WHEREAS ~ t.lJ.e President and Board of Trustees of the Village of r-fount
Prospect ~ Unity Ventures ~ Inc. ~ and La Salle National Ba."1k, as Trustee
under Trusts Nos. 31535 and 40666, heretofore entered into a certain
ilnnexatian Agreement dated ~flt iL (, 1971 .lith respect to the
proporty hereinafter described; and
WHEPElS~ prior to the execution of said !\Ill1exation Agreemont~ the Board
of [,ppeals of the Village of Eount Prospect held a special j oint meeting
uiw'1 the liount Prospect Plan Commission on January 26, 1971~ at the hour of
8: 00 P.E in the Haunt Prospect Village Hall pursuant to notice published
it" the I'bunt Prospect Herald on January 8, 1971; and
lAJHEREAS, the Board of I\:ppeals of the Village of ~ 10unt Prospect heard
testimony presented under Case No. 71-4A pertaining to a request fOT certain
variations from the subdivision regulations contained L.'l ./\rticle II of the
Hount Prospect Village Plan; and
\'\1H!3PJ1-'\S ~ the Board of Appeals of the Village of !'bunt Prospect has filed
a report 'It'lith the President and Board of Trustees recoIIll'..ending the allo'lfJaTIce
of such variations for tho reasons stated thercin; and
WI-IERE!'S~ said property has been annexed to the Village of H01.mt Prospect
and duly classified in the B-3 Business District; and
WHEREftS, pursuant to Section 5 of the aforesaid fmnexation Agreement
the Village has agreed that it '!flill adopt an ordinance pursuant to Section 11
of Article II of the MoUnt Prospect Village Plan gra."lting certain variations
from wi.e subdivision regulations 'I]'i~~ respect to the subject property; and
WI-Ifill.EAS) the Village has given all the notices and held all of the
public hearings required by law to he held in connection with the approval
of suc.h i\nnexation Agreement and of the variations heroinafter authorized;
and
WI-lEill1'\S) the President and Board of Trustees of the Village of Haunt
Prospect have rerim'led the said proposed variations and have determined that
the samo are in tl~3 best interest of the Village of r10unt Prospect;

SECTION onE: Pursuant to Section 11 of l\rticle II of the f10unt Prospect
Village Plai, the following variations from tho subdivision regulations
contained in Article II of the }~ount Prospect Village Plan l':Tith rospect to

granted.
(A) The terms of Section 7 (.1\.) (I) of i\rticle II of said Village
Pl&~ be and they arc hereby varied so as to permit private
streets and roadways at least blenty-four (24) feet in

cn) The tenns of Section 8 of Article II of said Village Plan
be and tI1ey are hereby vaTied so as to penn.i. t private

gutters.

be and they are hereby varied so as to permit the installation
