and-a-half (1 1/2) hours shall be established. ~. ,~ u.. Upon the deposit of sufficient United States coins, except pennies, amounting to twenty (20) cents, a parking limit of two (2) hours shall be established. e. Upon the deposit of sufficient United States coins, except pennies, amounting to twenty-five (25) cents, a parking limit of two-and-a-half (2 1/2) hours shall be established. f. Upon the deposit of sufficient United States coins, except pennies, amounting to thirty (30) cents, a parking limit of three (3) hours shall be established. D. Each parking meter shall be so designed, constructed~ installed and set that upon the expiration of the time period registerd, by the deposit of one or more coins, as provided herein, it will indicate by an appropriate signal that the lawful parking meter period has expired, and during said period of time and prior to the expiration thereof, will indicate the interval of time which remains of such period. ~. 1. Each parking meter shall bear thereon a legend indicating the days and hours when the requirement to deposit coins therein shall apply, the value of the coins to be depositedJ and the limited period of time for which parking is law- fully permitted in the parking meter zone in which such meter is located. 2. Except as hereinafter provided parking time limits on /""""\ weekdays, except holidays} Saturdays and Sundays? shall ,~ be the hours of 6:00 a.m, to 6:00 p.m. On Saturday and Sunday the parking time limits shall be two (2) hours for which there shall be no charge; provided, however) this provision does not apply to any person pa.ying the rates required for the parking meter on Saturday or Sunday. 3. The following days shall be designated as holidays: January I Good ~riday, May 30, July 4, Labor Day? Thanksgiving D~y; and December 25. If any of these days shall fall on Sunday and be observed on Monday, or if any of these days shall fall on Saturday and be observed on the Friday pre- ceeding, then such Monday or Friday shall be considered as a holiday for the purposes of this Section. r-. E. Deposit Of Coins And Time Limits, 1. No person shall park a vehicle in any parking space along- side of and next to which a parking meter has been installed during the restricted and regulated time applicable to the parking meter zone in which such meter is located unless a coin or coins of United States currency of the appropriate denomination as provided in this C apter shall have been deposited therein? or shall have been previously deposited therein for an unexpired interval of time, and said meter has been placed in operation, 2. No person shall permit a vehicle within his control to be parked in any such parking meter space during the re- stricted and regulated time applicable to the parking meter zone in which such meter is located while the parking meter for such space indicates by signal that the lawful parking time in such space has expired. This provision shall not apply to the act of parking or the necessary time which is required to deposit immediately thereafter a coin or coins in such meter. 3. No person shall park a vehicle in any such parking meter space for a consecutive period of time longer than that limited period of time for which parking is lawfully per- mitted in the parking meter zone in which such meter is loca ted. 4. It shall be unlawful for any person to deposit or cause to be deposited an additional coin or coins to extend the parking time limit beyond the maximum parking time limits as established for parking meter zones. 5. The provisions of this Section shall not relieve any per- son from the duty to observe other and more restrictive provisions of this Chapter prohibiting or limiting the stopping, standing, or parking of vehicles in specified places or at specified times. ,~ F. Use Of Slugs Prohibited. No person shall deposit or attempt to deposit in any parking meter any slug~ button or any other device or substance as substitutes for coins of United States currency. G. Tampering With Meter. No person shall deface, injure, tamper with~ open or wilfully break, destroy~ or impair the useful- ness of any parking meter. H. Special Penalty. 1. Notwithstanding the provisions of Sections 18.1905 and 18.1324 of this Chapter, a.ny person~ firm~ or corporation who violates subsections F and G of this Section 18.1322 shall be fined not less than Five Dollars ($5.00) nor more than Two Hundred Dollars ($200.00) for each offense. 2. It shall be the duty of the Police Department of the Village of Mount Prospect to issue citations to any per- sons who violate the provisions of subsections B, C, E, and F. Such citations may be delivered to the violator personally or may be affixed to the vehicle of the violator. Nothing in this subsection shall be construed to abridge the power of a police officer to arrest any violator and take him into custody. I. Installation Of Parking Meters. 1. The Village Manager with the approval of the Board of Trustees shall install parking meters in the parking meter zones established as provided in this Chapter within approximately twenty-four (24) inches of the outer curb line or sidewalk line immediately adjacent and in front of the individual parking spaces. 2. The Village Manager shall have markings painted or placed upon the curb and/or upon the street or pavement adjacent to each parking meter for the purpose of designating the parking space for which said meter is to be used, or withjn a parking lot and each vehicle parking adjacent or next to any parking meter shall park within the lines or markings so es tablished. 3. The installation of parking meters in the twelve (12) hour zones established in subsection B of this Section shall be subject and pursuant to the provisions of the agreement and lease with the Chicago & Northwestern Railway Company relating to the installation of parking meters in such zones. ,~ 4. Plans and specifications for the installation of parking meters in the Village shall be placed on file with the Village Clerk and shall be open for inspection by the public. .--. f~. .- 5. The payment for such parking meters and the installation under any contract or contracts heretofore entered into by the Village or hereafter to be entered into by the Village for the purpose of leasing, acquiring, installa- tion, operation, maintenance, supervision, regulation, and use of the parking meters provided for herein, either for a trial period or otherwise, shall be only and solely from the receipts, funds and revenues obtained from the operation of said parking meters, without in any manner obligating the Village to pay for the same from any other sources, and further that no revenue bonds shall be issued to pay for any such meters. 6. The operation, maintenance, and management of the parking meters shall be under the supervision of the Village Manager, who shall see that said meters are kept in good working and operating order and are installed to the ad- vantage of the Village, and shall operate the whole pro- ject in an economical and efficient manner. J. Application Of Proceeds. I. The Village Manager, subject to the approval of the President and Board of Trustees, shall designate such collector or collectors and methods as are necessary to collect properly all coins deposited in the meter boxes. 2. Such collector or collectors shall be only such employees as are now or may hereafter be duly bonded in the sum not less than One Thousand Dollars ($1,000.00) for the faith- ful performance of their duties. 3. All moneys so collected shall be deposited with the Village Treasurer, who shall credit such collections to the parking meter fund for the purposes set forth herein and shall submit a monthly report to the Village Board showing all revenues derived from parking meters. 4. The coins required to be deposited in parking meters as provided in this Article are levied and assessed as fees to cover the regulation and control of parking upon public streets; the costs of parking meters, their installation, inspection, supervision, operation, repair and maintenance, control and use of parking spaces, and regulating the parking of vehicles in parking meter zones; and the costs of acquiring, establishing, improving, maintaining} and operating public off-street parking facilities. .~ 5. The Village Treasurer shall pay from such special fund the costs of any parking meters purchased by the Village and installed as provided in this Article, and expenses incurred for their installation, inspection, service, supervision~ repair, and maintenance, for making collec- tions from such parking meters, and for the enforcement of the provisions of this Chapter applicable to parking meter zones. The net proceeds of the operation of parking meters in said special fund, after the payment of such costs and expenses, shall be used for parking studies and for the acquisition, establishment, improve- ment, maintenance, and operation of public off-street parking facilities as the Village Board shall from time to time direct. 6. The percentage of revenue to be applied to the cost of installation of meters in the twelve (12) hour zone established in subsection B of this Section shall be thirty-three and one-third (33 1/3%) percent of the gross revenue as provided in the agreement and lease with the Chicago & Northwestern Railway Company consenting to the installation of meters in said twelve (12) hour meter zones established in subsection B of this Section. 7. The parking meter fund shall be audited as a separate fund at the time of the annual audit by the Village. t,. Proof of registration of a motor vehicle and proof of viola- tion of this Section shall be construed as prima facie proof that the registered owner of such motor vehicle was the user or operator thereof at the time of the violation charged. ~ Section 18.1323. Parking In Municipal Parking Lots. In any munici- -pali ty olmed and metered parking lot, it shall be unlawful for any .;'8rs on: A. To park a vehicle in any area of such lot which is not d0sig- nated~y lines or markings painted or placed on the pavement, wheel stops, etc.) as a parking space and/or which space has no parking meter adjacent thereto for the use thereof. B. To back a vehicle into any parking space thereof whenever signs have been placed in such lot which shall read} "Park Facing Meter Do Not Back In". Section 18.1324. Penalty. A. Notwithstanding the provisions of Article XV of this Cnapter. OT subsection H of Section 18.1322 whenever a police officer - is authorized to arrest a person without a warrant because of Q violation of any Sections of this Article~ said police officer may, in lieu of the filing of a complaint in Court, in the first instance issue to such alleged violator~ a CITATION: 1. Advising said person that he has violated a specified Section herein. 2. Requesting him to make payment in an amount applicable to said alleged violation as set forth in paragraph E of this Section as settlement of said violation claim, and 3. Informing him that upon failure to so settle~ a complaint ,"- will be filed in the Circuit Court of Cook County, charging ~ him with such violation. B. Pursuant to said CITATION, the person so accused of said viola- tion may settle and compromise the violation claim in respect to such Section violation by paying to the municipality the applicable amount as shown in the Schedule set forth in para- graph E of this Section, within a period to be specified in said CITATION -- not more than seven (7) days of the time said alleged offense was committed. Such payment shall be made in accordance with the instructions contained in the aforesaid CITATION, at the Office of the Finance Department, who shall issue a receipt for the money so received and promptly remit said amount to the Village Treasurer to be credited to the proper municipal fund. C. In the event that the person to whom said CITATION is issued fails to settle and pay said violation claim within the pre- scribed time, or within a period of time specified in a Final Notice (if one is served upon him) then the Peace Officer is authorized to cause a Notice to Appear to be served upon said alleged violator and is authorized to file a complaint and to prosecute the same in the Circuit Court of Cook County. ~ Do The fact that an automobile or motor vehicle which is illegally operated or parked is registered with the Secretary of State in the name of said alledged violator; or, in the alternative, in the event that a vehicle sticker issued by a municipality has been issued in the name of and to said alleged violator, shall be considered prima facie proof that said alleged viola- tor was in control of or was the operator of the automobile or motor vehicle at the time of such alleged violation. E. The violation claim described in said CITATION so to be issued pursuant to the terms of this Article, excepting subsections F and G of Section 18.1322, may be settled, compromised and paid in the respective amounts set forth in the following schedule 1. In the event that said payment is made prior to the mailing by the municipality or by the Peace Officer of a Final Notice~ the following amounts shall be accepted as settle- ment: i Improper parking .... 0 . . . . . . . . . . . . . . . . . . . $ 5.00 Overtime parking ... ............. In the event that payment is not made within the time prescribed in the Final Notice, and a Notice to appear has been served and a complaint filed in the Circuit Court of Cook County, payment of any fine and costs shall be in such amounts as may be determined and es- tablished by the Circuit Court of Cook County pursuant to Section 18.1905 of this Chapter. Article XIV. Miscellaneous Laws Section 18.1401. Unattended Motor Vehicles. No person dri~ing or in charge of a motor vehicle shall permit it to stand unattended without first stopping the engine. locking the ignition and re- moving the key. or when standing upon any perceptible grade without effectively setting the brake and turning the front wheels to the curb or side of the street. Section 18.1402. Limitations On Bac~ing. A. The driver of a vehicle shall not back the same unless such movement can be made with safety and without interfering with other traffic. B. The driver of a vehicle shall not back the same upon any con- trolled-access highway. Section 18.1403. Driving Upon Sidewalk. No person shall drive any motor-driven vehicle upon a sidewalk or sidewalk area except upon a permanent or duly authorized temporary driveway. or for routine maintenance~ utility or emergency service. or for special delivery or pick-up involving goods or customer services. Section 18.1404. Age Limit. It shall be unlawful for any person ,- under sixteen (16) years of age to operate any motor vehicle upon a~y street or alley of the Village of Mount Prospect. Section 18.1405. Conditions For Operation. No person shall operate ill ambulance. which for purposes of this Chapter shall include any motor vehicle primarily designed and used for conveyance of sick or injured persons, in a manner not conforming to a provision of the motor vehicle laws Dnd regulations of this State or of this Village as such provision applies to motor vehicles in general. ex- cept in compliance with the following conditions: ../\ " The person operating the ambulance shall be either responding to a bona fide emergency call or specifically directed by a licensed physician to disregard traffic laws in operating the ambulance during and for the purpose of the specific trip or journey that is involved; Bo The ambulance shall be equipped \vi th a 5i Ten producing an audible signal of an intensity of 100 decibels at a distance of SO feet from said siren. and with a lamp emitting an oscillating. rotat- ing or flashing redb~am Jir~cted in part toward the front of the vehicle and containing a power rating of at least 100 amps; ,~ ;~j " The aforesaid siren and lamp shall be in full operation at all times during such trip or journey; and D. Whenever the ambulance is operated at a speed in excess of 40 miles per hour, the ambulance shall be operated in complete conformance with every other motor vehicle law and regulation of this State and of this Village in which he ambulance is operated>> relating to the operation of motor vehicles, as such provision applies to motor vehicles in general~ except laws and regulations pertaining to compliance with official traffic- control devices or to vehicular operation upon the right half of the roadway. Section 18.1406. Obstruction Of Driver1s View Or Driving Mechanism. No person may drive a vehicle when it is so loaded~ or when there are in the front seat such number of persons~ as to obstruct the view of the driver to the front or sides of the vehicle or as to interfere with the driver's control over the driving mechanism of the vehicle. Section 18.1407. Opening Vehicle Doors. No person shall open the door of a vehicle on the side available to moving traffic unless and until it is reasonably safe to do so, and can be done without interfering with the movement of other traffic, nor shall any per- son leave a door open on the side of a vehicle available to moving traffic for a period of time longer than necessary to load or unload pas senge'rs . Section 18.1408. Riding In House Trailers. No person or persons shall occupy a house trailer while it is being moved upon a public highway. Section 18.1409. Clinging To Vehicles. It shall be unlawful for any person on any street riding a bicycle, motorcycle or any toy vehicle to cling to or attach himself or his vehicle to any moving motor vehicle or vehicle attached thereto. Section 18.1410. Coasting Prohibited. A. The driver of any motor vehicle traveling upon a down grade shall not coast with the gears or transmission of such vehicle in neutral. B. The driver of a motor vehicle of the second division when traveling upon a down grade shall not coast with the clutch disengaged. Section 18.1411. Following Fi re ADparatus Prohibi ted. The driver ~----_.- . of any vehicle other than one on official business shall not follO'W any fire apparatus traveling in response to a fire alarm closer than 500 feet or drive into or p rk such vehicle within the block where fire apparatus has stopped in answer to a,fi.re alarm. Section 18.1412. Crossing Fire Hose. No vehicle shall'""".pe driven over any unprotected hose of a fire department when laid down on any street, private road, or driveway to be used at any fire or alarm of fire, without the consent of the fire department official in command. ~. Section 18.1413. Putting Glass) Etc.s On Highway Prohibited. A. No person shall throw or deposit upon any highway any glass bottle, nails, tacks, wire, cans, or any other substance likely to injure any person, animal or vehicle upon such highway. B. Any person who drops, or permits to be dropped or thrown, upon any highway any destructive, dangerous, hazardous or injurious material shall immediately remove the same or cause it to be removed. However, this subsection B shall not apply to in- pIements of husbandry designed and adapted exclusively for agricultural, horticultural, or livestock raising operations that may inadvertently deposit dirt or other substances upon the highway. C. Any person removing a wrecked or damaged vehicle from a high- way shall remove any glass or other injurious substance dropped upon the highway from such vehicle. Section 18.1414. Approaching, Overtaking~ And Passing School Bus. A. The driver of a vehicle upon a highway upon meeting or over- taking~ from either direction, any school bus which has stopped on the highway for the purpose of receiving or dis- charging any school children shall stop the vehicle before reaching the school bus when there is in operation on the school bus a visual signal as specified in Article XV of this Chapter and the driver shall not proceed until the school bus resumes motion or the driver of the vehicle is signaled by the school bus driver to proceed or the visual signals are no longer actuated. B. Every school bus when used for transportation of school children must comply with the color requirements established by the Superintendent of Public Instruction and shall bear upon the front and rear thereof plainly visible signs containing the words "SCHOOL BUSn in letters not less than 8 inches in height, and in addition shall be equipped with visual signals meeting the requirements of Article XV of this Chapter, which shall be actuated by the driver of the school bus immediately preceding the point at which the school bus stops for the purpose of loading or discharging passengers. Such visual signals shall be actuated by the driver continuously during not less than the last 100 feet traveled by the school bus within a business or residence district, except that outsi0e a business or resi- dence district such visual signals shall be given continuously during not less than the last 200 feet traveled by the school bus. Such visual signals must remain actuated when children are loading or unloading from a scholl bus which is stopped on a roadway. At no other time shall these visual signals be actuated. C. The driver of a vehicle upon a highway of which the roadways for traffic moving in opposite directions are separated by a strip of ground which is not surfaced or suitable for vehicular traffic need not stop his vehicle upon meeting or passing a school bus which is on the opposite roadway; and need not stop his vehicle when driving upon a controlled access highway when a school bus is stopped in a loading zone adjacent to the sur- faced or improved part of the controlled access highway where pedestrians are not permitted to cross such controlled access highway. D. When a school bus is being operated upon a highway for purposes other than the actual transportation of children either to or from school or in connection with any school activity, all signs thereon indicating HSCHOOL BUS" shall be covered or concealed, Section 18.1415. School Buses--Stopping, Loading And Discharging Passengers On Highways Having Four Or More Lanes. A. A school bus traveling on a highway having 4 or more lanes for vehicular traffic shall stop for the loading or discharging of passengers only on the right side of the highway and when so stopped shall load or discharge only those passengers whose residences are located to the right of the highway, E, The routes of school buses shall be so arranged that no child shall be required to cross such a 4 or more laned highway to board a school bus or to reach his residence after leaving the bus. C. ']h.is Section shall not apply when children are escorted by com- petent persons designated by the school authorities or by law enforcement officers. Section 18.1416. Obstructing Person In Highways. Any person who shall wilfully and unnecessarily hinder, obstruct or delay, or who shall wilfully and unnecessarily attempt to delay, hinder or obstruct any other person in lawfully driving or traveling along or upon any State highway or who shall offer for barter or sale merchandise on saiJ highway so as to interfere with the effective movement of traffic shall be guilty of a misdemeanor. Section 18.1417. Travel Regulated. It shall be unlawful for any person to drive or cause to be driven a vehicle of any description in or upon any portion of the highway immediately after the same has been dragged and before such portion of the highway shall have partially dried out or frozen; provided, that nothing in this Section shall apply .in those ins tances where it is imposs ible to drive with safety at one side of said dragged portion of the road~ or where a vehicle does not make a rut on such dragged portion of the road, injurious to the work accomplished by use of the road drag or where a vehicle does not make a rut nearer than nine (9) feet from the center of the dragged portion of the road. Section 18.1418. Farm Tractor Operation Regulated. A. No person shall operate a farm tractor on a highway unless such tractor is being used as an implement of husbandry in connec- tion with farming operations. B. For the purpose of this Section, use of a farm tractor as an implement of husbandry in connection with farming operations shall be deemed to include use of such tractor in connection with the transportation of agricultural products and of farm machinery~ equipment and supplies as well as transportation of such tractors in connection with the obtaining of repairs thereto. Section 18.1419. Operation Of Motor Vehicles-- Duration--Exceptions. It is unlawful for any owner to require~ permit, allow or suffer any operator of any of his motor vehicles of the second division to operate any such motor vehicle for a longer period than 10 hours following 8 consecutive hours off-duty or drive for any period after having been on duty 15 hours following 8 consecutive hours off-duty~ or to be or remain on duty more than 60 hours in any 7 consecutive days, and whenever any such operator has operated such motor vehicle for 10 hours following 8 consecutive hours off- duty or has been on duty 15 hours following 8 consecutive hours off-duty, he shall be relieved and not required~ permitted, allowed, or suffered again to operate any such motor vehicle until he has had at least 8 consecutive hours off-duty. A. However, the Illinois Department of Public Safety may fix by general rule or temporary order the circumstances and regula- tions under which in case of emergency or unusual temporary demands for transportation any such operator may be permitted to operate any such motor vehicle or to stay on duty for longer periods of time than set by this Section. B. The provisions of this Section shall not apply to any public utility in the operation of any motor vehicle not for hire in case of emergency or in case of unusual temporary necessity for transportation of persons or property or safeguarding of vehicles and their loads~ nor shall such provisions apply to operation of any motor vehicle as a part of the agricultural operations of canning, packing or freezing establishments en- gaged in the growing and processing of perishable fruits and vegetables, including the hauling of such products between fields and such canning~ packing or freezing establishments and between such establishments, nor shall such provisions apply to operation of any motor vehicle being used for trans- portation of construction materials or equipment to~ on or from construction sites within a radius of fifty miles of such construction sites~ nor to driver salesmen operating within a radius of 50 miles of their principal place of busi- ness, ~ Section 18.1420. Funeral Processions. ,~ A, Funeral processions have the right-of-way at intersections when vehicles comprising such procession have their headlights lighted~ subject to the following conditions and exceptions: 1. Operators of vehicles in a funeral procession shall yield the right-of-way upon the approach of an authorized emer- gency vehicle giving an audible or visible signal; 2, Operators of vehicles in a funeral procession shall yield the right-of-way when directed to do so by a traffic officer; 3. The operator of the leading vehicle in a funeral procession shall comply with stop signs and traffic control signals but when leading vehicle has proceeded across an intersec- tion in accordance with such signal or after stopping as required by the stop sign, all vehicles in such procession may proceed without stopping, regardless of the sign or signal and the leading vehicle and the vehicles in proces- sion shall proceed with due caution. B. The operator of a vehicle not in the funeral procession shall not drive his vehicle in the funeral procession except when au- thorized to do so by a traffic officer or when such vehicle is an authorized emergency vehicle giving audible or visible SIg- nal. C, Operators of vehicles not a part of a funeral procession may not form a procession or convoy and have their headlights lighted for the purpose of securing the right-of-way granted by this Section to funeral processions. D. The operator of a vehicle not in a funeral procession may over- take and pass the vehicles in such procession if such overtaking and passing can be accomplished without causing a traffic hazard or interfering with such procession. F, The lead vehicle in the funeral procession may be equipped with a flashing amber light which may be used only when such vehicle is used as a lead vehicle in such procession. Vehicles comprising a funeral procession may utilize funeral pennants or flags or windshield stickers to identify the individual vehicles in such a procession. r-, Article XV. Equipment of Vehicles Section 18.1501. Scope And Effect of Equipment Requirements. A. It is unlawful for any person to drive or move or for the owner to cause or knowingly permit to be driven or moved on any highway any vehicle or combination of vehicles which are in such unsafe condition as to endanger any person or property; or which do not contain those parts or are not at all times equipped with such lamps and other equipment in proper condition and adjustment as required in this Article or which are equipped in any manner in violation of this Article~ or for any person to do any act forbidden or fail to perform any act required under this Article. B. The provisions of this Article with respect to equipment on vehicles shall not apply to implements of husbandry~ road machineryy road rollers~ or farm tractors or to farm-wagon type trailers having a fertilizer spreader attachment per- manently mounted thereon, having a gross weight of not to exceed 10]000 pounds and used only for the transportation of bulk fertilizer or to farm-wagon type tank trailers of not to exceed 1200 gallons capacity, used during the liquid fertilizer season as field-storage "nurse tanksll supplying the fertilizer to a field applicator and moved on highways only for bringing the fertilizer from a local source of supply to farm or field or from one farm or field to another. Section 18.1502. When Lighted Lamps Are Required. A.. When upon any highway or street in this Village, during the period from sunset to sunrise, or at any other time when visibility is so limited as to require the use of lights for safety; every motorcycle shall carry and exhibit one lighted lamp commonly known as a driving light and every other motor vehicle two (2) such lighted driving lamps showing white lights, or lights of a yellow or amber tint] visi Ie at least 500 feet in the direction toward which each motorcycle or motor vehicle is proceeding. Parking lamps may be used in addition to but not in lieu of any such driving lamps. Each motor vehicle~ trailer, or semitrailer shall also exhibit at least two (2) lighted lamps which shall be mounted on the left rear and right rear of the vehicle so as to throw a red light visible for at least 500 feet in the re- verse direction~ except that a motorcycle need be equipped with only one (1) such lamp. r-- B. Either a tail lamp or a separate lamp shall be so constructed and placed as to illuminate with a white light a rear regis- tration plate when required and render it clearly legible from a distance of SO feet to the rear. Any tail lamp or tail lamps, together with any separate lamp or lamps for illuminating a rear registration plate~ shall be so wired as to be lighted whenever the head lamps or auxiliary driving lamps are lighted. r. Section 18.1503. Clearance~ Identification And Side Marker Lamps. A. Every motor vehicle of the second division~ the length of which together with any trailer or trailers in tow thereof is more than 25 feet or the width of which is more than 80 inches~ while being operated on the streets or highways within the limits of the Village~ during the period from sunset to sunrise, shall display on the front of the vehicI.c two (2) yellow or amber lights, one on each upper front corner of the vehicle, which shall be plainly visible at a distance of at least 500 feet; also on the rear thereof in a horizontal line; three (3) red lights or such red lights conforming to the specifications prescribed by the Bureau of Motor Carrier Safety of the Federal Highway Administra- tion, plainly visible at a distance of not less than 500 feet; also on the front of the body of that vehicle near the lower left hand corner one yellow or amber tinted re- flector, and near the lower right hand corner one yellow or amber tinted reflector~ also red reflectors on the rear of the body of that vehicle) not more than 12 inches from the lower left hand and right hand corners. All motor vehicles of the second division more than 20 feet long, and all trailers and semitrailers, except trailers and semitrailers having a gross weight of 3,000 pounds or less including the weight of the trailer and maximum load; while being operated on the streets or highways within this Village, during the period from sunset or sunrise, shall display on each side of the vehicle at approximately the one-third points of the length of the same, at a height not exceeding 5 feet above the surface of the road, and reflecting on a line approximately at right angles to the center line of the vehicle, two (2) amber tinted reflectors of a type approved by the Secretary of State or reflectors on each side thereof conforming to the specifications prescribed by the Bureau of Motor Carrier Safety of the Federal Highway Administration. Provided, however, that on motor vehicles equipped ..-lith acetylene headlights, approved reflectors, conforming as to color and location, may be used in lieu of the two (2) yellow or amber lights and the three (3) red lights required under this Section. Bo Every trailer and semitrailer having a gross weight of 3~OOO p(junds or less including the weight of the trailer and maximum load, towed either by a motor vehicle of the first division or a motor vehicle of the second division shall be equipped with two (2) red reflectors, which will be visible when hit by headlight beams 300 feet away at night, on the rear of the body of such trailer, not more than 12 inches from the lower left hand and lower right hand corners. ~. Section 18.1504. Lamps On Parked Vehicles. A. During that period from sunset to sunrise every motorcycle or motor vehicle which is standing on any highway shall dis- ,,-.. play a parking light on the front and at the rear of the same~ unless the Village by Ordinance designates any part or parts of any streets as parking places in which motor- cycles and motor vehicles may be parked without having their lamps lighted as otherwise required by this Section. B. Any lighted driving lamps upon a parked vehicle shall be depressed or dimmed. Section 18.1505. Lamp Or Flag On Projecting Load. Whenever the load upon any vehicle extends to the rear 4 feet, or more beyond the bed or body of such vehicle there shall be displayed at the extreme rear end of the load at the times specified in Section 18.1502 hereof, a red light or lantern plainly visible from a distance of at least 500 feet to the sides and rear. The red light or lantern required under this Section shall be in addition to the red rear light required upon every vehicle. At any other time there shall be displayed at the extreme rear end of such load a red flag or cloth not less than 12 inches square. Section 18.1506. Lamps On Other Vehicles And Equipment. Every vehicle other than an antique vehicle displaying an antique plate, including animal drawn vehicles referred to in paragraph B of Section 18.1501, not specifically required by the provisions of this Article to be equipped with lamps or other lighting de- vices, shall at all times specified in Section 18.1503 of this Chapter be equipped with at least two (2) lamps displaying a white light visible from a distance of not less than 1,000 feet to the front of such vehicle and shall also be equipped with two (2) lamps displaying a red light visible from a distance of not less than 1,000 feet to the rear of such vehicle. An antique vehicle shall be equipped with lamps of the same ty~e originally installed by the manufacturer as original equipment and in working order. The provisions of this Section are in addition to any lighting equipment required by Section 18.607 of this Chapter. Section 18.1507. Lamps And Other Equipment On Bicycles. A. Every bicycle~ when in use during the period when lighted lamps are required under Section 18.1502 of this Chapter shall be equipped on the front with a lamp which shall be emitting a white light visible from a distance of at least 500 feet to the front and with a red reflector 0 the rear of a type approved by the Secretary of State. A lamp emitting a red light visible from a distance of 500 feet to the rear may be used in lieu of a red reflector. B. Every bicycle shall be equipped with a brake which will enable the operator to make the braked wheels skid on drYJ level~ clean pavement. C. No person shall operate a bicycle unless it is equipped ~ with a bell or other device capable of giving a signal audib13 for a distance of at least 100 feet, except that a bicycle ,shall not be equipped with nor shall any person use any siren or whistle upon a bicycle. D. The parent of any child and the guardian of any ward shall not authorize or knowingly permit any such child or ward to violate any provision of this Act. Section 18.1508. Spot Lamps And Auxiliary Driving Lamps. A. Any motor vehicle may be equipped with not to exceed one (1) spot lamp and every lighted spot lamp shall be so aimed and used upon approaching another vehicle that no part of the high-intensity port~on of the beam will be directed to the left of the prolong~tion of the extreme left side of the vehicle nor more than 100 feet ahead of the vehicle. B. Any motor vehicle may be equipped with not to exceed three (3) auxiliary driving lamps mounted on the front at a height not less than 12 inches nor more than 42 inches above the level surface upon which the vehicle stands. Section 18.1509. Signal Lamps And Signal Devices. A. Every vehicle other than an antique vehicle displaying an antique plate operated in this Village shall be equipped with a stop lamp or lamps on the rear of the vehicle which shall display a red light visible from a distance of not less than 500 feet to the rear in ormal sunlight and which shall be actuated upon application of the service (foot) brake" and which may but need not be incorporated with other rear lamps. During times when lighted lamps are not required, an antique vehicle may be equipped with a stop lamp or lamps on the rear of such vehicle of the same type originally in- stalled by the manufacturer as original equipment and in ''\Torking order. However 9 at all other times, such antique vehicle must be equipped with stop lamps meeting the re- quirements of Section 18.1509 of this Chapter. L. Every motor vehicle other than an antique vehicle dis- playing an antique plate shall be equipped with an electric turn signal device which shall indicate the intention of the driver to turn to the right or to tho left in the form of flashing lights located at and showing to the front and rear of the vehicle toward which the turn is to be made. The lamps showing to the front shall be mounted on the same level and as widely spaced laterally as practicable and, when signaling, shall emit a white or amber light, or any shade of light between white and amber. The lamps slrO\'Jing to the rear shall be mounted on the same level and as widely spaced laterally as practicable and, when signaling, shall emit a red light. An antique vehicle shall be equipped witt a turn signal device of the same type originally installed by the manufacturer as original equipment and in working oras!" ,~ C. Every trailer and semitrailer shall be equipped with an electric turn signal device which indicates the intention of the driver in the power unit to turn to the right or to the left in the form of flashing red lights located at the rear of the vehicle on the side toward which the turn is to be made and mounted on the same level and as widely spaced laterally as practicable. D. Turn signal lamps must be visible from a distance of not less than 300 feet in normal sunlight. E. Motorcycles and mot r-driven cycles need not be equipped with turn signals unless such were installed by the manu- facturer as original equipment. Section 18.1510. Additional Lighting Equipment. A. Any motor vehicle may be equipped with not more than two side cowl or fender lamps which shall emit an amber or white light without glare. B. Any motor vehicle may be equipped with not more than one running board courtesy lamp on each side thereof which shall emit a white or amber light without glare. Co l\rry rnotor ,rehicle may be equipped with a back-up lamp eitl1cr separately or in combination with another lamp; except that no such back-up lamp shall be continuously lighted ,,,rhen the motor vehicle is in forward motion. D. Any motor vheicle owned or fully operated by a volunteer fireman; paid fireman, part-paid fireman~ or call firemans may be equipped with not to exceed two (2) lamps which shall emit a blue light without glare, Section 18.1511. Use Of Head Lamps. A. Whenever the driver of any vehicle equipped with an electric driving head lamp or head lamps is within 500 feet of another vehicle approaching from the opposite direction~ the driver shall dim or drop such head lamp or head lamps. B. The driver of any vehicle equipped with an electric driving head lamp or head lamps shall dim or drop such head lamp or head lamps when there is another vehicle traveling in the same direction less than 300 feet to the front of him. Section 18.1512. Number Of Driving Lamps Required Or Permitted. A. . At all times specified in Section 18.1502, at least two (2) lighted lamps shall be displayed, one on each side at the front of every motor vehicle except when such vehicle is parked subject to the regulations governing lights on parked vehicles. ,.,- c~\ B. Whenever a motor vehicle equipped with head lamps as herein required is also equipped with any auxiliary lamps or a spot lamp or any other lamp on the front thereof projecting a beam of an intensity greater than 300 candle-power, not more than a total of four (4) of any such lamps on the front of a vehicle shall be lighted at anyone time when upon a highway or street. - Section 18.1513. Special Restrictions On Lamps. A. Except as provided in Sections 1~.1514 and 18.1516: 1. No person shall drive or move any vehicle or equipment upon any street with any lamp or device thereon dis- playing a red light visible from directly in front thereof. 2. Subject to the restrictions in Section l8.804~ para- graph D, of this Chapter, flashing lights are prohibited on motor vehicles except as a means for indicating a right or left turn or the presence of a vehicular traffic hazard requiring unusual care in approaching, overtaking or passing. Section 18.1514. Special Lighting Equipment On __Sc.hgol_~uses 0 Every school bus used for the transportation of school children to and from school, in addition to any other equipment and dis- tinctive markings required by this Act, shall be equipped with signal lamps mounted as high as and as widely spaced laterally as practicable, which shall be capable of displaying to the front two (2) alternately flashing red lights located at the samB level, and to the rear two (2) alternately flashing red lights located at the same level, and these lights shall have the sufficient intensity to be visible at 500 feet in normal s unl igh to Section l8.15IS.~ecial Lighting Equipment On Rural Mail Delivery Vehicles. If a rural mail delivery vehicle is equipped witn-special signal lamps, there shall be displayed to the front two (2) such alternately flashing amber lamps located at the same level and mounted as high and as widely spaced laterally as practicable and to the rear two (2) al- ternately flashing amber lamps loc2tetl at the same level and mounted as high and as widely spaced laterally as practicable. Such lamps shall be of sufficient intensity to be visible at 500 feet in normal sunlight and shall be controlled so that they will only be used to indicate to other traffic that a stop is being made for the purpose of picking up or delivering U. S. mai 1. Oscillating, Rotating Or Flashing Lights On Except as otherwise provided in this Chapter: Section 18.1516. Motor Vehicles. ~ A. Red oscillating, rotating or flashing lights are permitted only on: r-, 1, Police vehicles of the State or Federal Government or this Village; 2, Firefighting vehicles of the State 0 Federal Govern- ment or this Village; and :;.. Vehicles which are designed as ambulances and \.'Thi1e responding to an emergency call for the purpose of con- veying sick or injured persons. B. Amber oscillating, rotating or flashing lights are permitted only on: 1. Second division vehicles designed for towing or hoisting disabled vehicles while actually being used for such purpose; 2. Motor vehicles or equipment of the Village of Mount Prospect~ the St~te of Illinois, and contractors while engaged in maintenance or construction operations within the limits of construction projects; 3. Vehicles OT equipment used by engineering or survey crews while actually engaged in work on a highway; 4. Vehicles of he Mount Prospect Public Works Department and public utilities while engaged in maintenance or construction operations within the limits of construc- tion projects; 5. Oversized vehicle or load moving under permit issued by the State Department of Public Safety; 6. The front and rear of motorized equipment owned and operated by the State of Illinois or the Village of Mount Prospect, which is designed and used for re- moval of snow and ice from highways; and I . Such other vehicles as may be authorized by the Village of Mount Prospect. c. Blue oscillating, rotating or flashing lights aTe permitted only on the front of any motor vehicle owned or fully operated by a volunteer fireman, paid fireman~ part-paid fireman~ or call fireman while responding to a fire call. Section 18.1517. Under the above conditions the hand brake shall be adequate to stop such vehicle or vehicles~ except any motorcycle" within a distance of 55 feet and the hand brake shall be adequate to hold such vehicle or vehicles stationary on any grade upon which operated. 3. Under the above conditions the service brakes upon a vehicle of the first division that is more than 30 years of age and which is driven on the highways only in going to and returning from an antique show or for servicing or for a demonstration shall be adequate to stop the vehicle within a distance of 40 feet and the ~and brake adequate to stop the ~ehicle within a dis- tance of 55 feet. 4. All braking distances specified in this Section apply to all vehicles mentioned, whether such vehicles are unloaded or are loaded to the maximum capa.city permitted under this Act. 5. All brakes shall be maintained in good working order and shall be so adjusted as to operate as equally as practi- cable with respect to the wheels on opposite sides o~ the vehicle. Section 18.1519. Brake Fluid. A. On or after January l~ 1967 ~ no person? firm, associ('..tion. or corpo~ation shall sell, offer for sale or distribute bra fluid for use on motor vehicles for repair purposes unless such fluid is of a type and specification approved by the Department of Public Works and Buildings of the State of Illinois. Bo Any person who sells~ offers for sale~ or distributes braks fluid in violation of any of the provisions of this subsec- tion is guilty of a misdemeanor. Every motor vehicle when operated upon a highway shall be equipped with a horn in good working order and capable of emitting sound audible under normal conditions from a dis- tance of not less than 200 feet, but no horn or other warning device shall emit an unreasonable loud or harsh sound or a whistle. The driver of a motor vehicle shall when reasonably necessary to insure safe operation give audible warning with his horn but shall not otherwise use such horn when upon a highway. B. No vehicle shall be equipped with nor shall any person use upon a vehicl~ any siren, whistle, or bell, except as ,-. otherwise permitted in this subdivision. Any authorized emergency vehicle as defined in Article I of this Chapter~ may be equipped with a siren~ whistle; or bell~ capable of emitting sound audible under normal conditions from a dis- tance of not less than 500 feet, but such siren, whistle or bell, shall not be used except when such vehicle is operated in response to an emergency call or in the immediate pursuit of an actual or suspected violator of the law in which said latter events the driver of such vehicle shall sound said siren~ whistle or bel1~ when necessary to warn pedestrians and other drivers of the approach thereof. C. No bicycle shall be equipped with nor shall any person use upon a bicycle any siren or whistle. Section 18.1521. Mufflers~ Prevention Of Noise Or Smoke. A. Every motor vehicle driven or operated upon the highways or streets of this Village shall at all times be equipped with an adequate muffler or exhaust system in constant operation and properly maintained to prevent any excessive or unusual noise and annoying smoke. ~ B. No such muffler or exhaust system shall be equipped with a cutout, bypass, or similar device. No person shall modify the exhaust system of a motor vehicle or squeal the tires thereof or unnecessarily race his motor while running idle in a manner which will amplify or increase the noise of such vehicle above that emitted by the muffler originally installed on the vehicle or above that emitted by tires normally or above that emitted at normal idle. No person shall use any sound amplifying device? recorded music~ or radio in or from any vehicle on any street in such manner as to attract the attention of persons outside of such vehicle to the sounds issuing therefrom, excepting herefrom persons in vehicles and devices officially used by govern- mental units in the exercise of official functions and ex- cept as provided in Chapter 24J Article VII. Section 18.1522. Mirrors. Every motor vehicle~ operated singiy --or when towing another vehicle, shall be equipped wi th a mirror having at least three (3) square inches of reflecting surface and so located as to reflect to the driver a view of the highway for a distance of at least 200 feet to the rear of such motor vehicle. Section 18.1523. Windshields Must Be Unobstructed And Equipped_ lNi th Wipers. A. No person shall drive any motor vehicle with any slgn~ poster. or other non-transparent material upon the front windshield, sidewings~ side or rear windows of such vehicle which obstruc~: the driver's clear view of the street. B. No person shall drive any motor vehicle with any objects ~ placed or suspended between the driver and the front wind- shield or between the driver and the rear window which obstructs the driver's clear view of the street. C. The windshield on every motor vehicle shall be equipped with a device for cleaning rain, snow or other moisture from the windshield, which device shall be so constructed as to be controlled or operated by the driver of the vehicle. D. No object, stationary or mobile, shall be placed on or suspended from the rearview mirror, front windshield, rear window, or any other part of the inside of a motor vehicle except: 1. Religious or lodge statues or statuettes not exceeding six (6) inches in height. 2. Wearing apparel which is suspended behind the driver and in a manner so as not to obstruct the driver's clear view of the street. Section 18.1524. Restriction As To Tire E~uipment. A. No metal tired vehicle~ including tractors, motor vehicles of the second division, traction engines and other similar vehicles, shall be operated over any improved street of this Village, if such vehicle has on the periphery of any of the road wheels any block, stud, flange, cleat, ridge~ lug or any projection of metal or wood which projects radially beyond the tread or traffic surface of the tire. This prohibition does not apply to pneumatic tires with metal studs between October 1 of any year until May 1. of the following year or to track type motor vehicles' when that part of the vehicle coming in contact with the road surface does not contain any projections of any kind likely to injure the surface of the road: however, tractors, trac- tion engines, and similar vehicles may be operated which have upon their road wheels V-shaped, diagonal or other cleats arranged in such a manner as to be continuously in contact with the road surface~ provided that the gross V{eight upon such wheels per inch of width of such cleats in contact with the road surface, when measured in the direction of the axle of the vehicle, does not exceed 800 pounds. Studded tires may be used between October 1 of any year until May 1 of the following year and only on single tire vehicles with a rated capacity of not more than 10,000 pounds gross vehicle weight on which there are wheelwells or other items of a similarly protective nature, whether permanently or temporarily attached thereto. B. All motor vehicles and all trailers or oth~r vehicles 1n tow thereof, or thereunto attached;; operating upon any roadway; shall have tires of rubber or some material of equal resiliency. Solid tires shall be considered defect iv,s' ,,-,\ and shall not be permitted to be used if the rubber or other material has been worn or otherwise reduced to a thickness of less than three-fourths of an inch or if such tires have been so worn or other ise damaged as to cause undue vibration when the vehicle is in motion or to cause undue concentration of the wheel load on the sut- face of the road. The requirements of this Section do not apply to agricultural tractors or traction engines or to agricultural machinery~ including wagons being used for agri- cultural purposes in tow thereof, or to road rollers or road building machinery operated at a speed not in excess of 10 miles per hour. All motor vehicles of the second division, operating upon any roadway sha1.l have pneumatic tiresy un- less exempted herein. Section 18.1525. Tractors) Traction Engines And Motor Trucks -- Operation On Highways - - Turning 011 Highways During FarmfIig-- Operations -- Violations, No tractor~ traction engine~ motor truck or other similar vehicle shall be operated across, over or along any public highway of this State which has been oil treated, if any such vehicle has on the periphery of any of the road wheels any block~ stud, flange, cleat, ridge, lug, or any projection of metal or wood which projects radially beyond the tread or traffic surface of the tire; except that this prohibi- tion shall not apply to tractors or traction engines equipped with what is known as crawler type tractors, when the same does not contain any projections of any kind likely to injure the surface of the road, nor to tractors, traction engines and simi- lar vehicles which have upon their road wheels V-shaped, diago- nal or other cleats arranged in such a manner as to be continu.- ously in contact wi th the road surface.- In no event shall the oil mat surface of any oil treated public road be used as an area or space for turning any tractor or other farm machinery :in carrying on or performing any farming operations upon the adjacent land. Provided, that nothing in this Section con- ~2ined shall prohibit the operation of tractorsy traction en- gines or motor trucks across any oil treated road in order to r2ach adjacent lands or the operation of any such vehicles upon. the treated portion of such oil treated roads if there is no tm- treated portion thereof over which they may be operated or the ore ration of any such vehicles on oil treated roads if in passing along said road they travel over the portion of said road which does not onstitute the oil mat surface created by s~id oil treatment or the use of flexible tire chains on any tractor) traction engine, motor truck or other similar vehicle heing operated upon any such oil treated road. Section 18.1526. Safety Gla~in.K.M9:!.e~iaLIn II/Iotor Vehicles. A, No person shall knowingly sell any 1936 or later model motor vehicle nor shall any such motor vehicle be register20 unless such ,rehicle is equ~_pped with_ safety glazing mat()ri-:::'.. of a type approved by the Secretary of State wherever glazing material is used in doors~ windows and windshields. Tnesc provisions apply to all motor vehicles of the first ana ,,-,\ second division but 1-lith respect to trucks, including <~ truck tractors, the requirements as to safety glazing material apply to all glazing material used in doors, windows and windshields in the drivers I compartments of such vehicles. B. It is unlawful for the owner or any other person knowingly to replace shattered or broken glass in any door~ window or windshield of any motor vehicle with any glazing mater~al other than safety glazing material of a type approved by the Secretary of the State of Illinois. Section 18.1527. Seat Safety Belts. A. No person shall sell any 1965 or later model motor vehicle of the first division unless the front seat of such motor vehicle is equipped with two (2) sets of seat safety belts, Motorcycles are exempted from the provisions of this Sec- t- . ~lon. B. No person shall operate any 1961 or later model motor vehicle of the first division that is titled or licensed by the Secretary of State unless the front seat of such motor vehicle is equipped with two (2) sets of seat safety belts. Section 18.1528. Vehicles Of The Second Division To Carry Warning Flags And Flares Or Similar Devices. A. No person shall operate any motor vehicle of the second divi- sion upon a highway outside of a business or residence dis- trict at any time unless there are carried in such vehicle a sufficient number of red warning flags~ not less than three (3) ~ and a sufficient number of flares, not less than three (3) ~ or electric lanterns or other signals capable of continuously producing three warning lights, or not l~~s than three (3) red emergency reflectors conforming to the specifications prescribed by the Bureau of Motor Carrier Safety of the Federal Highway Administration, each visible from a distance of at least 500 feet for a period of at least twelve (12) hours, except that a motor vehicle trans- porting flammable liquid shall carry solely such red reflec- tors. B. Whenever any motor vehicle of the second division during the period between sunrise and sunset and such vehicles cannot immediately be removed from the main traveled por- tion of a highway outside of a business or residence dis- trict, the driver or other person in charge of such vehicle shall cause such red warning flags to be placed upon the highway, one at a distance of approximately 200 feet in advance of such vehicle and one each at a distance of approx- imately 200 feet and 100 feet respectively to the rear of the vehicle. Whenever any motor vehicle of the second division is disabled during the period between sunset and sunrise and such motor vehicle cannot immediately be re- .~ moved from the main traveled portion of a highway outsido ot a business or residence district, the driver or other person in charge of such vehicle shall cause such flares, lanterns, red reflectors, or other signals to be lighted and/or placed upon the highway, one at a distance of approximately 100 feet in advance of such vehicle, one at a distance approxi- mately 100 to the Tear of the vehicle, and the third upon the roadway side of the vehicle, except tha t if the vehi-. eIe is transporting flammables three (3) such red reflec- tors shall be so placed and no open burning flare shall be placed adjacent to any such last mentioned vehicle, Co No person shall at any time operate a vehicle transporting explosives as a cargo or part of a cargo upon a street or highway unless it carries red warning flags and flares or electric lanterns or red reflectors as herein required, but such flares or electric lanterns must be capable of producing a red light and shall be displayed upon the road- way when and as required in this Section. Section 18.1529. Road Oil Vehicles -- Dripping On Certain Highways Forbidden. No person shall operate, on a durable all-weather street or highway of a type other than gravel or crushed stone, any vehicle used for the purpose of applying road oil, liquid asphalt or similar material to road surfaces unless such vehicle is so equipped as to absolutely prevent such material from dripping on such h~ghway, nor shall such material be allowed to drip on any such highway. Section 18.1530. Rear Fender Splash Guards. A. It is unlawful for any person to operate ?ny motor vehicle of the second division, except a truck tractor, to which this Section is applicable upon the street or highways of this Village unless such vehicle is equipped with rear render splash guards of either the contour type or the flap type which comply with the specifications provided in this Section for the type of splash guards used on the ve- hicle, and which are so attached as to prevent the splashing of mud or water upon the windshield of other motor vehicles. Specifications for such splash guards shall conform to those set by the State of Illinois. B. This Section shall not apply to motor vehicles the construc- tion or design of which does not require such splash guards, nor to motor vehicles in-transit and capable only of using temporary splash guards approved by the State Police? nor to pole trailers. .~ Section 18.1531. Vehicles Transporting Explosives. Any person operating any vehicle transporting any explosive as a cargo or part of a cargo upon a street or highway shall at all times com- ply with the provisions of this Section. A. Said vehicle shall be marked or placarded on each side and -', the rear with the word nExplosivesH in letters not less than eight (8) inches high, or there shall be displayed on the rear of such vehicle a red flag not less than twenty-four (24) inches square marked with the word "Danger" in whi te Ie tters six (6) inches high. B. Every said vehicle shall be equipped with not less than two (2) fire extinguishers) filled and ready for immediate use, and placed at a convenient point on the vehicle used. Section 18,1532, Vehicles Transporting Flammable Liquids When Lights Required - - Marked With Reflectorized Paint. No ,. person shall operate upon the streets or highways of this Village any second division motor vehicle customarily used In cargo transportation of flammable liquids during the hours when lighted lamps are required under Section 18.1502 of this Chapter unless such vehicle is marked or placarded in reflec- torized paint on each side and rear with the word !lFlammablel1 in letters not less than three (3) inches high. Section 18.1533. Number Of School Bus Passengers. No school bus or motor vehicle owned or used for hire by and in connec- tion with the operation of private or public schools, day camps, summer camps or nursery schools shall be operated if it is occupied by more passengers than recommended by the manufacturer thereof if said vehicle is manufactured as a passenger vehicle; if said vehicle is manufactured for use other than passenger~ then it shall not accommodate more passengers than provided for by the manufacturer in passenger vehicles of like style or rating, Section 18.1534. Sale Or Offer Of Sale Of First Division Motor Vehicle Ii res Wi th Other Than Original Grooves. It is unlm'lfu1. for any person to sellar offer for sale any tire for use on any motor vehicle of the first division into which any groove? other than the original grooves made by the manufacturer thereof? is deliberately made by cutting, burning~ or other means to within 4/32 of an inch of the cord. 3sction 18,l~35. Sale Or Offer Of Sale Of Second Division Motor Vehicle Tires Wi th Other Than Original Grooves-~t is unlawful for any person to sellar offer for sale any tire for use on alq motor vehicle of the second division into which any groove, other than the original grooves made by the manufacturer thereof, is deliberately made by cutting, burning or other means to within 7/32 of an inch of the cord. Section 18.1536. Sale Or Offer Of Sale Of Any Regrooved Motor Vehicle Tires Without Marking. It is unlawful for any person to sellar offer for sale any tire, for use on any motor vehi- cle. into which any groove, other than the original grooves made by the manufacturer thereof, is made by cutting, burning or other means, unless the words i9regrooved tiren are branded thereon in letters not less than one (1) inch in height, Section 18,1537, Television Screen In Motor Vehicle. No person shall install or cause to be installed a television screen in or upon any motor vehicle at any point forward of the back of the driver's seat? or which is visible to the driver while operating the vehicle? nor shall any person operate upon the public highways of this Village any motor vehicle which has a television screen so installed; provided~ that nothing in this Section shall prohibit the installation in any motor vehicle of special equipment designed to be used in the trans- mission or monitoring of television broadcasts or the making of scientific measurements of television station transmissions or shall prohibit the operation upon the public highways of Dotor vehicles in which such equipment has been installed. ,- Article XVI. Bicycles Section 18.1601, A licabilit Of Traffic Laws. Every person riding a bicycle upon a roadway shall be granted all 0 the rights and - 11 be subject to all of the duties applicable to the driver of a vehicle by the laws of the State of Illinois declaring rules of tho road applicable to the driver of a vehicle except as to special regulations in this Article and except as to those provisions of laws and Ordinances which by ,their nature can have no application. Section 18.1602. Obedience To Official Traffic Devices And Signs. J\, Any person operating a bicycle shall obey the instructions of official traffic signals, signs and markings unless otherwise directed by a police officer. B. On any street or intersection where IIU" turns or other turns are prohibited and signs are erected and in place so indicating, no person operating a bicycle shall disobey the direction of any such sign~ except where such person dismounts from the bicycle to make any such turn, in which event such person shall then obey the regulations applicable to pedestrians. Section 18.1603. Manner Of Riding. :-., A. Any person operating a bicycle shall not ride other than upon or astride the permanent and regular seat attached thereto, nor carry any other person upon such bicycle other than upon a firmly attached and regular seat thereon. B, No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped. Section 18.1604. Regulations For Operation Of Bicycles Generally., It shall be unlawful for any person to operate a bicycle in any of the following described manners or any of the following enumerated. conditions: A. At a speed greater than 1S reasonable and prudent under condi- tions then existing. B. Upon any street or highway except as near to the right hand side as practicable and with due care when passing any standing vehicle or any vehicle proceeding in the same direction. C. To emerge from any alley, public or private driveway or building upon any street~ sidewalk or sidewalk area without y.ielding the right-af-way to all vehicles and pedestrians approaching upon any street, highway sidewalk or sidewalk area. D. By attaching the bicycle or the rider in any manner to any bus or vehicle upon the street or highway. E ~ By tcr\ving o!," drawing any coaster, sled/ l)el~SOn on roller sk~fltC:': /~ /- toy vehicle or other similar vehicle upon the street or highway. F. Riding in groups upon any street or highway~ except in single file. G. Carrying any package~ bundle or article which prevents or interferes with the rider keeping both hands upon the handlebars. H. Riding with both hands removed from the handlebars, or both feet from the pedals or practice any acrobatic riding upon any bicycle upon the street or highway. I. Parking or leaving any bicycle upon the street or highway other than against the curb thereof or upon any sidewalk without supporting same in an upright position by a kickstand or rack~ or against any building, in such manner as to afford the least obstruction to pedestrian traffic. Section 18.1605. Riding On Sidewalks. A. No person shall ride a bicycle upon a sidewalk within a business district. However, persons may dismount and walk their bicycles on the sidewalk within a business district. B. No person shall ride a bicycle upon a sidewalk in a residence district without yielding the right-of-way to any pedestrian on such sidewalk and without dismounting from such bicycle before overtaking or passing any such pedestrian. Section 18.1606. Equipment Required. " ~.t f> Every bicycle~ when in use during the period when lighted lamps are required under Section 18.1502 of this Chapter, shall be equipped on the front with a lamp which shall be emitting a white light visible from a distance of at least 500 feet to the front and with a red reflector on the rear of a type approved by the Secretary of State of the State of Illinois. 1\. lamp emitting a red light visible from a distance of 500 feet to the rear may be used in lieu of a red reflector. No person shall operate a bicycle unless it is equipped with a bell or other device capable of giving a signal audible for a distance of at least one hundred feet~ except that a bicycle shall not be equipped with nor shall any person upon a bicycle use any siren or whistle. The parent of any child and the guardian of any ward shall n('t authorize or knowingly permit any such child or ward to viclatc any provision of this Section. 1'''''''''''' ::)~~tion 18.1607. Duty Of Parents Or Guardians; Applicability Of ?rovisions of Chapter. No parent of any child or guardian of any ward shall authorize or knowingly permit any such child or ward to violate any of the provisions of this Chapter. B This Chapter shall be applicable to all bicycles operated upon any street, alley, highway, a sidewalk or upon any public path set aside for the exclusive use of bicycles within the Village. Section 18.1608. License Required. No person who resides within the Village shall ride or propel a bicycle upon any street or upon any public way within the Village unless such bicycle has been licensed and a license plate or sticker is attached thereto as pro- vided herein. Soction 18.1609, License Application. Application for a bicycle license and a license plate or sticker shall be made upon a form provided by the Village and shall be made to the Chief of Police. Section 18.1610. Issuance Of License. A. The Chief of Police upon recelvlng proper application therefore is authorized to issue a bicycle license without charge which shall be effective until the next succeeding first day of May. B. The Chief of Police, or other person assigned suchresponsi- bility by the Chief of Police, shall not issue a license for any bicycle when he knows or has reasonable grounds to believe that the applicant is not the owner or entitled to possession of such bicycle. C. The Chief of Police, or other person assigned such responsi- bility by the Chief of Police~ shall inspect each bicycle before licensing the same and shall refuse a license for any bicycle which he determines is in unsafe mechanical condition~ or when the bicycle is not properly equipped in accordance with the provisions of this Chapter. D. The Chief of Police shall keep a record of the number of each license, the date issued, the name and address of the person to whom issued and the number on the frame of the bicycle for which issued. E. The Chief of Police upon issuing a bicycle license shall also issue a license plate or sticker bearing the license number assigned to the bicycle~ the ITalie MOUNT PROSPECT and the period for which issued and such plate or sticker shall be firmly attached to the bicycle in such position as to be plainly visible from the rear. .~ Section 18.1611. Transfer Of Ownership. Bicycle licenses are not transferable. Upon the sale or transfer of a licensed bicycle the ,"- r""'""< licensee shall notify the Chief of Police of same. The purchaser or transferee~ if he resides within the Village, shall make application for a new license as provided herein. Section 18.1612. Rental Agencies. A rental agency shall not rent or offer< any bicycle for rent unless the bicycle is licensed and a license prateoI:<sticker is attached thereto as provided herein and such bicycle 'Is <,eqllipped in accordance with the pro- visions of this Chapter. Section 18.1613. Use Of Sirens Prohibited. No bicycle shall be equipped with nor shall any person use upon a bicycle any siren or whistle. Section 18.1614. Penalties, Any person found guilty of vio- lating any provision of this Article shall be punished by a fine of not less than one dollar nor more than $25.00 and/or by sus- pension of the bicycle license for a period not to exceed ninety (90) days. ~ ''''"''''', Article XVII, Weight And Load Section 18.1701. Restricted Operation Of Certain Vehicles. It shall be unlawful to drive any vehicle of the second division, except for the purpose of making a delivery? and then for only one (1) block? on any street where such vehicles are prohibited by ordinance passed and approved by the Village Board of Trustees, signposted, and included in Schedule XVI of the APpendix to this Chapter. Section 18.1702. Weight. It shall be unlawful to drive on any street any motor vehicle with a weight9 including load9 in excess of that permitted by the State of Illinois Traffic Law for driving on improved highways or with weight distributed in a manner not conforming to such law. Section 18.1703. Towed Vehicles. A. When one vehicle is towing another9 the drawbar or other connection shall be of sufficient strength to pull all the weight towed thereby and the drawbar or other connection shall not exceed 15 feet from one vehicle to the other, except for the connection between any two (2) vehicles transporting poles, pipes, machinery or other objects of structural nature which cannot readily be dismembered. B. Outside a businesss residential or suburban district or on any controlled access highway, no vehicle other than a pole trailer or a semi-trailer which is being towed by a truck tractor and is connected by the means of a fifth wheel shall be towed on a roadway except by a drawbar and each such vehicle so towed shall, in addition9 be coupled with two (2) safety chains or cables to the towing vehicle. Such chains or cables shall be of sufficient size and strength to prevent the towed vehicle parting from the drawing vehicle in case the drawbar should break or become disengaged. Section 18.1704, Spilling Loads On Highways Prohibited. A, No vehicle shall be driven or moved on any street or alley unless such vehicle is so constructed or loaded as to pre- vent any of its load from droppings sifting? leaking or otherwise escaping therefrom, except that sand may be dropped for the purpose of securing traction? or water or other substance may be sprinkled on a roadway in cleaning or maintaining such roadway. B. No person shall operate on any street or alley any vehicle with any load unless said load and any covering thereon is securely fastened so as to prevent said covering or load from becoming loose, detached, or in any manner a hazard to other users of the highway. ~\ "-,, Section 18.1705. Projecting Loads On Passenger Vehicles. No passenger-type vehicle shall be operated on any highway with any load carrier thereon extending beyond the line of the fenders on the left side of such vehicle nor extending more than six (6) inches beyond the line of the fenders on the right side thereof. Section 18.1706, Protruding Members Of Vehicles. No vehicle with boom, arm~ drill rig; or other protruding component shall be operated upon the highway unless such protruding component is fastened so as to prevent shifting~ bouncing, or moving in any manner. Section 18.1707. Planking Edge Of A Pavement. No tractor~ traction engine9 or other metal tired vehicle~ weighing more than four (4) tons, including the weight of the vehicle and its load, shall drive up onto, off or over the edge of any paved public highway in this Village, without protecting such edge by putting down solid planks or other suitable device to prevent such vehicle from breaking off the edges or corners of such pavement. ~ ."-,, C. When a vehicle removal from either public or private property is authorized by the Police Department1 the owner of the vehicle will be responsible for all towing costs. · Section 18.1804. Reports On Towed Vehicles. When a motor vehicle or other vehicle is authorized to be towed away as provided in Section 18.1802 or 18.18031 the Police Department shall keep and maintain a record of the vehicle towed, listing the color1 year of manufacture 1 manufacturer's trade name~ manufacturer's series name, body style, Vehicle Identification Number and license plate year and number displayed on the vehicle. The record shall also include the date and hour of tow, location towed from, location towed to, reason for towing and the name of the officer authorizing the tow. Section 18.1805. .Record Searches. A. When the Police Department authorizes the impounding of a motor vehicle or other vehicle and does not know the identity of the registered owner or other legally entitled person, the Police Department will cause the motor vehicle registration records of the State of Illinois to be searched by a directed communication to the Secretary of State for the purpose of obtaining the required ownership information. ,-,. B, The Police Department will also cause the stolen motor vehicle files of the Illinois State Police to be searched by a directed communication to the Illinois State Police for stolen or wanted information on the vehicle. When the Illinois State Police files are searched with negative results, the information contained in the Nation Crime Information Center (NCIC) files will be searched by the Illinois State Police. When the information determined from these record searches is returned to the Police De- partment, it shall send a notification by certified mail to the owner or legally entitled person advising where the vehicle is held, requesting a disposition be made and setting forth public sale information, Exceptions to a notification by certified mail to the registered owner or other legally entitled person are set forth in Section 18.1809 of this Article. ,-,. Section 18.1806. Identifying And Tracing Of Vehicle Ownership. When the registerd owner or other person legally entitled to the possession of a motor vehicle or other vehicle cannot be identified from the registration files of this State, from the registration files of a foreign state, if applicable, the Police Department shall notify the Illinois State Police, for the pur- Dose of identifying the vehicle owner or other person~ legally entitled to the possession of the vehicle. When the informa- tion obtained by the Illinois State Police is forwarded to the Police Department~ it shall notify the owner as set forth in Section 18.1805 of this Article. ,~ ~ Section 18.1807. Reclaimed Vehicles -- Expenses. Any time before a motor vehicle or other veh.le is sold at public sale or disposed of as provided in Section 18.1808, the owner or other person legally entitled to its possession may reclaim the vehicle by presenting to the Mount Prospect Police Depart- ment proof of ownership or proof of the right to possession of the vehicle. No vehicle shall be released to the owner or other person under this Section until all towing and storage charges have been paid. Section 18.1808. Disposal Of Unclaimed Vehicles. When an abandoned~ losty stolen or unclaimed motor vehicle or other vehicle seven (7) years of age or newer remains unclaimed by the registered owner or other person legally entitled to its possession for a period of thirty (30) days after notice has been given as provided in Sections 18.1805 and 18.1806 of this Article, the Police Department or towing service having possession of the vehicle shall cause it to be sold at public sale to the highest bidder. Notice of the time and place of the sale shall be posted in a conspicuous place for at least ten (10) days prior to the sale on the premises where the vehicle has been impounded. At least ten (10) days prior to the sale9 the Police Department or the towing service where the vehicle is impounded 9 shall cause a notice of the time and place of the sale to be sent by certified mail to the regis- tered owner or other person known by the Police Department or towing service to be legally entitled to the possession of the vehicle. Such notice shall contain a complete description of the vehicle to be sold and what steps must be taken by any legally entitled person to reclaim the vehicle. In those instances where the certified notification specified in Sectlons 18.1805 and 18.1806 of this Chapter has been re- turned by the postal authorities to the Police Department or towing service due to the addressee having moved? or being unknown at the address obtained from the registration records of this State, the sending of a second certified notice will not be required. Section 18.1809. Disposal Of Unclaimed Vehicles Without Notice, A. When the identity of the registered owner or other person legally entitled to the possession of an abandoned; 10st9 or unclaimed vehicle of seven (7) years of age or newer cannot be determined by any means provided for in this Articley the vehicle may be sold as provided in Section 18.1808. B. When an abandoned vehicle of more than seven (7) years of age is impounded as specified by this Articley it will be kept in custody for a minimum of ten (10) days for the purpose of determining ownership, the contacting of the registered owner by the U.S. Mail, public service or in person r a determination of disposition; and, an examina- tion of the Illinois State Police stolen motor vehicle .~ files for theft and wanted information, At the expira- tion of the ten (10) day period~ without the benefit of disposition information being received from the registered owner, the Police Department will authorize the disposal of the vehicle as junk only; without the issuance of a junking certificate by the Secretary of State of Illinois. C. A motor vehicle or other vehicle classified as an antique vehicle is excluded from this Article. Section 18.1810. Police Reports After Vehicle Is Reclaimed . ----6TDrsposea. Of. When a motor vehicle or other vehicle in the custody of the Police Department is reclaimed by the regis- tered owner or other legally entitled person? or when the vehicle is sold at public sale or otherwise disposed of as provided in this Article, a report of the transaction will be maintained by the Police Department for a period of one (1) year from the date of the sale or disposal. Section 18.1811. Disnosition Of Proceeds Of Sale Of Unclaimed Vehicles. When a vehicle located within the corporate limits of the Village of Mount Prospect is authorized to be towed away by the Police Department and disposed of as set forth in this Article? the proceeds of the public sale or disposition after the deduction of towing~ storage~ and processing charges shall be deposited in the treasury of this Village. Section 18.1812. Liability. A law enforcement officer of the Village of Mount Prospect, -towing service owner9 operator or employee shall not be held to answer or be liable for damages in any action brought by the registered owner1 former registerd owner; or his legal representative, or any other person legally entitled to the possession of a motor vehicle or other vehicle when the vehicle was processed and sold or disposed of as pro- vided by this Article. Section 18.1813. Penalties. Any person who violates or aids and- abets - in the violation of this Article is guil ty of a mis- demeanor and subject to the following penalties: A. To be fined not less than $25.00 or more than $500.00; and, B. Shall be required by the court to make a disposition on the abandoned or unclaimed vehicle. '''-'\ Article XIX. Construction9 Penalties, And Disposition Of Fines. ,~ Section 18.1901. Effect Of Headings. Chapter, Article~ and Sec- tion headings containe~''''~erein shall not be deemed to govern, limit, modify~ or in ah,... manner affect the scope, meaning or intent of the provisions of any Article or Section hereof. Section 18.1902. Severability. If any part or parts of this Chapter shall be held to be unconstitutional, such unconstitution- ality shall not affect the validity of the remaining parts of this Chapter. The Board of Trustees hereby declares that it would havE passed the remaining parts of this Chapter if it had known that such part or parts thereof would be declared unconstitutional. Section 18.1903. Traffic Violation Tickets. Except where other- 1.:;:tS8 provided in this Chapter ~ police officers may issue traffic olation tickets, setting forth the date~ time and place of the offense~ the nature of the offense 9 the make, year~ registration and license numbers of the vehicles involved~ the name and address of the driver where possible~ and notifying the offender to appear i.n court on a specific time and date9 as is designated for hearing such cases. In the event that the offender does not appear at the time, date and place specified, the arresting officer may sign ~ comnlaint for the issuance of a warrant for the offenderis arrest. Section 18.1904. Arrests. Any person arrested for violation of EIli:S'--Chapter shail be released upon proper bai 1 being furnished, as required by statute. The amount of bailor bond in each in- stance may be prescribed by the police officer in command of the police station in the absence of a police magistrate or justice of the peace, provided that the arrested person maY9 at his re- quest, elect to have the amount of such bailor bond set by a magistrate or justice as provided by statute. Section 18.1905. Penalties For Misdemeanor. A. It is a misdemeanor for any person to violate any of the provisions of this Chapter unless such violation is by this Chapter or other law of the State of Illinois declared to be a felony. B. Every person convicted of a misdemeanor for a violation of any of the provisions of this Chapter for which another penalty is not provided shall for first conviction thereof be punished by a fine of not less than Ten Dollars ($10.00) nor more than One Hundred Dollars ($100.00); for a second such conviction within one (1) year thereafter such person shall be punished by a fine of not less than Twenty-Five Dollars ($25.00) nor more than Five Hundred Dollars ($500.00); upon a third and subsequent conviction within one (1) year after the first con- viction such person shall be punished by a fine not less than One Hundred Dollars ($100.00) nor more than Five Hundred Dollars ($500.00) Section 18. 1906. Disposition Of Fines. For offenses committed upon the streets or highways of this Village, or within the limits or jurisdiction of this Village, fines and penalties recovered under the provisions of this Chapter shall be paid over to the Treasurer of this Village. ~ r~' ARTICLE XIX.
