CAF/ 8/23/97 ORDINANCE NO. 4888 AN ORDINANCE GRANTING A CONDITIONAL USE FOR PROPERTY COMMONLY KNOWN AS 15 EAST PROSPECT AVENUE (MID-ClTY NATIONAL BANK) WHEREAS, representatives of Mid-City National Bank of Chicago (hereinafter referred to as Petitioner) has filed a petition for a Conditional Use with respect to property located at 15 East Prospect Avenue, (hereinafter referred to as the Subject Property) and legally described as follows: Lots 7 and 8 in Waldemar Krause's Addition to Mount Prospect in the East Half (~) of the Northwest Quarter (1/4) of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois also That part of Lot 9 in Waldemar Krause's Addition to Mount Prospect, in the East (~) of the Northwest Quarter (1/4) of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois, described as follows: Commencing at the Northwest corn of said Lot 9, tuning thence Southeast along the Northeast line of said Lot, 135 feet to the angle corner of said Lot which is 40.75 feet West of the Northeast corner of said Lot; thence West 115.15 feet to a point in the West line of said Lot which is 70.47 feet South of the point of beginning; thence North 70.47 feet to the point of beginning also Lots 10 and 11 in Block 6 in Busse & Wille's Resubdivision in Mount Prospect in the West Half (~) of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois WHEREAS, Petitioner seeks a Conditional Use to permit a drive-thru facility in conjunction with the operation of an existing financial institution; and WHEREAS, a public hearing was held on the request for Conditional Use being the subject of ZBA Case No. 11-97 before the Zoning Board of Appeals of the Village of Mount Prospect on the 26th day of June, 1997, pursuant to proper legal notice having been published in the Mount Prospect Journal on the 6th day of June, 1997; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendations to the President and Board of Trustees relative to the request being the subject of ZBA 11- 97; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have given consideration to the request herein and have determined that the same meets the standards of the Village and that the granting of the proposed Conditional Use would be in the best interest of the Village. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect do hereby grant a Conditional Use to permit a drive-thru facility on the Subject Property, BA 11-97 Mid-City Bank Page 2 of 2 which drive-thru facility is in conjunction with the operation of an existing financial institution, as shown on the Site Plan attached hereto and hereby made a part hereof as Exhibit "A". SECTION THREE: That the Village Clerk is hereby authorized and directed to record a copy of this Ordinance with the Recorder of Deeds. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
