ORDINANCE NO. 2282
AN ORDINANCE AMENDING SECTIONS 20 AND 24 OF THE ZONING ORDINANCE
OF THE VILLAGE OF MOUNT PROSPECT
VlliEREAS, the Plan Commission of the Village of Mount Prospect did hold a
public hearing under Case No. 70-14p on October 16, 1970,; at the hour of
8:00 P.M. in the Village Hall, pursuant to proper legal notice publiShed
in the Mount Prospect Herald on October 1, 1970; and
WHEREAS, the said Plan Commission did recommend to the President and Board
of Trustees approval of the amendment contained herein below under Case
No. 70-14p; and
WHEREAS, the Judiciary Committee of the Board of Trustees of the Village of
Mount Prospect has reviewed the amendments to Sections 20 and 24 regarding
parking in the business districts and nonconforming uses; and
WHEREAS, the said Judiciary Committee has recomrr.ended to the President and
Board of Trustees of the Village of Mount Prospect the adoption of the
aforementioned amendments proposed under Case No. 70-14P; and
WHEREAS, the President and Board of Trustees of the Village of Mount
Prospect have determined that the best interests of the Village of
Mount Prospect will be attained by the adoption of the recommendations
of the Plan Commission and Judiciary Committee under Case No. 70-14P;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENrr' AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: That paragraph A of Section 20 of the Mount Prospect
Zoning Ordinance, as amended, be and the same is hereby further amended
to include the two (2) "uses" at the very end of said paragraph A; so
that hereafter the said paragraph A of Section 20 shall be and read as
follows:
"(A) SCOPE OF REGULATIONS:
The off-street parking and loading provisions of this
Ordinance shall apply to the various B-Use Districts except
with reference to the B-1 (Shopping Center District) uses."
SECTION TWO: That subparagraph 1 of paragraph 1 of Section 20 of the
Mount Prospect Zoning Ordinance, as amended, be and the same is here-
by further amended by substituting the word "all" for the word
"professional" at the very beginning of the said subparagraph 1; so
that the said subparagraph 1 of the said paragraph 1 in the said
Section 20 shall hereafter be and read as folloVJs:
"1. All Offices, Finance Banking, and Financial Institutions:
One parking space shall be provided for each 200 square
feet of gross floor area used in the building in relation-
ship to that use."

SECTION THREE: That Section 24 of the Mount Prospect Zoning Ordinance,
as amended~ be and the same is hereby amended to reduce the designated
period of time from one (1) year to six (6) months~ after which a non-
conforming use may not be established if discontinued; so that the
said Section 24 shall hereafter be and read as follows:
ilSection 24 Nonconforming Uses
A. Any use~ lawfully existing or under construction on the
adoption date of this ordinance or of a later amendment
thereto~ which does not conform to the use provisions of
said ordinance or amendment shall be known as a noncon-
forming use. Such nonconforming use, building or structur8
may be continued, maintained, or changed to a nonCOnf01TIing
use; but a nonconforming use shall not be:
1. Changed to a use of a less restricted class.
2. Expanded.
3. Reestablished either if discontinued for six (6) months
or more or if changed to a conforming use for six (6)
months or more.
4. Continued if the building or structure be destroyed OT
damaged to the extent of 50 per cent or more of its
value.
B. A complete record of the location, value~ nature and extent
of all nonconforming uses and variations shall be sh0\1n by
the Superintendent of Buildings."
SECTION FOUR: That this ordinance shall be in full force and effect
from and after its passage, approval, and publication in the manner
provided by law.
