Prospect, Unity Ventures, Inc., and L2. Salle I'Tational Bank, as Trustee under
Trusts' Nos. 31535 and 40666, heretofore enterod into a certain A'1Ilexation

WHEREf\S, prior to the execution of said J'\rmexation Agreement the Board
of.A.ppeals of the Village of I.1Olmt Prospect held a special joint meeting 'with
the I/1o'unt Prospect Plan Commission on January 26, 1971, at the hour of 8:00 P.M.
in the Ibunt Prospect Village Hall pursuant to notice published in the I'lount
Prospect Herald on Januc1.ry 8, 1971; and
VtlflEZREf3, the Board of i\uoeals of the Village of HOlll1t Prospect heard

testimony presented undor Case No. 7:..-4A pertaining to a request by lInity
Ventures, Inc. for certain variations from the Ilount Prospect Zoning Ordina~ce
to pe;!mit: tIre development of the property hereinafter described as an office

WHEREf\S, said property has been annexed to the Village of Mount Prospect

Village has agreed that it will adopt an ordinance pursuant to Sections 30
cmd 34 of t~le Hount Pros:!)ect Zoning Ordinance granting certain variations
't'lith respect to the subject property; and
WHER&\S~ the Village has given all the notices and held all of tile public
hearings required by law to be held in connection Ni t..~ the approval of SUdl
fmnexation i\greement and of the variations hereinafter authorized; and
WHEI'..E.i\.S~ the President and Board of Trustees of 't:.'le Village of Haunt
Prospect have revic'l,ved the said proposed vari2.tions and have determined that

OF THE VILLAGE OF I'IOU'Nf PROSPECT, COOK COlJN'IY ~ ILLINOIS, as fol101tlS:
SECTION ONE: T'ne following vaTiations be and they are hereby granted
for the property ltJhiCil. is the subject matter of Case No. 71-4A, which
property is legally descri::;;,2d i.n Exhibit 1 attached hereto and made a
part hereof by this reference and which is classified in tl1.e B-3 Business
District pursuant to the Hount Prospect Zoning Ord:in&"1ce:

they are hereby varied so as to pennit the construction

SECTION TWO: The aforesaid variations shedl be valid and effective
only upon t.ll.e pcrfOrmal"lCe 8l1d continuous maintenance l'lith respect to the
subject property and the following conditions and restrictions:
(A) The floor area ratio on the subject property, exclusive
of 1mdergrOlm.d off-street parking areas, shall not exceed
1.2.
(B) The minimum horizontal distance between one (I) story
or two (2) story buildings shall be not less than
fifteen (15) feet.
(C) The minimtun horizontal distance bcr-ween buildings ex-
ceeding ttllO (2) stories in height shall be equal to the
height of the tallest building from ltlhich the measurement
is taken.
(D) Wi th respect to buildings located on or abutting the plaza,
the open pOTtion of the plaza lying ben-Teen any nvo (2)
buildings shall be considered in co~uting the minimum
horizontal distances required by Subsections (B) and (C)
of this SECTION TWO.
(E) .All structures on D1.0 subject property shall be set back at
least eighty-four (84) feet from Elmhurst Road, thirty (30)
feet from Algonquin Road, and twenty-five (25) feet from
the nort.r.1. and If'~st property lines.
SECTION THREE: The Director of Building and Zoning of the Village of
Motmt Prospect is hereby directed to issue building pennits for the subject
property in accordance with the variations and limitations theroon herein-
after set out. The variations granted by this Ordinance shall be null and
void and of no force and effect l'lhatsoever unless an application for a
building pennit pursu&'1t to such variations is made and construction

commenced't^!ithin five years of the date said Ordinance becomes effective.
SECTION FOUR: This Ordinance shall be in full force and effect from
and after its passage ~ approval and publication in the manner provided
by Iffi\l.
