ORDINANCE NO. 2288
AN ORDINANCE AMEl"JDING ARrICIE II OF CHAprIER 22
WHEREAS, the Village of Mount Prospect, Cook County, Illinois, is a Permittee o.
the IVetropoli tan Sanitary District of Greater Chicago; and
WHEREAS, certain ordinances heretofore passed by the IVetropolitan Sanitary
District of Greater Chicago provide that corrnrencing Janu.a.r,)T 1, 1970 sewer
permits will be issued only to municipalities, townships, sanitary districts,
or utility companies; and
1;lHEREAS, the aforesaid ordinances impose the burden of issuance of sewer
permits upon the Permittee and further impose the obligation of maintenance
upon Permittee; and
WHEREAS, the sUllage of Mount Prospect operates a sanitary sewer system; and
WHEREAS, the President and Board of Trustees of the Village of Motmt Prospect
deem it necessary and for the best interests of the Village of Motmt Prospect
to provide for the issuance of sanitary sewer permits and to establish rules
and regulations relative thereto;
NOW, THEREFORE" BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF HOUNT PROSPEGr, COOK COUNTY" ILLINOIS:
SECTICN mE: That Article II of Chapter 22 of the f1un1cipal Code of fv'lotmt
Prospect of 1957, as amended, be and is hereby further amended in its entirety,
by substituting therefor an entirely new Article II providing procedures for I
permit application and issuance, and installation specifications in addition to I
rates and fees, so that hereafter the said Article II shall be and read as I
follows:
"Article II. Sanitary Sewers
Section 22.201. Definitions.
Al-:I- words and phrases, not defined in the following text, which shall take
precedence, shall be in accordance with - "Glossary - Water and Sewage Control
Engineering," published by the Arrerican Public Health Association, the Arrerican
Society of Civil Engineers, the Arrerican Water Works Association and the
Federation of Sewage and Industrial Wastes Association.
A. Building Sanitary Sewer Service. That part of the sanitary sewer between
the connection to the sanitary sewer main and the external walls of the
building.
B. Engineer. The Village Engineer of the Village of Mount Prospect or his
authorized representatives.
C. Garbage. Solid wastes from the domestic and conrrercial preparation,
cooking, and dispensing of food, and from the handling, storage, and sale
of produce.
D. Industrial Wastes. Liquid wastes from industrial manufacturing processes,
trade, or business as distinct from sanitary sewage.
E. Intercepting Sewer. A M:!tropolitan Sanitary District sewer into which the
sewage from a sanitary sewer main or mains is discharged and is transmitted
to a sewage treatment plant.
F. Natural Outlet. Pny outlet in a watercourse, pond, ditch, lake, or other
body of surface or ground water.
G. Properly Shredded Garbage. The wastes from the preparation, cooking, and
dispensing of food that have been shredded to such a degree that all part-
icles will be carried freely tmder the flOW' conditions prevailing in public
sewers with no particle greater than one-half inch in any dinension.
H. Public Sewer. A sewer in which all owners of abutting properties have
equal rigpts and is controlled by public authority.
I. Sanitary Sewer. A sewer that carries liquid and water-carried wastes from
residences, cormercial or industrial plants and institutions, together
with minor quantities of storm, surface and grotmdwaters that are not ad-
mi tted intentionally.
J. Sanitary Sewer r-1ain. A sewer into which the sewage from two or more build-
ing sanitary sewer services is discharged.
K. Sewage. A coIl'binaticn of the liquid and water-carried waste from residence
single or multiple, conrrercial or industrial buildings and institutions,
(also known as wastewater).
L. Sewage Treatnent Plant. /my arrangenent 0[1 devices and structures used for
treating sewage.
H. Sev-ler. A pipe or conduit that carries wastewater or drainage water.
N. Sewerage System. The facilities for COllecting, conveying, treating, and
disposing of sewage.
O. Storm Sewer. A sewer that carries sto!'l1Water and surface water but ex-
cludes domestic sewage and industrial wastes.
P. Suspended Solids. Solids that either float on the surface of, or are in
suspension in water, sewage, or other liquids, and which are removable by
laboratory filtering.
Q. Trunk Line. A line which collects sewage from one or more sanitary sewer
main lines and carries it to either an interceptor or a treatnent plant.
R. User. '!he word "User" may be used with reference to:
1. Residential User shall be deerred to be~ the owner, tenant, or occupant
of a single-family dwelling connected to Motmt Prospect sanitary sewer
trunk line.
2. Multiple IMelling Unit User shall be deerred the owner, tenant, or
occupant of a building devoted to residence purposes which contains two
or more single-family dwellings, \'lhich building is directly or in-
directly connected to a Village of Mount Prospect sanitary sewer trjtlk
line.
3. Industrial or Corrnrercial User shall be deerred to be the owner, tenant,
or occupant of any establishfrent, which CMner, occupant, or tenant is
not a residential user as defined in Section 101 of this Article or a
multiple dwelling unit used as defined in Secticn 102 of this Article,
but which establishrrent has sanitary sewer facilities directly or in-
directly connected to a r10unt Prospect sanitary sewer trunk line.
4. "Collector" as used herein shall mean the Village Treasurer
appointed to issue all bills and collect all charges.
S. Hatercourse. A channel in which a flOW' of water occurs, either con-
tinuously or intermittently.
Section 22.202. Connection Required.
The sanitary sewer facility of any building requiring such sanitary sewer
facilities located within the Village, which building is located within 300
feet of a sanitary sewer ina.1t:i line shall have said sanitary sewer facilities
connected to the said sanitary sewer 'ina:1ri: line.
Section 22.203. Permits - Application.
A. Tnere shall be three (3) classes of sewer permits: (a) for a single-famil,y
residential building connecting to or extending - an existing main line sewer,
(b) for a multiple residential building (or buildings), connecting to - or ex- I
tending - an ex, isting main line, sewer, and, (c) industrial or commercial build- I
ings connecting to or extending - an existing main line sewer.
B. Each permit application shall be submitted, with the required IVe troPoli,tan l
Sanitary District plans and documents, or with fOrnB provided by the Village
when under its jurisdiction only. All permit applications shall be supple:rrente
with plans, specifications, and additional information as required by the
Engineer. I
Section 22.204. Permit and Inspection Fees - Bond.
A. A plan review and inspection fee shall be paid to the Village prior to
issuance of any permit. In all cases, primary inspection of all work shall
be the responsibility of the owner's Engineer.
B. The fees shall be as follows:
1. fue fee for a sing.le-family residential connection to the main sanitary
sewer shall be forty dollars ($40.00), which shall include plan review,
permit approval, and a final inspection of the work. If rrore than one
inspection is required, an additional fee of ten dollars ($10.00) per
hour shall be charged. A minimum amount of fifty dollars ($50.00) shal
be placed in escrow for additional inspection;, all unused monies in the
escrow accomt will be returned to the applicant upon final acceptance
of the work.
2. The fee for multiple residential, conrrercial and/or industrial build-
in~ connecting to the main sanitar,y sewer shall be one hundred dollars
( $100.00) per building, which shall include plan review , permit ap-
proval, and a final inspection of the work. If more than one inspec-
tion of the work is required, an additional fee of ten dollars ($10.00)
per hour shall be charged. A minimum amount of two hundred dollars
( $200.00) shall be placed in escrow for additional inspection; all un-
used monies in the escrow account will be returned to the applicant
upon final acceptance of the work.
3. An additional fee for plan review and final inspection will be required
for all projects involving the extension of an- existing sanitary sewer
main. This fee shall be based on the following percentages of the es-
timated ccnstruction cost of the sewer extension ( exclusive of services
to the proposed buildings) :
a. 2.0% of the construction cost of the improvements when such cost
is $50,000 or less.
b. 1. 5% of the construction cost of the irrprovements when such cost
is over $50,000.

Ii Section 22.205. Specifications.

III Sanitary sewer systeTl13 shall be desigfled in accordance with "Rules and Regula-
11 tions for Submissicn of Plans and Documents;" (Circular No. 840) as published
II by the Illinois Sanitary Water Board; "'!he Industrial Waste Ordinance of the
'II Metropolitan Sanitary District;" "The Sewer Permit Ordinance of'thef1etropol-
I itan Sanitary District" and "The Ordinanc e for the Control and Abaterrent of
II Pollution of Water vJ1thin the IVetropolitan Sanitary District," all 0, f the ab,ove
I and other Sanitary District regulations shall govern the minimum engineering
I standards for the design, construction and maintance of sewers and sewerage
II systeTl13 within the Sanitary District, including, as to types of materials,
II method of installation, maximum,permiSSible rates of infiltration, and other
I, engineering pararreters including but not limited to the following:

In each instance above where the said permit is issued for sewer connecti
lying outside the corporate limits of the Village of MOtmt Prospect, said
fee shall be 200% of such fee listed hereinabove in order to cover the ad-
ditional costs and inspections therefor.
As a further condition of the issuance of a permit, the individual or firm
connecting a building sewer service to the sewer system shall provide a
performance bond payable to the Village of Mount Prospect to cover the full
cost of all sanitary sewerage system improvements.
1. The amount of such performance bend shall be based upon an estimate of
cost approved by the Village Eng:1maer.
2. Said performance bond shall be effective for a period of two years
following the projects acceptance by the Village Engineer, during
which time the permittee shall be responsible for the maintance of the
irrprovements installed under the permit.
3. '!he performance bond shall also inderrnify the Village of Motmt Prospect
from any costs, charges, expenses, loss or damage that may arise
directly or indirectly out of the installation, construction, connecti
or failure to maintain or repair the sanitary sewer so installed.

All sanitary sewer mains shall have a minimum internal diameter of
eigj1t (8) inches. Sanitary f3ewer services shall have a minimum interna
diameter of six (6) inches.
2. Sanitary sewers with internal diameter between eigj1t (8) inches and
twenty-one (21) inches, and sanitary sewer services, shall be con-
structed of extra strength vitrified clay pipe in conformance with
the specifications of the American Society for Testing Materials,
Designation C-200, or Truss Pipe (A.B.S. Pipe) -- A.S. T.N. 0-2680.
3. Sanitary sewers with internal diameter twenty-four (24) inches and over
shall be constructed of either reinforced concrete pipe conforming to
the Arrerican Society for Testing Materials, Designation C-76, wall
thickness B, or Asbestos Cerrent Pipe conforming to the Arre-rican Society
for Testing Materials, Desigflation 0-1069.
if. Amvit joints or other approved joints of materials having resilient
properties for vitrified cla,y pipe sanitary sewer services shall be
the compression type in conformance with the specifications of the
Arre-rican Society for Testing Materials, Desigpation C-425-60T.
5. Joints for reinforced concrete sewers shall be either Rubber Gaskets
conforming to Arrerican Society for Testing f1aterials, Designation C-443
or shall be of a Mastic type. Bituminous Jointing Compound, made from
asphalt, liquefiers, mineral fillers and fibers, shall be free from
moisture.

6. The filler shall be such that it shall have positive adhesion to pipe
surfaces, and shall be water, acid and alkali resistant. It shall be
plastic and workable with a trowel and of a conposition which will not
result in a plastic flOtAT of the material at temperatures up to 80
degrees F.
7. Joints for Asbestos Cement pipe shall consist of an asbestos cerrent sleeve,
made from material similar to the pipe, and two rubber ring gaskets,
all desigr1ed and suitable for connecting the lengths of pipe together.
8. Rubber gaskets shall be of uniform thickness throughout, smooth, free
from pitting, blisters, air checks, and other imperfections.
9. All pipe installation shall be in accordance with ASTM Designation C12.
B. Building Sanitary Sewer Services.
1. Sanitary Sewer services shall in general be constructed in accordance
with the specifications shown in subsection A above, with the exception
that the maximum length of building sanitary sewer service shall not
exceed 120 feet in length. If this length is exceeded, an intermediate I
manhold shall be constructed.
2. f1inimum s lope for all building sanitary services shall be one eil2hth
(1/8) inch per foot. A lesser slope as approved by the Engineer may
be used for pipe sizes larger than six (6) inches.
3. The connection of the sewer service the sanitary sewer main shall be
made at an existing wye branch if available.
~. If a wye branch is not available, the tap (connection) to the sewer
main shall be made by a circular saw-cut of sewer main by proper
tools ("Shewer-Tap"machine or similar), and proper installation of
hub wye saddle or hub tee saddle, in accordance with manufacturer's
reconrrendatiens.
b. All such connections must be inspected by the Village Engineer or
his authorized representative. After the connection has been
made, it shall be made secure and watertigpt by encasenent in
concrete.
c. Bedding shall be required for all sewer construction except ductile
iron pipe and shall be not less than four (4) inches thick.
Material for bedding shall be crushed l1rrestone gradiation CA6 in
conformance with Article 704.01 of the Illinois Standard Specifi-
cations for road and bridge construction.
4. All sanitary services shall be "overhead" installations. If buildings
have basenents, a pump or ejector s~all be provided to pump the waste-
i'later to the sanitary sewer service in accordance with the Village
PJ.unbing Code.
5. All floor drains shall be connected to sump purrps and discharged into
the sanitary sewer system.
6. Footing drains shall be connected to sump pump and discharged to drain-
age swaThs in rear of yards or discharged to the storm sewer.
7. Downspouts shall discharge on ground surface.
C. Trench BackfilL
1. All trenches caused by the construction of sewers, water mains, water
service pipes, and in excavation around catch basins, manholes, in-
lets and other appurtenances which occur within the limits of existing
or proposed pavements, sidewalks and curb and gutters shall be back-
filled with trench backfill.
2. Trenches and excavations near or adj acent to proposed or existing
paverrents, sidewalks and curb and gutters shall be backfilled with
trench backfill to an elevation equal to the intersection of a one to
one slope line from the top of the pavement sidewa1ks or curb edge,
with a vertical line througtl the nearest edge of the trench or excava-
tion.
3. Trench backfill shall consist of sand, pitrun gravel or crushed stone
and shall be con:pacted in place to 95% of maximum density at optimum
moisture as determined by the Standard Proctor Test.
D. fVJanholes.
1. Manholes for sanitary sewers thirty-six (36) inches and smaller shall
have an inside diarreter of forty-eigp.t (48) inches, and a six (6)
inch thick precast concrete base, in one piece, bedded in at least two
(2) inches of gravel or crushed stone.
2. Manhole sidewalls shall be of precast concrete ring construction which
shall have a five (5) inch minimum th1:ckness.
3. f1anhole bases for sewers with an internal diameter forty-two (42)
inches and larger shall be constructed of reinforced concrete.
4. Frames and grates for manholes shall be similar to Neenah manufacture
No. R-I015, with a coIl'bined weigtlt of 540 pounds. '!he frames shall be
set in a full mortar joint on each structure.
5. All sanitary sewer manholes constructed V'lithina flood plain, as desig-
nated an the maps prepared by the United States 6eological Survey,
shall have a minimum rim (top) elevation of one (1) foot above the
record higp water elevation for the area.
6. When the manhole rim is less than two and one half (2 1/2) feet above
the record higp water elevation an approved watertigt1t manhole cover
must be provided.

E. ,Erotection Of Property And '!he Public
1. rvTeans shall be taken to protect all public and private property in the
construction area. All areas disturt:led by construction shall be re-
stored to original ccndition, including - but not limited to - streets,
sidewalks, parkways, trees, bushes, and fences.
2. The provisions of this Mtmicipal Code relating to excavations in street
shall be complied with in making excavations in streets or other public

places. I
3. All other excavations shall be adequately guarded with barricades and
ligt1ts so as to protect the public from hazard.
F. As Built Drawings. For all projects involvin~ extension a sanitary sewer
main, there shall be submitted to the Village Engineer three (3) copies of
an "as built" plan showing the actual locations and grades of sewers, man-
holes, and sewer services.
Section 22.206. Sanitary Sewer Rates.
A. Single-Family Residential Users. All residential users to whom a sewer
permit has been issued by the Village of f10unt Prospect shall pay an oper-
ating, maintenance, and collection charge as follows:

II Section 22.208. Tampering.

I without first obtaining a written permit from the Village Auditor.

I unconstitutional, such unconstitutionality shall not affect the validity of

1. Fairview Gardens and that area fornerly certificated by the Utility
Sewer and Water COTlpany for service shall be at the rate of $2.50
per month billed quarterly for past three (3) months.
2. The remaining Village areas shall be at the rate of $2.50 per month
bmed quarterly in advance for next three (3) months.
Commercial, Industrial, Schools, Churches, and Multiple Residential Users.
All industrial and cormercial sanitary sewer users shall pay an operating,
maintenance, and collection charge based upon their semi-annual water usage
at the following rates: I
1. All Village users within the Village except those users lying with
that area that had been certificated for service by the Utility
Sewer and Water COTlpany prior to October, 1969, shall be charged
at the rate of $4.00 per month, billed quarterly in advance for
next three (3) months.
2. All Village users within that area that had been certificated for
service by the utility Sewer and Water COIIPany prior to October,
1969, shall be charged at the rate of $1.50 per month for multiple
units billed quarterly forpast three (3) months.
3. Cornrrercial, industrial, schools, and :churches within that area
that had been certificated for service by the Utility Sewer and
\1ater Company prior to October, 1969, shall be charged at the rate
of 40% of water used for past three (3) months.
All rigtlt, title, and interest in and to the improverrent authorized by the
sewer permit shall vest in the Village of flIount Prospect and shall remain
the sole property of the said Villa~ so long as same remains connected to
the public sewer system excepting as otherwise herein provided. 'lhe Presi-
dent and Board of Trustees reserves the rigtlt to require at any tirre sub-
sequent to the application for a permit, the execution of an easerrent agree
Trent in the form and of the content determined by the Engineer, providing
adequate access to the improvement and sufficient for maintenance, improve-
Trent, and/or repair thereof.

SEGrICN THREE: That all other ordinances or parts of ordinances in conflict'~
herewith are hereby repealed.
SEGrICN FOUR: That this ordinance shall be in full force and effect from and
after its passage, approval, and publ1caticn in the manner provided by law.
