ORDINANCE NO. 5572 AN ORDINANCE AMENDING CHAPTER 19 ENTITLED "GARBAGE AND REFUSE" OF THE VILLAGE CODE OF MOUNT PROSPECT BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS: SECTION ONE: That Article II entitled Garbage and Refuse of Chapter 19 of the Village Code of Mount Prospect; as amended, is hereby further amended to delete Sections 19.203 A.1, 19.203 A.3, 19.208 A and 19.208 A.1 in their entirety and to insert in lieu thereof, entirely new Sections 19.203 A.1 I 19.203 A.3, 19.208 A and 19.208 A. 1 to be and read as follows: 19.203: RECEPTACLES: A. 1. A Village owned/ imprinted and furnished (one per single family dwelling) green wheeled cart thirty-five (35), sixty-five (65) and/or ninety-five (95) gallon receptacle for the purpose of storage and collection of garbage, refuse or waste, rocks and building materials resulting from do-it-yourself projects and all other items of similar nature which do not exceed the size of the approved receptacle. Said receptacle shall be a wheeled cart of standard waterproof construction with handles, wheels and a tight-fitting cover or lid and shall be no larger than 35, 65 or 95 gallons in capacity. There is no limit as to the number of such containers used by any family unit. Unless specified otherwise in the Village's solid waste contract all garbage must be contained in the Village approved cart. 3. A village owned/imprinted and furnished (one per single family dwelling) thirty-five (35), sixty-five (65) and/or ninety-five (95) gallon blue wheeled cart is the approved receptacle for the collection of recyclables. Said receptacle shall be a wheeled cart of standard waterproof construction with handles, wheels and a tight-fitting cover or lid and shall be no larger than 35, 65 or 95 gallons in capacity. All recycling materials must be contained in the blue wheeled cart or it will not be collected. Single family dwellings will be allowed one (1) additional cart (any size) at no cost. 19.208: FEES: The following fees are required for the collection and disposal of garbage, refuse, recyclables and yard materials. A. Residential: The village shall provide a once-a-week service collection and disposal of garbage, refuse, and recyclables only, as described in the village's current Solid Waste Contract. Every owner, agent, tenant or occupant of any single family residential dwelling or residential multi-family dwelling located within the corporate limits of the village shall pay a portion of the village's cost for the once-a-week service, including collection, disposal and administrative fees, as well as an additional one (1) time rental fee for additional carts, as follows: 1. Single family residential dwellings. a. Single family residential dwellings will pay the amount as set forth in Appendix A, Division II of this code in the form of a direct bill for once-a-week service, including collection, disposal and administrative fees. b. Single family residential dwellings will pay the amount as set forth in Appendix A, Division II of this code for each additional Village-owned/ imprinted refuse cart in excess of one (1), regardless of size. c. Single family residential dwellings will pay the amount as set forth in Appendix A, Division II of this code for each additional Village owned/ imprinted recycling cart in excess of two (2), regardless of size. SECTION TWO: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
